Re: Public Disclosure of Waiver of HUD Conflict of Interest Regulations
This is to inform you of requests made to HUD to waive its conflict of inter-
est rules to allow certain citizens to participate in the City's Housing
Rehabilitation Program.
Ms. Anne Rawland, a member of the Committee on Community Needs has applied
for a Housing Rehabilitation Loan to purchase and install a new furnace in
her residence, and Marc Moen, whose wife, Monica, is a City employee (PPD)
and Frank Wagner, whose wife, Barbara, is a member of the Historic Preserva-
tion Commission (Moen and Wagner together) have applied for a Rental Reha-
bilitation Loan for work on an apartment house at 914 Iowa Avenue, which they
recently purchased. Neither Mrs. Moen nor Mrs. Wagner has a direct ownership
interest in the property. The Legal Department has opined that the transac-
tions involve no conflict -of -interest under state or local laws, and the
Department of Housing and Urban Development (HUD) has been asked to waive its
somewhat stricter conflict-of-interest rules - which would appear to prohibit
participation in housing rehabilitation programs by anyone employed by the
City or serving on any of the City's boards or commissions. The waivers have
been sought on the basis that none of the persons involved has any decision-
making authority with respect to housing rehabilitation, and denying these
persons participation in the Housing Rehabilitation Program would hinder the
intent of the programs to maintain neighborhoods and the City's housing
stock, and provide affordable housing to lower income households. It is
Staff's understanding that HUD is prepared to issue waivers if Council has no
objection.

Your request for these waivers is approved subject receipt, by
this office, of the notice of full public disclosure. Based to recece your
telephone conversation with Ms. Humbert, it is understood that these
disclosures will be made at your January 19, 1988, Council meeting.

Ms. Peg McElroy. Mayor's Youth is an outstanding service organization which
provides exemplary community based vocational opportunities for youth. On
an ongoing basis, Ms. McElroy and her staff are continually looking for ways
to provide innovative programming. Her commitment to economically
disadvantaged and high risk youth provides a fundamental service to the
community. We would strongly advocate increased support of this quality
service program.
