Comment: The Planning and Zoning Commission, at a regular meeting
held on October lq, 197R, recommended by a four to zero vote and
one abstention approval of the subject request to rezone a four-
acre tract located at the northwest corner of N. Dodge Street
and M. Dubuque Road. This is an application which was submitted
approximately two years ago and which the Commission failed to
recommend approval of by a three to three vote. Their decision
to reconsider and recommend approval of the request was based on
the following factors: (a) the results of a trade area analysis
L prepared by the staff of north Iowa City (attached to the agenda
of October 11, 1978), (b) failure by the City Council to approve
by an extraordinary majority vote rezoning of the subject property
to no R3 zone contemplated In the moratorium rezoning,; and (c) the
desire of Hy -Vee Food Stores Inc. to construct a 20,000 square v f

3 d. Consider an ordinance rezoning part of an 80 acre tract of
land From A2, County Resort, to an M1 zone and consider
a resolution to annex the area. (Submitted by Wapner -Murphy
Foundation). (y.-7801) (first consideration)
Cnmment: The. Planning and Zoning Commission, at a special meeting
held on starch 16, 1979, recommended by a unanimous vote approval
of an application to annex an 80 acre tract of land located ad-
jacent to the southerly City limits on the east side of Highway
219 and to rezone said property to MI and Cl zones. This recom-
mendation Is consistent with a staff recommendation presented in
a staff report dated February 23, 1978, which was attached to
the Council agenda of September 5, 1978, However, the applicant
has withdrawn the portion of the 80 acre tract (pond area) for
annexation and rezoning. This Item, therefore, is to rezone and
annex only that portion of the 80 acres located east of Highway
218 to an M1 zone. Restrictive covenants are being placed on
the property to restrict use of the property to industrial.
Third consideration will he deferred until the City receives
acknowledgement from the City Development Board ofItheir endorsement
of the annexation, n

will he acquiring land at State cost for Highway D1 from U.S. #6
to the ,junction of proposed Freeway 518. This agreement makes
no reference to the location of Freeway 518 and it is not felt
that this agreement prejudices the City's case in any manner
except to recognize that there wilt be a 518. Hiphway #1 will
he rebuilt as a four -lane roadway from Riverside west to the
freeway.

providing for the issuance and securing of payment of revenue
bonds for the parking facllitles. Chapter 23-279 provides that
meter revenues must be put hack Into a fund for parking meters
only; repeal would allow application'of the revenues toward hoed
payment.
