We read with interest your pending ordinance prohibiting

As you are aware, we are in the process of constructing
a two-story enclosed shopping center within the Central
Business District. There is a strong possibility that a bar
or cocktail lounge could be located on the second floor of
the center.
Therefore, we respectfully request that you reconsider
the scope of the ordinance and consider allowing the dispen—
sation of liquor within shopping centers. We would be happy
to have our attorneys work with yours in a simple language
change in the ordinance to accomplish this goal.

At its regular meeting of December 12, 1978, the City Council received
and placed on file your letter regarding the proposed ordinance which
prohibits dispensation of liquor above the first floor in any building.
As you may know, the Council has revised this ordinance to allow the
dispensation of liquor on upper levels within shopping malls and has
referred the ordinance to the staff for addttional study.,

RE: Leasing of Airport Property Not Needed for Actual Operations
of Aircraft or Facilities
As I indicated at last month's meeting between the City Council
and Board and Commission heads, the ICMAC no longer has a proposed
tenant for any of the land bordered by Highway 6, the river and
Highway 218.
The abstracts covering all the Airport lands have just recently
been up -dated by Security Abstract of Iowa City and are now in
the hands of Mr. William Tucker, who has been retained by the
ICMAC as its legal council. Appraisals of the leaseable land in
question as well as a few other parcels have been completed by
Winegar Appraisal Co. of Des Moines, Iowa, for the ICMAC.
Mr. Bowlin has indicated that there is some question as to who has
control over the property west of the Iowa River and east of High-
way 218. Realizing that the outcome of this question will affect
the income realization of the ICMAC, the city maintenance department
and its charges against the ICMA, the plans of the Parks and Re-
creations Commission and the River Front Commission, the Comp-
rehensive Plan of Iowa City and ultimately the property tax payers
of Iowa City, I wish this matter to be settled. I request that
Mr. Bowlin present the "questions" he has on control of said
property so that they may be investigated and answered at the

Mr. Mayor and Members of the Council:
On behalf of Johnson County request is made
herewith for vacation and conveyance to the State of
Iowa of the portion of West Harrison Street described
as follows:
Harrison Street from the westerly right-
of-way of Capitol Street to the easterly
right-of-way of Madison Street.
This requested vacation and conveyance would be
in furtherance of the attached three -party agreement
which we propose to you.
In return for conveyance of this real estate and
your establishment of a scenic easement over three blocks
of South Capitol Street, the University of Iowa is pre-
pared to deed to Johnson County one of three alternative
jail sites in the block directly southwest of the court-
house square. A copy of Vice-president .Jennings' letter
to that effect is also attached.
Consistent with this request, we would suggest that
you defer further action on the pending Capitol Street
vacation ordinance until such time as you are able both
to complete the vacation and disposition of this one -
block of Harrison Street and necessary action on the
proposed easement.
We much appreciate your continued efforts in seeking
a satisfactory site to the new jail.

AGREEMENT
REGARDING
REAL ESTATE
Whereas, Johnson County, Iowa, has petitioned the City
of Iowa City to vacate Capitol Street between the southerly
line of Court Street and the northerly line of Harrison Street;
and
Whereas, Johnson County, Iowa, has requested that, upon
vacation, that portion of the Capitol Street right-of-way be
conveyed by the City of Iowa City to Johnson County, Iowa,
for use as the site for a new county jail and sheriff's office;
and
Whereas, the University of Iowa has stated its concern
regarding the aesthetic impact which that proposed site would
have on the southerly approach to Old Capitol; and
Whereas, the parties to this agreement, subject to
approval of the City of Iowa City, desire mutually to seek to
assure expeditious development of a new county jail without
any detrimental impact on the southerly approach to Old Capitol;
Now, therefore, it is mutually agreed as follows:
1. The State of Iowa, upon the recommendation of the
University of Iowa and the State Board of Regents, will convey
a parcel of land to Johnson County, Iowa, for construction of a
new jail and sheriffs offices. The parcel to be conveyed will
be one of the configurations and locations shown on the exhibits
attached hereto as Attachments A, B and C.
2. The specific conveyance will be chosen from Exhibits
A, B and C by Johnson County, Iowa. Selection of the specific
conveyance is to be made following more detailed site and design
analysis by Johnson County.
3. The City of Iowa City will convey to the State of Iowa
a scenic easement over the Capitol Street right-of-way between
the northerly line of Court Street and the northerly line of
the Rock Island Railroad right-of-way. Said easement shall be
perpetual and shall covenant that no building will ever be bdilt
on that right-of-way and that it would be maintained as open
space for street or other non -building use.

2. The specific conveyance will be chosen from Exhibits
A, B and C by Johnson County, Iowa. Selection of the specific
conveyance is to be made following more detailed site and design
analysis by Johnson County.
3. The City of Iowa City will convey to the State of Iowa
a scenic easement over the Capitol Street right-of-way between
the northerly line of Court Street and the northerly line of
the Rock Island Railroad right-of-way. Said casement shall be
perpetual and shall covenant that no building will ever be built
on that right-of-way and that it would be maintained as open
space for street or other non -building use.

Re: Pending Hearing for Copper Dollar
It is my understanding that the hearing on the Copper Dollar's liquor
permit, deferred from last fall, should be placed on the Council agenda
soon.
Since the establishment was placed under new management we have had very
few complaints originating in or from the establishment. As a matter of
fact only six complaints have been -received since August. This is not
an unusual number of complaints and few have been serious in nature.
It is my personal opinion that the hearing does not need to be held.

Re: Authorization of Part -Time Technical Assistant (Graphics)
Position
While the City of Iowa City was developing a Comprehensive Plan, a
Planning Technician was employed to provide graphic support for that
activity. Because the Comprehensive Plan was to be completed as of
June, 1978; the position was not reauthorized in the FY79 Budget. A
temporary employee was hired to provide graphic support until the
project was completed, and it could be determined whether there was
enough other work to justify a per position. At this time the
situation has been analyzed, and I recommend that a permanent part-time
position for a Technical Assistant be authorized.

A temporary employee began working on March 1, 1978, to complete graphic
work for the Comprehensive Plan. On July 1, 1978, arrangements were
made so that all departments could receive graphic support. Arrangements
were made and the employee worked hour per hour as the workload demanded.
Since July 1, the individual has worked an average of 62.3 hours bi-
weekly. This arrangement has been mutually satisfactory. The union
contract states that a temporary employee may request permanent status
after six months. Subsequent to the request we have analyzed the situation,
and recommend that the position be authorized.
Since June 30, graphic support has been provided for the following
departments: City Manager's office, 34 hours; City Council; 11 hours;
Planning Division, 248 hours; CDBG Division, 103 hours; Energy Program,
1 hours; Finance Department, 10 hours; Housing & Inspection Services,
154 hours; Human Rights Commission, 42 hours; Parks & Recreation Department,
65 hours; Public Works Administration, 11 hours; Purchasing.Division,'3
hours; Transit Division, 67 hours; and other, 15 hours. Now that the
Comprehensive Plan is completed, there is not adequate work within the
Department of Planning and Program Development to retain a staff person
solely for this Department's use. However, her workload since June
adequately justifies retaining a graphic technician on a part-time
basis.
If the City Council chooses not to authorize the creation of this position,
various departments will be required to individually search for adequate
graphic support. The result will most likely be that division heads and
department heads will be forced to either do the graphic work themselves,
or search for students who are willing to work on a particular project.
The cost of commercially contracting for graphic support will most
likely exceed the cost of retaining a part-time employee. Since each
