Iowa City City Council, regular meeting, 7:00 p.m. at City Hall. Mayor Hayek,
presiding. Council Members present: Botchway, Dickens, Dobyns, Hayek, Mims,

Mary Gravitt appeared regarding the need for bus shelters on the outbound side of
the Towncrest bus route and on the comer of Kirkwood and Gilbert Streets; curb ramps
on Lower Muscatine near Kirkwood Community College; questioned when the
Sycamore Mall bus would return to the Sycamore Mall rather than the McDonalds' site;
relocation of the bench back to the curb between Dubuque and Clinton Streets; and
noted the arrival of the International Writers to the City. Iowa City Library Dir. Craig
noted in September the Library was kicking off "Music is the Word" welcoming the
School of Music to Downtown and distributed a schedule and calendar regarding
Season 1 and Season 2 events and encouraged Council Members and the public to
attend. Harry Olmstead, reiterated remarks made about the One Community, One
Book event highlighted by ICPL Library Dir. Craig; encouraged inclusionary housing not
exclude anyone from housing; and noted the recent announcement from the Justice
Department about an agreement with the City of Cedar Rapids and Linn County
regarding access for persons with disabilities, and encouraged Iowa City to look at
Robert A. Lee Recreation Center for necessary improvements. Joy Beadleston,
reported on a construction project at the Eastdale Plaza and difficulties with workers,
mail delivery, and bus signage. Staff will follow up. Roger Beyhl appeared regarding
kids in the street and problems near Wetherby Park.
A public hearing was held on an ordinance rezoning approximately 1.45 acres of
property from Community Commercial (CC -2) to Riverfront Crossings - West Riverfront
(RFC -WR) Zone located at the northwest corner of Benton Street and Riverside Drive
(REZ15-00015). The Mayor requested Council Members disclose any ex parte
communications and none were reported. Associate Planner Howard presented a
power point, and stated the conditional zoning agreement had not been signed. Shavon
Harmon and Keith Weggen appeared representing Kum and Go. Individual Council
Members expressed their views. Moved by Mims, seconded by Payne to continue
public hearing and defer first consideration of the ordinance to September 15.

A public hearing was held on an ordinance conditionally rezoning approximately 1.85
acres of property zoned Community Commercial (CC -2), located between Westbury
Drive, Eastbury Drive, and Middlebury Road, in order to amend a conditional zoning
agreement (REZ15-00016). The Mayor requested Council Members disclose any ex
parte communications and none were reported. Development Services Coordinator
Yapp presented a power point. Council Member Dobyns stated he would be abstaining
due to a conflict of interest. Kevin Digmann, representing the development group
appeared. Individual Council Members expressed their views.
Moved by Payne, seconded by Botchway, that the ordinance conditionally rezoning
approximately 1.85 acres of property zoned Community Commercial (CC -2), located
between Westbury Drive, Eastbury Drive, and Middlebury Road, in order to amend a
conditional zoning agreement (REZ15-00016), be given first vote. The Mayor declared
the motion carried, 6/0/1, with the following division of roll call vote: Ayes: Botchway,
Dickens, Hayek, Mims, Payne, Throgmorton. Abstaining: Dobyns.
A public hearing was held on an ordinance conditionally rezoning to approve a
Planned Development (OPD) Plan for a manufactured housing park to add 38 -units on
approximately 14.36 acres of property located east of Riverside Drive and north of
McCollister Boulevard (REZ15-00017) (Cole's Mobile Home Park). The Mayor
requested Council Members disclose any ex parte communications and none were
reported. Development Services Coordinator Yapp presented a power point. Individual
Council expressed their views. Ed Cole, operator of the Park, appeared.
Moved by Payne, seconded by Dobyns, that the ordinance conditionally rezoning to
approve a Planned Development (OPD) Plan for a manufactured housing park to add
38 -units on approximately 14.36 acres of property located east of Riverside Drive and
north of McCollister Boulevard (REZ15-00017) (Cole's Mobile Home Park), be given
first vote.
A public hearing was held on an ordinance conditionally rezoning approximately
33.37 acres of property located on the east side of Camp Cardinal Road north of Camp
Cardinal Boulevard (St. Andrew Church) from Low Density Single Family Residential
(RS -5) to Planned Development Overlay / Low Density Single Family Residential
(OPD5), and approval of Preliminary Sensitive Areas Development Plan (REZ15-
00013). The Mayor requested Council Members disclose any ex parte communications
and none were reported. Development Services Coordinator Yapp presented a power
point. Individual Council Members expressed their views. Loren Hall, Hall & Hall
Engineers, appeared.
Moved by Mims, seconded by Payne, that the ordinance rezoning approximately
33.37 acres of property located on the east side of Camp Cardinal Road north of Camp
Cardinal Boulevard from Low Density Single Family Residential (RS -5) to Planned
Development Overlay / Low Density Single Family Residential (OPD5), and approval of
Preliminary Sensitive Areas Development Plan (REZ15-00013), be given first vote.
Moved by Mims, seconded by Payne, that the rule requiring ordinances to be
considered and voted on for final passage at two Council meetings prior to the meeting
at which it is to be finally passed be suspended, the second consideration and vote be
waived, and that ORD. 15-4636, VACATING AN UNPAVED STREET RIGHT-OF-WAY
KNOWN AS AUDITOR'S PARCEL #2008020 AND TWO UTILITY EASEMENTS
WITHIN HIGHLANDER DEVELOPMENT (VAC15-00002), be voted on for final passage
at this time. Moved by Mims, seconded by Botchway, that the ordinance be finally
adopted at this time.

