The lack of attention given to this street cannot help but contribute to a serious accident soon. The following serious problems exist: (a) The Benton Street -Sunset Street intersection is very busy and attention needs be given to the possibility of a traffic light there soon. It is impossible during athletic events at the University. In addition, the center line east of,Sunset',is 6 feet north of the centerline west of Sunset, and this intersection is approached by a hill from two sides which makes it almost blind. (b) The center the the street hasnot been paved for over ten years. Recently a utility company dug up the center portion and left a large mound of dirt at the top of the hill between Arbury Streets two intersections which is overgrown with weeds 4 feet tall. It is impossible to see the northbound lane from Aurbury when you are turning left. If I let weeds grow like that in my yard you would summon the weed commissioner and cite me for a violation. In addition the soil has washed away from the paving in the center of the street, and 12-115 inch dropoffs exist there that easily can cause a car to turn over. (c) Between Benton and Derwin on the west side of Sunset there is no sidewalk for 11 block and a large pine tree has been allowed to grow into the street and take up any possible walking space... Children often ride their bikes or walk in the street as a result, and if a car swerves to miss them it will fall into the 15 " drop-off mentioned above. (d) No stopsigns have been installed along Derwin and Arbury. People traversing Sunset assume they have the right-of-way, but under Iowa law the person approaching the intersection from the right of an unmarked intersection have the right-of-way. Some accidents have already occurred there, and more are sure to follow because of increasing population density in the area. I In two to threelyears it is anticipated that Sunset Street will be pushed south to Highway I. It will then serve as a major north -south arterial relieving traffic on Wylde Green Road. At the present time, Sunset Street is acting only as a collector and the traffic volumes do not yet warrant a traffic controlled intersection at the intersection of Benton and Sunset. We do anticipate that as soon as Sunset is pushed through to Highway 1, traffic volumes will increase dramatically and the intersection will need to be controlled with traffic signals. The center section of Sunset Street is programmed in the Capital Improvement Budget for paving in the summer of 1979. A work order has been written to fill in the channels caused by erosion and this work should be'done by the time you receive this letter. The absence of a sidewalk on the west side of Sunset is a definite deficiency. The particular house and property in question were part of the old farmstead and as the area was subdivided, this one lot was not subject to the City subdivision ordinance. The City is going to attempt to increase the amount of special assessment work on sidewalks and alleys in the next' few years but there appears to be no quick short term solution that will alleviate the problem immediately. The Traffic Engineering Division has written work orders for stop signs controlling tho streets coming into Sunset. In this letter I shall summarize to you the opinions expressed at a meeting Sunday July 23, and shared by all the five families residing on the road --Mr. & Mrs. D. Casady, Dr. & Mrs. H. Kolder, Mr. & Mrs. A. Nagel, Mr. & Mrs. George Petsel, and Mr. & Mrs. B. ; Tucker. The Tuckers rent from Mrs. W. Hieronymus; the other four own their houses and land. As a group we are satisfied with city services. Garbage pickup was begun two i years ago; police patrols are satisfactory; road maintenance is adequate. The j Fire Department deserves special mention both for an excellent job at saving j the Kolder's house in December 1977, and for Tom Hansen's specific helpfulness last week, in regard to our problem with the bridge. The bridge has been know to be weak for some time now: a ten -ton limit was put on about two years ago. Otherwise the road is in acceptable condition. None of j the families has expressed discontent at living on a dead end road, or at the single entry to the area. Coralville has maintained their part of the road reasonably well to date. Our shared interests in regard to the bridge fall very heavily upon the following: 1) fire protection should be adequate, and not compromised with City standards 2) fuel delivery trucks (propane and oil) must be able to pass 3) road maintenance equipment needs access --the maintainer/grader and at least small gravel trucks (Chadek has for several years insisted that his firm could provide to us no more than eight -ton loads, which seem adequate to our private drive maintainence.) 4) ambulance and police access must be ready and reliable 5) we recognize the need for Charles Grunewald, who farms Hieronymus land, to bring his tractor, combine, stock and grain trucks and other neces- sary equipment to the end of the road 6) the projected use of the Rotary Camp (Camp Cardinal) as a nature park for Iowa City suggests the need for school -bus access In addition individuals of the group have mentioned the following concerns: 1) a through road: in favor --ease of access; opposed --heavy traffic, especially from those seeking a cut-off between Rts. 218/6 and Melrose Ave., West High School, and the SUI stadium MICROFILMED BY DORM MICR+LAB i CEDAR RAPIDS • DES 1401NES t11CROFILMED BY JORM MICROLAB -2- CEDAR RAPIDS AND UES MUINL:), IU-, rid 2) environmental concerns, especially the Clear Creek watershed and flood -plain, and the presence of protected species of