RESOLUTION NO. 89-46
RESOLUTION SETTING PUBLIC HEARING ON PROPOSAL TO CONVEY A
PORTION OF A VACATED ALLEY IN BLOCK 46 IN EAST IOWA CITY, AN
ADDITION TO IOWA CITY, IOWA.
WHEREAS, by Ordinance No. 2283 adopted on May 5, 1964, the City of Iowa
City vacated the following described alley:
Alley in Block 46 in East Iowa City Addition; and
WHEREAS, the City of Iowa City, Iowa, executed a quitclaim deed in favor
of John J. Reiland and Ella M. Reiland on July 31, 1964, for a portion of
the vacated alley described as follows:
The alley running in a North-South direction in Block
Forty-six (46) in east Iowa City, Iowa, an addition to
Iowa City, said alley being located between Lots 5, 6
and 7 and Lots 4 and 9 in said Block Forty-six (46) in
east Iowa City, an addition to Iowa City, Iowa,
according to the recorded plat thereof, and
WHEREAS, this quitclaim deed was subsequently recorded, but since no
authorizing resolution could be found, in 1971 the City Council, by
Resolution No. 71-440, authorized the disposal of a portion of the vacated
alley but described the property as:
Alley in Lot 6-7-8 Block 46 East Iowa City, according
to the Plat, and,
WHEREAS, no new quitclaim deed was executed pursuant to the 1971
resolution, or if any were executed, it has not been recorded; and
WHEREAS, because a title objection was again lodged in 1976, the City
Council, by Resolution No. 76-370, again authorized conveyance to the
Reilands of the property originally described in the 1964 resolution,
namely:
The alley running in a North-South direction in Block
Forty-six (46) in east Iowa City, Iowa, an addition to
Iowa City, Iowa, said alley being located between Lots
Five (5) Six (6), and Seven (7) and Lots Four (4) and
Nine (9) in said Block Forty-six (46) in east Iowa
City, an addition to Iowa City, Iowa, according to the
recorded plat thereof, and
WHEREAS, title objection concerning the above-described transactions has
now been lodged because both the 1964 quitclaim deed and 1976 resolution
omitted Lot 8 from the legal description of said property; and
WHEREAS, it is in the public interest to consummate conveyance of these
portions of the vacated alley and to clear this title objection; and
WHEREAS, the City shall retain any and all sanitary sewer and other
easements thereon which inure to the benefit of the City of Iowa City; and

WHEREAS, no consideration is required at this time since the purpose of
this Resolution is to clear the title objection, and
WHEREAS, the current title holder of Lots 7 and 8 and the south 10 feet of
Lot 6 of said Block 46 as well as the portion of said vacated alley
adjacent to said lots are Robert L. Woodburn and Mary Ann Woodburn; and
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA
CITY, IOWA:
1. That the City of Iowa City, Iowa, for title correction purposes,
hereby proposes to convey by quitclaim deed to Robert L. Woodburn and
Mary Ann Woodburn that portion of said vacated alley adjacent to said
Lots 7 and 8 and the south 10 feet of Lot 6, and described as
follows:
Commencing at the Southeast corner of Lot Eight (8) in
Block Forty-six (46), in East Iowa City, Johnson
County, Iowa, according to the recorded plat thereof,
thence North 170 feet, thence East 10 feet, thence
South 170 feet, thence West 10 feet to the place of
beginning.
2. That conveyance of this quitclaim deed is not intended to include any
conveyance of easements for sanitary sewer or other public purposes,
whether or not of record; and that such easements shall continue to
inure to the benefit of the City of Iowa City; and
3. That a public hearing on the proposed conveyance of the above-
described property will be held on the 21st day of March
1989, at 7:30 p.m. in the Council Chambers at the Civic Center, 410
E. Washington Street, Iowa City, Iowa.
4. That the City Clerk is hereby authorized to publish notice of this
hearing.
5. That the Mayor is authorized to sign and the City Clerk to attest
this Resolution.

CITY OF IOWA CITY
RESOLUTION NO. 89-47
RESOLUTION AUTHORIZING THE FILING OF AN APPLICATION WITH THE IOWA
DEPARTMENT OF TRANSPORTATION FOR FY90 IOWA DOT STATE TRANSIT
ASSISTANCE.
WHEREAS, the City of Iowa City has undertaken to provide its residents with a
public transportation system, and
WHEREAS, the Iowa Department of Transportation offers financial assistance to
local governmental units for their public transportation systems, and
WHEREAS, 2.6988% of formula funding is being applied for and $36,493 in Special
Project funding is being applied for from the State Transit Assistance program.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF IOWA CITY, IOWA:
1. That the City Manager is authorized to act as signatory for the City of
Iowa City on State Transit Assistance application documents.
2. That JCCOG is authorized to file and administer the application in behalf
of the City of Iowa City.
3. That the City Manager is authorized to sign contract documents with the
Iowa Department of Transportation.

