CONSIDERATION OF A RESOLUTION APPROVING A PURCHASE
AGREEMENT AND OPTION TO PURCHASE FOR THE CITY'S
PURCHASE OF AN APPROXIMATELY 31.5 ACRE PARCEL OF THE 53.6
ACRES OF LAND KNOWN AS THE SHOWERS ADDITION ALONG THE
IOWA RIVER EAST OF SAND LAKE AND AN OPTION TO PURCHASE
THE REMAINDER OF SAID SHOWERS ADDITION.
COMMENT: The City's comprehensive plan designates the property known as the
Showers Addition as open space. The site would be used by the City to provide
additional park land with access to the river. Based on a recent appraisal, city staff has
negotiated an offer to purchase the 31.5 acre parcel for $10,841.00 per acre from the
owner, the Clarence Hagen Revocable Trust and an option to purchase the remainder.
The offer is contingent upon City Council approval.

Comment: At its August 16 meeting, by a vote of 6-0 (Smith absent) the

and Camp Cardinal Boulevard. This rezoning would allow this property to be
developed with a planned development of 18 single-family dwelling lots, 17
attached single-family dwelling units, 69 multi-family units, and approximately
14 acres set aside as open space. Staff recommended approval in a report
dated August 2.

SUCCESSORS AND ASSIGNS, THE RIGHT AND FRANCHISE TO
ACQUIRE, CONSTRUCT, ERECT, MAINTAIN AND OPERATE IN THE CITY
OF IOWA CITY, A NATURAL GAS SYSTEM FOR A PERIOD OF TEN YEARS,
WITH A TEN YEAR AND FIVE YEAR RENEWAL THEREAFTER, TO
FURNISH, DELIVER AND SELL NATURAL GAS TO SAID CITY AND ITS

Comment: The ordinances which govern the franchise with MidAmerican
Energy for providing both electric and gas utilities in Iowa City expired in November
2001. MidAmerican Energy representatives and staff have negotiated renewal of these
franchises. This ordinance will grant MidAmerican a franchise for a natural gas system
for a period of ten years, with a ten year and five year renewal thereafter. A public
hearing is required under Iowa Code section 364.2(4)(a) when a municipality
is considering whether to grant a franchise.

Comment: The Board of Appeals, at their public meeting on August 13, 2007, voted 4
to 2 to recommend approval of this code as amended. On September 13, 2007 the
Historic Preservation Commission reviewed the code amendments and recommended
approval to Council. The draft minutes of the August 13th Board of Appeals meeting
was sent in Council's August 16 information packet. The "usability" requirements are
deleted from the amendments.

AT TITLE 17 OF THE CITY CODE, ENTITLED "BUILDING AND HOUSING,"
CHAPTER 9, ENTITLED, "BUILDING CONSERVATION CODE," BECAUSE
THE PROVISIONS ARE NOW INCLUDED IN THE BUILDING CODE. (PASS AND

Comment: Section 17-9 of the Code was passed in 1999, and it regulates existing
buildings. Those same provisions are now included in the City Building Code, and
because it is duplicative, staff recommends repealing it.

ASSOCIATES FOR RADIO DESIGN SERVICES FOR THE JOINT EMERGENCY
COMMUNICATION CENTER.
Comment: This resolution approves a consultant's agreement with Elert &
Associates for radio design services. Johnson County, Coralville, and North Liberty will
agree to pay 60% of the fees of this agreement. The resolution approving the
agreement to share the fees and costs is Item 20 on the agenda. Staff memorandum
relating to items 18, 19, and 20 is included in Council packet.

CONSIDER A RESOLUTION AMENDING THE BUDGETED POSITIONS IN THE
PARKING DIVISION OF THE PARKING AND TRANSIT DEPARTMENT BY
DELETING ONE FULL-TIME MAINTENANCE WORKER I - TOWING POSITION
AND ADDING ONE FULL-TIME MAINTENANCE WORKER II - PARKING
POSITION.
Comment: Based on an evaluation of the duties currently being performed by
the Maintenance Worker I - Towing position in Parking it has been determined that this
position is responsible for work of the same nature and responsibility as the
Maintenance Worker II - Parking position. This resolution deletes a Maintenance
Worker I - Towing position and replaces it with a Maintenance Worker II - Parking
position. Annual cost is approximately $2,000. Memo from the Parking Manager to the
City Manager is included in the agenda packet.

CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY
CLERK TO ATTEST THE IOWA DEPARTMENT OF TRANSPORTATION FUNDING
AGREEMENT FOR THE COURT HILL TRAIL PROJECT, STP-E-3715(635)--8V-52.
Comment: This project will construct a recreational trail along Ralston Creek from
Creekside Park to Court Hill Park. This agreement provides for a Iowa DOT
Transportation Enhancement Grant in the amount of $305,676 with a total estimated
construction cost of $751,934. The City's local share will be funded with GO bond and

CONSIDER A RESOLUTION NAMING THE SMALL DOG SECTION WITHIN THE
THORNBERRY OFF-LEASH DOG PARK THE "LINDER TIRE SERVICE
SMALL DOG YARD."
Comment: In continuing their fund raising efforts, the Johnson County Dog Park Action
Committee (DogPAC) has secured a donation from Linder Tire Service for the naming
rights to that section of the dog park designated for use by small dogs. This completes
the naming of all sections of the dog park. The $10,000 contribution is the same as
those contributions given for "Lucky Pawz" and "Emma's Run". The Parks and
Recreation Commission unanimously supports this proposal.

Comment: This new parkland, located on Lower West Branch Road, was obtained
partially through the Neighborhood Open Space process and partially through donated
land by the Miller family who farmed the area for more than 70 years. The family has
requested that the new park be named "Frauenholtz-Miller Park", and the Parks and
Recreation Commission has unanimously endorsed this request.

Comment: At the Council meeting of September 18 a petition signed by 5000 citizens
was submitted to the City Council asking for a creation of a task force, and set forth
objectives. Council Member Correia indicated that she and UISG Representative
Volland would be facilitating the formulation of that task force.

COMMENT: The City's comprehensive plan designates the property known as the
Showers Addition as open space. The site would be used by the City to provide
additional park land with access to the river. Based on a recent appraisal, city staff has
negotiated an offer to purchase the 31.5 acre parcel for $10,841.00 per acre from the
owner, the Clarence Hagen Revocable Trust and an option to purchase the remainder.
The offer is contingent upon City Council approval.