Moved by Mims, seconded by Throgmorton, that the rule requiring ordinances to be
considered and voted on for final passage at two Council meetings prior to the meeting
at which it is to be finally passed be suspended, the second consideration and vote be
waived, and that ORD. 15-4737, VACATING A PORTION OF HARRISON STREET
LOCATED WEST OF LINN STREET AND EAST OF DUBUQUE STREET (VAC15-
00004), be voted on for final passage at this time. Moved by Mims, seconded by
Botchway, that the ordinance be finally adopted at this time.
Moved by Payne, seconded by Dickens, that the ordinance amending Title 14:
Zoning to Zoning to add a definition for "Rooftop Service Areas" and establish standards
for such uses, be given second vote.
Moved by Mims, seconded by Dickens, that the ordinance amending Title 4,
Alcoholic Beverages, to acknowledge and cross-reference amendments proposed to
the zoning code allowing rooftop service areas and amendments to Title 10, Public
Ways and property, to allow sidewalk cafes in the Riverfront Crossings District, be given
second vote.
The Mayor noted previously announced vacancies to Boards and Commissions:
Airport Zoning Brd. of Adjustment for a five-year term January 1, 2014 — December 31,
2018 (Formerly advertised; Full term); Appeals, Board of for an unexpired five-year term
January 1, 2014 - December 31, 2018. (For a HVAC or building design professional or
qualified by experience and training, Unexpired term; Community Police Review Board
for a four-year term, September 1, 2015 — September 1, 2019 (Fidencio Martinez Perez
term expires); Historic Preservation Commission for a Jefferson St. representative to fill
three-year terms, March 29, 2013 — March 29, 2016 (New District formed). Applications
must be received by 5:00 p.m., Wednesday, September 9, 2015. New: Airport
Commission for an unexpired four-year term effective upon appointment — March 1,
2017 (Dave Davis resigned). See correspondence included in Council packet. Moved
by Payne, seconded by Dickens, to accept correspondence from Dave Davis.
Applications must be received by 5:00 p.m., Wednesday, October 14, 2015.
Council Member Botchway encouraged individuals to subscribe to the City website
to receive notifications on upcoming events and various other City updates. Council
Member Payne noted that the new website may require individuals to re -subscribe.
Council Member Throgmorton reported he had a great experience on his ride -along
with Police Office Roling, and thanked the department; and stated he would be
attending the Labor Day picnic at Upper City Park again this year.
Mayor Pro tem Mims welcomed back University of Iowa students, faculty and staff
and urged them to utilize the City website for information; and stated she hoped
everyone a safe upcoming holiday.
Council Member Dickens reminded everyone of the annual Regina Fall Fun Festival
planned over the Labor Day week -end.
Council Member Payne noted the earlier proclamation on National Preparedness
Month and urged people to be aware of hazards, creating an emergency plan, and
building an emergency supply kit.
Mayor Hayek stated the University of Iowa would be announcing a new president
soon, and reported he and the City Manager had the privilege of sitting in on meetings
with the four candidates, and was looking forward to working with the new president.
City Manager Markus stated an announcement on a new president is expected by
Friday.

QUESTIONS FROM COUNCIL REGARDING AGENDA ITEMS
1. (Agenda item 4d - Rooftop Service Areas ...) In response to Council, Asst. City
Manager Fruin responded to questions regarding a required elevator; support of the
business community, and vertical expansion of drinking establishments.
2. (Consent Calendar items # 2f(1)- Nanci Kohl letter ... road diet concerns) In response to
Council Member Payne, Transportation Planner Ralston and City Manager Markus
responded to comments received on the Mormon Trek project.
3. (Consent Calendar item 2f(2) - ... Petition ... End Discrimination against black youth ...
and 2f(4) Venson Curington II: request for work session) In response to Council Member
Throgmorton, a majority of Council agreed to make individual appointments with Mr.
Curington as their schedules allow and also encouraged him to schedule a meeting with
the Diversity Roundtable group representing major organizations in the community.
4. (Consent Calendar items # 2f(7) - Johnson County Board of Supervisors ... Minimum
Wage Ordinance for Johnson County) In response to Council Member Botchway, the
City Manager and City Attorney suggested Council wait until after the County discusses
the latest revisions to the ordinance, the County Attorney's opinion on the legality, and
takes action on an ordinance prior to a City response.
5. (Consent Calendar item # 2e(2) - Rezoning Benton Street / Riverside Drive ...) City
Clerk Karr noted a correction in the second last line of the agenda item title, the word
"southwest" should be "northwest" referring to the corner of Benton Street.
6. (Consent Calendar item # 2e(7) - Willow Creek / Kiwanis Park Renovation Project ...) In
response to Council Member Dobyns, Parks and Forestry Supt. Hall responded to
questions regarding the addition of a second baseball backstop; possible redesign plans
for various uses such as t -ball and cricket; and the potential to add alternates in Phase 3
of a splash pad.