RESOLUTION APPROVING PLANS, SPECIFICATIONS, FORM OF CONTRACT,
AND ESTIMATE OF COST FOR THE CONSTRUCTION OF THE
BENTON STREET BRIDGE WIDENING PROJECT M-4044(1)--81-52
AND DIRECTING CITY CLERK TO PUBLISH NOTICE TO BIDDERS
WHEREAS, notice of public hearing on the plans, specifications, form of
contract and estimate of cost for the construction of the above-named project
was published as required by law, and the hearing thereon held.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF IOWA CITY,
IOWA:
1. That the plans, specifications, form of contract, and estimate of cost
for the construction of the above-named project are hereby approved.
2. That the City Clerk is hereby authorized and directed to publish notice
for the receipt of bids for the construction of the above-named project in a
newspaper published at least once weekly and having a general circulation in
the city not less than four (4) nor more than twenty (20) days before the date
established for the receipt of bids.

RESOLUTION CERTIFYING UNPAID VEHICLE REMOVAL, SIGN
REMOVAL, SNOW AND ICE REMOVAL AND SIDEWALK REPAIR
CHARGES TO COUNTY AUDITOR FOR COLLECTION IN THE SAME
MANNER AS A PROPERTY TAX.
WHEREAS, Section 31-121, Code of Ordinances of the City of Iowa City,
Iowa, and Section 364.12 of the Code of Iowa, provide that the City
Council may certify unpaid vehicle removal, sign removal, snow and ice
removal and sidewalk repair charges to the County Auditor for collection
in the same manner as a property tax; and
WHEREAS, there exist unpaid vehicle removal, sign removal, snow and ice
removal and sidewalk repair charges for the owners and properties, and in
the amounts specified in Exhibit A, attached to this Resolution and by
this reference made a part hereof; and
WHEREAS, the Council finds that each property owner has received a written
notice by certified mail, return receipt requested, of the date and time
for the City Council's consideration of this resolution, at which time the
property owner could appear before the Council and be heard concerning the
unpaid charges.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA
CITY, IOWA,
That the City Clerk is hereby authorized to certify to the auditor of
Johnson County, Iowa, for collection in the same manner as a property tax,
unpaid vehicle removal, sign removal, snow and ice removal and sidewalk
repair charges as stated in Exhibit A attached.

sign is not removed or repaired, as the case may be, within the time
allowed, the City may cause to have the sign removed to be used as evi-

may also result in the filing of court charges. Even if the violation is
corrected prior to the court date, the City will not agree to dismiss the

RESOLUTION NO. 89-51
RESOLUTION APPROVING THE FINANCIAL PLAN FOR THE CITY OF IOWA
CITY, IOWA, FOR FISCAL YEARS 1990-1992.
WHEREAS, the City Council of the City of Iowa City, Iowa, deems it in the
public interest and in the interest of good and efficient government for
the City of Iowa City, Iowa, to adopt a three-year Financial Plan for both
operations and capital improvements; and
WHEREAS, the three-year financial plan is subject to annual review and
revision; and
WHEREAS, a public hearing was held on February 28, 1989, at a special
formal Council meeting, and public comments were received.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF IOWA CITY, IOWA:
1. That the City Council of the City of Iowa City does hereby adopt the
Financial Plan for the Fiscal Years 1990-1992.
2. That this Resolution is an expression of the Council's legislative
intent for planning future operations and capital improvements for
the City of Iowa City, Iowa; and the anticipated means of financing
said plan, subject to applicable laws.
It was moved by Ambrisco and seconded by Iiorowi.tz the
Resolution be adopted, and uponroll call there were:

RESOLUTION NO. 89-52
RESOLUTION AUTHORIZING THE ACQUISITION OF CERTAIN TEMPORARY
CONSTRUCTION EASEMENTS AND PERMANENT SEWER EASEMENTS FOR THE SLUDGE
FORCE MAIN CONSTRUCTION PROJECT, ALL IN CONJUNCTION WITH IOWA CITY'S
WASTEWATER FACILITIES IMPROVEMENTS PROJECT.
WHEREAS, the City of Iowa City has undertaken a project to make major improve-
ments to its wastewater collection and treatment system, including the
construction of a new South Wastewater Treatment Plant and a new Sludge Force
Main to transport activated sludge from the North Wastewater Treatment Plant to
the South Wastewater Treatment Plant for final treatment and processing; and
WHEREAS, this City Council has been advised and has determined that the
acquisition of certain easements, as indicated on Exhibit A, are necessary for
the construction of said public improvements and are for a necessary public
purpose; and
WHEREAS, the City has obtained an appraisal and review appraisal for each of the
said acquisitions; and
WHEREAS, City staff should be authorized to acquire said properties and
easements at the best overall price and cost to the City as reflected in said
appraisals.
NOW, THEREFORE, BE AND IT IS HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
IOWA CITY, IOWA, that the City Manager or his designee is hereby authorized and
directed to negotiate the purchase of easements for the Sludge Force Main
Project, designated as Parcels SFM.O1 through SFM.10, at the appraised values
indicated on the accompanying exhibit, or at such higher value as this Council
may hereafter approve.
AND BE IT FURTHER RESOLVED that in the event such properties and easements
cannot be acquired by negotiation at the appraised values indicated on the
accompanying exhibit, the City Attorney be and he is hereby authorized and
directed to initiate condemnation proceedings for the acquisition of such
properties or easements.
It was moved by Balmer and seconded by Ambrisco the
Resolution be adopted, and upon roll call there were:
