Our office represents the owners of the University Lake Apartments,
also known as the Melrose Lake Apartments, located south of Melrose
Avenue on an extension of Woodside Drive which is privately owned.
The extension of Woodside Drive serves this property as a paved
access, but there is also an easement extending north from the property
to Melrose Avenue, which primarily serves as an access by foot and
bicycle for residents of the apartments who are employed in the Health
Sciences Complex at the University of Iowa and the Veterans Adminis-
tration Hospital. The owners of the apartment complex have just
completed a long and costly suit against an adjoining property owner
relative to the validity and extent of the easement, which culminated
in a decision of the Iowa Court of Appeals upholding the easement.
Our clients are extremely concerned that, if Melrose Court is cut
off as a through street, this will greatly increase traffic on the
private street and easement serving our clients' apartments and will
additionally burden the easement in question, thereby potentially
leading to further litigation with regard to the extent of the ease-
ment.
It would further appear that the closing of a portion of Melrose
Court is objectionable on the grounds of public convenience alone.
The area of the Health Sciences Complex is extremely congested at
the present time, particularly with regard to north -south accesses.
The Melrose Court -Myrtle Avenue -Greenwood Drive street system provides
the only north -south access between Benton Street and Melrose Avenue
west of Riverside Drive and east of Koser Avenue -George Street.
Although I certainly appreciate that Melrose Court is a narrow street,
the traffic conditions upon that street are not of recent origin,
and the effects of cutting off that access would be catastrophic
from a traffic congestion standpoint. It must be realized that a
great many people residing in the Benton Street-Oakcrest Avenue
area rely upon this street for access to their place of employment.

Dear Mr. Downer:
At its regular meeting of October 31, 1978, the City Council received
and placed on file your letter concerning the proposed closure of Melrose
Court. The pros and cons of this proposal were discussed by the City
Council at its informal session of October 30. A majority of the City
Council is interested in closing Melrose Court. However, action will
be taken only after alternative solutions for handling the traffic are
considered. The Public Works Department presently is in the 'process of
preparing these proposals for Council review. Traffic counts and origin/
destination studies will be conducted, and It estimated that the pro-
posals will be ready for the Council in about a month.

requesting that they give assistance. It was not possible for them to
provide any and the woman left my office after receiving my advice that
she stay in a home with relatives or friends and not be caught alone on
the street by her husband. After lunch, I went to the Sheriff's office
to talk with the Sheriff about the possibility of protection for this
woman but we were interrupted when sirens went off and the Sheriff had
to make an emergency call in the Town of Lone Tree. The woman was
murdered by her husband in a tavern in Lone Tree during the lunch hour
while she was having her lunch. Had a shelter or safe house been available
to her, I am convinced that this loss of life would not have occurred.
The first client I ever had as a practicing attorney was a woman
whose nose had been broken so many times by her husband that a surgeon
who was attempting to do reconstructive surgery could not count the
number of breaks. She had nine pregnancies, and her last child was
stillborn after she was kicked in the stomach by her husband. She had
not been allowed medical treatment during the entire pregnancy. She
left her home with her surviving eight children and was only able to make
a go of the dissolution and re-establish because a local church group
offered shelter for her at a safe location for as long as she needed to
commence legal action and find suitable housing.
Very recently, I filed a dissolution action on behalf of a client whose
husband repeatedly followed her to my office. She had been beaten many times.
On this occasion, her husband attacked and beat her with his fist as she
walked along the street in front of my office holding her young son in her
arms. Some of the blows missed the woman and struck the child. All the
members of the crowd of on -lookers stood and watched the attack and no one
attempted to intervene until our mailman physically subdued the husband.
This ,woman was placed in a YWCA shelter in a surrounding town as a personal
favor to me by the Director of that organization with the clear understand
that I could not regularly expect such help for my clients.

I am aware that as a group you must be aware that 3/4 of all murders
in this country take place within family groups. I am also sure you must
know that one-quarter of all police officers killed in the line of duty
in this country are killed when they attempt to intervene in domestic
quarrels.
I find this problem to be particularly severe in Iowa City; the
women mentioned above and other battered wives whom I have represented
did not come from one social or economic class; they have been professional
",omen, wives of professional men; from student families, from laboring families
or from indigent families. These incidents are by no means the innocent
result of the husband having a little too much to drink. :Indeed, many
authorities are taking a position in which I concur --that men drink in
order to be free to beat their wives rather than that they beat their
wives because they got a little drunk.
I realize that the other requests and grants are all meritorius, but
' I believe that if only one life was saved by the presence in Iowa City
of a shelter for women and children that the benefit to this community
would be far greater than our capacity to measure the gain.

