RESOLUTION TO ISSUE CIGARETTE PERMITS
WHEREAS, the following firms and persons have made appli-
cation and paid the mulct tax required by law for t
cigarettes and cigarette papers; therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF IOWA CITY, IOWA, that
the applications be granted and the City Clerk be and he/she

I hereby certify that the construction of the improvements listed below
have been completed in substantial accordance with the plans and specifi-
cations of the Engineering Division of the City of Iowa City. The
required maintenance bond is on file in the City Clerk's office.
Concrete Paving and Storm Inlets as constructed by Metro Pavers,
Inc., Iowa City, Iowa and Storm Sewer as constructed by Knowling
Brothers Construction Company, Coralville, Iowa for Lots 3 through
18 of resubdivision of Lot 30, Conway's Subdivision. Not to in-
clude the detention facility.
I hereby recommend that the above mentioned improvements be accepted by
the City of Iowa City.

Re: Preliminary Plat of Regency Gardens, Part 1
The application of Regency Gardens, Part 1 was deferred on April 6,
1978 at the applicant's request. The applicant has now requested
that the preliminary plat be processed (see attached letter).
The subject plat has not been revised to incorporate the deficiencies
and discrepancies noted in staff report 5-7814. It is the staff's
understanding that the plat will be revised in time for the
Commission's regular meeting on January 4, 1979. Until the plat has
been revised and reviewed by the staff, the recommendation as
presented in the aforementioned staff report is still applicable.

You by Mr. Ron Meyer of MMS Consultants in a conversation on the 30th of
November to take action on the consideration of the subdivision preliminary plat
at your first meeting -in January.
The reasons for our original request for deferral, conveyed to you by our
attorney, Tom Cilek, no longer exist and we would be most appreciative of your
consideration of the preliminary plat "Regency Gardens" subdivision at this
time. Because the final plat has not yet been fully completed to the desired
standards of the City staff we would request that its consideration be timed to
follow up the approval of preliminary plat.

ANALYSIS
This request proposes to subdivide 3.62 acres Iocated west of Mark IV Apartments.
Under its present zoning (113) approximately 40 to 45 dwelling units could be
developed on this tract. This proposal also extends Westwinds Drive to a point
just north of where Roberts Road could eventually intersect with it. With the
subsequent development of the property to the south of this proposal, provision
should be made to intersect said streets.
It should also be pointed out that the provisions of the Stormwater Management
jOrdinance are being met by providing the necessary storage at an off-site location.
Staff finds no major constraints in subdividing and developing this property.
The staff recommends that the subject plat be deferred. Upon remedy of the
deficiencies and discrepancies noted below, the staff recommends that the plat be
approved.
DEFICIENCIES AND DISCREPANCIES
1. All lot lines should be fully dimensioned.
2. Stormwater detention calculations should be provided to the Engineering Division.
3. The. typical street cross section should be corrected to show a two percent
parabolic crown and sidewalks on both sides.
4. A more specific description should be provided as to the location of the off-site
water detention facility.
S. The size of the proposed water mains should be shown.
6. Overland flow for the stormwater storage pond should be shown to Willow Creek.
7. The lot line between Lots 1 and 2 should be redrawn to be radial to the curve.
8. All necessary easements for the stormwater ponding area and access to said
facility should be shown.

RECOMMENDATION
The staff recommends that consideration of the final plat be deferred but upon
revising the plat Incorporating the deficiencies and discrepancies noted below,
the final pint be approved waiving the street requirements of the rural develop-
ment standards.
DEFICIENCIES AND DISCREPANCIES
1. The signatures of the utility companies and the Registered Land Surveyor
should be provided.
2. The legal papers are not In order and should be revised.
3. The stormwater storage areas should he fully dimensioned.
4. Notes to indicate future roadway locations and future rights-of-way to he
dedicated upon annexation and acceptance by the City should he provided as
shown on the preliminary plat.

