AN C(DIWNCE TO VACATE AN bNI14PROVED PORTION OF
FIRST AVENJE BETWEEN J STREET TVD THE IOWA INTER-
STATE RAILWAY, A 360 FOOT LNIbP WED NORD{/OR
ALLEY BETWEEN FIRST AND SECOND AVENIES, AND A 175
FOOT LNIFPROVED EASIERLY/WESTERLY ALLEY ALONG THE
NORREIN RIGHT-OF-WAY LINE OF THE IOWA INTERSTATE
RAILWAY.
WHEREAS, alleys were platted in sore areas of the
City and are uninproved; and
WHEREAS, sore street rights-of-way and alleys
cease to be necessary for access to proerty; and
WUEAS, a portion of the former First Avenue
right-of-way contained within Lots 2, 3, 4, and 5,
within Block 10 of the East Tara City addition
subdivision, and the hninproved north -south alley
between Lots 1-5 and Lots 6-9 of East Iove City
Addition subdivision, and the uninproved east -west
alley between Lot 5 of the East love City Addition
subdivision and the northern right-of-way line of
the Iowa Interstate Railway, do not provide any
vehicular access to abutting properties and are no
longer needed.
NOW, THEREFORE, BE IT CUINED BY THE CITY
MKIL OF IM CITY, IDWA:
SECTION I. That the right-of-way in Iawa City,
Iowa, herein described in AttwJmt A and incorpo-
rated by reference herein is vacated for vehicle
access subject to the provision of a 10 foot utility
easment over the north -south alley and a 5 foot
utility easement over the easterly -westerly alley to
be vacated.
SECTIO! TI. REPEALER: All ordinances and parts
of ordinances in conflict with the provisions of
this Ordinance are hereby repealed.
SECTION 111. SEVERABILITY: If any section,
to be invalid ion or ort of the Ordinance shall be rxmstitutiona1 such ajuli�aton
shall not affect the validity of the Ordinance as a
whole or any section, provision or part thereof not
adjudged invalid or unconstitutional.
SECTITN IV. EFFECTIVE DATE: This Ordinance
shall be in effect after its final passage, approval
and publication as required by law.
