RESOLUTION ACCEPTING THE WORK FOR SANITARY SEWER, STORM SEWER AND PAVING
IMPROVEMENTS FOR CERTAIN LOTS IN THE TY'N CAE SUBDIVISION, PART THREE
WHEREAS, the Engineering Division has certified that the following
improvements have been completed in accordance with the plans and specifications
of the City of Iowa City:
Sanitary sewer and storm sewer improvements for lots 84-95, 96C, 96D,
and 96E of Ty'n Cae Subdivision, Part 3 as constructed by H.D. Knowling
Co. of Iowa City, Iowa.
Paving improvements for lots 84-95, 96C, 960, and 96E of Ty'n Cae
Subdivision, Part 3 as constructed by Metro Pavers, Inc. of Iowa City, Iowa.
AND WHEREAS, maintenance bonds have been filed in the City Clerk's office,
NOW THEREFORE BE IT RESOLVED by the City Council of Iowa City, Iowa, that

WHEREAS, the City Council approved the preliminary LSNRD plan for Phases VI
through IX of Millard Warehouse on August 12, 1986, which is effective for a 24 -
month period or until August 12, 1988; and
WHEREAS, the City Council is empowered to extend the expiration date of said
preliminary LSNRD plan for an additional twelve months upon written request of
the applicant, pursuant to Chapter 27-39 of the Iowa City Municipal Code; and
WHEREAS, the City has received such request; and
WHEREAS, no new regulations pertinent to this development have been adopted
since the 1986 approval, and circumstances in the area of the proposed
development are unchanged.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA
CITY, THAT:
The expiration date for approval of the Large Scale Non -Residential Development

RESOLUTION NO. 89-66
RESOLUTION PROPOSING TO CONVEY A PORTION OF A VACATED ALLEY IN
BLOCK 46 IN EAST IOWA CITY, AN ADDITION TO IOWA CITY, IOWA.
WHEREAS, by Ordinance No. 2283 adopted on May 5, 1964, the City of Iowa
City vacated the following described alley:
Alley in Block 46 in East Iowa City Addition; and
WHEREAS, the City of Iowa City, Iowa, executed a quitclaim deed in favor
of John J. Reiland and Ella M. Reiland on July 31, 1964, for a portion of
the vacated alley described as follows:
The alley running in a North-South direction in Block
Forty-six (46) in east Iowa City, Iowa, an addition to
Iowa City, said alley being located between Lots 5, 6
and 7 and Lots 4 and 9 in said Block Forty-six (46) in
east Iowa City, an addition to Iowa City, Iowa,
according to the recorded plat thereof, and
WHEREAS, this quitclaim deed was subsequently recorded, but since no
authorizing resolution could be found, in 1971 the City Council, by
Resolution No. 71-440, authorized the disposal of a portion of the vacated
alley but described the property as:
Alley in Lot 6-7-8 Block 46 East Iowa City, according
to the Plat, and,
WHEREAS, no new quitclaim deed was executed pursuant to the 1971
resolution, or if any were executed, it has not been recorded; and
WHEREAS, because a title objection was again lodged in 1976, the City
Council, by Resolution No. 76-370, again authorized conveyance to the
Reilands of the property originally described in the 1964 resolution,
namely:
The alley running in a North-South direction in Block
Forty-six (46) in east Iowa City, Iowa, an addition to
Iowa City, Iowa, said alley being located between Lots
Five (5) Six (6), and Seven (7) and Lots Four (4) and
Nine (9) in said Block Forty-six (46) in east Iowa
City, an addition to Iowa City, Iowa, according to the
recorded plat thereof, and
WHEREAS, title objection concerning the above-described transactions has
now been lodged because both the 1964 quitclaim deed and 1976 resolution
omitted Lot 8 from the legal description of said property; and
WHEREAS, it is in the public interest to consummate conveyance of these
portions of the vacated alley and to clear this title objection; and
WHEREAS, the City shall retain any and all sanitary sewer and other
easements thereon which inure to the benefit of the City of Iowa City; and
WHEREAS, no consideration is required at this time since the purpose of
this Resolution is to clear the title objection, and