Topography is gentle to rolling with
a slope of less than ten percent. An
existing drainageway runs north—northeast
to the rear portion of the site.
The applicant proposes to construct an addition to the existing 7,000 plus
square foot screen process printing firm, Ilawkeye Industries, Inc. This proposal
is Phase II of a previously approved LSNRD plan submitted in 1977. The LSNRD
ordinance allows building permits to be issued for new construction which does
not result in a deviation of more than 25 percent of the gross floor area shown
on the final approved plan or as in this situation does not result in a lateral
deviation of more than 25 feet. The subject proposal exceeds both of these
provisions, therefore requiring a new LSNRD plan to be submitted to the City for
its approval.
There are no major constraints in the development of this site.
RECOMMENDATION
The staff recommends that action on the LSNRD plan be deferred. Upon revision
of the plan incorporating the deficiencies and discrepancies noted below, the
staff recommends the plan be approved.
DEFICIENCIES AND DISCREPANCIES
1. Signatures of the utility companies should be provided.
2. The height of the proposed building should be indicated on the plan.
3. The proposed building should be fully dimensioned.
4. The distance between the proposed building and the property line should be
shown.
5. The title of the plan should be changed to reflect the title used for the
Phase I LSNRD plan.

6. A fire hydrant should he provided near the loading area of the proposed
addition.
7. The proposed parking lot should be fully dimensioned.

NECESSITY REQUIRES ISSUANCE OF CERTAIN TAXI -CAB
CERTIFICATES.
WHEREAS, pursuant to Ordinance No. 2844, a Certificate of Public
Convenience and Necessity is required prior to the operation of any taxi-
cab upon the streets of Iowa City, Iowa, and,
WHEREAS, A Better Cab Company
has made application for such Certificate, and,
WHEREAS, a public hearing was held on the 16thday of January
1979 on the application, and,
WHEREAS, council deems that the public convenience and necessity requires
the issuance of such Certificate(s) to A Better Cab Company
for the operation of 7 taxi -cabs.

A Better Cab Co. hereby submits to the City Council of the City
of Iowa City, Iowa, the following proposed schedule of fares and charges
for taxicab services:
In town: (Iowa City and Coralville)
For a single passenger the fare shall be $1.45 for the first mile
(or, if the trip is less than one mile, for the trip) and $0.50 for
each additional half mile or portion thereof.
For groups the fare shall be the single passenger fare for one
member of the group plus an additional $0.25 for each additional passen-
ger provided that he or she has celebrated his or her 6th birthday.
Small parcel delivery - When a parcel is to be delivered by a taxi
driver rather than carried by a passenger, the charge shall be:
$1.70 for the first mile or portion thereof
and $0.50 for each additional half mile or portion thereof
Out of town: (Any trip of ten miles or more excluding Cedar Rapids and
the Cedar Rapids Airport)
For a single passenger traveling only one way the fare shall be
$1.00 for each mile or portion thereof.
For a single passenger making a round trip the return fare will
be half -fare, or $0.50 for each mile or portion thereof.
There will bo no additional charge for additional passengers.
Cedar Rapids and the Cedar Rapids Airports
The fare to the Cedar Rapids Airport shall be $16.00 for groups
of one to three persons. There will be an additional charge of $4.00
for each additional person more than three.
The fare to downtown Cedar Rapids -- i.e. First Ave. and Second St. --
shall be $21.50 for groups of one to three persons. There will be addi-
tional charges of $4.00 for each additional person more than three and

$1.00 for each additional mile or portion thereof beyond First Ave. and
Second St., Cedar Rapids.
All locations:
Luggage with passengers - Normal suitcases and small parcels will
not constitute cause for additional charge. There will be no charge
for groceries, laundry or shopping bags accompanying a passenger. Nor
- will there be any flight charges (for stairs). Drivers will deliver
such parcels to the customer's door unless the customer requests that
they be left elsewhere.
Trunks will be charged for at the rate of $1.50 each.
Foot lockers will be charged for at the rate of $1.25 each.

RESOLUTION NO. 79-23
RESOLUTION AUTHORIZING EXECUTION OF CONTRACT TO PURCHASE LAND.
WHEREAS, the City of Iowa City, Iowa is a municipal corporation duly
authorized and acting under the laws of the State of Iowa, having the
power granted by the State of Iowa to purchase property for park and
recreational purposes, and
WHEREAS, the City of Iowa City desires to purchase the property described
as follows for park purposes: the east 120 feet of the north 40 feet of
lot 13 in Irish's extension of Woods addition to Iowa City, Iowa, according
to the recorded plat thereof, and
WHEREAS, it is necessary to enter into a contract for the purchase of
said property with Ms. Orelia Solnar of 526 Reno Street, Iowa City,
Iowa.