Member Throgmorton, Public Works Dir. Knoche stated "PCC" stands for "Portland

5. Council Member Botchway noted item # 12 in the August 6 packet regarding the loss of
77 jobs at Schenker. City Manager Markus reported a change in corporate philosophy
and distribution model.

Moved by Payne, seconded by Botchway, that the ordinance amending Title 14:
Zoning to zoning to add a definition for "rooftop service areas" and establish standards
for such uses, be given first vote.
Moved by Mims, seconded by Dickens, that the ordinance amending Title 4,
Alcoholic Beverages, to acknowledge and cross-reference amendments proposed to
the zoning code allowing rooftop service areas and amendments to Title 10, Public
Ways and property, to allow sidewalk cafes in the Riverfront Crossings District, be given
first vote.
A public hearing was held on a resolution amending the FY2016 Operating Budget.

Moved by Payne, seconded by Botchway, to adopt RES. 15-266, AMENDING THE
CURRENT BUDGET FOR THE FISCAL YEAR ENDING JUNE 30, 2016.
Moved by Mims, seconded by Botchway, that the rule requiring ordinances to be
considered and voted on for final passage at two Council meetings prior to the meeting
at which it is to be finally passed be suspended, the second consideration and vote be
waived, and that ORD. 15-4635, AMENDING TITLE 9, ENTITLED "MOTOR VEHICLES
AND TRAFFIC," CHAPTER 1, ENTITLED "DEFINITIONS, ADMINISTRATION AND
ENFORCEMENT OF TRAFFIC PROVISIONS," AND CHAPTER 8, ENTITLED
"BICYCLES," TO EXPAND THE DEFINITION OF "BICYCLE"; PERMIT THE RIDING
OF TWO BICYCLES ABREAST EACH OTHER; REMOVE THE REQUIREMENT THAT
BICYCLISTS RIDE TO THE FAR RIGHT SIDE OF THE ROAD; AND AUTHORIZE THE
IMPOUNDMENT OF INOPERABLE BICYCLES. be voted on for final passage at this
time. Affirmative roll call vote unanimous, 7/0, all Council Members present. The Mayor
declared the motion carried. Moved by Mims, seconded by Botchway, that the

The Mayor noted the previously announced vacancies to Boards and Commissions:
Airport Zoning Brd. of Adjustment for a five-year term January 1, 2014 — December 31,
2018; Appeals, Board of, for an unexpired five-year term January 1, 2014 - December
31, 2018, for a HVAC or building design professional or qualified by experience and
training. (Unexpired term); Community Police Review Board for a four-year term,
September 1, 2015 — September 1, 2019. (Fidencio Martinez Perez term expires);
Historic Preservation Commission for a Jefferson St. representative to fill three-year
terms, March 29, 2013 — March 29, 2016 (New District formed). Applications must be
received by 5:00 p.m., Wednesday, September 9, 2015. Applicants MUST reside in
Iowa City and be 18 years of age unless specific qualifications are stated. [Staff will not
publish additional notices after a period of six publications; but will continue to advertise
vacancies with postings and on the Council agenda. However, no additional publication
costs will be incurred.]
Council Member Dobyns thanked the Kingdom Center congregation for welcoming
his wife and himself at services the previous week -end.
Council Member Payne noted this was the time of year when there is more bicyclists
and pedestrians and encouraged everyone to be watchful when driving.
Council Member Dickens reminded the community of the Pathways fundraiser, Men
Who Cook, coming up Saturday, the 22"d
Mayor Pro tem Mims noted recent discussion on the KXIC radio show regarding the
arrival of University students and echoed Council Member Payne's remarks about being
safe.
Council Member Throgmorton noted the recent passing of former Council Member
Steven Kanner and a memorial celebration planned for August 23rd at Happy Hollow
Park.
Council Member Botchway reminded everyone of the Soul Fest event planned the
week -end of the 29th/
Mayor Hayek noted the grand opening of Alexander Elementary on Thursday the
20th and the cooperative efforts of the City and School in the development, and
encouraged the community to keep an eye on the facilities plan as it moves forward;
noted the passing of former Human Rights Coordinator Heather Shank; and
acknowledged the participation of City Manager Markus in an exchange program under
the auspices of the State Department and the International City Managers Association
(ICMA) and recently returned from a trip to Indonesia.
City Manager Markus reported on his Indonesia visit.
Council Member Payne noted the opening of the City's new Animal Shelter. City
Manager Markus stated the Center was open at the new location and a grand opening
is planned later in the fall.
