Dear Mr. Berlin:
David Perret told me a few months ago that the Iowa City Council passed
a motion in favor of negotiations between Iowa City and University
Heights regarding transit services by Iowa City to University Heinhts.
Since it has been some time since such a motion was passed by the Iowa
City Council, I was curious if Iowa City continues to desire such
negotiations. If so, we are willing to meet with you. Our position
on this matter continues to be that we are desirous of obtaining transit
service from the Iowa City Transit Service.
The Melrose Avenue railroad bridge has sidewalks on both sides which are
not being shoveled after a snow storm. It is my understanding that Iowa
City has an ordinance requiring snow to be removed from sidewalks within
24 hours following snow storms. Since the Melrose Avenue bridge sidewalk
is within the city limits of Iowa City and is owned and maintained by
your city, it would seem that the city of Iowa City should also take
responsibility for snow removal from the sidewalks on the bridge, consis-
tent with your city ordinance.
I would appreciate your consideration of these matters and look forward
to hearing from you soon.

I recently received a copy of the unsigned "legal memo" and newspaper
clippings which representatives of Eastern Iowa Cablevision, Cedar Rapids,
circulated at the December 19 meeting of the Iowa City City Council. We
have not previously responded in writing to the many irrelevant and false
charges Cox has made during closing phases of the Iowa City CATV franchise
award process. However, because Cox has chosen to formally present its
most recent set of charges in writing to the Council, we feel obligated
to respond in like manner.
With respect to the Waterloo CATV franchise litigation, we do not believe
it is necessary or proper for us to explain the law to you. You have an
able City Attorney who reviewed all applicable law and litigation, includ-
ing, we believe, the Waterloo case, before advising you on how to structure
your CATV franchising procedure. But, because Cox has made an inaccurate
interpretation of the Waterloo matter, we will provide the Council with
further information.
Cox did not provide you with a copy of the trial court judgment, and did
not recite for you the facts of the case. Had they done so, you probably
would have concluded that the facts of the case in Waterloo are totally
opposite the situation in Iowa City. Further, a careful reading of the
trial court judgment reveals that the trial court judge did not rule on
the issue of whether the City of Waterloo could grant a franchise to only
one CATV operator.
In Waterloo, the City Council had adopted after three readings an ordi-
nance granting American Cablevision of Waterloo a franchise contingent on
voter approval. Voter approval was subsequently obtained. Another
company also received an ordinance and voter approval. Then, on May 24,
the City Council passed on first reading an ordinance repealing our
franchise. At this point, we went to court -seeking a declaratory judgment
that we had a valid CATV franchise, and seeking to enjoin the City from
attempting to repeal our ordinance. The question was whether we had
received a valid franchise. In August, the trial court upheld our position.

As a small portion of its case, Waterloo contended they had a right to
grant only one franchise. Waterloo presented evidence on the problems
of having two franchises, and on the legality of a city granting only one
franchise. The court determined that it would not be necessary to decide
whether Waterloo must grant two franchises, because the court had already
determined that two franchises were awarded --ATC and another company had
received valid franchises. The court stated that if the Appeals Court
should subsequently rule that ATC does not have a franchise, it might
then be necessary to determine whether Waterloo has the right to refuse
to grant us a franchise.
The law states that a city may not grant an exclusive franchise, and both
Waterloo and Iowa City have complied. The law states that a city may
grant one or more franchises under certain conditions, but does not state
any conditions under which a city shall grant more than one franchise.
The latter issue has been the subject of extensive litigation, but has
certainly not yet been determined in Waterloo. In summary, we do not
believe that either existing law or the Waterloo case would now require
Iowa City to grant two franchises.
Your City Attorney has advised you that you nay proceed to grant a
franchise to only one applicant. We believe you should continue on your
chosen course. By doing so, you will be helping to ensure that you receive
the best possible cable television service. Granting two franchises would
unnecessarily fragment the extremely advanced and community -oriented cable
television system vie have proposed for Ions City. For the proposed city-
wide integrated communications system to operate in the best public
interests, there should initially be only one franchise in Iowa City.
However, you are not granting an exclusive franchise, and will. always
have the right to grant a second franchise. For example, should Hawkeye
fail to provide the type of service it has promised, you would have the
right to grant a second competing franchise. We believe this is the
intent of the prohibition on exclusive franchises.
If you refuse to grant a second nonexclusive franchise at this time, you
will not have deprived Cox of the legal remedies they might use in seeking
a second franchise at a later date. We can understand your concern that
Cox might institute litigation, because they have done so in the past.
However, we do not think that the threat of potential litigation alone is
sufficient reason for you to either delay proceedings further, or to grant
two competing franchises.
By presenting to the City Council copies of the newspaper article regarding
our Shreveport, Louisiana operations, Cox is venturing into an area which
cannot be treated on a case-by-case basis. The City staff undertook a very
thorough and professional written survey of officials in all cities served
by both applicants. The results of this survey concluded that the reputations
of both companies were satisfactory. We believe this survey, and not third -
hand newspaper articles from a single market, should be the evidence relied
upon by the Council in granting the franchise. Nonetheless, we believe a
response to the Shreveport issue is necessary.

