Comment: This resolution would assure that the City will comply with the 1970 Uniform Relocation Assistance and Land Acquisition Poli c ies Act. This is a yearly statement that is a requirement for receiving Federal Aid funds for projects. Public Works recommends approval. A copy of the Assurance Statement is attached. Consider setting a public hearing for January 26, 1988, on amendments to the off-street parking requirements. Comment: After having worked with the off-street parking design standards for nearly five years , the staff proposes four amendments to clarify provisions of the Ordinance and to adapt the standards to current vehicle dimensions. The amendments address the general applicability of the standards, the size of a standard parking space, the minimum width of a driveway, and the percentage of compact spaces allowable. The Planning and Zoning Commission recommended approval of these amendments by a vote of 5-0 at their December 17. 1987, Ameeet i ng. Action Agenda Iowa City City Council January 12, 1987 Page 4 Public hearing on a resolution adopting an addendum to the 1983 Comprehensive Plan Update which addresses development proposals out of sequence with the growth management policy espoused in the Comprehensive Plan Update. Comment: At its December 3, 1987, meeting, the Plan- ning and Zoning Commission recommended, by a vote of 6-0, to approve a proposed amendment to the 1983 Com- prehensive Plan Update which would allow the develop- ment of a tract of land out of phase with the development sequence adopted for the City, provided the out of sequence development approximates the efficiency of development upon which the City's growth management policy is based. This recommendation is consistent with the amendments suggested by staff in a memorandum dated December 3, 1987, Action: Public hearing on a resolution amending the 1983 Com- prehensive Plan Update to reclassify the land use designation of a tract known as Southwest Estates which is located within the corporate limits of Iowa City, north of Rohret Road and east of Slothower Road from Agricultural/Rural Residential to Residential at a density of 2.8 dwelling units per acre. Comment: By a vote of 6-0, the Planning and Zoning Commission, at its December 3, 1987, meeting, recom- mended approval of the request to reclassify the land use designation of Southwest Estates in the context of the proposed amendment to the Comprehensive Plan Update which addresses out of sequence development. Staff addresses this issue in memoranda to the Commission dated October I , 1987, and November 5, 1987. Public hearing on an ordinance to rezone an 84.73 acre tract known as Southwest Estates from ID -RS, Interim Development - Single -Family Residential, and RR -1, Rural Residential to RS -5, Low Density Single -Family Residential, subject to conditions, (Z-8703) Comment: At its December 3, 1987, meeting, by a vote of 6-o, the Planning and Zoning Commission recommended approval of an application submitted by Frank Eicher to rezone the subject tract from ID -RS and RR -1 to RS -5 subject to the condition that all costs associated with that development, including costs typically subsidized by the City, will be paid by the developer; costs customarily paid by the City may be recouped at such time as either (a) intervening development between Hunter's Run Subdivision and Southwest Estates is substantially complete, but not before 1998, or (b) the growth management policy for the southwest area is amended such that development of Southwest Estates is regarded as being in sequence with that development policy. This recommendation is consistent with the Comprehensive Plan amendment recommended by the Commis- sion in the preceding items. Memoranda from staff to the Commission which address out of sequence develop- ment costs are included in the Council packet. The details of the Conditional Zoning Agreement are being discussed with the developer. Council should, there- fore, defer the public hearing on this item until the January 26, 1988, Council meeting. Public hearing on an ordinance to rezone an approximate 1.8 acre tract located east of Boyrum Street and north of Olympic Circle from I-1, General Industrial, to CI -1, Intensive Commercial. (Z —8709) Comment: Southgate Development Company has submitted a request to rezone this property from I-1 to CI -1 to allow conversion of existing buildings on the tract for office use, a use not permitted in the 1-1 zone. Staff finds that rezoning the property from I-1 to CI -1 would allow development of the site for uses which are both compatible with adjacent uses and consistent with the City's Comprehensive Plan. The Planning and Zoning Commission will consider this application at its Janu- ary 7, 1988, meeting. The applicant has requested expedited consideration of this item. In a report dated December 17, 1987, staff recommends in favor of this rezoning request. Action: �„ Consider an ordinance to rezone an approximate 1.8 acre tract located east of Boyrum Street and north of Olym- pic Circle from 1-1, General Industrial, to CI -1, Intensive Commercial. (first consideration) Comment: See preceding item. The applicant requests expedited consideration of this proposal. Consider an ordinance to rezone from RS -5 to RS -8 property located at 612 and 620 Kirkwood Avenue and from P to RS -8 property