The powers and duties of the Board of Adjustment
are:
1. To hear and decide appeals where it is alleged
there is an error in any administrative action
in the enforcement of the ordinance.
2. To hear and decide on special exceptions that
are specifically provided for in the ordinance.
3. To authorize on appeal in specific cases
variances from the terms of the ordinance.
Variances granted by the Board of Adjustment
may only be granted in the case of "wecessary
hardship." The hardship mist be substantial,
serious, real, and of compelling force, as
distinguished frau reasons of convenience,
maximization of profit or caprice.
Iona City appointed members of boards and commis-
sions must be eligible electors of the City of Iowa
City.
This appointment will be made at the January 24,
1989, meeting of the City Cantil at 7:30 p.m. in
the Cantil Chambers. Persons interested in being
considered for this position should contact the City

Re: Creation of Organizational Board of Directors for Private Non -
Profit Organization
The process for development of a private Non -Profit Organization (NPO) to
program local access Channel 26 and operate the Community Programming
Center (CPC) has reached the point where it is necessary to appoint an
Organizational Board of Directors to develop the NPO, with the assistance
of a hired consultant, representatives from the Iowa City Public Library
and the Broadband Telecommunications Commission, and staff from Heritage
Cablevision and the City. This organizational board of directors will
serve as a task force to develop the NPO to which the City can transfer
responsibility for programming Channel 26 and operation of the CPC from
Heritage Cablevision. The Organizational Board of Directors will be
dissolved upon establishment of the permanent NPO. The City will monitor
this process through the Broadband Telecommunications Commission and staff
(the Broadband Telecommunications Specialist and the Assistant City
Manager) and will provide whatever assistance is necessary to the organi-
zational board. It is the goal of the Commission that this be
accomplished within approximately six months. Thus, this organizational
board is an ad hoc task force which will exist for only a short time. It
may be anticipated that some of its members will become members of the
permanent Board of Directors when the NPO is established.
Applications for appointment to the Organizational Board were sought by
the Commission and were taken from November 22, 1988, to January 16, 1989.
The original deadline was extended by 33 days in order to ensure citizens
would have ample time to apply. Many local organizations were notified
and were provided information. Public notices were published similar to
the current policy of the City for filling vacancies on its advisory
boards and commissions. Nineteen applications were received from which
five applicants were selected by the Broadband Telecommunications Commis-
sion at its regular meeting on January 18, 1989. These five are recom-
mended to the City Council for appointment. The five persons are:

Copies of all applications considered, along with copies of the public
notices published, are attached for your information. The Commission is
requesting that Council officially appoint the five individuals recom-
mended to become the voting members of the Organizational Board of
Directors. In addition, the Commission requests that Dewey McGuire,
representing the Iowa City Public Library; Doyle Detroit, representing the

Broadband Telecommunications Commission; and John Hess, representing
Heritage Cablevision, be appointed as ex -officio, non-voting members.
I anticipate that the process of establishing the NPO to the point of its
assuming responsibility for Channel 26 and CPC operations, employing the
services of The Buske Group as a consultant, and retaining some temporary
help for the Broadband Telecommunications Specialist during the process,
will cost approximately $10,000-$12,000. Any expense incurred for legal
services would be in addition to this amount. These funds are available
from the increased franchise fee revenue which will be received during the
current fiscal year and the appropriate budget amendments have been
submitted.

serve on an organizational Board of Directors to
formulate a new Non -Profit Organization (NPO) to
manage and operate local access channel 26 and its
related Cammnity Programming Center in Iowa City.

Broadband Telecommunications Commission:
I wish to serve on the organizational Board of Directors to
plan a new Non -Profit Organization to manage the local cable TV
access Channel 26 and Community Programming Center.
Local public access can benefit the community immensely. I
would like to help manage it so that it is accessible to all
members of the community. Channel 26 can show us what a wealth
of resources we have in Iowa City. For example, I was motivated
to get involved with Big Brothers/Big Sisters after seeing
participants on Channel 26 during public access week.
Most of my experience with cable TV has been as a viewer.
In 1983, I arranged a session about cable TV in the public
library at the Iowa Library Association conference.
Currently I am a computer consultant at Weeg Computing
Center at the University of Iowa. I enjoy managing technology --
translating for the novice. I write course handouts and
newsletter articles for the computing center. I am also editing
documentation for a computer -controlled videodisc simulation
being produced by the College of Dentistry. Serving as one of
the directors of the New Pioneer Cooperative Society Credit Union
has also provided me with experience which I could put to further
use on the NPO Board of Directors.

shaping the future of cable TV Public Channel 26 in Iowa City and ensuring it fulfills its

The Iowa Public Transit Association
(IPTA) is an organization designed to
promote well managed, safe, and efficient
transit service in the State of Iowa. IPTA
has developed an excellent working rela-
tionship with the Iowa Department of
Transportation Air and Transit Division. A
well-defined communication network
exists between the thirty-five (35) transit
systems and the Air and Transit Division,
which allows for the flow of valuable
information and the exchange of ideas.
The IDOT staff and IPTA members often
work hand-in-hand on transit issues and
training. For example, the Iowa DOT has
co-sponsored a State-wide transit rodeo
at the IPTA's last two annual 'meetings,
which promotes and rewards safe driving
techniques.
The citizens of Iowa are well -served by 35
public transit systems operating through-
out the State. Sixteen systems serve rural
areas in form of regional transit operations
and nineteen systems provide service to
small and large urban areas. This network
of transit systems is often viewed as a
model for other states, particularly those
with substantial rural populations.
During the last decade ridership on Iowa's
35 transit systems has increased by 85%
from 13 million to 24 million. Iowa's transit
operatiors have improved in the efficiency
of service delivery. Although operating
expenses have tripled in the past ten
years, when adjusted for inflation, the cost
per mile and cost per ride for providing
transit services have actually decreased
during this decade.
2. Coordinate Transit Services in fovea. Q
The State of Iowa has been a fore-
runner in the provision of coordinated
funds and equipment for public trans-
portation service. Through Chapter
601J of the Iowa Code, the Iowa Legis-
lature has required transit
systems to coordinate their transit ser-
vice efforts with human service
agencies and other transportation
providers. These coordination efforts
have saved tax dollars and increased
transportation for Iowa's citizens.

1989 Legislative Priorities:
1. Dedicated Percentage o/ Use Tax for
State Assistance.
The Iowa Public Transit Association
wants to thank the Governor and the
1988 Iowa Legislature for their efforts 3
in securing 1/20th of the Use Tax for
Public Transit. Thisdedicated revenue -
source provides important funding
support for all public transit service in,
the State. A dedicated source of State
funds is critical during this period of
declining property tax-,4uations in
some areas and shrinking federal
transit supporta IPTA'wlll work to
ensure the continuationbf the motor
vehicle use tax being dedicated to-
ward the funding of transit systems in
Iowa. . .
The Iowa Department of Transporta-
tion has worked with the local school
districts to promote transportation
coordination between school districts
and transit systems in Iowa, both
urban and rural. IPTA applauds these
efforts to maximize the service effi-
ciency to the hundreds of thousands
of Iowa's citizens who ride and depend
on public transit, school buses and
human service agency vehicles.

During the 1988 legislative session
Senate File 2196 was passed which not
only increased transit's portion of the
motor vehicle use tax to 1/20th, but
also required that a consultant be
hired to study "...the mechanisms for
the distribution of public transit
assistance funds." The study is being
conducted by a consulting team under
the direction of a steering committee :'
