(1) Consider resolution accepting, storm sewer for Bryn Mawr
Heights, Parts 11 and 12.
Comment: This resolution would accept the storm sewer
in the detention area of Bryn Mawr Heights, Parts 11
and 12 as constructed by Knowling Brothers, Sharon
Center, Iowa. Public Works recommends approval of this
resolution.
C. Correspondence.
(1) Letter from Old Capitol Associates regarding the pro—
posed ordinance prohibiting bars or the dispensation
of liquor above the first floor In a building. This
letter has been referred to the City Manager for reply.
(2) Letter from Mrs. Irma Haugen regarding snow removal and

Item No. 4 — PLANNING AND ZONING MATTERS.

a. Consider an ordinance amending Zoning Ordinance 2238 by
changing the use regulations of certain property from CH
to C2 Zone (submitted by A. E. Greb). (second consideration)
Comment: The Planning and Zoning Commission at a regular
meeting held on October 19, 1978, recommended by a five to
zero vote approval of the subject request to rezone a, tract
of land located south of Highway 6 Bypass and west of the
VFW Club. This recommendation is consistent with the staff's
recommendation presented In a staff report dated October 19,
1978, which was attached to the agenda of August 21, 1978.
The requested rezoning is consistent with the Comprehensive
Plan.

h. Consider an ordinance rezoning part of an 80 acre tract of
land from A2, County Resort, to an MI zone. (Submitted by
Wagner—Murphy Foundation). 7,-7801 (massed and adopted)
Comment: The Planning and Zoning Commission, at a special
meeting held on March 16, 1Q78, recommended by a unanimous
vote approval of an application to annex an 80 acre tract
of land located adjacent to the southerly City limits on the
east side of Highway 218 and to rezone said property to MI
and Cl zones. This recommendation is consistent with a
staff recommendation presented In a staff report dated
February 23, 1978, which was attached to the Council agenda
of September 5, 1978. However, the applicant has withdrawn
the portion of. the 80 acre tract (pond area) for annexation
and rezoning. This item, therefore, is to rezone and annex
only that portion of the 80 acres located east of highway 218
to an M1 zone. Restrictive covenants are being placed on
the property to restrict use of the property to Industrial.
The City Development Board's endorsement of the annexation
has been received by the City Clerk.

Comment: The Planning and Zoning Commission, at a regular
meeting held on October 5, 1978, recommended by a 6 to 0
vote, approval of a request by the County to vacate the
subject portion of Capitol Street for a new County ,jail
facility. The Commission also recommended that the City
Council direct the staff to develop alternatives to the
traffic problem prior to the effective date of the vaca-
tion.

Police Chief advised that the new management was making an effort
to comply with the City Code and State law. The Police Chief
now advises (see attached memo) that no complaints have been
received regarding the Copper Dollar during the past three
months. Accordingly, the staff recommends that the Council
close this public hearing and take no action.