The Shreveport article is the result of investigative reporting, and not
a City inquiry. (Interestingly, the article fails to reveal that the
newspaper was a partner with one of the losing competitors for the
Shreveport franchise, and one of the local 'britics" quoted in the article
is a nearby CATV operator who has been in franchising competition with us
in Shreveport, Bossier City, Louisiana and elsewhere.) The City Council
has taken all the charges under advisement, and is studying the matter.
We do not know what the next step will be, or when a final report will be
issued.
Nonetheless, we expect that there may be some areas of misunderstanding
regarding our performance in Shreveport. The Shreveport ordinance and
proposals were written during the "blue sky" days of cable television when
proposals addressed the vast potential of CATV, but made some items contin-
gent on operational and economic realities of the optional and potential
services described. It appears that perhaps some contingent items are
being construed as mandatory. If, during its study, Shreveport finds
deficiencies in our system, we will correct them. We have already taken
steps to correct known problems, and will continue to do so.
Cox contended that the City should be looking for "clear and convincing
proof" that Iowa City will not have similar problems. The best proof is
that over the years ATC has consistently been one of the most successful
CATV operators. City after city has investigated our background and track
record, found us acceptable, and granted us a franchise. These same cities
have generally found us to be excellent operators, as the results of the
Iowa City written survey found. As further proof of our integrity, ATC
has accumulated over the years a number of commendations, news clippings,
and favorable reports. Enclosed with this letter you will find a copy of
Volume II of the Burlington, Iowa franchise proposal. This document is a
compilation of testimonials, news clippings, and other information on our
"track record". We hope you find it to be of use.
However, we recognize that you may wish to further investigate the reputa-
tions and past performance of both companies. In that event, we are fully
prepared to present to you information on the failings of Cox in many
systems. We, too, keep track of our franchising competitors, and are
prepared to play their game. However, we sincerely hope that this does
not become necessary. Both companies overall have sound reputations, and
we do not think such time-consuming debate will be productive. Many
cities have been satisfied with both companies.
In determining whether Iowa City will get what it has been promised, the
Council should also review the excellent job its staff did in preparing
the franchise ordinance and proposal format. There will be no ambiguity
as to the meaning or extent of the information contained in the Hawkeye
proposal. We have been careful to set forth our understandings, and to
present realistic financial plans, including higher subscriber rates.
We have answered fully and carefully all questions put to us by City
staff and others. The kinds of misunderstandings, qualified promises,
and unrealistic financial plans which occasionally have led to problems
in other franchises nationwide should not be a problem in Iowa City.

Committee, discussed the charges which Cox has made. His comment is
perhaps the best summary:
Pepper said the advisory staff "contacted all the
cities in which the two companies are operating" in in
their evaluation of the franchise proposals and found that
"both had outstanding systems to point to and both had
systems in which there were problems." He said Shreveport
officials also responded to the City's survey indicating
that they had had no major problems with their cable
system.
He termed Eastern Iowa's legal question and the firm's
public statements regarding its opponent "delay tactics. ."
We concur with Dr. Pepper's analysis of the situation. We believe there
is sufficient information before you to permit you to adopt an ordinance
granting the franchise to Hawkeye. The City's independent consultant
found Hawkeye to be more responsive to the City's stated needs. The
.Advisory Committee concurred, and endorsed Hawkeye. The voters ovenihelm-
ingly endorsed our proposed services, and only narrowly permitted Cox to
be considered further. ATC is a strong company, and the Hawkeye proposal
is outstanding. It is now time to pick the better system for Iowa City --
and we believe the choice can only be Hawkeye.