It is apparent that a misunderstanding exists relative to the period
of time during which the Greater Iowa City Area Chamber of Commerce
has expressed serious concerns regarding the site of the proposed new
public library. While the Chamber is in total agreement that a new
facility is needed for the Iowa City community, the Chamber has long
opposed the use of prime retail space for such a facility.
The Board of Directors first expressed concern with the location fol-
lowing a site study report by city consultants, David R. Smith and
Robert H. Rohlf, in July of 1976. Members of the library board were
aware of the opposition voiced at this meeting.
The Executive Committee of the Chamber of Commerce met with the library
board in August of 1976, and again expressed opposition to the proposed
site.
In May of 1978 another meeting was held between the Chamber and the
library board. At the May meeting and in subsequent correspondence in
June, the Chamber again reiterated its opposition to the proposed site.
A special study committee was formed to evaluate the Chamber's position
in September 1978. A committee report was given to the Chamber of Com-
merce Board in October 1978 and the Chamber's position was re -affirmed
by a unanimous vote of the Board of Directors in opposition to the pro-
posed library site.
Individual members of the Chamber have also expressed their
disapproval of the proposed site to members of the library M
board and to members of the city council and to city staff
members.

I On March 27, 1979, a three-day meeting will be held in Des Moines --
the Iowa Governor's Pre-White•House Conference on Libraries. The en-
closed fact sheet explains the purposes and goals of this event which j

I am writing to you on behalf of the cooperating public libraries in
Johnson County (Coralville, Iowa City, oxford and Solon) to urge you
to become involved in this process which will culminate in a nationwide,

There are several ways you can participate: i
1.. Read the enclosed fact sheet to become informed about the
goals of the state and national conferences.

libraries: Coralville Public Library, Iowa City Public

Governor Robert D. Ray called the Conference for March 27, 28, 29, 1979.
The State Library Commission of IOWA has been designated by the, National
Commission on Libraries and Information Services to coordinate the Con-
ference. Barry Porter, State Librarian, is Conference Coordinator.
Assistance will be given by interested persons from around the state.
WHO IS PLANNING THE CONFERENCE?
A Planning Committee of 20, representative of the public and library pro-
fession, has the responsibility for directing the Conference. Specific
areas of concern are being handled by sub -committees, whose members come
from a variety of backgrounds and geographical areas. Citizens throughout
the state will be given an opportunity to suggest topics of concern. "THE
LIBRARY ... A PLACE TO GROW" will be the Conference theme.
WHERE AND WHEN WILL 1T BE HELD?
The three-day meeting will be held at the Savery Hotel in Des Moines, on
MARCH 27, 28, 29, 1979.

WHO WILL PARTICIPATE?

The White House Conference and the Governor's Conference are designed to
involve all citizens. Two-thirds of the 150 state conference delegates will
be IOWA citizens representing a broad cross-section of the population.
The other one-third will be library -related representatives such as li-
brarians, audio-visual specialists, media specialists in schools, library
educators and library trustees.
HOW WILL DELEGATES BE SELECTED? WHAT IS THE DEADLINE FOR APPLICATIONS?
Persons who wish to nominate themselves may pick up applications forms at
public libraries, Area Education Agency Media Centers and from the State
Library Commission. The completed forms must be submitted to the State Li-
brary Commission and be postmarked no later than midnight, NOVEMBER 10, 1918.
The delegates will be chosen by the Delegate Selection Committee from the
applications submitted with geographic and demographic representation
important considerations.
Observers will be welcome at the Conference.
WHAT ARE UELEGATE RESPONSIBILITIES?
Selection as a delegate to the Conference carries with it certain important
responsibilities. Delegates must agree to read the background materials
that will be sent to them, to participate in all Conference meetings and
deliberations and to take part in pre -conference briefing meetings.
Delegates will be provided background materials on Iowa libraries and
citizens' input on library needs in order to prepare themselves for the
Conference itself.
WHAT WILL THE PROGRAM INCLUDE?
Outstandinn speakers and group discussions will examine the present level
of IOWA's information resources in public schools, in colleges, in public
libraries, and in special libraries. Citizens will inform the profession
what types of services they need and expect. Together they will outline
concerns and issues for their collective action, and make recommendations
to pass along to the Governor, State Legislature, and White House Conference.
WHAT ACfION WILL FOLLOW THE GOVERNOR'S CONFERENCE?
Coordinated effort to implement the suggestions reached by the Conference
delegates; increased contact with political leaders requesting their help
in obtaining the Conference goals; local meetings to encourage action by
citizens and organizations; and preparation for the White House Conference
will be the results of the Conference. Nine delegates will be chosen to
represent IOWA.
HOW CAN YOU AS A CITIZEN CONTRIBUTE TO THE CONFERENCE?
Help spread the word about the Conference and its purposes. Contact the
Governor, your legislators, and your community leaders. Visit the libraries
in your area. Tell them what your library needs are.

