The permit included the new effluent characteristics that are the result of the Wastewater Treatment Facilities Consolidation Project, and additionally requires the submittal of a report that evaluates the practicality of reducing total nitrogen (TN) and total phosphorus (TP) discharges to the Iowa River. History/Background: The report must identify preferred operational changes and/or new or additional treatment technologies that will be implemented to achieve these reductions. One full year of operating data will be collected and evaluated after the changes and/or modifications are implemented. The effluent discharge limits in the NPDES permit will be amended after a subsequent six month optimization period. The IDNR permitting process continues to evolve and a nutrient reduction study is an unanticipated condition of the permit that was not required at the time of the original design contract. Discussion of Solutions: Moving forward with this work is a requirement of the permit and is an extension of much of the work that has been done during the design of the Wastewater Treatment Facilities Consolidation Project. Financial Impact: The not -to -exceed fee for completion of the study is $74,650 and funds are available in the South Wastewater Plant Expansion account. Recommendation: Staff recommends approval of Amendment No.1 to the May 10, 2010 Agreement by and between the City of Iowa City and Stanley Consultants, Inc. for the Wastewater Treatment Facility Consolidation Project. Washington St., Iowa City, IA 52240; (319) 356-5436 RESOLUTION NO. 15-191 RESOLUTION APPROVING, AUTHORIZING AND DIRECTING THE MAYOR TO EXECUTE AND THE CITY CLERK TO ATTEST AMENDMENT NO. 1 TO THE MAY 10, 2010 AGREEMENT BY AND BETWEEN THE CITY OF IOWA CITY AND STANLEY CONSULTANTS, INC. TO PROVIDE ENGINEERING CONSULTANT SERVICES FOR THE WASTEWATER TREATMENT FACILITIES CONSOLIDATION PROJECT. WHEREAS, the Contract contemplated that Consultant would assist the City in obtaining a National Pollutant Discharge Elimination System permit (NPDES Permit) from the Iowa Department of Natural Resources (IDNR) for the South Wastewater Treatment Plant; and WHEREAS, the City did receive said NPDES Permit, effective May 1, 2014, but said Permit requires submittal of an additional report to the IDNR evaluating the practicality of reducing total nitrogen (TN) and total phosphorus (TP) discharges to the Iowa River; and WHEREAS, this additional report was not included in the Scope of Services for the Contract; and WHEREAS, it is in the public interest to engage Consultant to assist the City in gathering the data necessary for this additional report and preparation thereof. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY, IOWA, THAT: The Consultant's Agreement Amendment No.1 attached hereto is in the public interest, and is approved as to form and content. 2. (Consultant) and CITY OF IOWA CITY, IOWA (Client) on this4th day of June 2015. NOW, THEREFORE, It is agreed by and between the parties hereto that the May 10, 2010 Consultant Agreement is hereby amended as follows: A. Section I "Scope of Services", 2.6, Task 60 "Regulatory and Funding Agency Coordination" is amended to add the following service: 2.6.6(a) Assist the City in optimizing existing processes for treatment performance including nutrient reduction, analyze plant performance for nutrient reduction, and prepare required nutrient reduction report, and assist City in communication with the Iowa Department of Natural Resources (IDNR) to comply with the May 1, 2014 NPDES Permit requirements. 1.1 Project Management and Communications 1 A A Overall contract administration and coordination including invoicing. 1.1.2 Communications 1.1.2.1 Initial Project Meeting — Conduct an initial project meeting with City to: 0 review scope and activities, schedule, 0 discuss expectations, and communication procedures. • review and discuss City's existing sampling plan and locations. Discuss possible supplemental sampling locations and parameters for process insight. • review and discuss performance data collected by City • discuss process operations and performance. • Consultant's process subconsultant will participate in meeting via internet. • Prepare and distribute electronic meeting notes. 1.1.2.2 Participate in periodic (every 8 weeks) 1 hour long progress teleconferences up to a total of six (6) teleconferences. Prepare and distribute electronic meeting notes. 1.1.2.3 On-site visits and meetings — Attend up to two (2) on-site meetings in addition to meetings listed in specific tasks. Consultant's process subconsultant will participate in one of the meetings by phone and the other meeting on-site. Process Evaluation — Existing Systems 1.1.3 Assistance During Interim Operational Trials - Provide up to thirty-two (32) hours of process consultation during the interim operational trials conducted early 2015 to early 2016 to assist City in operational issues and questions that may arise during operation. 