Recommended approval of Z-8711, a request submitted by Iowa City Land- scaping to rezone a 1.32 acre parcel located at the intersection of Highway 1, Hudson Avenue and Miller Avenue from P, Public Zone, and RS -8, Medium Density Single Family Residential Zone, to CI -1, Intensive Commer- cial Zone. 2. Recommended approval of an amendment to Section 36-68 of the Zoning Ordi- nance to allow unenclosed gas pump canopies as permitted obstructions in required yards. 3. Recommended approval of S-8716, an application submitted by Metro Pavers, Inc., for approval of a preliminary Large Scale Non -Residential Develop- ment (LSNRO) plan for property located at 1722 Stevens Drive. CALL TO ORDER: In the absence of Chairperson Scott, Commissioner Dierks called the meeting to order at 7:35 PM. PUBLIC DISCUSSION OF ANY ITEM NOT ON THE AGENDA: There was no public discussion. CONSIDERATION OF THE MINUTES OF JANUARY 7, 1988: Cooper moved to approve the minutes of January 7, 1988. Cook seconded the motion. The motion carried 5-0-1, with Wallace abstaining due to her absence at the January 7 meeting. ZONING ITEMS: 1. Z-8711. Public discussion of a request submitted by Iowa City Landscap- ing of rezone a 1.32 acre parcel located at the intersection of Highway " 1, Hudson Avenue and Miller Avenue from P, Public Zone, and RS -B, Medium Density Single Family Residential Zone, to CI -1, Intensive Commercial Zone. (45 -day limitation period: January 29, 1988.) Beagle reported that staff had nothing further to add concerning this item since presentation of the staff report on January 7, 1988. /7G Planning and Zoning Commission January 20, 1988 Page 2 Clark asked whether consideration had been given to prohibit parking altogether on Miller Avenue or possibly just within the commercial area. Beagle replied no since Miller and Hudson are designed as residential streets the parking provides a constraint on through traffic and if this were eliminated the streets may be used more as collector streets between Benton Street and Highway 1. Clark asked where the curb cut is to be on Miller Avenue. Larry Schnittjer of MMS Consultants stated that they would by 74' from the pavement edge of Highway 1. Commission discussed the parking lot layout and the position of curb cuts. Wallace moved to approve item Z-8711, a request to rezone a 1.32 acre Parcel from P, and RS -8, to CI -1. motion carried, 6-0. Cooper seconded the motion. The 2. Z-8712. Public discussion of a City -initiated application on behalf of Johnson County Ambulance Service to rezone property located at 808 S. Dubuque Street from CI -1, Intensive Commercial Zone, to P, Public Zone. (45 -day limitation period: February 11, 1988.) Beagle reported that the site of Fisher's Auction Service at 808 S. Dubuque Street was recently purchased by Johnson County to transfer the location of their ambulance service from 719 S. Capitol Street. Section 36-30 of the zoning ordinance indicates that any land which is owned or otherwise controlled by a government entity will be designated a public zone (P). Land which is acquired by a government entity must, there- fore, be rezoned to P in accordance with the procedures of Section 36-88. The site is part of an established intensive commercial area south of downtown. Surrounding land use patterns reflect the intensive commercial nature of the uses permitted in the CI -1 zone. Staff does not anticipate that the operation of an ambulance service will conflict with or be incompatible with the nature of surrounding property. The ambulance service does not anticipate any major changes to the property and the existing building will be retained. Staff recommends the proposed rezon- ing of 808 S. Dubuque Street from CI -1 to P be approved. Wallace asked what happens to the present site of the ambulance service considering that it is not currently zoned Public as it should be. Beagle replied that technically any property acquired by a governmental entity, such as 808 S. Dubuque Street, must be zoned P. Beagle said he does not have sufficient information concerning 719 S. Capitol, but that if it is owned by Johnson County it should be zoned P. Boyle replied that the property at 719 S. Capitol would be considered non -conforming. David P. Cole, Director of Johnson County Ambulance Service, addressed the Commission and stated that they will be sending a letter to Council requesting expedited consideration since they will have to halt their renovation plans until the rezoning is approved. Cook commented that he is concerned over the reduction of taxable property in the City and this is the reason for his concern over the outcome of the old facility and the land it sets on. Mr. Cole replied that Johnson County may be remod- eling the existing facility at 719 S. Capitol to provide a facility for a /76 Planning and Zoning Commission January 20, 1988 Page 3 hazardous response team required under the Department of Civil Defense. Mr. Cole went on to say that in any case, Johnson County will be holding on to the property at 719 S. Capitol. Clark asked why Johnson County was concerned about expediting the rezoning of the property. Mr. Cole re- plied that at the present time a backup ambulance sits outside which creates a much longer response time if this ambulance is needed it must be warmed up and stocked. A second reason is that the new facility will allow for a classroom in which to teach CPR. Clark responded that the Commission may want to recommend to the Council that this item be expediated to the extent possible. Commission members discussed the possibility of sending the item on to