The area in question is bounded by the following streets and alleys: North Summit Street to the west, North Dodge Street to the north, Conklin Street to the east (also St. Joseph's Cemetery), and St. Peters Alley to the south (see Location Map). It is the Council's intent to down zone the subject area to a zone which permits uses more consistent with the land use recommendations of the Comprehensive Plan. This action would be only an interim measure until the adoption of a new zoning ordinance. According to the Comprehensive Plan Land Use Map, the area in question is shown as a striped land use classification. Although the Plan recommends this classification for several locations within the City, the Plan document does not address the 'intent of this classification. Regarding the area in question, the Plan text recommends that this striped area be developed as "...neighborhood commercial/moderately high density residential mix..." (this recommendation is unclear because of the use of the slant line between the two suggested uses and means "and", "or"). The deliberations of the Comprehensive Plan Coordinating Committee (CPCC) do indicate, however, that the intent of the striped classification was to provide a transitional area which allowed the mixing of both commercial and residential uses, i.e., much in the same manner as now permitted by our CBS (Central Business Service) Zone or possibly that allowed within a neighborhood commercial area, The present Zoning Ordinance does not contain a Neighborhood Commercial zone. The closest substitutable existing commercial zone would be Cl. The Cl Zone is the most restrictive commercial zone that permits both residential and commercial uses. However, the Cl Zone also permits uses which are not characteristic of neighborhood commercial uses. An advantage of the C1 Zone in lieu of the present CH Zone is that it further restricts the number of non -neighborhood commercial uses. Those uses prohibited by the C1 Zone are: creameries, motels, hotels, restaurants, tea rooms, cafes, taverns, sale of any goods and products at retail, and filling stations. The Staff recommends that the area in question be rezoned to Cl as an interim measure. Ultimately, the Commission should address the issue as to the Comprehensive Plan's land use intent for the subject area. The Commission recommended approval of the annexation request but that the property he zoned RIA In lieu of RJR. Primary concern weighed by the Commission in consider- ation of the rezoning request was need and location of future elementary school facilities in this area. Formal action on the subject request was not taken by the City Council. At the applicant's request, the original petition is now being referred back to Planning and Zoning by City Council for reconsideration. Important factors for consideration by the Commission are: elementary school needs and sanitary sewer requirements. Unquestionably a need for additional elementary schools to serve developing areas in southwest Iowa City exists. Ernest Horn Elementary has neither the capacity nor the location to serve both the remaining developable area within the City or any future areas annexed. The Comprehensive Plan recommends location a new elementary school south of Horn to serve an area defined by the following streets: Mormon Trek Boulevard on the west, Highway 1 on the south, and Sunset Street on the east. This recommendation assumes annexation and development of that area south of the City limits. Only through annexation can enough service area be provided to justify construction of a new elementary school. Busing, necessarily will be an interim measure until the elementary school population is large enough to support a new school. Future elementary school population is related directly to density and types of residential development and the zoning determines the density and type of development which can occur. The Plan recommends the subject area be zoned to permit a density of development of between 2 to 8 dwelling units per acre. The applicant's request is for RIB, approximately 4 dwelling units per acre, which is consistent with the y I Plan's recommendation. At the time of the submittal of the petition for annexation, available sewer capacity did not seem to be a problem. Subsequently, the Comprehensive Planning Process and studies by the Engineering Division have brought to light capacity constraints in the South-West Intercepter Sewer. There are five capacity restrictions in this trunk sewer all of which are found in an area between Highway 1 and the Ty'n Cae development. The most restrictive link of this sewer limits capacity to an additional 350 Gallons Per Capita Per Day (GPCPD), an equivalent of 2,550 popu- lation, than presently being served. Correlated in terms of acreage, present sewer capacity could serve 160 additional acres, assuming 3.5 people/unit and 4.5 units/acre. If sewer service is to be provided to the remaining undeveloped areas located in the western part of the Willow Creek Watershed and those areas south of the City limits, the existing sewer will necessarily need to be upgraded. The