RESOLUTION NO. 88-1
RESOLUTION AUTHORIZING THE MAYOR TO SIGN A RIGHT
OF WAY ASSURANCE STATEMENT FOR FEDERAL AID PROJECTS
WHEREAS, the Department of Transportation requires cities to
comply with the provision of the 1970 Uniform Relocation Assistance
and Land Acquisition Policies Act by furnishing assurances
concerning acquisition of right of way for highway projects funded
with Federal Aid Funds to them.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF IOWA CITY, IOWA, that the Mayor is hereby authorized to sign a
right of way assurance statement for Federal Aid Projects.

RIGHT OF WAY ASSURANCE STATEMENT
City of Iowa City
To comply with the provisions of the 1970 Uniform Relocation Assistance and Land
Acquisition Policies Act, the City Council of the City of
Iowa City furnishes the following assurances to the Iowa
Department of Transportation.
1. It is the policy of the City of Iowa City to acquire right-of-way
in accord with Title III of said 1970 Act and applicable state laws.
2. It is the policy of the City of Iowa City to provide relocation
assistance benefits in accord with Title II of said 1970 Act and applicable
state laws.
3. The above named City will contact the Iowa Department of Transportation for
assistance as needed to assure compliance with applicable laws which are
summarized in the instructions entitled "Right -of -Way Acquisition Policies and
Procedures."

RESOLUTION NO. 88-3
RESOLUTION APPROVING THE PRELIMINARY PLAT OF
VILLAGE GREEN, PART X1, A SUBDIVISION OF JOHNSON COUNTY, IOWA.
WHEREAS, the owners, William and Sherry Frantz, have filed with the City Clerk
of Iowa City, Iowa, an application for approval of the preliminary plat of
Village Green, Part XI; and
WHEREAS, the Department of Planning and Program Development and the Public Works
Department have examined the proposed preliminary plat, and find that it meets
the technical specifications of the City's Subdivision Regulations, but do not
endorse the street pattern shown on the preliminary plat of Village Green, Part
XI because it departs from the internal collector street system in the developed
portions of the Village Green area; and
WHEREAS, the preliminary plat has been examined by the Planning and Zoning
Commission and, after due deliberation, the Commission has recommended that it
be accepted and approved, and that the Subdivision Regulation requirement that
blocks be a minimum of 220 feet wide be waived for the following three blocks:
(1) Chamberlain Place between Village Road and Hampton Street,
(2) Hampton Street between Chamberlain Place and Hampton Court, and
(3) Hampton Street between Hampton Court and Scott Boulevard; and
WHEREAS, except where such requirements are waived, the preliminary plat is
found to conform with all of the technical requirements of the City Ordinances
of the City of Iowa City, Iowa.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY,
IOWA:
That the preliminary plat of Village Green, Part XI, is hereby approved,
with a waiver of the minimum block width requirement for the following

