Washington St., Iowa City, IA 52240 (319) 356-5030 RESOLUTION NO. 15-267 RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST TO THE PARTIAL RELEASE OF A MORTGAGE HELD BY IOWA CITY TO SECURE A LOAN FOR THE COST TO CONSTRUCT CAMP CARDINAL ROAD. WHEREAS, the City has a mortgage securing the loan made to Southgate Construction Company for its portion of the cost to construct Camp Cardinal Road in Iowa City. The original principal balance on the Note was $1,260,909.91 with interest paid annually at the rate of 5.6608%. The current balance is $200,004. Monthly payments are current and the loan will be paid in full no later than February 28, 2017; and WHEREAS, in addition to monthly payments, the Note calls for additional payments to be made upon the sale of, or final plat approval of, a subdivision of more than 5 acres on a per acre basis of $4,300.00 per acre prior to the City's partial release of those acres; WHEREAS, the current owner of the property, The Crossing Development LC, proposes to transfer Auditor's Parcel 2011054, which includes 27.68 acres of land subject to said mortgage, to a related entity for purposes of development and has asked the City to release said parcel without additional payment in order to facilitate development of the parcel; and, WHEREAS, a release of said Auditor's parcel will leave approximately 95 acres of property that is not yet final platted as adequate security for the remaining balance on the City's loan; and, WHEREAS, the City should execute a partial release of the mortgage releasing Auditor's parcel 2011054 from the mortgage. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY, IOWA, THAT: The Mayor is authorized to sign and the City Clerk to attest the attached Partial Release of Mortgage, whereby the City does release Auditor's parcel 2011054 from the lien of the mortgage recorded in the records of the office of the Recorder of Johnson County, State of Iowa in Book 3877, Pages 419-428. Washington St., Iowa City, IA 52240 (319) 356-5044 RESOLUTION NO. 15-268 RESOLUTION ACCEPTING THE WORK FOR THE CITY OF IOWA CITY: SENIOR CENTER FIRE ALARM SYSTEM PROJECT WHEREAS, the Engineering Division has recommended that the work for construction of the City of Iowa City: Senior Center Fire Alarm System Project, as included in a contract between the City of Iowa City and HITECH Communications of Robins, Iowa, dated March 12, 2015, be accepted; and WHEREAS, the Engineer's Report and the performance and payment bond have been filed in the Engineering Division office; and WHEREAS, funds for this project are available in the Senior Center Operational Budget, account # 10570100; and WHEREAS, the final contract price is $26,880.00. Washington St., Iowa City, IA 52240 319.356.5230 RESOLUTION NO. 15-269 RESOLUTION TO SUBMIT A HAZARD MITIGATION GRANT PROGRAM APPLICATION TO PURCHASE PROPERTY IN THE 100 -YEAR FLOODPLAIN, PROVIDE THE 15% REQUIRED LOCAL MATCH AND AUTHORIZING THE CITY MANAGER TO SUBMIT AND SIGN ALL CONTRACTS AND AMENDMENTS FOR SAID PROGRAM. WHEREAS, the City of Iowa City has prepared an application to submit to the Iowa Homeland Security and Emergency Management Division (HSEMD) for funding from the Hazard Mitigation Grant Program through the Federal Emergency Management Agency (FEMA), in the amount of $1,459,187; and WHEREAS, the City of Iowa City recognizes the fact that this grant is based on a cost share basis with the federal share not exceeding 75%, the state share not exceeding 10% and the local share being a minimum of 15% of the total project cost. The minimum 15% local share can be either cash or in-kind match; and WHEREAS, the City of Iowa City anticipates out of a total estimated project cost of $1,459,187, Iowa City would receive $1,094,390 in FEMA funding, $145,918 from the State of Iowa and would provide at least $218,879 in local funds. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY, IOWA, THAT: 1. The City of Iowa City shall submit an application for the Hazard Mitigation Grant Program for the acquisition of up to nine homes in the 100 -year floodplain. 2. The City of Iowa City agrees to provide and make available at least $218,879 of local monies to meet the minimum 15% match requirement for this mitigation grant application. 3. The City Manager is hereby authorized to sign the application on behalf of the City of Iowa City, to file it with HSEMD for the purpose of obtaining financial assistance under the Robert T. Stafford Disaster Relief and Emergency Assistance Act (PL 93-288, as amended) and the Code of Iowa, Chapter 29C, to sign the grant agreement if the application is approved, and to sign amendments as needed to said grant agreement. DIRECTING CITY CLERK TO PUBLISH NOTICE OF SAID HEARING, AND DIRECTING THE CITY ENGINEER TO PLACE SAID PLANS ON FILE FOR PUBLIC INSPECTION; AND RESCINDING RESOLUTION 15-265. WHERAS, Resolution 15-265 set a public hearing for September 1, and plans and specifications were not filed with the City Clerk at the time the public hearing was set; and WHEREAS, funds for this project are available in the C.I.P. account #4322. BE IT RESOLVED BY THE COUNCIL OF THE CITY OF IOWA CITY, IOWA: Resolution 15-265 is hereby rescinded. 2. That a public hearing on the plans, specifications, form of contract, and estimate of cost for the construction of the above-mentioned project is to be held on the 15th day of September, 2015, at 7:00 p.m. in the Emma J. Harvat Hall, City Hall, Iowa City, Iowa, or if said meeting is cancelled, at the next meeting of the City Council thereafter as posted by the City Clerk. 3. That the City Clerk is hereby authorized and directed to publish notice of the public hearing for the above-named project in a newspaper published at least once weekly and having a general circulation in the City, not less than four (4) nor more than twenty (20) days before said hearing. 4. That the copy of the plans, specifications, form of contract, and estimate of cost for the construction of the above-named project is hereby ordered placed on file by the City Engineer in the office of the City Clerk for public inspection.