Comprehensive Plan makes the policy recommendation that the sequence of growth in southwest Iowa City should occur first within the corporate limits and second in the area within which the subject request is located and shown as being part of Phase 3 growth. Adequate sewer capacity does exist to meet the development demands for those undeveloped areas indicated by the Land Use Map as being in existing and Phase 1 development sequences. However, before Phase 2 growth can occur in this area, it will be necessary for the City to upgrade the sewer which could then provide service to the request area (Phase 3). Assuming the South-West Trunk Sewer is given the highest priority for upgrading, the earliest these improvements are scheduled to begin is Phase 2 or approximately 7 to 12 years hence. Dietz, City Engineer N Re: Southwest Interceptor Sewer At your formal meeting on November 16th, we discussed the capacity of the Southwest Interceptor Sewer at some length. For the record, I would like to briefly summarize that discussion in this memo. Approximately 18 to 24 months ago, the City Council requested information concerning capacities of sewers within Iowa City. For that purpose, I put together a very hurried presentation which was intended to show that there was enough sewer capacity within the existing system to serve at least the year 2000 projected population. One of the areas discussed in that presentation was the southwest corner of town. The purpose of this memo was to show as a minimum what populations could be served. As a. minimum, I informed the Council and others that 6,000 people could be served on the Southwest Interceptor. Subsequently, use of the figures have been made for other purposes. Unfortunately, since the numbers were generated for a specific purpose, they have caused a great deal of misconception; particularly as relates to the Ty'n Cae Subdivision. We have therefore'done a much more thorough analysis on the capacity of the Southwest Interceptor. In fact, rather than a capacity of five or six thousand people, we find that capacity of.that sewer is in the range of 13,000 to 15,000. This range is for unused capacity. As discussed, Doug Boothroy provided me with information concerning the potential population in this corner of town. The area tributary to the Southwest Interceptor and within the area growth line and within the City limits had a population range from 8,600 to 11,500. Even the high total popula- tion is less than the lower end of the range that we believe to be available for capacity in the sewer. The 39 acres of the Ty'n Cae Subdivision which is proposed to be annexed would appear to have a high total.population of approximately 772. As you can see, even at the high end of the population range, there should be ample capacity sewer to allow the connection of the Ty'n Cae Subdivision: There is an abundance of details which I could have submitted in this memo. However, for brevity, I have selected not to incorporate it into paragraphs. It is our opinion that a fence permit should be obtained before erecting a fence for a very minimal. fee for the purpose of obtaining a plot plan of the property and a design and location of where a fence might be located. This would help us to assure compliance with the fence ordinance and would avoid having individuals buy a fence from someone like Sears or Wards, have it installed and later having us come along and issue a citation for illegal placement or improper height. It is our opinion that this type of procedure would eliminate approximately 90% of all improper installations now occurring in the Iowa City area. During the summer months we received many phone calls asking if we do require a permit and asking for regulations of fences. It is also our opinion that by obtaining a fence permit it would help the enforcement procedure in establishing what fences are now legal non -conformities and what fences are not. Presently, we have no documentation to any fence being erected in Iowa City and with the establishment of a new fence ordinance it would be virtually impossible.for us to determine whether a fence or a dog run would or would not be a legal nonconformity. Lastly, we would like to obtain a permit for the structural stability of a fence. As I am sure you are well aware, fences that are over 6 feet in height are regulated by the Building Code and when a fence does become over 6 foot in height, there is a good probability of some structural failure. High fences must be built in a unique way to withstand the severe wind and snow loads that occur in the mid- western states. By requiring a fence permit we could see a diagram of how the fence were to be built and could offer some suggestions on whether it would withstand the proper wind and snow loads. It is not our ambition to generate more revenue for the City of Iowa City but merely to regulate and enforce the various City codes. We feel that a nominal fee, such as $1.00, would be more than sufficient as a permit fee, but we also feel that it would not be sufficient enough to cover the costs that occur trying to enforce the ordinance.
