Comment: The Planning and Zoning Commission, at a special meeting
!held on March 16, 1978,1 recommended by a unanimous vote approval
of,an application to, annex an 80 acre tract of land located ad
'.'jacent to the southerly! City limits an the east side of Highway �-
j 218 and to rezone saidproperty to((M1 and Cl zones. This recom-
mendatinn,is consistent' with a staff recommendation presented--Yn
a'staff report dated February 23, 1978, which'is attached to this
/ agenda. 'According to the Zoning Ordinance,. the Council must act
upon a resolution annexing an area 'at the time of the public i
hearing on the zoning classification. If the Councilpasses the
resolution, the annexation proposal must then be submitted to
the City Development Bonrd in Des Moines for acknowledgement of
the annexation. Approval of the rezoning request must necessarily ;
he deferred until acknowledgement. The public hearing on this
item is continued from April 18, 1978, pending construction of
a berm on the Gordon Russell property to the north. +4

The City's share of the project is $50,000 and the Commission's
share is $75,000 for a, total of 5125,000. The estimated cost'
of the project is $105,000 with the remaining $20,000 for design.
The Commission has $63,000 on hand plus $6,000 in pledges, and

has submitted a grant application for $10,000 to Nationai En-
n-dowment'for
dowment forthe Arts. A member of the design firm (Planned
` Environments) will be present at the hearing as well as a member r

TENANCE OF TRAFFIC CONTROL DEVICES AT CERTAIN INTERSECTIONS ON
WOOLF AVENUE NEAR UNIVERSITY HOSPITALS.
Comment: This agreement provides for the maintenance of traffic control:
devices at the intersections of. Woolf Avenue and the main hospi-
tal entrance, and Woolf Avenue and the hospital parking ramp
exit located south of the main hospital entrance. The University

agree. 'to notify the City when repair work is needed, and the
City agrees to do the repair work subject to' payment by the
University on a cost and materials basis. Either party would
have the 1 right to terminate this agreement upon the giving of
ten days 'written notice. As for liability, while there is not
a 'hold harmless clause In the contract as the University will
not enter into such clause because itfeels '..it cannot under
State law, the agreed upon liability language does give,the Uni-
versity"the burden of notifying the City when there is a problem.
Basically, the City would be liable for negligent ',repair of the
signals, or for failure to act after actual. notice.

12 - CONSIDER RESOLUTION APPROVING AGREEMENT FOR WATER MAIN EXTENSION.
Comment: This resolution would authorize the Mayor to execute an
agreement with the Cameron family for an'iextensipn of a water
main an Mormon Trek Boulevard. This agreement is similar to
several that were previously signed that 'essentlnlly'allows
the City to install the water main and the owner agrees to
pay a tapping fee if a connection is made in the future.
