of $1,355,250.66 for the period of September 1 through
September 30, 1e78, as recommended by the Finance Di-
rector, subject to audit.

subject to audit.
Resolutions.
(1) Consider resolution accepting FY79 asphalt resurfacing
project.
Comment: This resolution accepts the work performed
by the L.L. Pelting Company of Iowa City, Iowa. See
attached engineer's report. Public Works recommends
approval.
(2) Consider resolution accepting paving and related storm
and sanitary sewer work for Bryn Mawr Heights, Parts
11 and 12.
Comment: This resolution would accept the concrete pav-
ing as constructed by Metro Pavers, Inc., Iowa City,
Iowa, and sanitary sewer and storm sewer as constructed
by Sulzberger Excavating, Muscatine, Iowa, all for Bryn
Mawr Heights, Parts 11 and 12; but not including the
storm sewer in the detention area.
Setting Public Hearings.
(1) Consider setting a public hearing on December 19, 1978,
to receive public Input from citizens on the Small Cities
Program application for improvements in the Armory area.
Comment: This public hearing will he held in compliance
with Federal regulations governing CDBG funds. The Coun-
cil will be receiving additional information.
Correspondence.
(1) Letter from the Chairman of the Airport Commission re-
garding a Noise Abatement Committee. This letter has
been referred to the City Managet For reply.
(2) Letter from Danny .Joseph regarding the need for a stop-
light at the corner of Gilbert and Renton. This letter

3 e. Consider an ordinance amending the Zoning Ordinance by eatah-

conforming buildings, and non -conforming lots. (second con-
sideration)

Comment: The Planning and Zoning Commission at a regular
meeting held on October 5, 1978, recommended by a six to
zero vote approval of the subject proposed ordinance. This
ordinance would allow for structural alterations (additions)
to be made to existing non -conforming buildings as long as
the non -conformity was not increased or extended. The ordin-
ance has also been reviewed by the Board of Adjustment and
their suggested changes are contained in the ordinance. The
staff requests that the Council consider giving the second
and final readings to this ordinance so that it may be in-
cluded in first supplement to the new Municipal Code of Iowa
City. F

f. Consider an ordinance rezoning certain property from R2 and
CH zones to PC zones (Lots 8 and q, St. Mathias, 2nd Addi-
tion, as requested by Hy -Vee Food Store.) (second consider-
ation)
Comment: The Planning and Zoning Commission, at a regular
meeting held on October 19, 1978, recommended by a four to
zero vote and one abstention approval of the subject request
to rezone a four -acre tract located at the northwest corner
of N. Dodge Street and N. Dubuque Road. This is an applica-
tion which was submitted approximately two years ago and
which the Commission failed to recommend approval of by a
three to three vote. Their decision to reconsider and recom-
mend approval of the request was based on the following
factors: (a) the results of a trade area analysis prepared
}
by the staff of north Iowa City (attached to the agenda of

October 31,1978), (b) failure of the City Council to approve
r
by an extraordinary majority vote rezoning of the subject
property to an R3 zone contemplated in the moratorium re-
zoning; and (c) the desire of Hy -Vee Food Stores Inc. to
construct a 20,000 square foot supermarket on the property
presently zoned CH. A letter signed by all property owners

on the south side of Dodge Street objecting to the proposed

g. Consider an ordinance rezoning part of an 80 acre tract
of land from A2, County Resort, to an M1 zone. (Submitted
by Wagner -Murphy Foundation). 7.-7801 •(second consideration)
Comment: The Planning and Zoning Commission, at a special
meeting held on March 16, 1978, recommended by a unanimous
vote approval of an application to annex an 80 acre tract
of land located adjacent to the southerly City limits on the
east side of Highway 218 and to rezone said property to M1
and Cl zones. This recommendation is consistent with a
staff recommendation presented in a staff report dated
February 23, 1978, which was attached to the Council agenda
of September 5, 1978. However, the applicant has withdrawn
the portion of the 80 acre tract (pond area) for annexation
and rezoning. This Stem, therefore, 1s to rezone and annex
only that portion of the 80 acres located east of Highway 218
to an MI zone. Restrictive covenants are being placed on
the property to restrict use of the property to industrial.
The City Development Board's endorsement of the annexation
has been received by the City Clerk.

Consider an ordinance vacating Capitol Street between Harri-
son Street and Court Street. (second consideration)•
Comment: The Planning and Zoning Commission, at a regular
meeting held on October 5, 1978, recommended by a 6 to 0
vote, approval of a request by the County to vacate the
subject portion of Capitol Street for a new County jail
facility. The Commission also recommended that the City
Council direct the staff to develop alternatives to the
traffic problem prior to the effective date of the vacation.

LAND.
Comment: This resolution authorizes the Mayor and City Clerk to enter Into
an agreement whereby the City will purchase a 40 by 155 foot
tract of land at 526 Reno Street from Ms. Aurelia SoInar. Ms. Sol -
Dar has accepted the offer to buy for $1,200. This previously
wan npproved by the City Council on October 17, 1978.

Item No. 11 - CONSIDER RESOLUTION APPROVING. AGREEMENT WITH IDOT - AGREEMENT
Z_// FOR FEDERAL AID RAILROAD CROSSING PROTECTION PROJECT.
Comment: This resolution would authorize the Mayor to execute an agreement
with IDOT which would allow IDOT to negotiate with the C.R.I.6P.
Railroad to install crossing protection on the crossing at S. Gil-
hert Street. There will be five agreements for the S. Gilbert
Street Project which will include the use of three sources of
funding - FAUS, USTEP, and 90/10 special federal grade crossing
funds. This agreement uses the federal funds in which the City's
10% share is approximately $4,000. Public Works recommends adop-
tion of the resolution.

Chapter 23-279 should be repealed so that there will be no City
ordinance which is inconsistent with the terms of the resolution
providing for the issuance and securing of payment of revenue
bonds for the parking facilities. Chapter 23-279 provides that
meter revenues must be put back into a fund for parking meters
only; repeal would allow applicntlon of the revenues toward bond

Comment:
This ordinance would restrict extremely heavy truck traffic on
Kirkwood Avenue. A weight limit has been set which will allow

most of Iowa -Illinois Cas and Electric's trucks but which will
exclude six to eight yard concrete trucks and tractor trailer
units. Concrete trucks are licensed for 22-24 tone and tractor
trailers are licensed for 35-36 tons. Most of Iowa -Illinois'
13-16 tons. Accordingly, the ordin-