The topography of the tract is
rolling with an approximate
slope of six percent.
The proposed 14.98 acre subdivision is located within the RS -5, Low Den-
sity Single -Family Residential, zone. All of the 43 lots meet the minimum
dimensional requirements specified within the Zoning Ordinance for lots
located within that zone. The sizes of the lots within the proposed
development are consistent with the lot sizes within the two developments
immediately west of the subject subdivision. The density of development
for this subdivision will, therefore, resemble the development density in
the immediate area. The proposed development is expected to be compatible
with the surrounding uses.
Subdivision Code Compliance
The proposed subdivision is in general compliance with the regulations of
the Iowa City Subdivision Code. The open space reflected within the
Hampton Court turnaround is labeled "private open space." Prospective
buyers should be aware that this area is private property and the City is,
therefore, assuming no responsibility for the maintenance of this land.
The Comprehensive Plan policy discourages driveway access for single-
family residences along arterial streets. The purpose of this policy is
to facilitate the ability of arterial streets to carry large volumes of
traffic. The proposed subdivision has been designed to obviate the need
for driveway access onto Muscatine Avenue, an arterial street, and Scott
Boulevard which is expected to function as an arterial subsequent to
proposed improvements to this roadway. Due to these restrictions, the
creation of some lots with double frontage is unavoidable. Ten of the 43
lots proposed within this subdivision will have rear yard exposure to one
of these two arterials in addition to frontage onto either Hampton Court
or Avon Circle.
Section 32-54(a)(5) of the Subdivision Regulations specifies that the
width of blocks shall be sufficient to permit two tiers of lots but in no
case shall the width be less than 220 feet. Although the average width of
the block between Hampton Court and Avon Circle is greater than 220 feet,
frontage of Lots 19 and 20 onto Village Road indicates that block width at
this point is only 200 feet. At the expense of reducing the depth of the
lots with frontage onto Scott Boulevard and, thereby, increasing these
lots' exposure to the negative effects of arterial traffic circulation,
staff recommends that the Commission, in this instance, waive the require-
ment that blocks be a minimum of 220 feet wide.
Secondary Access
Provisions for secondary access assure emergency and service vehicle
accessibility, reduce the impact of a new subdivision on the existing
neighborhood, and guarantee property owners ingress and egress to and from
the subdivision. Subdivision of the subject tract into 43 single -family
residential lots necessitates provisions for secondary access.
The street pattern proposed for this subdivision is generally consistent
with the street pattern concept (see Attachment 2) proposed on the adopted
plat for Village Green Part X. This plan was accepted by the Commission
at that time as the appropriate street pattern for the area. Note that
the plan indicates that Village Road will connect with Scott Boulevard.
The accompanying plat indicates that secondary access to Village Green
Part XI is proposed via Scott Boulevard. The access point shown on the
plat is, however, north of the access point to Scott Boulevard proposed on
the concept plan for the Village Green and the Village Green South areas.
While this shift may necessitate that a third access to Scott Boulevard be
employed to accommodate future development within the remaining portions
of this tract, an additional access point is not expected to hinder the
ability of this arterial street to circulate larger volumes of traffic.
Placement of the proposed access in the location shown also allows lati-
tude in locating access points along the west side of Scott Boulevard in
conjunction with an existing access on the east s

The plat does not provide for a stormwater management basin on the 14.98
acre tract under consideration. Instead, a detention basin for the entire
Village Green area will be provided immediately north of the Iowa Inter-

Economic Impact
Given the value of existing residential developments in the immediate area
of the proposed subdivision, the assessed value of each lot within the
proposed development, including a single-family residential dwelling, is
approximately $90,000. For tax purposes, the values of residential uses
within this tax year are rolled back to 77.3604% of their assessed values.
The City tax levy presently imposed on a residential use is
$11.54919/$1,000 of assessed valuation. Assuming a lot in the proposed
subdivision is developed and that the property has an assessed value of
$90,000, the amount of tax due on that property this year would be about
$804. If the 43 lots within the subdivision were developed today, the
City would realize an annual increase in the tax base of approximately
$34,572.
While no direct construction costs to the City in the way of overwidth
pavement or extra capacity utility lines are required with this subdivi-
sion, indirect costs such as garbage pickup, maintenance of streets and
municipal utilities, and police and fire protection are incurred. With
increased residential development, local schools, parks, the public li-
brary, the transit system, and roadways outside the development are also
impacted. This subdivision is not expected, however, to affect the City's
ability to provide municipal services.
STAFF RECOMMENDATION
Staff recommends that the preliminary plat of Village Green Part XI be
approved.