located at the corner of Kirkwood Avenue and Dodge Street. (first considera- tion) Comment: At its November 19, 1987, meeting, the Plan- ning and Zoning Commission recommended, by a vote of 6-0, approval of a request to rezone the site of the old Kirkwood Schoolhouse from P to RS -8. The Conunis- sion also recommended approval of the rezoning of two adjacent properties, west of the schoolhouse, from RS -5 to RS -8. These recommendations are consistent with that of staff. No comments were received at a public hearing held December 22, 1987. Action: �t/r��%t�iJ ii �s/cy �i 2'aafl� h 1. Consider an ordinance to vacate a portion of Clinton Street abutting the site of the National Guard Armory. (first consideration) Comment: The Planning and Zoning Commission recommended at its November 19, 1987, meeting, by a vote of 6-0, vacation of a portion of the Clinton Street right-of-way. The National Guard has requested the vacation to permit lease of the property by the Guard for additional parking. The recommendation of the Commission is consistent with that of the staff. No comments were received at the December 22, 1987, public hearing. Action: Ilette Agenda Iowa City City Council January 12, 1987 Page 8 j. Consider a resolution approving the preliminary plat of BB- C-,3 Village Green, Part XI, a 41 -lot single-family residen- tial subdivision located south and west of the inter- section of Mu scatine Avenue and Scott Boulevard. (S-8720) Comment: The developer, Frantz Construction Company, has submitted a plat for the subdivision of property east of existing Village Green development. The plat represents a consensus of developer and neighboring residents' interests. Staff, however, does not endorse the street pattern shown on the preliminary plat of Village Green, Part XI since it abandons the collector street concept which staff feels is needed within future residential development south of the proposed subdivision. A memorandum dated January 7, 1988, addresses staff concerns. The Planning and Zoning Commission will consider this proposal at its January 7, 1988, meeting. The applicant has requested expedited Counc it consideration of this item. A memo- randum explaining the evolution of the design of this subdivision is included in the Council packet. Agenda Iowa City City Council January 12, 1987 Page 9 Consider a recommendation of the Planning and Zoning Commission concerning a request submitted by Mr. John Sohm to rezone the location of an existing 1.75 acre parcel from RS, Suburban District, to Al, Rural Dis- trict, and to rezone a new 1.43 acre parcel from Al to RS, located west of Highway 1, approximately two miles north of Iowa City. (CZ -8720) Comment: At its meeting of December 17, 1987, the Planning and Zoning Commission, by a vote of 4-0, found the combined rezoning request to be inconsistent with the development policy of Area 4 of the Fringe Area Policy Agreement. Agricultural use is the preferred use for properties located west of Highway 1 within Area 4. The existing 1.75 acre parcel was one of two parcels rezoned in 1984 to permit a two -lot residential subdivision, and was opposed by the City as being inconsistent with Area 4 policy. The proposed rezoning alters the location of one of the two RS zoned parcels to coincide with a lot in a proposed two -lot subdivi- sion. After the City Council and Board of Supervisors have ruled on the rezoning, the Commission will deal with the proposed subdivision plat. The Commission's recommendation concerning the rezoning is consistent with that of staff in a report dated December 17, 1987. Comment: The U.S. Department of Housing and Urban Develop- ment (HUD) has published a Notice of Funding Availability (NOFA) for FY88 and a new housing bill was signed by the President, Based on the Housing Authority's performance during the past year and early lease up of voucher units it is anticipated that an application for additional units wil 1 receive favorable consideration. An application for 50 freestanding units (either vouchers or certificates) will be submitted and a separate application will be sub- mitted for 12 units in support of the Rental Rehabilitation Program. This is based on the same funding level as FY87. Specific dollar amounts are not known at this time. Justi- fication for these units - we have in excess of 275 names on our waiting list. These units will be administered by the Iowa City Housing Authority and will merely be an extension of the existing program administered by the Housing Authority. No addi- tional staff will be required. (First consideration) Comment: The City is often confronted, after heavy snows such as have recently occurred, with complaints of abuses in the remova 1 of snow from private property. These com- plaints usual ly involve individuals who remove snow and ice fromtheir streets Property and deposit it on adjacent properties an irresponsible manner, creating hazards and hardships for adjacent property owners or for those at- tempting to travel those streets. This ordinance puts into effect some common sense regulations regarding where pri- vate property owners may deposit snow and ice removed from their propert ies. As to users with multiple accounts at multiple service locations, t ordinance provides for discontinuance of service at alt l such locations if one or more accounts became delinquent.