both plants and animals confirmed in the area 3) land values and road -construction assessments The group concluded overall that the bridge should be repaired for limited use as soon as possible. In regard to replacement or major repair, the common opinion holds that a one -lane bridge, capable of supporting a loaded large Iowa City fire truck, is both the minimum necessary and a desirable and entirely adequate solution to our needs. (Here presumed that such a truck is the heaviest load mentioned in the first list above.) I shall be happy to respond in any way to you or to other city officials about our currently serious situation. I am sure you have some sense of our dismay at being unable to cross the bridge by any kind of vehicle heavier than a bicycle. These two questions were raised at that time: (1) Was travel on Kirkwood -Lower Muscatine necessary? (2) Would an embargo conflict with the cities comprehensive plan? These questions have not been satisfactorily dealt with, although, there is an alternative route available and on August 1, 1978, Mr. Don Schmeiser stated that the embargo would not be in conflict with Iowa City's comprehensive plan. Additionally, as citizens, we disagree with the conclusions of the Director of Public Works in the following areas: (1) Conclusion a and d of the April 8 memorandum. The analogy and comparisons between Burlington, Jefferson, Dodge, Gilbert, Dubuque, and Kirkwood -Lower Muscatine are unrealistic and at times fabricated guess work. Our view is based on the following elements not considered in the memorandum; (a) residential "character", (b) differences in street sizes, (c) Burlington, Jefferson, etc., are part of the State highway system, whereas Kirkwood -Lower Muscatine is not, (d) no viable alternatives to the highway system are available, whereas, Kirkwood -Lower Muscatine has a designed by-pass, namely Highway 6. Furthermore, in the Public Works Director's memorandum, the conclusions are based upon Kirkwood - Lower Muscatine being a primary major arterial. Iowa City's comprehensive plan at that time classified it as a "collector", and only recently, arbitrarily, classified it as a secondary arterial. Mr. Schmeiser stated that a street by being called an arterial does not make it immune from embargo. (2) Conclusion b- Enforcement. As stated by engineer Jim Brachtel, enforcement is not in the Public Works Departments expertise. This passivity does not eliminate the problem. (3) Conclusion c- Trucks as tax payers. The Iowa Department of Transportation in 1978 reported that trucks pay for less than 5010 of the damage done to roadways by their vehicles. (4) Conclusion d. We contend that trucks embargoed from Kirkwood - Lower Muscatine will use Highway 6 by-pass as opposed to Highland Street, etc., since Highway 6 seems a more "attractive alternative" than other residential streets. Highland's five eastern intersections are extremely difficult to manage especially for heavy trucks. Other than Highland there are nc other through .streets in the area. We feel that conclusion d is highly speculative with not tangible evidence. Furthermore, some of the residents of Kirkwood -Lower Muscatine feel indignant towards what weems biased consideration given to some residents in regard to neighborhood protection while seemingly being deprive from them. Let us address the residential problems of heavy truck traffic. Due to the heavy truck traffic and its subsequeint noise this summer, it has become unbearable and intolerable to many residents on Kirkwood - Lower Muscatine. Some people find it difficult to keep their young children at home during the day because of the lack of daytime napping attributed to truck noise; morning sleep is a problem for some; use of outdoor facilities such as screened in porches is impracticle; vocal medias are drowned out; safety for bicyclists, i to layground and schools is children playing, children cross ng r e eneral safety is of concern, especially a serious problem. Now, or cours , g following recent reports by the General Accounting Office and the National Safety Transportation Board, estimating that 50% of heavy trucks are unsafe and 40% carry harardous cargo, which may j provide extreme danger to residential areas. The Environmental Protection Agency is in the process of setting noise standard to protect the public ehalth. Their view is for Immunities to limit even garbage trucks, which visit a residential neighborhood once a week, to BO dicibles. The residents fon Kirkwood -Lower Muscatine have to endure over 90 dicibles constantly due to truck traffic. It is ironic that some of the drivers of vehicles seen on Kirkwood -Lower [Muscatine wer noise protection devices over their ears. This information seems a clear indication that the public health is being affected in out neighborhood. It would, also, seem to indicating that•the possibility of more home selling and degenerating in an otherwise very stable and historic community into one of transience and neglect will continue. As Mr. Jim Brachtel, the Public Works engineer told me during our discussion onf August 1, his job necessitaties looking at the problem through "tunnel vision" and it is up to the council to weigh all the factors. He has assured me that the streets department will do a fine job of "si fining" if the council so wishes. I am looking forward to addressing the City Council again on August 8, 1978. They have asked that truck traffic be prohibited from using Kirkwood Avenue. Truck Counts On March 10, 1977, truck traffic was actually stopped on Kirkwood east of Summit from 8:40 a.m. to 4 p.m. and drivers were asked where they were coming from and where they