WHEREAS, the current title holder of Lots 7 and 8 and the south 10 feet of
Lot 6 of said Block 46 as well as the portion of said vacated alley
adjacent to said lots are Robert L. Woodburn and Mary Ann Woodburn; and
WHEREAS, a public hearing on the proposed conveyance was held on the21
day of _ March 1989, at 1:30 p.m. in the Council Chambers
at the Civic Center, 410 East Washington Street, Iowa City, Iowa.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA
CITY, IOWA:
1. That the Mayor is hereby authorized to sign and the City Clerk to
attest, for title correction purposes, a quitclaim deed to Robert L.
Woodburn and Mary Ann Woodburn for that portion of said vacated alley
adjacent to said Lots 7 and 8 and the south 10 feet of Lot 6 and
described as follows:
Commencing at the Southeast corner of Lot Eight (8) in
Block Forty-six (46), in East Iowa City, Johnson
County, Iowa, according to the recorded plat thereof,
thence North 170 feet, thence East 10 feet, thence
South 170 feet, thence West 10 feet to the place of
beginning.
2. That conveyance of this quitclaim deed is not intended to include any
conveyance of easements for sanitary sewer or other public purposes,
whether or not of record; and that such easements continue to inure
to the benefit of the City of Iowa City; and
3. That the Mayor is authorized to sign and the City Clerk to attest
this Resolution.

RESOLUTION NO. 89-67
RESOLUTION APPROVING A PLAN FOR PROJECTS AT THE DOMESTIC VIOLENCE INTERVENTION
PROGRAM, EMERGENCY HOUSING PROJECT, AND YOUTH HOMES, INC. THAT ARE PROPOSED FOR
IOWA EMERGENCY SHELTER GRANTS PROGRAM FUNDING.
WHEREAS, the State of Iowa has created the Iowa Emergency Shelter Grants Program which
utilizes United States Department of Housing and Urban Development funding for the purpose
of providing shelter services for homeless people in Iowa; and
WHEREAS, the City of Iowa City deems it in the public interest to support services for
homeless people in Iowa City; and
WHEREAS, the Domestic Violence Intervention Program, Emergency Housing Project, and Youth
Homes, Inc. are agencies which provide emergency shelter and related assistance to homeless
adults and children in Iowa City; and
WHEREAS, the Iowa State Department of Economic Development has agreed to consider proposals
for Iowa Emergency Shelter Grants Program funding submitted by agencies which provide shelter
services only when such proposals are approved by the unit of local government.
NOW, THEREFORE, BE AND IT IS HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY,
IOWA:
1. That the Plan of Projects Proposed for Iowa Emergency Shelter Grants Program Funding
attached hereto, and made a part hereof, is hereby approved;
2. That the Mayor is hereby authorized to endorse requests for Iowa Emergency Grants
Program funding which are based upon the Plan of Projects approved above and are
submitted by the Domestic Violence Intervention Program, Emergency Housing Project,
and Youth Homes, Inc.

Re: Iowa Emergency Shelter Grants Program Proposals
The rules that govern applications for Iowa Emergency Shelter Grants Program
(IESGP) funding have changed. For the first round of IESGP funding (July, 1987
to June, 1988) only cities with populations of more than 10,000 were eligible
applicants. Iowa City was awarded a total of $20,600.00 first round IESGP
funding for the Domestic Violence Project ($4,070.00), Emergency Housing Project
($8,290.00), and Youth Homes, Inc. ($8,240.00). For the second round of IESGP
funding (January to December, 1988), counties as well as cities of more than
10,000 population were eligible applicants. Iowa City was awarded a total of
$40,000.00 second round IESGP funding for the Domestic Violence Project
($12,500.00) and Emergency Housing Project ($27,500.00), and Johnson County was
awarded $40,000.00 for Youth Homes, Inc.
Applications are now being accepted for third round IESGP funding. For the first
time, agencies which provide shelter services are eligible to apply for this
funding directly if their proposals are approved by the local units of
government. Representatives of the Domestic Violence Intervention Program,
Emergency Housing Project, and Youth Homes, Inc. have developed the attached Plan
of Projects Proposed for Iowa Emergency Shelter Grants Program Funding which is
presented for your approval. The proposed projects would significantly improve
the services offered to homeless people in our community. It is important to
remember that expenses which are eligible for this grant funding are restricted.
For example, IESGP funding may not be used to purchase buildings for use as
shelters. The attached Plan includes only eligible activities.
The IESGP has already provided $100,600.00 to support services for homeless
persons in our community. It is hoped that your approval and support will enable
these agencies to secure additional funds to enhance their important activities.
If you have any questions or concerns about the proposed projects or about any
aspect of the IESGP process, please call me at 356-5242. On April 4, 1989,
representatives of all three agencies and I will attend both the Board of
Supervisors' informal meeting and the City Council's formal meeting to answer
your questions and to provide additional information as needed. Thank you for
your consideration of these proposed projects.