Re: FY80 Budget -Staffing Level
Dear Mayor and Councilmembers:
On behalf of the Iowa City Human Rights Commission, I would like to
express our concerns regarding the staffing level for the Department
of Human Relations in the FY80 budget. The Commission is recommending
that the Department be expanded by adding one additional professional
staff person (either part- or full-time) to the current staff of director
and two support personnel.
The additional staff member is necessary in order for the Commission
and Department to implement more out -reach educational programs for
the community and for the City. As regulations in the'area of equal
opportunity/non-discrimination expand and become more complex, it is
necessary to provide professionally conducted seminars focusing on
these issues. The Commission strongly feels that more out -reach
programs to the community and City personnel will increase the awareness
of organizations' and individuals' responsibilities, promote better
relations between the Commission and community, and effectuate voluntary
compliance with non-discrimination laws. The additional staff person
is necessary to devote the time and attention to develop quality
educational programs for both the community and the City.
We appreciate your consideration of our recommendation. If you have
any questions regarding our recommendation, please contact us. On
behalf of the Commission, thank you for your attention to our concern.

Dear Members of Council:
It has been brought to my attention by older citizens
and my staff about the serious problems resulting from
the heavy snow and ice storm recently.
I realize that City is doing all that is utterly possible'
in maintaining the streets and snow removal, and we are
fully aware of extreme circumstance and physical factors
brought on by winter storms.
Major reasons for concern are:
-Snow, heaped up along sidewalks, in front of homes,
business „offices and stores, making it extremely
hazardous and impassable for individuals to leave
their houses, or to board and get off buses, cars,
etc., to walk/travel along the streets.
-Sidewalks in front of public housing especially s
Mark IV, have not been taken care of. A 79 year
old man had to be taken to hospital for several
stitches about the face and treated for a broken
finger as result of fall from slip on the iced
sidewalks.
-Volunteers, working with Council on Aging and the
nutrition program, experienced difficulty in reach-
ing their clients.
-There are no parking places available, volunteers i
can not get out of own drive way in order to assist
with snow removal.

In the interest of full communication with the Iowa City community, this
letter is written to apprise you and members of the City Council of an impending
new service to be offered by the University of Iowa Hospitals and Clinics. I
will attempt to summarize it briefly in the following paragraphs.
As you may know, the University of Iowa Hospitals and Clinics was desig-
nated in 1975 by the Governor's Advisory Council on Emergency Medical Services
as Iowa's sole comprehensive emergency treatment center. This designation was
coordinate with University Hospitals' mission as Iowa's comprehensive tertiary
health care center and was an element of a statewide plan for categorizing
hospital emergency medical services to facilitate the accommodation of emergency
patients at the most appropriate site of care and thus reduce mortality and
morbidity.
As is generally recognized, the availability of emergency ground and air
transportation, together with staff skilled in advanced life support, greatly
influences the extent to which Iowa's stratified system of emergency medical
services optimally functions. The number of ground ambulance services and
trained emergency medical technicians has improved substantially in Iowa during
the past few years. However, the absence of comprehensive high quality emer-
gency air transportation with associated critical care capacity, by which select
gravely ill patients and those with multiple system injuries may be quickly
transported from a hospital or accident scene to an appropriate level of emer-
gency care, has impaired the realization of an optimal emergency medical service
program in Iowa. It is in this context of statewide emergency air trans-
portation and care for select emergency patients that University Hospitals
perceives an immediate obligation to extend its tertiary level emergency medical
services through an expanded Emergency Helicopter Service.
Accordingly, we are pleased to indicate that, effective February, 1979, an
emergency helicopter will be based immediately outside University Hospitals' new
Emergency Treatment Center in the Roy J. Carver Pavilion on continuous alert for
the transportation and care of critically ill and injured patients upon request
of community physicians, hospitals and law enforcement officials. This hospital-
based emergency helicopter will supplement our longstanding cooperative program
of emergency patient transportation via helicopter with the Iowa National

