Comment: JCCOG will be completing Iowa City
Transit's FY89 State Transit Assistance applica-
tion in February. In accordance with Iowa DOT
administrative rules, a public hearing must be
held on the application, and a notice published at
least 30 days prior to the hearing. The hearing
will be held at the March 8, 1988, City Council
meeting.

ITEM NO. 4 - PLANNING AND ZONING NATTERS.
Consider setting a public hearing for February 9, 1988,
on an ordinance to rezone Lots 20, 21, 50-54 Bailey &
Beck's Addition and the former Howard Street
right-of-way, property on Highway 1 West formerly owned
by the Iowa Department of Transportation, from RS -8 and
P to CI -1.
Comment: The Planning and Zoning Commission, at its
meeting of January 20, 1988, recommended by a vote of
6-0 approval of a request submitted by the Iowa City
Landscaping Co. to rezone the former site of the Iowa
DOT maintenance facility from RS -8 and P to CI -1,
Commercial Intensive. This recommendation is consis-
tent with that of the staff. Expedited consideration
of this 99ppplication has been requested.

b. Consider setting a public hearing for February 9, 1988,
on an amendment to the Zoning Ordinance to permit
canopies over gas pumps in the required front yard.
Comment: At its January 20, 1988, meeting, the Plan-
ning and Zoning Commission recommended, by a vote of
6-0, approval of an ordinance amendment to permit
canopies over gas pump islands to be placed in the 20
foot front yard setback on commercial properties. This
recommendation is consistent with that of the staff.

Public hearing on an ordinance regarding storage of
special vehicles.
Comment: At its December 3, 1987, meeting, the Plan-
ning and Zoning Commission recommended by a vote of 4-2
(Dierks and Clark voting no) that amendments to the
Zoning Ordinance providing for the storage of special
vehicles in residential zones be approved. This ordi-
nance amendment was recommended to the Commission by
the Special Vehicles Committee. The Committee was
formed in June 1987 after a controversy arose in re-
sponse to a proposed ordinance to restrict the storage
of special vehicles. Due to constraints on informal
Council meeting time, this hearing should be continued
to February 23, 1988.

d. Public hearing on an ordinance to amend portions of the
Zoning Ordinance regarding off-street parking require-
ments.
Comment: After having worked with the off-street
parking design standards for nearly five years, the
staff proposes four amendments to clarify provisions of
the Ordinance and to adapt the standards to current
vehicle dimensions. The amendments address the general
applicability of the standards, the size of a standard
parking space, the minimum width of a driveway, and the
percentage of compact spaces allowable. The Planning
and Zoning Commission recommended approval of these
amendments by a vote of 5-0 at their December 17, 1987,
meeting. A memorandum from the Planning staff is
attached to the agenda.

Consider an ordinance to rezone an approximate 1.8 acre
�a tract located east of Boyrum Street and north of Olym-
pic Circle from I-1, General Industrial, to CI -1,
Intensive Commercial. (passed and adopted)
Comment: Southgate Development Company has submitted a
request to rezone this property from I-1 to CI -1 to
allow conversion of existing buildings on the tract for
office use, a use not permitted in the 1-1 zone. The
Planning and Zoning Commission recommended approval of
this application at their January 7, 1988, meeting by a
vote of 5-0. The Commission's recommendation is con-
sistent with that of the staff. A public hearing was
held January 12, 1988; no comments were received.

g. Consider an ordinance to rezone from RS -5 to RS -8
property located at 612 and 620 Kirkwood Avenue and
from P to RS -8 property located at the corner of
Kirkwood Avenue and Dodge Street. (passed and
adopted)
Comment: At its November 19, 1987, meeting, the Plan-
ning and Zoning Commission recommended, by a vote of
6-0, approval of a request to rezone the site of the
old Kirkwood Schoolhouse from P to RS -8. The Commis-
sion also recommended approval of the rezoning of two
adjacent properties, west of the schoolhouse, from RS -5
to RS -8. These recommendations are consistent with
that of the staff. No comments were received at a

Consider an ordinance to vacate a portion of Clinton
Street abutting the site of the National Guard Armory.
(passed and adopted)
Comment: The Planning and Zoning Commission recom-
mended at its November 19, 1987, meeting, by a vote of
6-0, vacation of a portion of Clinton Street
right-of-way. The National Guard has requested the
vacation to permit lease of the property by the Guard
for additional parking. The recommendation of the
Commission is consistent with that of the staff. No
comments were received at the December 22, 1987, public
hearing.

Consider a resolution adopting an addendum to the 1983
Comprehensive Plan Update which addresses development
proposals out of sequence with the growth management
policy espoused in the Comprehensive Plan Update.
Comment: At its December 3, 1987, meeting, the Plan-
ning and Zoning Commission recommended, by a vote of
6-0, to approve a proposed amendment to the 1983 Com-
prehensive Plan Update which would allow the develop-
ment of a tract of land out of phase with the
development sequence adopted for the City, provided the
out of sequence development approximates the efficiency
of development upon which the City's growth management
policy is based. A public hearing was held January 12,
1988; comments were received from three residents of
Rohret Road objecting to the amendment to the Compre-
hensive Plan and the change in land use designation of
Southwest Estates. /

8�5 Plan Update to reclassify the land use designation of a
tract known as Southwest Estates which is located
within the corporate limits of Iowa City, north of
Rohret Road and east of Slothower Road from Agricul-
ture/Rural Residential to Residential at a density of
2-8 dwelling units per acre.
Comment: By a vote of 6-0, the Planning and Zoning
Commission, at its December 3, 1987, meeting, recom-
mended approval of the request to reclassify the land
use designation of Southwest Estates in the context of
the proposed amendment to the Comprehensive Plan Update
which addresses out of sequence development.