Re: Village Green, Part XI
The purpose of this memorandum is to identify staff reservations regarding
the proposed preliminary plat of Village Green, Part XI, and its impact on
the design of future subdivisions of land south of the proposed develop-
ment. Although the Commission must only consider the merits of the
preliminary plat of Village Green, Part XI at this time, the subdivision
design proposed for this development establishes the basis for future
design alternatives for subdivisions of land south of Village Green, Part
XI.
The original design envisioned for the approximate 200 acre tract known as
Village Green and Village Green South incorporated a looped collector
street known as Village Road that was intended to filter traffic from
local residential streets to arterial streets. Given the size of the
Village Green and Village Green South tract, the collector street was
intended to minimize unnecessary traffic on local streets and facilitate
the provision of transit and emergency services in the area. Discouraging
driveway access to the collector minimizes side friction and facilitates
the flow of traffic. About half of this collector system has been
installed and is serving existing subdivisions in the northern and western
portions of this tract. This system shields existing residences from the
amount of traffic generated daily by a development of this size and
provides a way for smooth traffic flow.
The subdivision design proposed for Village Green, Part XI, obstructs the
ability to continue the collector street concept on the eastern part of
the tract. The continuous or looped design of the collector system is
disrupted by T-ing Village Road into a local street identified as
Chamberlain Place and allowing direct access of single-family residential
uses onto these streets.
This system fails to immunize new residential uses from the negative
effects of higher traffic volumes by exposing these uses not only to local
traffic accessing individual properties but to traffic moving through the
neighborhood to get from one end of the neighborhood to another. This
arrangement is also expected to hinder the provision of emergency services
to the area by establishing a maze of local streets that must be negotia-
ted by emergency service providers.

While staff is sympathetic to concerns expressed by existing residents of
the Village Green area regarding the impact of new residential uses on
established uses, the proposed design does not mitigate the effects of
anticipated increased traffic volumes on the proposed development. Staff
maintains that minimization of the impact of increased traffic on existing
development by new development can be achieved without sacrificing the
collector street concept which is intended to relieve the negative effects
of traffic produced by a sizeable residential development.
The staff cannot, therefore, endorse the street pattern shown on the
preliminary plat of Village Green Part XI.

Re: Village Green, Part XI
In September, 1987, Frantz Construction Company submitted a plat for
Village Green, Part XI, an approximate 15 acre single-family residential
subdivision located south of Muscatine Avenue, west of Scott Boulevard and
immediately east of existing Village Green development. In a report dated
September 17, 1987, staff recommended approval of this plat. As shown on
the attached copy of that plat (Attachment 1), the subdivision design
provided secondary access via Scott Boulevard and allowed for the con-
tinuation of Village Road, a looped collector street. The street was
intended to minimize traffic on local streets within the Village Green
development by filtering traffic from residential streets to arterial
streets and to facilitate the provision of transit and emergency services
in the area. The Village Road, collector street concept, was proposed with
the first Village Green subdivision and about half of this collector
system has been installed and utilized by existing development.
Residents of existing Village Green development objected to the subdivi-
sion plat submitted in September citing its deviation from the open
space/court concept implemented in existing Village Green subdivisions and
their anticipated exposure to traffic given the development's access to
Scott Boulevard and perpetuation of a collector street system that resi-
dents envisioned would encourage traffic from Scott Boulevard through the
Village Green area to points west. They were also concerned about the
effect of this traffic on Wayne Avenue, the 25 foot wide paved street
located on the western boundary of the Village Green area.
Subsequently, the developer and Village Green representatives worked
together to arrive at a subdivision design that satisfied both interests.
The result of those negotiations is represented in Attachment 2, the
subdivision plat for Village Green, Part XI submitted in December, 1987.
The plat abandons the collector street concept and inhibits the opportu-
nity to continue a collector street along the western and southern por-
tions of the entire tract. In a memorandum to the Planning and Zoning
Commission dated January 7, 1988, staff identifies the shortcomings of
this design.
Staff will be present at the January 11, 1988, informal Council meeting,
to discuss this proposal with you. In the meantime, if you have any

COLLECTION IN THE SAME MANNER AS A PROPERTY TAX.
WHEREAS, Section 33-167, Code of Ordinances of the City of Iowa City, Iowa,
provided that the City Council may certify unpaid water, sewer and refuse
charges to the County Auditor for collection in the same manner as a property
tax; and
WHEREAS, there exists unpaid water charges for the owners and properties, and
in the amounts, specified in Exhibit A, attached to this resolution and by
this reference made a part hereof; and
WHEREAS, the Council finds that each property owner has received a written
notice by certified mail, return receipt requested, of the date and time for
the City Council's consideration of this resolution at which time the prop-
erty owner could appear before the Council during the discussion period for
this resolution and be heard concerning the unpaid charges.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY,
IOWA, that the City Clerk is hereby authorized to certify the unpaid water
charges as stated in Exhibit A attached, to the Auditor of Johnson County,
Iowa, for collection in the same manner as a property tax.

