WHEREAS, the City Council has established a classification/compensation plan for AFSCME employees; and WHEREAS, the classification plan of the City of Iowa City was established and is maintained to reflect through job classification and compensation the level of job duties and responsibilities performed. WHEREAS, the City of Iowa City did on June 17, 1986, enter into a contract with Metcalf & Eddy, Inc. (%E), entitled "AGREEMENT BETWEEN THE CITY OF IOWA CITY AND METCALF & EDDY, INC. FOR PROFESSIONAL ENGINEERING AND PRO- FESSIONAL MANAGEMENT SERVICES (hereinafter "the Contract"), pursuant to which Contract M&E agreed to design certain improvements to the City's wastewater collection and treatment system, to manage the construction of said improvements, and to provide overall project management services to assure that the system would meet Federal and State wastewater discharge requirements within the timeframes specified by Federal and State regula- Departmtory eral Resourcesnmental (IDNR)) as settion forth and Iowain Agency iche(MaA) Project Schedule, Section 3 of the Contract; and WHEREAS, pursuant to Resolution No. 88-28, adopted on February 9, 1988 and thereafter served upon Metcalf & Eddy, Inc. NE), this City Council declared a default by M&E in its performance of its obligations under said Contract and demanded the cure thereof by M&E by execution of an Addendum to the Contract; and WHEREAS, M&E has failed to execute the Addendum to the Contract as re- quested by the City; and WHEREAS, M&E's default in the performance of its contractual obligations remains uncured; and WHEREAS, unless M&E executes the Addendum to the Contract thereby agreeing to bring its performance into closer conformance with Contract require- ments, this City Council intends to terminate its C ontract with M&E. NOW, THEREFORE, BE AND IT IS HEREBY RESOLVED CITY OF IOWA CITY, IOWA, that it does hereby nate its Contract with M&E if M&E does not Contract as heretofore requested.
