HomeMy WebLinkAbout1989-01-24 OrdinanceOIDINANCE N0. 89-3401 AN OFDINNiCE VACATING A PORTION OF U.S. HIGMY 6 BY-PASS RIF IT-OF-VAY. WHEREAS, the Iowa State Hiomy Commission granted to the City the right of jurisdiction over the excess highvay right-of-way in 1966 for the purpose of constructing and maintaining a frontage road; and WHEREAS, due to changes in traffic patterns and the previous vacation of a portion of the excess right-of-way to the east to ly-Vee, the frontage road concept is no longer feasible; and WHEREAS, the owner of ROBO Car Wish has epmssed interest in acquiring the excess right-of-way in order to expand the parking area; and WHEWAS, the excess right-of-way is not needed for the proper function of the highey and its vacation mould restore it to productive use and place it back on the tax rolls. NOW, TFFREFCRE, BE IT OfEAM BY THE CITY COUNCIL OF TIE CITY OF ICWI CITY, Im: SECTION I. VACATICN. That the City of I" City hereby vacates that portion of ewess U.S. MJW 6 By -Pass right-of-way as described in the attached Exhibits A and B. SECTION 11, REPEALER: All ordinances and parts of ordinances in conflict with the provisions of this Ordinance are hereby repealed. SECTION III. SEVEWrBILITY: If any section, provision or part of the Ordinanoe shall be adjupd to be invalid or unconstitutional, such adulication shall not affect the validity of the Ordinance as a vkale or any section, provision or part thereof not adjudged invalid or unconstitutional. SECTICN IV.