AN AMENDMENT TO THE ELEVENTH RENEWAL OF
A 28E AGREEMENT BETWEEN IOWA CITY AND JOHNSON COUNTY
FOR TRANSIT SERVICES
WHEREAS, the City Council of the City of Iowa City has determined that it is
necessary and desirable to provide its residents with specialized transit service
for persons with disabilities, and
WHEREAS, the City Council of the City of Iowa City has fulfilled this necessity
and desire through a 28E Agreement with Johnson County for transit services, and
WHEREAS, the City Council has been advised and does believe that it would be in
the City's best interest to increase the hours of said transit service provided
by Johnson County to approximate the hours of transit service operated by Iowa
City Transit, and
WHEREAS, the City Council has been advised and does believe that it would be in
the City's best interest to amend the Eleventh Renewal of said 28E Agreement with
Johnson County to increase the City's contribution to fund said activity during
FY89 from an amount not to exceed $98,000 to an amount not to exceed $143,000.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY,
IOWA:
1. That the "Amendment to the Eleventh Renewal of a 28E Agreement for Transit
Services" between the City of Iowa City and Johnson County is hereby
approved as to form and content;
2. That the Mayor and City Clerk are hereby authorized and directed to execute
and attest, respectively, said amendment for and on behalf of the City of
Iowa City, Iowa;
3. That the City Clerk is directed to file said amendment with the Secretary
of State and the Johnson County Recorder as required by Chapter 28E, Code
of Iowa.

AMENDMENT TO THE ELEVENTH RENEWAL OF A
28E AGREEMENT FOR TRANSIT SERVICES
This Amendment to the Eleventh Renewal Agreement is entered into by and between
Johnson County, Iowa, and the City of Iowa City, Iowa, both municipal
corporations.
Whereas, the parties hereto wish to amend the Eleventh Renewal Agreement for
Transit Services, the original agreement of which is recorded in Book 501 at Page
303 in the Office of the Johnson County Recorder;
Now, therefore, be it agreed by and between Johnson County, Iowa, and the City
of Iowa City, Iowa, as follows:
1. That the Eleventh Renewal term of the 28E Agreement for Transit Services
between Johnson County, Iowa, and the City of Iowa City, Iowa, remains in
effect with the following modifications:
a. Numbered paragraph 2 shall be deleted and replaced as follows: "The
County shall operate the service within the corporate limits of Iowa
City from 6:00 A.M. until 11:00 P.M., Monday through Friday; 6:00
A.M. to 7:30 P.M. on Saturday; and 8:00 A.M. to 2:00 P.M. on Sunday;
except for holidays established by the Johnson County Board of
Supervisors. All specific operational decisions shall be made by
the Board of Supervisors and the SEATS Manager to maximize
responsiveness to demand and productivity.
b. Numbered paragraph 4 shall be deleted and replaced as follows: "For
service operated from 7:00 A.M. to 6:00 P.M. Monday through Friday,
and 8:00 A.M. to 2:00 P.M. on Saturday and Sunday, the City of Iowa
City agrees to pay Johnson County $3.14 per one-way trip for each
Iowa City passenger carried. Total funding for this portion of the
service during FY89 shall not exceed $128,000. All remaining service
shall be charged to the City of Iowa City at a rate of $13.05 per
vehicle hour of service, not to exceed $15,000.
2. In all other respects, the original agreement, as amended, between the
parties remains in full force and effect.
3. This amendment to the Eleventh Renewal Agreement shall be effective April
17, 1989 through June 30, 1989.
4. This amendment to the Eleventh Renewal Agreement shall be filed with the
Secretary of the State of Iowa and the County Recorder of Johnson County,
Iowa.

