(1) Consider setting a public hearing on February 13, 1979, to consider an ordinance amending Ordinance No. 2238, the Zoning Code, by deleting the permit fees for signs from the Ordinance and requiring permit fees to he established by resolution of City Council. Comment: Last year the City Council instructed the staff to delete the requirements for permit'fees from all ordinances and have them established by resolution of City Council. The Sign Ordinance was overlooked during that resolution establishment process. This Item should be referred to the Planning and Zoning Commission for comment. (2) Consider setting a public hearing on February 6, 1979, on an ordinance amending Ordinance No. 77-2863, the Mechanical Code, by deleting the permit fees for mechan- ical permits from the ordinance and having them estab- lished instead by resolution of City Council. Comment: The City Council instructed the staff last year to delete permit fees from the codes and have them established per resolution of City Council. The Mechanical Code was overlooked during this process. There is no Board of Review for the Mechanical Code. (3) Consider setting a public hearing on February 6, 1979, on an ordinance to amend Ordinance No. 77-2861 which adopted the Uniform Fire Code, 1976 Edition, subject to certain amendments. 71, Comment: The Uniform Fire Code presently requires wet stand pipes in open parking garages. The Fire Chief 6'✓ is of the opinion that other facilities will provide sufficient protection with a reduction in cost. Chief Keating states that there is no State Code provision In conflict with this amendment. Consider an ordinance rezoning a 39.84 acre tract of land from county A-1 zone to an RIB zone. (Ty'n Cae - located east of Mormon Trek and south of City limits.) Z-7617 (second consideration) Comment: The Planning and Zoning Commission, at a regular meeting held on November 16, 1978, recommended by unanimous vote (5-0) approval of an application to annex a 39.84 acre tract of land located east of Mormon Trek Boulevard and - south of the City limits and to rezone said property to RIB. The annexation proposal must be submitted to the City De- velopment Board in Des Moines for acknowledgement of the an- nexation. Consider an ordinance of the City of Iowa City providing that the Code of Ordinances, City of Iowa City, be amended by revising Section 8.10.3.A and Section 8.10.27 of said code; providing more comprehensive regulations of fences. (second consideration) Comment: The Planning and Zoning Commission, at a regular meeting held November 16, 1978, recommended by a 4 to 1 vote approval of the subject proposed ordinance with subsequent minor revisions desired by the Council. The minor revisions Include: (a) prohibition of barbed wire and electric fences In residential zones except for the enclosure of farm animals and if set five feet back from street right-of-way, (b) pro- hibition of electric fences in commercial and industrial zones, and (c) requiring a permit for electric and barbed wire fences and fences over six feet in height. This recommendation is consistent with a staff recom- mendation presented in a staff report dated April 6, 1978, which was attached to the Council agenda of January 16, 1979. Comment: The Planning and Zoning Commission, at a regular meeting held December 21, 1978, recommended by a unanimous vote approval of the subject addition located two miles south- west of the City limits on Rohret Road. This recommendation Is consistent with the staff recommendation presented In a staff report dated December 21, 1978, which was attached to the Council agenda of January 9, 1979. V r Item No. 5 - PUBLIC HEARING ON A PROPOSED SNOW EMERGENCY ORDINANCE. Comment: This public hearing will allow citizen input to he heard on a proposed snow ordinance which will allow City Manager to imple- ment a total parking ban on other streets in the City not other- wise governed by calendar parking or other parking prohibitions. Because of legal complications it is probable that no ordinance will be completed for consideration. Action: ',—A.,.. All /D,in �_�w�r' Item No. 6 - PUBLIC HEARING ON THE GENERAL REVENUE SHARING FUNDS. Comment: Under Federal Revenue Sharing rules, two public hearings are re- quired to allow citizens an opportunity to discuss how they wish General Revenue Sharing monies to be spent. One public hearing was held by the City Manager on December 5, 1978, and this public hearing will meet the requirement for the second. See page 400 of the FY80 proposed budget. M-4051(1)--81-52, AGREEMENT NO. 78 -F -040(A). Comment: This resolution would authorize the Mayor to execute an amendment 'to the agreement for construction costa of the South Gilbert Street project. Since we will have a project cost higher than our allocation, this will not change the amount received. How- ever, it is necessary to conform to the new guidelines. Public Works recommends approval. Comment: The Small Cities Grant pre -application presents proposed housing and community development projects for the blocks adjacent to Ralston Creek between Harrison Street and Kirkwood Avenue. Two public hearings have been held to allow citizens the opportunity to participate in the project planning. This pre -application re- quests the first of three years of funding. OF INTENT TO ACCEPT A PROPOSAL TO PURCHASE AND X REDEVELOP CERTAIN URBAN RENEWAL PROPERTY. Comment: This resolution authorizes the City Clerk to publish notice of the Intent to accept the proposal offered by North Bay Construc- tion, Inc., for Urban Renewal Parcel 82-1b. A memorandum on this. subject accompanies this agenda. The staff recommends approval Of this Resolution. Action: i IItem No. 16 - CONSIDER RESOLUTION AUTHORIZING THE MAYOR TO EXECUTE AND THE CITY CLERK TO ATTEST AN AGREEMENT WITH JOHNSON COUNTY/MUNICIPAL CIVIL DEFENSE AGENCY. Page 9 2 Item No. 17 - CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO EXECUTE AND THE CITY CLERK TO ATTEST TO AN AGREEMENT PURSUANT TO SECTION 13c OF THE URBAN MASS TRANSPORTATION ACT OF 1964, AS AMENDED, BETWEEN THE CITY OF IOWA CITY, LEAD AGENCY, AND THE AMERICAN FEDERATION `f OF STATE, COUNTY, AND MUNICIPAL EMPLOYEES, AFL-CIO, LOCAL 183 —,/ AND LOCAL 12, THE UNION. Comment: The City of Iowa City, as lead agency in the proposed UMTA grant application, is required by law to enter into an agreement with the labor organizatlon(s) representing transit employees, that their conditions of employment will not he worsened as a result off the federally -assisted project. (first consideration) Comment: The purpose of this ordinance is to amend the Uniform Building Code, 1976 Edition by creating an exemption under Section 1109(6) Definition of Open Parking Garages and by exempting publicly owned open parking garages from the requirements of wet stand- pipes and automatic fire extinguishing systems, and to amend Section 1110 by allowing covered mall buildings to be built at- tached togIa, publicly owned open ptarking garage.