The Johnson County Board bf Supervisors in cooperation
with the City Council of Iowa City are proposing that the
Capitol Street right of way between Court and Harrison
Streets be vacated and made available for the purpose of
building a jail. The concerns of The University of Iowa
relating to this proposal are set forth in letters dated
September 12, 1978, from me and September 25, 1978,from
President Boyd, both to First Assistant County Attorney,
J. Patrick White, copies of which are enclosed.
The University's overriding concern on this matter relates
to the fact that the public view of Old Capitol from the south
will be obstructed by the proposed jail. We belive this is a
vitally important consideration when one recalls the great
significance of Old Capitol to the people of our city and our
state. Old Capitol is the birthplace of Iowa and our city.
Iowa City was planned around it. Unobstructed avenues of approach
were built on four sides of Old Capitol and these vistas have
remained unimpaired until recently. To improve these vistas,
the Old Dental Building was removed several years ago.
The importance of Old Capitol to the general public is
underscored by the fact that its recently completed restoration
was supported by public appropriations and private gifts from
thousands of Iowans. The building,and the Pentacrest which

The Johnson County Board bf Supervisors in cooperation
with the City Council of Iowa City are proposing that the
Capitol Street right of way between Court and Harrison
Streets be vacated and made available for the purpose of
building a jail. The concerns of The University of Iowa
relating to this proposal are set forth in letters dated
September 12, 1978, from me and September 25, 1978,from
President Boyd, both to First Assistant County Attorney,
J. Patrick White, copies of which are enclosed.
The University's overriding concern on this matter relates
to the fact that the public view of Old Capitol from the south
will be obstructed by the proposed jail. We belive this is a
vitally important consideration when one recalls the great
significance of Old Capitol to the people of our city and our
state. Old Capitol is the birthplace of Iowa and our city.
Iowa City was planned around it. Unobstructed avenues of approach
were built on four sides of Old Capitol and these vistas have
remained unimpaired until recently. To improve these vistas,
the Old Dental Building was removed several years ago.
The importance of Old Capitol to the general public is
underscored by the fact that its recently completed restoration
was supported by public appropriations and private gifts from
thousands of Iowans. The building,and the Pentacrest which
surrounds it, have been designated a national historic landmark.

We must all be custodians of this historic landmark.
Together we should strive to maintain the public's visual
and physical access to the building. We believe the Board
of Supervisors and the City Council share this concern and,
therefore, we wish to propose an alternate site for the
construction of a jail.
The essence of the University's proposal is as follows:
1. The City of Iowa City would vacate and convey
to the University the Capitol Street right of
way between Court and Harrison Streets.
2. The University would covenant that no building
would ever be built on this right of way; that
it would be maintained as green space or for
some other non -building use.
3. The City of Iowa City would covenant that no
buildings would be built in the Capitol Street
right of way between Burlington and Court and
Harrison and the Rock Island Underpass.
4. In return the State of Iowa, upon the recommendation
of The University of Iowa and the State Board of
Regents, would convey an amount of land on the west
side of Capitol Street between Harrison and Prentiss
Streets equivalent to the amount of land in the
Capitol Street right of way between Court and
Harrison Streets to the Johnson County Board of
Supervisors as a site for the proposed jail.
This action would be subject to the approval of the State
Board of Regents and the Executive Council of the State and
the entire proposal is dependent on receipt of that approval.
Representatives of the University will be available at any
time to consider this proposal more in detail.
