HomeMy WebLinkAbout1989-03-09 ResolutionRESOLUTION NO. 89-53 RESOLUTION APPROVING PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF COST FOR THE CONSTRUCTION OF THE CORALVILLE/IOWA CITY ANIMAL SHELTER PROJECT, ESTABLISHING AMOUNT OF BID SECURITY TO ACCOMPANY EACH BID, DIRECTING CITY CLERK TO PUBLISH NOTICE TO BIDDERS, AND FIXING TIME AND PLACE FOR RECEIPT OF BIDS WHEREAS, notice of public hearing on the plans, specifications, form of contract and estimate of cost for the construction of the above-named project was published as required by law, and the hearing thereon held. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF IOWA CITY, IOWA: 1. That the plans, specifications, form of contract, and estimate of cost for the construction of the above-named project are hereby approved. 2. That the amount of bid security to accompany each bid for the construction of the above-named project shall be in the amount of 10% of bid payable to Treasurer, City of Iowa City, Iowa. 3. That the City Clerk is hereby authorized and directed to publish notice for the receipt of bids for the construction of the above-named project in a newspaper published at least once weekly and having a general circulation in the city not less than four (4) nor more than twenty (20) days before the date established for the receipt of bids. 4. That bids for the construction of the above-named project are to be received by the City of Iowa City, Iowa, at the Office of the City Clerk, at the Civic Center, until 10:30 A.M. on the 28th day of March, 1989. Thereafter the bids will be opened by the City Engineer or his designee, and thereupon referred to the Council of the City of Iowa City, Iowa, for action upon said bids at its next meeting to be held at the Council Chambers, Civic Center, Iowa City, Iowa, at, 7:30 p.m. on the 4th day of April, 1989 or at such later time and place as may then be fixed. It was moved by Balmer and seconded by Ambrisco that the resolution as read be adopted, and upon roll call there were. IT CLERK APPROVED AS TO FORMY�Yyt»u+s¢ Legal Department �7 89 �� :.0 RESOLUTION NO. 89-54 RESOLUTION AUTHORIZING AND DIRECTING THE CITY MANAGER TO ACCEPT A PERMANENT SIDEWALK EASEMENT, IN LIEU OF WARRANTY DEED, FOR A STRIP OF PROPERTY ALONG BENTON STREET ADJACENT TO THE AMOCO SERVICE STATION AT 801 RIVERSIDE DRIVE, AND AUTHORIZING THE NEGOTIATION AND EXECUTION OF AN AGREEMENT FOR USE OF RIGHT-OF-WAY FOR AN UNDERGROUND GASOLINE STORAGE TANK FOR SAID SERVICE STATION, ALL IN CONJUNCTION WITH THE BENTON STREET INTERCEPTOR PROJECT. (PARCEL NO. BSI.01) WHEREAS, the City of Iowa City has undertaken a project to make major improve- ments to its wastewater collection and treatment system, including the construction of a new sanitary sewer interceptor to serve Iowa City and University Heights, and accompanying drainage, street and sidewalk improvements, which project is known as the Benton Street Sanitary Sewer Interceptor Project; and WHEREAS, pursuant to Resolution No. 88-224, adopted November 1, 1988, this City Council did authorize the acquisition of certain easements and property interests in conjunction with the Benton Street Interceptor Project; and WHEREAS, the City Manager did, pursuant to said resolution, offer to purchase a temporary construction easement and a three foot strip of property along Benton Street from Florence J. Morrow, the fee owner of the Amoco service station property at 801 South Riverside Drive, said three foot strip to be used for sidewalk purposes; and WHEREAS, upon further investigation it was determined that an underground gasoline storage tank is located beneath the said three foot strip of property which is being acquired by the City for sidewalk purposes, and that said tank may protrude into the existing Benton Street right-of-way; and WHEREAS, City staff now recommends that the City acquire a permanent easement for said sidewalk, rather than acquire fee title to said three foot strip, and that the fee owner and the American Oil Company (Amoco), as lessee, be required to execute a right-of-way use agreement in favor of the City to properly maintain said tank, to indemnify the City for such use of Benton Street right- of-way and to provide appropriate insurance therefore in the event it is determined that said underground tank lies within the Benton Street right-of- way; and WHEREAS, the City's appraiser has indicated that the valuation for acquisition of a permanent sidewalk easement on said property should be the same as for the fee title acquisition of said property, $3,100, and that the temporary construction easement valuation should remain at $150. NOW, THEREFORE, BE AND IT IS HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY, IOWA, that the City Manager or his designee is hereby authorized and directed to negotiate the purchase of temporary construction easement and a permanent sidewalk easement for the Benton Street Sanitary Sewer Interceptor Project, designated as Parcel BS1.01, at the appraised values indicated above. AND BE IT FURTHER RESOLVED that the City Manager is authorized and directed to negotiate and execute an agreement allowing said parties to continue the use of the Benton Street right-of-way for location and maintenance of the underground gasoline storage tank in the event said tank is determined to be in said street right-of-way. #QS Resolution No. 89-54 Page 2 AND BE IT FURTHER RESOLVED that in the event said easements cannot be acquired by negotiation at the appraised values indicated above, or in the event the fee owner or Amoco decline to execute the agreement for use of Benton Street right- of-way for the underground gasoline storage tank, then in that event the City Attorney be and is hereby authorized and directed to initiate condemnation proceedings for the acquisition of said easements, and to secure the removal of said storage tank from the Benton Street right-of-way.
