CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST THE RELEASE OF A PUBLIC WALKWAYITRAIL EASEMENT AGREEMENT AND AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST A PERMANENT RECREATION TRAIL EASEMENT AGREEMENT SUBSTITUTED IN LIEU THEREOF FOR THE COURT HILL TRAIL PROJECT. Comment: In 1997, in contemplation of a future public walkway/trail along the northern edge of the site of the First Avenue Food Store, an easement agreement was authorized and executed between the City and Hy-Vee, Inc. as part of the site plan for said development. The property acquisition for the Court Hill Trail Project was authorized by Council on July 24, 2007 by Resolution No. 07-220 and during the design of said trail it was discovered that the easement area obtained from Hy-Vee in 1997 was now covered by a large dirt pile preventing its use in the construction of the trail. Since the cost to remove this dirt pile would be prohibitive, City staff and Hy-Vee have negotiated an agreement to replace the easement area with a substituted easement area of identical size and width. This resolution calls for the release of the first easement agreement for a public walkway/trail and authorizes the second agreement for a permanent recreation trail easement. CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO EXECUTE AND THE CITY CLERK TO ATTEST TO A SUBORDINATION AGREEMENT BETWEEN THE CITY OF IOWA CITY AND WEST BANK, IOWA CITY, IOWA FOR PROPERTY LOCATED AT 1020 COVERED WAGON DRIVE, IOWA CITY, IOWA. Comment: West Bank has requested that the City approve a Subordination Agreement for property at 1020 Covered Wagon Drive. On July 10, 2007, The Housing Fellowship, owner of the property, received a loan from the City of Iowa City's HOME Investment Partnership (HOME) funds. West Bank gave the Vocational Training Council of the Home Builders Association of Iowa City a construction loan for a student built home. The property has enough equity to cover the City's lien position. 3. CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST TO THE RELEASE OF LIENS REGARDING ONE MORTGAGE AND THREE PROMISSORY NOTES FOR THE PROPERTY LOCATED AT 2603 WAYNE AVENUE, IOWA CITY, IOWA. Comment: The owner of the property located at 2603 Wayne Avenue received assistance through the City of Iowa City's Housing Rehabilitation Program. The loans have been paid off; thus the liens need to be released. 4. CONSIDER A RESOLUTION APPROVING THE EXTERIOR DESIGN OF A NEW COMMERCIAL BUILDING ON LOT 3, PEPPERWOOD PLAZA. Comment: Kay Developers have applied for a permit to construct a new commercial building on Lot 3 of Pepperwood Plaza. Because there was a TIF agreement for the redevelopment of this plaza, Staff Design Review Committee and City Council approval is required. After review and consideration, the Design Review Committee recommends approval of the submitted design. f) Correspondence. 1. City of Iowa City Page 6 d) CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND CITY CLERK TO ATTEST AN ACCESS EASEMENT AND PARKING AGREEMENT WITH HIERONYMUS SQUARE ASSOCIATES FOR THE DEVELOPMENT OF CERTAIN LOTS ON BLOCK 102, IOWA CITY, IOWA. Comment: Hieronymus Square Associates desires to construct a parking structure underneath the Hieronymus Square development. Access to this structure would be gained through the Dubuque Street entrance to the Court St. Transportation Center. This Agreement grants HSA an access easement for such purposes and permits them to rent 100 spaces within the Court St. Transportation Center. Staff supports this Agreement due to the increased demand for parking and increase in traffic that will result upon the construction of this large mixed-use development near downtown Iowa City. Comment: At its September 20, 2007 meeting, by a vote of 7-0, the Planning and Zoning Commission recommended denial of this rezoning as it does not comply with Fringe Area Agreement or the Johnson County Land Use Plan. (Streb