Guard. The expanded Emergency Helicopter Service at University Hospitals will
feature one of the world's finest engineered helicopters for emergency patient
transportation -- an Aerospatiale A -Star 3500 -- and a five minute response time
in having it airborne upon request. Highly skilled critical care nurses and,
when indicated, emergency physicians will accompany the pilot on each flight.
The emergency helicopter will be outfitted with a complete array of life support
equipment and medical supplies. Ground -to -air radio communications will link
the Emergency Treatment Center staff at University Hospitals with the clinical
care team aboard the helicopter. The helicopter will be backed up by a new
overland Critical Care Van and the present Neonatal Infant Transport Van.
To the end of good community relations, we will locate the helipad landing
site some 750 feet north of Melrose Avenue on present University Hospital land-
scape space. This location was selected in order not to disrupt west campus
playing fields, parking, and pedestrian traffic, as well as to minimize noise
for the surrounding residential community. With respect to the noise consid-
eration, I should also indicate that we have contracted for a helicopter with a
decibel rating some fifty percent less than the helicopter which the National
Guard has been using in our longstanding Emergency Service Helicopter Program.
The A -Star Helicopter, which will be based at the University Hospitals, has a
decibel rating ranging between 69 and 82 during landing and takeoff. This can
be compared to decibel ratings of 95 for semi -trucks and 78 for automobiles at
distances of fifty feet and National Guard, helicopters at ratings of 120-130.
Lastly, the helicopter's flight patterns to and from University Hospitals have
been established in accord with applicable Federal Aviation Agency regulations
giving recognition to adjacent residential areas. Resultingly, the Guard heli-
copter landings now occurring on the playing fields immediately adjacent to
Melrose Avenue will be relocated to the new northerly helipad site. Accord-
ingly, we have every reason to believe that the residential areas surrounding
our west campus will be little affected by this new service.
While we have recently had the opportunity to review this service with City
Manager Berlin in some detail, we would be pleased to amplify on any dimension
of the program that you should wish.
Many thanks to you and the Council for your past and present support in
helping us to better meet the health needs of all Iowans.

This correspondence is in reference to the proposed ordinance which
would prohibit bars or taverns above first floor levels. My understanding
of the ordinance as now proposed, is that bars in a "mall" area would be
exempt from this ordinance.
Unless very specific preventive measures would then be required of
a "mall" bar, wouldn't the potential for restroom water overflow problems
also exist?

Thank you for your comments regarding the proposed amendments to the
liquor ordinance; they will be referred to the City Council for their
consideration. Our interest in preventing second floor bars was prompted
by the difficulties of the Police in enforcing liquor regulations in
bars which are not quickly accessible to them. In addition, there is j
concern over the time required to evacuate a second floor bar in case of
fire. A mall level functions as a street level in relation to these
concerns.
While the problem of restroom overflow may occur in a mall, it would
seem that it would be minimized by the type of construction in a new
mall in contrast to the existing situation in older buildings.

During the past few months, representatives from the American College
Testing Program, Inc. (ACT) have discussed with the City Manager and the
Director of Public Works the possible improvement of a section of Old
Dubuque Road. With the opening of a new ACT facility along this road
next summer, we anticipate a substantial increase in traffic and we are
concerned that the condition of this road be such that it adequately
serves the needs of our employees and our neighbors.
We have analyzed various alternatives for grading and resurfacing the
road, keeping in mind the City's plans for its eventual improvement and
the financial resources available for an appropriate interim solution.
As aresult, we request that the City Council approve the resurfacing of
Old Dubuque Road this summer from a point beginning at its intersection
with North bodge Street and continuing to a point immediately behind and
adjacent to ACT's present facility. This resurfacing would be to the
interim standard described in the City's comprehensive plan with grading
to be done in accordance with the eventual four -lane requirement.
If you approve this project, ACT will pay the entire construction cost,
currently estimated by your staff at approximately $100,000. In
of ACT's commitment to the project, we ask that the City staff prepare
complete plans and specifications necessary for ACT's use in letting a
contract for the construction. These plans should be available to ACT
no later than May 1, 1979. In addition, we ask that the City enter into
an agreement with ACT for the purpose of assuring that ACT will receive
credit for its financial commitment on this interim project should the
cost of the eventual improvement to the road be assessed in any manner to
the benefitting and/or adjacent property owners. While these two conditions
are very important to ACT, we feel the entire project offers substantial
and mutual advantages to both parties and to the public in general.