RESOLUTION NO. 88-5
RESOLUTIO14 CERTIFYING UNPAID REFUSE CHARGES TO COUNTY AUDITOR FOR
COLLECTION IN THE SA14E MANNER AS A PROPERTY TAX.
WHEREAS, Section 15-6, Code of Ordinances of the City of Iowa City, Iowa,
provided that the City Council may certify unpaid water, sewer and refuse
charges to the County Auditor for collection in the same manner as a property
tax; and
WHEREAS, there exists unpaid refuse charges for the owners and properties,
and in the amounts, specified in Exhibit A, attached to this resolution and
by this reference made a part hereof; and
WHEREAS, the Council finds that each property owner has received a written
notice by certified mail, return receipt requested, of the date and time for
the City Council's consideration of this resolution at which time the prop-
erty owner could appear before the Council during the discussion period for
this resolution and be heard concerning the unpaid charges.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY,
IOWA, that the City Clerk is hereby authorized to certify the unpaid refuse
charges as stated in Exhibit A attached, to the Auditor of Johnson County,
Iowa, for collection in the same manner as a property tax.

During the period between June 15 and October 15 individuals in violation
of the weed ordinance are sent notice of said violation by certified mail
which allows 10 days after mailing as a period to eliminate the violation.
Upon failure of the owner or person in possession of the property to act
within the prescribed time period, the City may obtain bids or have City
Personnel perform the required action. The costs thereof are billed to
the owner. Upon failure of the owner to pay these costs, the City may
assess the costs against the property for collection in the same manner
as a property tax.
Attached is a listing of the unpaid weed cutting charges for the period
between June 15 and October 15, 1987. I am requesting that you approve
the filing of liens against the properties listed. All property owners
have been sent notice by certified mail notifying them of the pending lien
filing action and giving them an opportunity to be heard at the City
Council meeting on January 12, 1988.
In the meantime, payments may be made. Therefore, an updated listing of
unpaid accounts will be provided to you at the January 12, 1988 meeting.

WHEREAS, on February 23, 1978, Velma Furman executed a promissory note to the
City of Iowa City in the amount of $5,000 for value received through a Hous-
ing Rehabilitation Loan, and
WHEREAS, said promissory note provided a lien against the property being
rehabilitated, and
WHEREAS, $5,000 or the full amount of said note was forgiven on February 23,
1981.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY,
IOWA, that the Mayor is authorized to sign and the City Clerk to attest the
attached Release of Lien, whereby the City does release the affected property