k. Public hearing on an ordinance to rezone 84.73 acres
known as Southwest Estates from ID -RS, Interim Develop-
ment/Single-Family Residential, and RR -1, Rural Resi-
dential to RS -5, Low Density Single -Family Residential,
subject to conditions. (Z-8703)
Comment: At its December 3, 1987, meeting, by a vote
of 6-0, the Planning and Zoning Commission recommended
approval of an application submitted by Frank Eicher to
rezone the subject tract from ID -RS and RR -1 to RS -5
subject to the condition that all costs associated with
that development, including costs typically subsidized
by the City, will be paid by the developer; costs
customarily paid by the City may be recouped at such
time as either (a) intervening development between
Hunter's Run Subdivision and Southwest Estates is
substantially complete, but not before 1998, or (b) the
growth management policy for the southwest area is
amended such that development of Southwest Estates is
regarded as being in sequence with that development
policy. This recommendation is consistent with the
Comprehensive Plan amendment recommended by the Commis-
sion. This hearing is deferred from January 12, 1988.
In a letter dated January 14, 1988, the applicant
requests expedited consideration of this rezoning
request.

Comment: At their regular meeting of January 7, 1988,
the Planning and Zoning Commission recommended by a
vote of 5-0 approval of a 238 foot extension of Weeber
Street. No development is proposed at this time. The
street extension resolves a legal dispute between two
private parties. The staff concurs with the Commis-
sion's recommendation.

n. Consider a resolution approving the preliminary Large
�R l� Scale Non -Residential Development (LSNRD) plan for
Metro Pavers, Inc., a 7.33 acre contractor yard and
concrete batch plant located 1722 Stevens Drive.

Comment: Metro Pavers, Inc, requests approval of the
preliminary LSNRD plan to permit expansion of an exist-
ing office building, enclosure of two existing concrete
batch mix plants, construction of a covered, unenclosed
structure to shelter construction materials and/or
equipment and construction of a four -car garage. The
plan notes that, until provisions are made on the site
to increase the water supply available for firefighting
purposes, no structures other than the batch plant
enclosures are to be constructed. In a report dated
August 20, 1987, and a memorandum dated January 15,
1988, staff recommends approval of the preliminary
plan. The Planning and Zoning Commission, at its
January 20, 1988, meeting, recommended approval of this
application by a vote of 6-0.

ITEM NO. 5 - PUBLIC HEARING TO RECEIVE CITIZEN COMMENTS ON THE REVISED
TENANT ASSISTANCE POLICY FOR THE IOWA CITY RENTAL REHABILI-
TATION PROGRAM.
Comment: The Tenant Assistance Policy has been revised to
clarify landlords' responsibilities regarding temporary or
permanent displacement of tenants. The Committee on Commu-
nity Needs (CCN) has also recommended that certain single,
non -elderly, low-income tenants be eligible for Section 8
housing assistance vouchers provided by HUD in conjunction
with the Rental Rehabilitation Program. The Housing Commis-
sion and the Assisted Housing Coordinator are opposed to
this recommendation. The revised Tenant Assistance Policy
is enclosed in the Council packet together with a memo
explaining the issues.

ITEM NO. 11 - RECOWENDATIONS OF BOARDS AND COMMISSIONS.
a. Consider recommendation of the Design Review Committee
that the City Council approve the awning proposal for
the Lenoch and Cilek Mall Project, 130 South Dubuque
Street.
Comment: As part of the project to subdivide first
floor space in the Lenoch and Cilek Building, a new
awning is proposed for the south entrance. Because
this awning will extend into City Plaza airspace, the
proposal was reviewed by the Design Review Committee at
its AQW%eeting. The awning will be fabric, rec-
tangular in shape and a teal blue/green color to match
the new trim. Council should act on this recommenda-
tion by motion. (A copy of the plan is available for
your review at the City Clerk's office until January
27.)

b. Consider recommendations of the Broadband Telecom-
munications Commission:
(1) That the Council add $300 to line item 6130 to
support a special population training program to
be conducted in conjunction with the (CPC's)
regular access video training workshop.
(2) That the Council approve the FY89 cable TV budget,
as revised.
(3) That the cable TV budget remain as proposed and
that any needed funds to pay City/Heritage lawsuit
court fees be sought outside the approved current
line items.
Comment: These items will be addressed by the
City Council during the budget process.

has agreed to provide to the City of Iowa City a maximum of
$40,000 in United States Department of Housing and Urban

tions on the part of the City in regard to maintaining the

DIVISION 3, 'ICE AND SNOW REMOVAL' OF THE CODE OF ORDI-
NANCES OF THE CITY OF IOWA CITY, IOWA, BY ADDING THERETO A
NEW SECTION TO BE CODIFIED AS SECTION 31-124, PROVIDING
REGULATIONS FOR THE REMOVAL OF SNOW AND ICE FROM PRIVATE
PROPERTY. (second consideration)
Comment: The City is often confronted, after heavy snows
such as have recently occurred, with complaints of abuses
in the removal of snow from private property. These com-
plaints usually involve individuals who remove snow and ice
from their property and deposit it on adjacent properties
or streets in an irresponsible manner, creating hazards and
hardships for adjacent property owners or for those at-
tempting to travel those streets. This ordinance puts into
effect some common sense regulations regarding where pri-
vate property owners may deposit snow and ice removed from
their properties.