Attached are responses to questions concerning local origination
and access first raised by a Mr. David Olive.
Eastern Iowa Cablevision, Inc, has been reluctant to respond to
these questions for two reasons:
1) We believe responding to Mr. Olive's inquiries represents an
addendum or modification to the two bids of record. This was pointed
our by our representatives at the first hearing before the Advisory
Committee.
2) We believe that placing an emphasis on local origination/access
equipment; their model numbers, per unit costs, and exact technical
capabilities focuses undue attention on only one facet of a cable
system designed for all Iowa City residents.
It has been our experience that local origination and access pro-
gramming promises have too often been the focal point in franchise
awards. It is unfortunate that these local programming promises are
quite often completely ignored by some cable companies. Equally un-
fortunate is the fact that many franchising boards still place high
priority on promised giveaways such as cameras in the library or
studios and mobile units which never materialize.
Eastern Iowa Cablevision and its parent company, Cox Cable, would
prefer not to further escalate the "promise anything" franchising
syndrome. Eastern Iowa submitted a responsive and substantial proposal
_ to the City; a bid which in many respects carries a greater commitment.
to performance in all areas of cable system operation than that of our
competitor.

Based upon the past performance records of both companies.in other
cities, we believe the question of whether their proposed mobile
unit is better than our mobile unit is a moot point, The important
question is what will Iowa City actually get once the franchising
rhetoric is over and the cold, hard economic facts of cable system
operation come into play?

background of each of the two applicants, Eastern Iowa Cablevision
believes performance in the past is an accurate indicator of per-
formance in the future,

Question $1, Problem Areas
Insufficient funding. In our proposal we have committed $947,600 to
local origination and access channels operating budget over a ten year
period. Our experience in other systems indicates this amount would
be more than adequate.
Lack of staff. We propose 3 full time and 2 part time people for local
origination and access and feel this would be adequate personnel for
the work involved. With the understanding that I am not changing the
proposal good management would dictate adding help if access channel
usage necessitated.
Lack of equipment. We believe the equipment listed in our proposal
(or equal) for local origination and access programming will assure
enough quality equipment to do an excellent job,
Maintenance. The three full time local origination and access staff
would handle day to day care. A bench man would handle some repairs
Other repairs would be handled by equipment distributor repair de-
partments.
Access to facilities. Scheduling is a key here, We would also commit
our access equipment to use in a library studio, if one is provided.
The access equipment can also be moved to other locations using the
van proposed for access use.
Promotional efforts for access. We would work with any group interested
in access for training purposes. We would look to the Cable Advisory

Committee we propose for direction and call upon our experience in
other systems to gain utilization of the access channels.
Need for improved technical quality. We believe the equipment (or equal)
we have proposed would assure excellent technical quality.
Question 42, Additional Equipment
We do list a van in our proposal, but otherwise feel the equipment listed
therein is more than adequate.
Question #3, Studio Space
We believe the 25'x25' local origination studio we propose at our offices,
use of the mobile van, and use of the Library Studio, if available, would
provide adequate studio space. If in practice this was not so, again,
good management would dictate seeking larger quarters.
Question #9, Video/Stereo-Audio Simulcasting
We do not currently do this but when we feel it is feasible, Iowa City
as well as other systems will have it.
Question #5, Mobile Van
The mobile van is a vehicle to transport access equipment listed in our
proposal.
Question #6, Free use of studio time
Access users would be granted use of five minutes of equipment for
public access. If our local origination director decided that certain