Council at this meeting as opposed to deferring it for a second public meeting as is Commission policy. Beagle said the Commission could devi- ate from this policy if they felt conditions warranted it. Boyle indi- cated that no time would be gained by the applicant if the Commission acted tonight because the Council schedule was already set for January 26. The next available agenda of the City Council is on February 9 which is when this item would appear even if the Commission allowed for addi- tional public input at the February 4 meeting. Bearing this in mind, Dierks said that she would prefer not deviating from the Commission's Policy of holding two public meetings on rezoning requests. Cooper moved to defer item Z-8712 to the Planning and Zoning Commission meeting of February 4, 1988. Cook seconded the motion. The motion carried, 6-0. Public discussion of an amendment to Section 36-68 of the Zoning Ordi- nance to allow unenclosed gas pump canopies as permitted obstructions in required front yards. Beagle reported that the proposed ordinance amendment is in response to a number of requests for special exceptions to modify or eliminate the front yard requirement in commercial zones to permit the construction of unenclosed canopies over gas pump islands. The staff and the Board of Adjustment have consistently found the construction of such canopies to be compatible with the public interest and have little or no effect on adjacent properties. Since it appears to be the case that these types of canopies are consistent with the intent of the Zoning Ordinance to keep the front yard free of obtrusive structures and they have a negligible impact on sight distances, the staff recommends that the proposed ordi- nance amendment be approved. Wallace moved to approve the proposed amendment to Section 36-68 to allow unenclosed gas pump canopies as permitted obstructions in required front yards. Clark seconded the motion. The motion carried 6-0. DEVELOPMENT S-8716. Public discussion of an application submitted by Metro Pavers, Inc., for approval of a preliminary Large Scale Non -Residential Develop- ment (LSNRD) plan for property located at 1722 Stevens Drive. /i` V w Planning and Zoning Commission January 20, 1988 Page 4 Beagle reported that consideration of the preliminary LSNRD plan for Metro Pavers, Inc, has been deferred since September 3, 1987, pending identification and approval by the City Fire Department, of a water source on the Metro Pavers site for firefighting purposes. The applicant and the City have discussed this issue and based on information presented to the City regarding materials that are expected to be housed in the batch plant enclosures, the Fire Department agrees that the two cementitous batch/mix plant enclosures proposed for the site may be constructed without provisions for additional water sources on the site. Two notes have been added to the plan specifying that "No structures, other than the Batch Plant Enclosure(s) are to be constructed without written approval from the Iowa City Fire Chief" and "No warehousing of flammable or hazardous substance shall be allowed within the Batch Plant Enclosure(s). An additional note has been added to the plan pertaining to the desire of the Riverfront Commission to retain existing natural vegetation along the east side of the Iowa River for the property owned by Metro Pavers. Clark moved to approve item S-8716, a preliminary Large Scale Non -Residential Development (LSNRD) plan for property located at 1722 Stevens Drive. Wallace seconded the motion. The motion carried, 6-0. OTHER BUSINESS: 1. Planning and Zoning Commission Information Beagle reported that an informal budget meeting of the City Council for Boards and Commissions will be held at 7:15, Monday the 25th. All Board and Commission members are invited to take part. Commissioner Cooper commented that the governmental affairs meeting was attended by himself, Commissioner Cook and Senior Planner Karin Franklin; the meeting discussed the airport budget. MEETING TO ORDER: 9:03 a.m. MINUTES: Minutes of December 8, 1987, were approved on a motion by Moore, seconded by Parden, carried 5-0. AMENDMENT TO HOUSING REHAB MANUAL: Milkman presented changes to the Housing Rehab Manual that include provisions for residential facilities to be included with the City's overall Housing Rehabilitation Program. In addition further explanation of "Emergency Repair" in regard to roofs was included, as well as adding the statements regarding applicant's income between 80-100% and the maximum loan amounts. Milkman stated that there will be a public hearing on 1-26-88 to discuss the revised Tenants Assistance Policy for the Rental Rehabilitation Program. The revisions deal with landlord responsibilities in cases of displacement of tenants and also eligibility for low-income single, non-elderly/handi- capped/disabled persons to be issued a Section 8 Certificate/Voucher in support of the Rental Rehab Program. HUD regulations state the local PHA (City Council) may decide to issue cer- tificates/vouchers to income -eligible, non-elderly/handicapped/disabled persons in the rental rehab program. Such single persons are not eligible for assistance under the Assisted Housing Program. CCN has recommended that up to 25% of the rental rehab certificates/vouchers be allocated for these persons. The Housing Commission is opposed to this recommendation. COORDINATOR'S REPORT: Seydel presented revised Fair Market Rents which became effective 12-21-87. He also stated that a Public Hearing is set for 2-9-88 requesting an addi- tional r rental rehab program.
