Notice is hereby given that a public hearing
will be held by the City Canil of Ioa City, foe,
at 7:30 p.m. on the 24th day of January, 1989, in
the Council Chambers of the Civic Certs, ba City,
Ios, on the following item:
An ordinance to vacate an unimproved
portion of First Avenue between J Street and
the Iowa Interstate Railway, a 360 foot
unimproved alley between First and Second
avenues, and a 175 foot unimproved alley along
the northern right-cf-way lire of the Iota
Interstate Railway.

W EAS, alleys were platted in sae areas of the
City and are uninproved; and
WIM, sae street rights-of-way and alleys
cease to be necessary for access to proerty; and
WiERFAS, a portion of the forner First Avenue
right-of-way contained within Lots 2, 3, 4, and 5,
within Block 10 of the East Iowa City addition
subdivision, and the uniteroved north -south alley
between Lots 1-5 and Lots 6-9 of East Iowa City
Addition subdivision, and the uninproved east -west
alley between Lot 5 of the East Im City Addition
subdivision and the northern right-of-way line of
the Iowa Interstate Railway, dD not provide any
vehicular access to abutting properties and are no
longer needed.
NOW, THEREFORE, BE IT OISINED BY -RE CITY
COXIL OF ICHA CITY, IQiA:
SECTION I. That the right-of-way in Iowa City,
Iowa, herein described in Attwkmt A and incorpo-
rated by reference herein is vacated for vehicle
access subject to the provision of a 10 foot utility
easerent over the north -south alley and a 5 foot
utility easement over the easterly -westerly alley to
be vacated.
SECTION II, REPEALER: All ordinances and parts
of ordinances in conflict with the provisions of
this Ordinance are hereby repealed.
SECTION III.SEVERABILITY: If any section,
provision or part of the Ordinance stall be adjudged
to be invalid or unconstitutional, such adjudication
shall not affect the validity of the Ordinance as a
whole or any section, provision or part thereof not
adjudged invalid or ummnstitutional.
SECTION IV EFFECTIVE DATE: This Ordinance
shall be in effect after its final passage, aTp oval
and publication as required by lar.

BACKGROUND:
The City of Iowa City wishes to vacate the unimproved former First Avenue
right-of-way, the unimproved 360 -foot north -south alley between First
Avenue and Second Avenue, south of J Street, and the unimproved 175 -foot
east -west alley north of the Iowa Interstate Railroad and west of First
Avenue. The City is requesting these right-of-way vacations to prepare
the City -owned land for development of six single-family homes.
VACATION OF FIRST AVENUE RIGHT-OF-WAY:
The First Avenue right-of-way to be vacated is wholly contained within the
City -owned Lots 2, 3, 4 and 5. (See Attachment 02.) This right-of-way
was the former alignment of First Avenue and is now being vacated to
prepare the site for development. Any existing utility system components
located within the right-of-way to be vacated will be relocated at the
public utility's expense.
VACATION OF NORTH -SOUTH ALLEY:
This 20 -foot wide by approximately 360 -foot long alley located between
First Avenue and Second Avenue and south of J Street has never been
improved. This segment provides no vehicular or pedestrian access to
properties fronting on either Second Avenue or First Avenue. In conjunc-
tion with development of the City -owned lots, a private access drive will
be constructed over the alley right-of-way to be vacated. The access
drive will be located such that a portion will be over former alley right-
of-way while the remaining part will be located on the lots themselves.
The westerly ten feet of the north -south alley will be offered for sale to
abutting property owners.
VACATION OF EAST -WEST ALLEY:
The alley right-of-way is located along the southern border of Lot 5 and
is 20 feet wide by 175 feet long. This alley right-of-way is, and has
been, unimproved and does not provide vehicular or pedestrian access to
properties fronting on either First Avenue or Second Avenue. The vacated
alley right-of-way is to be incorporated into Lot 5.
STAFF RECOMMENDATION:
Staff recommends the vacation of the unimproved First Avenue right-of-way,
the unimproved 360 -foot north -south alley between First Avenue and Second
Avenue, and the unimproved 175 -foot east -west alley bordering the north
right-of-way line of the Iowa Interstate railway.