Honorable Mayor and City Council Members:
As you are aware, the Iowa City Human Rights Commission and staff are
evaluating the amendments to Chapter 601A, the State Civil Rights Statute,
and the applicability of these changes to the City's Human Rights
Ordinance. Subsequent to the Commission's consideration of the neces-
sary changes in the local ordinance and the report to the City Council,
the staff received a delayed response from the Iowa Civil Rights Commis-
sion regarding some of our initial questions concerning the amendments
to the state statute.
Consequently, it is necessary for the Commission and staff to closely
review the State's input and reevaluate the proposed changes for the
local ordinance. It is our goal to revise the ordinance in a compre-
hensive manner and avoid subsequent modifications if possible. The City

As directed by Section 23-16 of the Municipal Code of Iowa City this
is to advise you of the following action:
ACTION:
Pursuant to Section 23-234 of the Municipal Code of Iowa City the
Traffic Engineer will direct that signs be installed so as to pro-
hibit parking in one stall of the parking lane of the east side of
N. Gilbert Street at the home addressed 624 N. Gilbert Street.
This action will be taken on or shortly after JanuarylO, 1979.
COMMENTARY:
This action is being taking to allow access to the curb lane for
the individual who resides at 624 N. Gilbert. This individual is
an elderly person with a physical handicap who has difficulty gaining
access to cars on Gilbert Street. This one stall parking prohibition
will ensure that the individual can gain access to vehicular transpor-
tation.

As directed by Section 23-16 of the Municipal Code of Iowa City this
is to advise
you of the following action:
ACTION:
Pursuant to Section 23-234 of the Municipal Code of Iowa City the
Traffic Engineer will direct
that signs be installed so as to prohibit
parking on both the north andsouth side of Hollywood Boulevard
from
the intersection of Hollywood Boulevard with Keokuk Street west to
the
west end of the paved portion of Hollywood Boulevard. This action
will be on or shortly
after January 10, 1979.
COMMENTARY:
This action is being taken to ensure that the frontage road, Hollywood
Boulevard, continues to
serve as an access facility. Certain com-
mercial establishments fronting on Hollywood Boulevard have
been using
the sidewalk area of the right-of-way to store vehicles. During the
snow
removal season this has presented problems to both the snow
removal effort and to individuals
attempting to drive past points of
constriction.

Re: Calendar Parking
As directed by the City Council, the Public Works Department has prepared
a program to implement calendar street parking. The purpose of this
will be to aid in removal of snow accumulations, street debris, and
garbage. Attached to this memo is a memorandum from the Traffic Engineer
which would implement the calendar parking.in an area bounded by Kimball
on the north, the Iowa River on the west, Highway 6 on the south and
Seventh Avenue on the east.
Parking is alternated on the side of the street with even addresses on
even calendar days and on the odd addressed side on odd calendar days.
The prohibition that would be in effect would be from 8:00 AM to 11:00
PM seven days a week. Public Works held extensive discussions about a
23 or 24 hour calendar parking system but the language and logic process
to implement calendar parking past 12:00 midnight are absolutely impossible
to comprehend. We believe that by taking calendar parking to 11:00 PM,
the number of cars parked on both sides of the street in that time
period from 11:00 PM to 8:00 AM the next morning will be minimized.
The estimated cost of this project will be $30,000. No money has been
budgeted for this project in the FY79 and FY80 budget. Council will
have to pass a budget amendment for the FY79 budget to provide for the
sign materials. The Road Use Tax fund is extremely strapped and it
should be realized that all expenditures out of the Road Use Tax fund
will likely result in increased bonding in the future, for such programs
as asphalt overlay.
If Council decides to pursue the program of calendar parking as outlined,
it is,requested that Council express this by passing a motion at this
Council meeting.

listed on the attached list so as to prohibit parking on the odd addressed
side of streets on even calendar days from 8:00 a.m. to 11:00 p.m. and
prohibit parking on even addressed sides of streets on odd calendar days
from 8:00 a.m. to 11:00 p.m. This action will be started during the
month of February, 1979 and will continue until all streets as listed on
the attached list are properly signed.
COMMENT:
This action is being taken to facilitate removal of snow accumulations,
street cleaning and refuse collection.