Investments Property) Action: ~M1;:: {jj!::~f 4'// 7"~ October 2, 2007 () 7 - .).9'6 ~ City of Iowa City Page 7 f) AUTHORIZING CONVEYANCE OF A STORM WATER MANAGEMENT DRAINAGE EASEMENT AND A STORM SEWER PIPE EASEMENT ALONG THE SOUTHWEST CORNER OF THE IOWA CITY MUNICIPAL AIRPORT TO HAROLD JOHN DANE, ALLEGRA DANE, JAN ELLEN SMITH, ROBERT A. DAVIS AND JAMES R. DAVIS. Comment: Harold John Dane, Allegra Dane, Jan Ellen Smith, Robert A. Davis and James R. Davis would like to purchase two easements along the southwestern border of the airport. One is a storm water management drainage easement (1.10 acres) and the second is a storm water sewer pipe easement (.12 acres). The land within the easements has been appraised at $14,100, which is the proposed purchase price. The FAA does not object to the City granting the easements, and the Airport Commission at its May 10 meeting passed a motion recommending that Council grant the easements. The easements are necessary for the development of JJR Davis Fourth Addition, Iowa City, IA and are required for approval of the final plat in the following item (g). 1. (SUB05-00027) Comment: At its January 5th 2006 meeting, by a vote of 6-0 (Koppes absent), The Planning and Zoning Commission recommended approval subject to staff approval of legal papers and construction drawings prior to Council consideration. Staff anticipates that construction drawings and legal papers will be approved prior to the Council meeting. Staff recommended approval in a report dated January 5, 2006. Approval will allow the development of JJR Davis Fourth Addition, a 4-lot, 6.68-acre commercial subdivision located on Grace Drive east of Mormon Trek Boulevard. This application was delayed pending acquisition of an easement over the airport property. It should be approved only if item "f' above pertaining to the easement is approved. ON AN ORDINANCE GRANTING TO MIDAMERICAN ENERGY COMPANY, ITS SUCCESSORS AND ASSIGNS, THE RIGHT AND FRANCHISE TO ACQUIRE, CONSTRUCT, ERECT, MAINTAIN AND OPERATE IN THE CITY OF IOWA CITY, A NATURAL GAS SYSTEM FOR A PERIOD OF TEN YEARS, WITH A TEN YEAR AND FIVE YEAR RENEWAL THEREAFTER, TO FURNISH, DELIVER AND SELL NATURAL GAS TO SAID CITY AND ITS INHABITANTS. ITEM 8. Comment: The ordinances which govern the franchise with MidAmerican Energy for providing both electric and gas utilities in Iowa City expired in November 2001. MidAmerican Energy representatives and staff have negotiated renewal of these franchises. This ordinance will grant MidAmerican a franchise for a natural gas system for a period of ten years, with a ten year and five year renewal thereafter. A public hearing is required under Iowa Code section 364.2(4)(a) when a municipality is considering whether to grant a franchise. ITEM 16. 07- C}..'t~ City of Iowa City Page 11 CONSIDER AN ORDINANCE REPEALING ORDINANCE NO. 99-3872, CODIFIED AT TITLE 17 OF THE CITY CODE, ENTITLED "BUILDING AND HOUSING," CHAPTER 9, ENTITLED, "BUILDING CONSERVATION CODE," BECAUSE THE PROVISIONS ARE NOW INCLUDED IN THE BUILDING CODE. (SECOND CONSIDERATION) Comment: Section 17-9 of the Code was passed in 1999, and it regulates existing buildings. Those same provisions are now included in the City Building Code, and because it is duplicative, staff recommends repealing it. (FIRST CONSIDERATION) Comment: At the work session of September 17 City Council directed staff to remove the current requirement for a two year City Council review for the Police Citizen Review Board. Comment: On September 13 the City Council Economic Development Committee recommended $25,000 in funding for this project. The Council Economic Development Committee has recommended that these funds be as a loan at 4% interest for a maximum term of 7 years. Due to high owner commitment and investment in the business and the owner's history of paying the obligations entered, the committee recommended funding this business without security.