RESOLUTION NO. 88-10
A RESOLUTION AUTHORIZING THE APPROVAL OF A JOINT POWERS AGREEMENT
AND DECLARATION OF TRUST FOR THE 101-A PUBLIC AGENCY INVESTMENT
TRUST AND AUTHORIZING PARTICIPATION THEREIN.
WHEREAS, Iowa Code Section 28E.1 (1987 as amended) permits political subdivi-
sions to make efficient use of their powers by enabling them to provide joint
services with other Public Agencies and to cooperate in other ways of mutual
advantage, and to exercise and enjoy jointly any powers, privileges or au-
thority exercised or capable of being exercised by one Public Agency of this
state or private agencies for the joint or cooperative action; and
WHEREAS, Iowa Code Sections 331.555 and 384.21 (1987 as amended) empowers
Cities, City Utilities and Counties to invest their moneys pursuant to a
joint investment agreement, and
WHEREAS, the City of Iowa City desires to adopt and enter into the Joint
Powers Agreement and Declaration of Trust, and it is in the best interest of
the City of Iowa City to participate in the Iowa Public Agency Investment
Trust for the purpose of joint investment of moneys with other cities, city
utilities and counties to enhance investment earnings occurring to each.
NOW, THEREFORE, BE IT RESOLVED:
Section 1. The Joint Powers Agreement and Declaration of Trust is approved
and adopted. The City of Iowa City shall join with the other public agencies
in accordance with the Joint Powers Act by becoming a Participant of Trust.
The Joint Powers Agreement and Declaration of Trust shall be filed in the
minutes of the meeting at which this resolution is adopted. The authorized
officials of the City of Iowa City are directed and authorized to take such
actions and execute any and all such documents as may be deemed necessary and
appropriate to effect the entry of the City of Iowa City into the Declaration
of Trust and adoption thereof by the City of Iowa City and to carry out the
intent and purpose of this resolution.
Section 2. The City of Iowa City is hereby authorized to invest its avail-
able moneys from time to time and to withdraw such moneys from time to time
in accordance with the provisions of the Joint Powers Agreement and Declara-
tion of Trust. The following officers and officials of the City of Iowa City
and their respective successors in office each hereby are designated as
"Authorized Officials" with full power and authority to effectuate the in-
vestment and withdrawal of moneys with the City of Iowa City from time to
time in accordance with the Joint Powers Agreement and Declaration of Trust.

The Trust shall be advised of any changes in authorized officials in accor-
dance with procedures and established by the Trust.
Section 3. The Trustees of the Trust are hereby designated as having offi-
cial custody of the City of Iowa City's moneys which are invested in accor-

Section 4. Authorization is hereby given for officials of the City of Iowa
City to serve as Trustees of the Trust from time to time if selected as such

Re: The Iowa Public Agency Investment Trust (IPAIT)
The Iowa Public Agency Investment Trust (IPAIT) is a cooperative venture of
the League of Iowa Municipalities, Iowa State Association of Counties and the
Iowa Association of Municipal Utilities and was established in October, 1987.
It is governed by a nine -member board appointed by the three associations
from officials of the participating public agencies. The purpose of IPAIT is
to provide a safe, convenient vehicle for pooling funds and to increase
investment earnings for Iowa's cities, counties and city utilities. The
diversified and professionally managed investments are limited to those
permitted under Iowa law. The larger denominations of funds and the
increased length of time that pooled money can be invested creates the envi-
ronment for higher yields that can be realized by individual public agency
units.
IPAIT has selected Norwest Bank of Des Moines as the depository for the trust
funds. The automated clearing house (ACH) allows cities to move money to and
from the trust by telephoning Norwest staff who will complete the transaction
as of the next business day. Cities may also wire money directly to or from
the trust account for "same day" transactions. No fees are charged for these
transactions.
In reviewing the yields offered by these funds, we find that they are consis-
tently a minimum of 150 basis points above the current short-term investments
available to the City at this time with the advantage of allowing the City to
invest or withdraw these funds upon request. This allows the City to meet
cash flow needs without any loss of interest income.
We recommend that the City of Iowa City participate in the IPAIT based on the
safety, competitive rate of returns, liquidity and no transaction cost fea-
tures of the trust. The Council must approve a resolution authorizing- a 28E
Agreement for the City's participation before staff may invest available City
monies in the investment trust. We will be at your Council meeting on Janu-
ary 12, 1988, to answer any questions you may have on the recommendation.

RESOLUTION AUTHORIZING APPLICATIONS FOR 62 SECTION 8 EXISTING HOUSING
UNITS (VOUCHERS OR CERTIFICATES) AND REQUESTING FUNDS.
WHEREAS, the City Council of the City of Iowa City functions as the Iowa City
Housing Authority and the Department of Housing and Urban Development has
Published a Notice of Funding Availability; and
WHEREAS, the Iowa City Housing Authority presently has contracts with the
Department of Housing and Urban Development to administer the Section 8
Existing Housing Program contract kKC9033 and HKC9033V and wishes to expand
those programs.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF IOWA CITY, IOWA:
I. That the Mayor and City Clerk are hereby authorized and directed to