Members of the Council:
I am a property owner in this rezoning area, In July of 1977 I purchased
CH (Highway Commercial),
1110 North Dodge St, for a business venture since the property was zoned
I intended to destroy the house and build a new building. Before all the
business items of loans, plans, etc, were accomplished....g rezoning of this
area was proposed and a building moratorium was placed on the property. I
rented the house as a dwelling.
In May of 1978 the moratorium was lifted -- No decision was made on the
J rezoning. I assume the rezoning was denied. Again, I found a local firm that
J wanted a building. We designed the building, took bids and while arranging
financing -----another rezoning was proposed and a moratorium on building was
placed on the property. The house was rented again as a dwelling.
For the second time, a rezoning is going to be decided. I ask that you make
your decision on the laws pertaining to land use ., not emotional basis. Your
are required to use this land for its highest and best use. You are going to
have to decide if the best use of the land is C-1 (A zone that discriminates
i against taverns, eating establishments and gas stations)
In your decisions you must ask ,yourself:
I. How do I Justify taking away the zoning from a tavern that enoyed
CH zoning under Iowa City law since 1962 and existed for 50 yjars on
the same spot. You must decide if the property owner is being damaged
14, and if so, can he sue the City for damages.
II. How do I Justify rezoning these properties twice in a six months
period and take way the use and enjoyment of an individuals property
for a period of one and one half years.

III. How do I justify rezoning seven homes and one tavern...
and in order not to be accused of spot zoning.. willfully
j and capriciously include a large part of an existing
cemetery in the zoning area?
I would believe that the Council
would be subject to ridicule upon
rezoning a cemetery from CH to Cl when the Iowa City Zoning Ordinance
does not mention cemetery at all. It appears that a cemetery can
exist only under special permission given by the Council or Baard of
Adjustment. Rezoning of the cemetery today would put the Council on
record as stating that cemeteries must exist in a C—]. zone.
In light of a 100% property owner's objection to this rezoning, the
establishment of a non -conforming use in the area, the possibility of
tax payer's expense in litigation and making a decision on cemetery
rezoning that is not necessary .... I would ask that you not rezone this
area.
Further, I would ask that you direct your staff to work closely with
all property owners in the area and offer city assistance and cooperation
in order to obtain the type of buildings and uses that will enhance the
North entrance to Iowa City.

AGREEMENTS: The utility company, corporation, applicant, permittee, or licensee, (hereinafter referred to as the Permittee)
agrees that the following stipulations shall govern under this permit.
L The location, construction and maintenance of the utility installation covered by this application shall be in accordance with the current
Iowa State Highway Commission Utility Accommodation Policy.
2. The lostallation shall meet the requirements of lecil municipal, county, state, and federal laws, franchise rules, and regulations, regula-
tlous and directives of the lows State Commerce Commission, Utilities Division, the low& Slate Department or Health, all rules and regula-
tions of the Tow& State Highway Commission, and any other laws or regulations applicable.
3. The Permittee shell be fully responsible for any future adjustments of Its facilities within the established highway right of way caused
by highway construction or maintenance operations. -
4. The Iowa State Highway Commisolon shall give the Permittee at least 48 hours written notice of any proposed construction or maintenance
work, on either existing or newly acquired right -of vay, that is likely to conflict with the Installation belonging to the Permittee, In order that
the Permittee may arrange to Protect its facilities.
S. The State of Tow& and the Iowa Stale Highway Commission assume no responsibility for damages to the Permittee', property occasioned by
any construction or maintenance operations on said highway.
6. The Permittee shall take all reasonable precaution during the construction and maintenance or sold installation to protect and safeguard
the lives and property or the traveling public and adjacent property owners.
7. The Permittee agrees to give the Slate Highway Commission forty-eight hours' notice of Its Intention to start construction on the highway
right-of-way. Said notice shall be made In writing to the Engineer whose name Is shown below.
8. The Permittee agrees to at all times give the Iowa State Highway Commission timely notice of Intention to perform routine maintenance
within the right -or -way. Said notice shall be to the Eogineer whose name Is shown below.
9. The Permittee, and Its contractors, shall carry on the construction or repair of the accommodated utility with serious regard to the safety
of the public. Traffic protection shall be in accordance with Part VE of the current Town Stale Ilighw&y Commission Manual on Uniform
Traffic Controls.
Highway Commission personnel may supervise flagging operations where considered necessary by the Engineer. The original place-
ment of signs and removal on completion or the work shall be accomplished by the (Permitte
