Is of the opinion that the density proposed via the final pint
of Mount Prospect, Part 4, is consistent With the Comprehensive
Plan. A public hearing was held on this item on October 24, 1978.
This item should he given consideration for approval only if the
preliminary and final plats of the subject addition are also con-
sidered at this time (see items below).
h. Consider a resolution approving the preliminary plat of Mount
4� Prospect Addition, Part IV.
Comment: The Planning and Zoning Commission had recommended ap-
proval of the subject preliminary plat on September 25, 1975.
Subsequent to that time the plat had been pending consideration
by the Council until properly rezoned. The preliminary plat is
now ready for consideration by the Council should the above Item

C. Consider a resolution to approve the final plat of Mount
Prospect, Part IV.
Comment: The Planning and Zoning Commission at a regular meeting
held on October 19, 1g78, recommended by a unanimous vote that the
subject final plat be approved subject to the legal papers being
revised and approved by the legal staff and the discrepancy in the
right-of-way width of Sycamore being altered on the plat. This
recommendation is consistent with a staff recommendation presented
in a staff report dated October 19, 1978, which was attached to
the Council agenda of October 31, 1978. The plat has been re-
vised and the legal papers are now in the process of review and
approval by the legal staff. However, signatures on the legal
papers have not been obtained, and if they haven't been obtained
by the time of the Council meeting, it is the staff's recommenda-
tion that action on the rezoning, preliminary plat and final plat
he deferred.

Action:
Comment: The Planning and Zoning Commission, at a special meeting
held on March 16, 1978, recommended by a unanimous vote approval
of an application to annex an 80 acre tract of land located ad-
jacent to the southerly City limits on the east side of Highway
218 and to rezone said property to M1 and Cl zones. This recom-
mendation is consistent with a staff recommendation presented in
a staff report dated February 23, 1978, which was attached to
the Council agenda of September 5, 1978. However C applicant
has withdrawn the portion of the 80 acre tract ( area) for
annexation and rezoning. This item, therefore, is to rezone and
annex only that portion of the 80 acres located east of Highway
218 to an Ml zone. Restrictive covenants are being placed on
the property to restrict use of the property to industrial.
According to the Zoning Ordinance, the Council must act upon a
resolution annexing an area at the time of the public hearing
on the zoning classification. If the Council passes the resolu-
tion, the annexation p oposal must then be submitted to the City
Development Board in Des Moines for acknowledgement of the an-
nexation. Approval of the rezoning request must necessarily be
deferred until acknowledgement.

PROPOSALS.
Comment: The Committee on Community Needs, through public meetings, has
received proposals for the allocation of approximately $1,000,000
of. CDBG funds. These proposals have been studied by the Committee
and recommendations have been made. The Council will discuss
these recommendations during the informal meeting on Monday."

Item No. 8 - PUBLIC HEARING ON AN ORDINANCE. VACATING CAPITOL STREET BETWEEN
HARRISON STREET AND COURT STREET.
Comment: The Planning and Zoning Commission, at a regular meeting held
on October 5, 1978, recommended by a 6 to 0 vote, approval of a
request by the County to vacate the subject portion of Capitol
Street for a new County jail facility. The Commission also recom-
mended that the City Council direct the staff to develop alterna-
tives to the traffic problem prior to the effective date of the
vacation.

a. Resources Conservation Commission. Four vacancies for three-
year terms expiring January 1, 1983. (Terms of James Broad-
ston, Harold Stager, Kent Angerer, and John Houck expiring.)
At least two of the four people appointed shall be by training,
education, experience, or demonstrated interest, knowledgeable

b. Human Rights Commission.
(1) Three vacancies for three-year terms expiring January 1,
1982. (Terms of Barbara Woodard, Patricia Gilroy, and
Ethel Madison expiring.)
(2) One vacancy for an unexpired term ending January 1,
1980 (term of Susan Davison).
The terms of Ethel Madison and Susan Davison are those
mentioned in the letter from the Chairperson, Human
Rights Commission, on the consent calendar of Novem-
ber 7, 1978, agenda.

Item No. 12 - CONSIDER MOTION APPROVING CONSTRUCTION IN HIGHWAY R.O.W.
Comment: This motion will allow the Director of Public Works to sign an
application allowing E.E. Dyer to construct a sanitary sewer in
the Highway 218 right-of-way. The sewer will be augered under
the road way and will not close the road to traffic.. The instal-
lation is part of an apartment complex adjacent to the B•11ws 0PAi;r1Ihe.
Motel being proposed. Public Works recommends approval of the
motion.

Item No. 13 - CONSIDER A RESOLUTION SETTING PARKING RATES FOR THE IOWA CITY
PARKING SYSTEM.

Comment: The Resolution provides for the increase in parking rates as
recommended in the Economic Feasibility Study prepared by Carl
Walker and Associates. The attached memo provides information
on the effective date.

Item No. 14 — CONSIDER AN ORDINANCE. REPEALING CHAPTER 23-279 OF THE CODE OF
ORDINANCES OF THE CITY OF IOWA CITY, IOWA, PERTAINING TO THE
PARKING METER FUND. (first consideration)
Comment: Chapter 23-279 should he repealed so that there will be no city
ordinance which is inconsistent with the terms of the resolution
providing for the issuance and securing of payment of revenue
bonds for the parking facilities.

Item No. 15 - CONSIDER ORDINANCE RESTRICTING TRUCK TRAFFIC ON KIRKWOOD AVENUE..
(first consideration)
Comment: This ordinance would restrict extremely heavy truck traffic on
Kirkwood Avenue. A weight limit has been set which will allow
most of Iowa -Illinois Gas and Electric's trucks but which will
exclude six to eight yard concrete trucks and tractor trailer
units. Concrete trucks are licensed for 22-24 tons and tractor
trailers are licensed for 35-36 tons. Most of Iowa -Illinois'
trucks are not heavier than 13-16 tons. Accordingly, the ordin-
ance calls for a load limit of 16 tons.
