Comments will also he heard on a proposed sno. ordinance which will allow City Manager to implement a total parking ban on other streets in the City not otherwise governed by calendar parking or other parking prohibitinns. e. Dodge Street between N. Summit Street and Conklin Street from CH zone to a C1 zone. C-7801 (first consideration) Comment: The Planning and Zoning Commission, at a regular meeting held on November 16, 1978, recommended by a 3 to 1 vote and one abstention approval of the subject rezoning. This recommendation Is consistent with the staff's recommenda- tion presented In a staff report dated November 2, 1978, and attached to the agenda of December 5, 1978. The City has received a protest against the subject rezoning by owners of 35% of the affected area. Therefore, approval would re- quire a favorable vote of three-fourths of the members of the Council. Consider an ordinance rezoning a 39.84 acre tract of land from county A-1 zone to an Rig zone. 7.-7617 (first con- sideration) Comment: The Planning and Zoning, Commission, at a regular meeting held on November 16, 1978, recommended by unanimous vote (5-0) approval of an application to annex a 39.84 acre tract of land located east of Mormon Trek Boulevard and south of the City limits and to rezone said property to R1B. The annexation proposal must he submitted to the City Development Board in Des Moines for acknowledgement of the annexation. Third conslderntion of the ordinance must necessarily be deferred until acknowledpement. A public hearing on this rezoning, was held .ianunry q, 1979. c. Consider an ordinance amending the Zoning Ordinance by es- tablishing provisions for location and types of fences per- mitted. (first consideration) , jComment: The Planning and Zoning Commission, at a regular meeting held November 16, 1978, recommended by a 4 to 1 vote approval of the subject proposed ordinance with suboequent minor revisions desired by the Council. The minor revisions Include: (a) prohibition of harked wire and electric fences in residential zones except for the enclosure of farm animals and If set five feet hack from street rtpht-of-way, (b) pro- hihttlon of electric fences in commercial and industrial zones, and (c) requiring a permit for electric and barbed wire fences i and fences over six feet in height. Consider an ordinance rezoning certain property from R2 and CH zones to PC zones (Lots R and 9, St. Mathias, 2nd Addition, as requested by Ily-Vee Food Stores). (third consideration) o� Z-7619 Comment: The Planning and Zoning, Commission, at a regular meeting held on October 19, 1978, recommended by a four to zero vote and one abstention approval of the subject request to rezone a four -acre tract located at the northwest corner of N. Dodge Street and N. Dubuque Road. This is an applica- tion which was submitted approximately two years ago and which the Commission failed to recommend approval of by a three to three vote. Comment: The Planning and Zoning Commission, at a regular meeting held on January 4, 1979, recommended by unanimous vote approval of the subject addition located northeast of Amhurst Street and west of Scott Boulevard. The PAD has been re- designed to resolve many of the staff concerns listed In the staff report dated October 19, 1978, which was attached to the Council agenda of November 14, 1978. This item Is ready for Council consideration. f. Consider a recommendation of the Planning and Zoning Commis- sion to approve the preliminary plat of Regency Gardens, Part I. 5-7815. Comment: The Planning and Zoning Commission, at a regular meeting held January 4, 197q, recommended by a unanimous vote (5-0) approval of the subject addition located west of Mark IV Apartments and south of the Westwlnds development. This recommendation is consistent with a staff recommenda- tion presented In a staff report dated April 6, 1978, which is attached to this agenda. A resolution for consideration of this item will be presented at the next regular meeting. g. Consider a recommendation of the Planning and Zoning Commis- sion to approve the final plat of Woodland Bills, Part IT. 5-7942. Comment: The Planning and Zoning Commission, at a regular meeting held January 4, 1979, recommended by a unanimous I vote (5-0) approval of the subject addition located west of Heinz Road and north of Highway 6 Bypass, subject to locating a fire hydrant on the west side of the property. Page 6 Item No. 5 - PUBLIC HEARING TO AMEND THE CITY OF IOWA CITY BUILDING CODE BY ELIMINATING THE BUILDING CODE REQUIREMENTS FOR SPRINKLERS OR AIITO- MATIC FIRE EXTINGUISHING SYSTEMS AND WET STAND PIPES, AND TO FURTHER AMEND THE CODE TO ALLOW AN ENCLOSED SHOPPING MALL TO BE BUILT ADJACENT TO A PARKING GARAGE OWNED BY THE CITY AND BE INTER- CONNECTED THROUGH FIRE CORRIDORS. THE CODE SHALL BE FURTHER MODI- FIED TO REWORD THE DEFINITION OF AN OPEN PARKING GARAGE TO ALLOW A PIIRLIC PARKING RAMP TO BE BUILT ACCORDING TO THE COUNCIL APPROVED DESIGN PLANS AS SUBMITTED BY THE ARCHITECT. Comment: The staff has reviewed the proposnls as submitted by the architect and finds conflicts with the Iowa City Building, Code in the park- ing ramp as designed. The Iowa City Fire Chief has requested that we eliminate certain fire protection devices required by the code to minimize vandalism. Prior to the first consideration of the ordinance the Board of Appeals will review the proposed amend- ments and provide comment to the Council. OCCUPANCY AND MAINTENANCE CODE BY INCLUDING A PARAGRAPH PROVIDING A CHECK- LIST SUITABLE FOR USE BY TENANTS AND THE OWNER OR OPERATOR OF THE RENTAL PROPERTY TO DETERMINE. DEFICIENCIES EXISTING IN A RENTAL UNIT PRIOR TO OCCUPANCY. THE PROPOSED AMENDMENT ALSO RF.OUIRES THAT A COPY OF THE COMPLETED CHECKLIST BE GIVEN TO THE TENANT PRIOR TO FXRCIITION OF THE LEASE. Comment: The above amendment was prepared In accordance with Council in - j structlons. AND NECESSITY REQUIRE THE PROPOSED TAXICAB SERVICE APPLIED FOR BY A BETTER CAR COMPANY. Comment: A Better Cab Company has made application for seven taxicabs. This application will cover the period from January 17, 1979, through February 28, 1979. A copy of the application was dis- tributed to Council on 12/12/78 when the public hearing was not. iAttached to this agenda Is a letter from A Better Cab Company requesting, a cab stand on the north side of College Street just of Gilbert Street. Comment: This resolution authorizes the City to purchase a strip of land from Mrs. Solnar as an extension of Reno Park. While a similar resolution appeared a few months ago, this resolution reflects the property description of the last stage of negotiation. The pur- chase price is S1,200.