were going. Maps were then prepared indicating these origins and destinations. The maps prepared from this data reveal that most of the vehicles are going to or coming from the Sycamore Mall/Owens Brush area. The other end of their trip is spread among freeway traffic, points within the downtown, and points out in Coralville or west of town. Please see the attached maps. A second check on truck counts was made March 31, 1977, using an unmarked vehicle. On other urban highways which carry traffic primarily between suburbs and the Central ( Business District truck traffic may be 50 or less. 9 A much higher percentage of trucks will apply... to serve truck or bus terminals or industrial areas." ."The following characteristics typify truck travel in American cities: 1. Motor truck travel represents approximately 15°s of the total daily urban vehicular trips." Trucking Firms i An attached map shows the locations of the local trucking firms in the community. In addition, Iowa City is served by several trucking firms t operating out of Cedar Rapids, v Analysis Based on the above data, Public Works has drawn the following conclusions: a) The origin/destination data indicates that it would be difficult to divert the traffic onto "truck routes". Many of the truck trips have origins and destinations within Iowa City and use of specified truck routes would result in very circuitous routes which must often eventually end or begin on residential streets. The most often mentioned truck routes have been Highway 6 Bypass, Gilbert Street, Riverside Drive, Dodge, and Governor Streets. A truck leaving the Owens Brush area westbound would very likely use Sycamore Street to reach Bypass 6 and thereby be transversing a predominantly residential area. Following Dodge Street leads them directly to Kirkwood, in order to prevent this, extensive signing would have to be installed in the north end of town to keep trucks on Gilbert. b) Enforcement of any truck route would be difficult even assuming the public safety department had the personnel available to enforce a low priority misdemeanor such as this. c) Another item of some concern is the fact that Kirkwood Avenue was recently repaved using $85,000 in Road Use Tax Funds. Some consideration must be given to the fact that all motor vehicles pay Road Use Tax and the street is a public right-of-way. State law makes it clear that the City Council can embargo truck traffic; however, the normal reason for this is because of a failing roadway surface or subbase. d) Kirkwood Avenue is one of the primary, major arterial streets in Iowa City. Its volumes are roughly comparable to portions of Burlington Street, Gilbert Street, Dubuque Street, and several other major arterials in the community. Prohibition of truck traffic on Kirkwood Avenue will cause some unknown number of trucks to travel on other streets. This travel upon other streets may have even more negative effects than upon Kirkwood Avenue. The exact number of trucks and the exact streets they will use are impossible to determine. It can be surmised, however, that probable streets that would come under increasing pressure from trucks would be Highland Avenue, Ginter Avenue, other streets in the Mark Twain School area, Muscatine Avenue north of the Rock Island railroad tracks, and First Avenue, to name a few. e) There are no rational criteria available to determine when to bar truck traffic on a major arterial street. The issue would be clear cut if Kirkwood Avenue was a purely local street serving only access to local abutting property owners. Unfortunately, as is the case with many streets in Iowa City, expansion of the community has transformed local or minor collector streets into major primary arterials. f) The Area Transportation Study indicates that Kirkwood Avenue is presently operating at a satisfactory level of service throughout most of its length; however, based on 1995 traffic projections there will be severe to moderate deficiencies enst of Dodge and on Lower Muscatine Road. The Area Transportation Study simply serves to indicate that the problem does not show early signs of ameliorating. Even assuming heavy transit usage decreases the number of automobiles, truck traffic will likely not show any large decrease even with a large increase in rail transport since the origin/destination survey indicated that many of the truck trips start and end within Iowa City. Truck traffic can be prohibited; however, the truck traffic will move onto other streets in a somewhat random manner. Enforcement will also be difficult. The best suggestion Public Works can make is for communication with all trucking companies asking them to avoid Kirk -wood Avenue whenever it is possible to just as easily utilize Highway 6 Bypass. The companies can also be asked to j voluntarily check the muffling system on their vehicles to decrease noise to the maximum extent possible. These steps are admittedly minor nature. The measure that would satisfy the residents on Kirkwood is total prohibition of truck traffic. This allows the applicant to construct a church to be located on lot 4, create two undeveloped lots (i.e. late 1 and 2) and place the existing house on lot 3. All proposed lots conform with the requirements of their present zoning, RIB. Lot 3 has sufficient yard distance to the east of the existing house and this could be allocated to lots 1 and 2 as to increase their depth. Roth of these lots could use the additional depth as to increase their buildable area (e.g. lot 1 would he increased to more than a 25 foot buildable depth, and lot 2 to more than 1,700 square feet of buildable area) and thus increase site design flexibility.
