Q�1 NL`�C Choi ROLL CALL. ITEM NO. 2 - PLANNING & ZONING MATTERS. a. Consider setting a public hearing for March 7, 1989, on an ordinance to rezone a 6.759 acre parcel located at the northeast quadrant of the Mormon Trek Boulevard and Benton Street intersection from RS -5 to PDH -5. Comment: Byers & Happel, Inc., are seeking flexibility in the development of the 6.759 acre parcel to permit the construction of seven (7), two (2) story, four (4) unit condominium dwellings. THe Planning and Zoning Commission held their first meeting for public discussion on February 2, 1989, and are expected to render a recommendation on the request at their February 16, 1989, meeting. Staff has recommended the proposed rezoning be approved. The applicant is requesting the Council give expedited consideration /of this request. Action: b. Consider an ordinance to amend the Zoning Ordinance to make the setback requirements for high-rise dwellings in the RM -145 zone consistent with the Uniform Building Code. (First Consideration) Comment: At its February 2, 1989, meeting, the Planning and Zoning Commission recommended to approve the proposed amendment to the RM -145 zone by a vote of 6-0. The Commission's recommendation is consistent with that of staff. Action: 44wel�' Agenda Special Council Meeting February 14, 1989 Page 2 Consider an ordinance to vacate an unimproved portion of First Avenue between J Street and the Iowa Interstate Railway, a 360 -foot alley between First and Second Avenues, and a 175 -foot alley along the northern right-of-way line of the railroad. (V-8808. Second Consideration) Comment: At its December 15, 1988, meeting, the Planning and Zoning Commission recommended by a vote of 5-1 (Clark voting no) to vacate the right-of-way noted. This recommendation is consistent with that of staff's. A public hearing was held January 24, 1989; no comments were received. Action: nndk"X 9.z"z ISO it/I a,Ye , f'l1 as d. Consider a resolution approving the amended preliminary Large Scale Non -Residential Development (LSNRD) plan for Blooming Prairie Warehouse, Inc., located at 2340 Heinz Road. (S-8901) Comment: Blooming Prairie Warehouse seeks amended preliminary LSNRD plan approval to permit a 47,437 square foot phased expansion of their present facility providing additional warehouse and office space. The Planning and Zoning Commission, at its February 2, 1989, meeting, recommended to approve the plan by a vote of 6-0. The Commission's recommendation is consistent with that of staff included in a report dated February 2, 1989. Action: ITEM NO. 6 - CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AN AGREEMENT TO TRANSFER TITLE OF TRAFFIC SIGNAL EQUIPMENT FROM THE U.S. DEPARTMENT OF ENERGY/IOWA DEPARTMENT OF NATURAL RESOURCES TO THE CITY OF IOWA CITY. Comment: This agreement will transfer the title for the traffic signal equipment installed by the City along Highway 6 during the summer of 1988. The equipment was purchased by the U.S. Department of Energy/Iowa Department of Natural Resources as part of the funds derived from the decision in the case of The United States vs. The Exxon Corporation. This appointment will be made at the March 21, 1989, meeting of the City Council.