22800 Iowa City Wastewater Treatment—Nutrient Study Page t of 3 1.1.4 Data Analysis 1.1.4.1 Update existing North and South Plant flow and load dataset with additional data for period of July 2010 to March 2016. Analyze updated influent data set to confirm current average, maximum month, maximum week, and maximum day flows and loadings. City will provide data in Excel workbook format. City will provide data in Excel workbook format, 1.1.4.2 Summarize plant effluent discharges (cBOD, TSS, NH3-N, TN, and TP) post - construction improvements during interim operational trials using MLE and A20 configurations. Deliverable: Nutrient Reduction Report 1.1.5 The nutrient reduction report scope of work is based on plant achieving required nutrient reduction without additional capital improvements. If plant cannot achieve required reductions, capital improvement concepts and costs updated to present time from plant planning work will be incorporated into the report. Conceptualization and capital cost estimation for following additional improvements as applicable 1) RAS anoxic mix chamber 2) step feed of primary effluent to cells 2 or 3 are included. New attematives identified during the course of the work will be developed and costs estimated at Client's request as an additional service. 1,1.6 Prepare six (6) copies of draft report in accordance with NPDES provisions including + plant performance data, interim operational trial results under MILE and A20 configurations, + operational alternatives, • cost analysis, + evaluations, • conclusions and recommendations. 1.1.7 Conduct Nutrient Reduction Report Review Meeting with City. Consultant's process subconsultant will participate by teleconference. 1.1.8 Finalize six (6) copies of report under licensed Iowa professional's engineer direction and submit on behalf of the City to the IDNR. IDNR Interaction 1.1.9 Communications/Review Support—as coordinated with City 1.1.9.1 Attend initial meeting with IDNR to discuss nutrient reduction policy and associated processes/procedures, conceptual approaches to the engineering work required for the required nutrient reduction report and IDNR approach to NPDES permit limits near term and long term. Consultant's process subconsultant will participate by teleconference. 1.1.9.2 Periodically update IDNR staff on progress and clarify requirements as required. 1.1.9.3 Review written comments from IDNR and prepare written response for City. 1.1.10 Nutrient Reduction Report IDNR Review Meeting - Attend meeting with IDNR accompanied by City to present report findings, and discuss review comments and discuss establishment of near-term nutrient limits based on operational performance with protection of long-term design load conditions. C. Section N "Compensation for Services" is amended as follows: Consultant shall perform the additional services added to the Scope of Services herein by this Amendment No. 1 for an additional not -to -exceed fee amount of Seventy -Four Thousand Six -Hundred Fifty Dollars ($74,650), based upon Consultant's Hourly Labor rate attached hereto and incorporated herein by this reference. Consultant's total not -to -exceed fee for the Scope of Services, as amended, shall not exceed $5,842,650. D. Except as specifically amended by this Amendment No. 1, all the terms and conditions of the original Agreement dated May 10, 2010 by and between the above-described parties shall remain in full force and effect. Washington St., Iowa City, IA 52240 (319) 356-5030 RESOLUTION NO. 15-192 RESOLUTION SETTING PUBLIC HEARING FOR JUNE 16, 2015, ON A PROPOSAL TO CONVEY A SINGLE FAMILY HOME LOCATED AT 1116 EAST BURLINGTON STREET. WHEREAS, the UniverCity Neighborhood Partnership Program is a joint effort between the University of Iowa and the City to encourage home ownership and reinvestment in designated neighborhoods surrounding the University of Iowa; and WHEREAS, the City purchases rental units located in designated neighborhoods surrounding the University of Iowa, rehabilitates them, and then sells them to income -eligible buyers; and WHEREAS, the City purchased and rehabilitated a single family home located at 1116 East Burlington Street, Iowa City; and WHEREAS, the City has received an offer to purchase 1116 East Burlington Street for the principal sum of $189,000 (the amount the City paid to acquire the home), plus the "carrying costs", which are all costs incurred by the City to acquire the home, maintain it and sell it, including abstracting and recording fees, interest on the loan to purchase the home, mowing and snow removal, utilities, real estate taxes, and any costs in excess of $50,000 to repair and rehabilitate the home; and WHEREAS, this sale would provide affordable housing in a designated area surrounding the University of Iowa; and WHEREAS, this sale is conditioned on the family securing adequate financing for the purchase of the home. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY, IOWA, that: 1. The City Council does hereby declare its intent to convey a single family home located at 1116 East Burlington Street, Iowa City, Iowa, also known as part of Lot 24, J. & J.W. Clark's Addition, Iowa City, Iowa, for the sum of $189,000, plus the "carrying costs". 2. A public hearing on said proposal should be and is hereby set for June 16, 2015, at 7:00 p.m. in Emma J. Harvat Hall of the Iowa City City Hall, 410 East Washington Street, Iowa City, Iowa, or if said meeting is cancelled, at the next meeting of the City Council thereafter as posted by the City Clerk, and that the City Clerk be and is hereby directed to cause notice of said public hearing to be published as provided by law.
