HomeMy WebLinkAbout1989-01-31 ResolutionRESOLUTION NO. 89-19 RESOLUTION AUTHORIZING THE ACQUISITION OF CERTAIN PROPERTIES, TEMPORARY CONSTRUCTION EASEMENTS, AND PERMANENT SEWER EASEMENTS FOR THE OUTFALL SEWER PROJECT, ALL IN CONJUNCTION WITH IOWA CITY'S WASTEWATER FACILITIES IMPROVEMENTS PROJECT. WHEREAS, the City of Iowa City has undertaken a project to make major improvements to its wastewater collection and treatment system, including the construction of a new South Wastewater Treatment Plant and a new Outfall Sewer to transport treated wastewater from said plant to the Iowa River, which sewer construction project is known as the Outfall Sewer Project; and WHEREAS, the said Outfall Sewer is to be constructed in a right-of-way which proceeds westerly from the South Wastewater Treatment Plant site in and under an existing roadway, commonly known as Nursery Lane, crosses under Sand Road, and then proceeds to the Iowa River through agricultural lands; and WHEREAS, at the time the City acquired the 51 acre site for the South Wastewater Treatment Plant, it also acquired the adjacent 109 acres with the intent to devote said property to park use in the near future, which 160 acre tract is described as the NEI of Section 35, Twp. 79 N, R614 of the 5th P.M. in Johnson County; and WHEREAS, in acquiring the said NE} of Section 35, the City also acquired an appurtenant easement for access to said tract over Nursery Lane, the extent of which access rights are a matter of some dispute with the owners of the lands upon which Nursery Lane is located; and WHEREAS, this City Council has been advised and has determined the necessity of acquiring fee title to the 49.5 foot strip of land comprising Nursery Lane (a) to provide a right-of-way for the construction, opera- tion, maintenance, repair and replacement of the Outfall Sewer, (b) to preserve and protect the said Outfall Sewer from roadway uses which might interfere with or damage said sewer, (c) to confirm and consolidate the City's access rights thereto, and (d) to provide for future unencumbered access to the NE# of Section 35 for park purposes; and WHEREAS, the accompanying exhibit sets forth the interests to be acquired from each affected property owner and the value of each such interest being acquired, based on an appraisal and a review appraisal thereof; and WHEREAS, City staff should be authorized to acquire said properties and easements at the best overall price and cost to the City as reflected in said appraisals. NOW, THEREFORE, BE AND IT IS HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY, IOWA, that the City Manager or his designee is hereby authorized and directed to negotiate the purchase of said properties and easements for the Outfall Sewer Project, designated as Parcels OS.01 through OS.03, at the appraised values indicated on the accompanying exhibit, or at such higher value as this Council may hereafter approve. /�W Resolution No. 89-19 Page 2 AND BE IT FURTHER RESOLVED that in the event such properties and easements cannot be acquired by negotiation at the appraised values indicated on the accompanying exhibit, the City Attorney be and he is hereby authorized and directed to initiate condemnation proceedings for the acquisition of such properties or easements. Temporary Construction Easement (farmland west of Sand Road) RESOLUTION NO. 89-20 RESOLUTION EXTENDING TIME FOR RECEIPT OF BIDS, APPROVING ADDENDA NOS. 1 THROUGH 4 TO THE PLANS AND SPECIFICATIONS, AND DIRECTING THE CITY CLERK TO PUBLISH NOTICE TO BIDDERS CONCERNING SAID TIME EXTENSION AND ADDENDUM NO. 4, ALL IN CONNECTION WITH THE SOUTHEAST INTERCEPTOR SEWER PROJECT. WHEREAS, pursuant to Resolution No. 88-259, passed and approved on December 21, 1988, this City Council did approve the plans, specifications, and form of contract for the above-mentioned project, did fix the time for receipt of bids for February 2, 1989, at 10:30 a.m. and did direct the City Clerk to publish notice to bidders; and WHEREAS, the City has heretofore issued Addenda Nos. 1, 2 and 3 to the plans and specifications for said project, which Addenda are on file in the office of the City Clerk; and WHEREAS, the Public Works Department, in consultation with the City's design consultant, Metcalf & Eddy, has prepared and is recommending Council approval of Addendum No. 4 to the plans and specifications for said project, in order to incorporate therein necessary changes and explanations to facilitate the construction bidding and the construction of said project, which Addendum is also on file in the office of the City Clerk; and WHEREAS, the Public Works Department and opening of bids be extended to prospective bidders the opportunity preparation of their bids; and has recommended that the time for receipt February 9, 1989, at 10:30 a.m. to give to respond to said Addendum No. 4 in the WHEREAS, the City Council has been advised and does believe that it would be in the best interest of the City of Iowa City to approve and affirm Addenda Nos. 1, 2 and 3 to the plans and specifications heretofore issued by the City, to approve and authorize issuance of Addendum No. 4 to the plans and specifications, and to extend the time for receipt and opening of bids for said project. NOW, THEREFORE, BE AND IT IS HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY, IOWA, that Addenda Nos. 1, 2 and 3 to the plans and specifications for the Southeast Interceptor Sewer Project, heretofore issued by the City, be and the same are hereby approved and affirmed. AND BE IT FURTHER RESOLVED that Addendum No. 4 to the plans, specifications and form of contract for said project, now on file in the office of the City Clerk, be and the same is hereby approved as to form and content.