Re: Contract Amendment: SEATS Service
At the April 4 City Council meeting you will be asked to consider an amendment
to the FY89 contract for SEATS service between Iowa City and Johnson County.
The amendment is to accomplish two purposes:
1. During FY89 Iowa City Transit budget preparation you were apprised that
the $98,000 figure budgeted for SEATS service would not be adequate. It
was decided to wait until an estimation could be made of the additional
funds needed, and then amend the contract with Johnson County SEATS
accordingly. The additional funding needed to maintain service until June
30 is now estimated at $30,000. This amount is available in the FY89 Iowa
City Transit budget due to under spending in other line items.
2. When preparing the FY90 Iowa City Transit budget, you approved an expansion
of SEATS' hours of service to match those of Iowa City Transit. Most
significantly, this implements evening SEATS service for Iowa City
residents. This action is required in order for Iowa City Transit to
maintain compliance with Section 504 of the Federal Rehabilitation Act of
1973.
A state grant is available which will pay 100% of the cost of implementing
the expanded service level between April 17 and June 30. This funding is
only available for this purpose and may not be carried over into FY90.

RESOLUTION ADOPTING THE ANNUAL BUDGET, FY90, ENDING JUNE 30, 1990,
FOR PUBLIC HOUSING PROJECT IA -022003, IA05P022004 AND IA05P022005.
WHEREAS, the City of Iowa City has in effect an annual contributions contract
No. KC9166 for Project IA -022003, IA05P022004 and IA05PO22005, and
WHEREAS, the Department of Housing and Urban Development requires the adoption
of the annual budget and any revision by formal resolution.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY,
IOWA, in its capacity of the City of Iowa City Housing Authority, that:
1. The Budget for the referenced projects as shown on the attached forms be
adopted.
2. The proposed expenditures are necessary in the efficient and economical
operation of the Housing Authority for the purpose of service to low-
income families.

3. The financial plan is reasonable in that:
a. It indicates a source of funding adequate to cover all proposed
expenditures.
b. It does not provide for use of Federal funding in excess of that
payable under the provisions of these regulations.
C. All proposed rental charges and expenditures will be consistent with
provisions of law and the Annual Contributions Contract.
4. The Iowa City Housing Authority is in compliance with Section 207(a) of
the Annual Contributions Contract, which states in part that the Housing
Authority is re-examining the incomes of families living in the project
at least once a year.

The Housing Authority administers 473 units of Section 8 Existing
Certificates, 193 units of Section 8 Existing Vouchers and 62 units of Public
Housing. The current staff is authorized by City Council resolutions 84-286
and 85-66. This same staff provides support for the Housing Commission,
performs studies and„provides administrative time necessary and required in
search of additional units.
All distributions are based on TEN PERCENT (10%) to PUBLIC HOUSING and NINETY
PERCENT (90%) to Section 8 programs. This represents the distribution of
units in these programs, 62 to 666, with a slight weighting toward Public
Housing due to the inherent activity as both rental assistance provision and
landlord responsibility.

RESOLUTION CONDITIONALLY AWARDING AND AUTHORIZING AND DIRECTING THE
MAYOR AND CITY CLERK TO EXECUTE AND ATTEST, RESPECTIVELY, THE
CONTRACT FOR CONSTRUCTION OF THE CORALVILLE/IOWA CITY ANIMAL CONTROL
FACILITY (FRANTZ CONSTRUCTION CO., INC., LOW BIDDER, $325,768.00).
WHEREAS, the cities of Iowa City and Coralville, in recognition of the need to
provide adequate animal control services to their citizens, entered into a
Chapter 28E Agreement for the Development, Use, Occupancy, Management and
Operation of a Joint Animal Control Facility, which Agreement is dated January
12, 1988; and
WHEREAS, pursuant to said Agreement, the City of Iowa City has accepted bids for
the construction of said facility, and has received the recommendation of the
Animal Control Advisory Board that the contract for construction be awarded to
the low bidder, Frantz Construction Co., Inc., including deduct items 2, 3, 6,
8, 11, 13 and 16 as part of the project, for the contract amount of $325,768.00,
which amount is in excess of the engineer's estimate; and
WHEREAS, the City Council has been advised and does believe that the award of
said contract as aforesaid is in the best interests of the City of Iowa City,
Iowa; and
WHEREAS, pursuant to the Chapter 28E Agreement, the City of Iowa City is
required to obtain the concurrence of the City of Coralville in the award of
said contract inasmuch as the contract amount is in excess of the engineer's
estimate for said project.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY,
IOWA:
1. That the contract for the construction of the above-named project is
hereby conditionally awarded to Frantz Construction Co., Inc. of Iowa
City, Iowa, subject to the condition that awardee secure adequate
performance bond, insurance certificates, and contract compliance program

'The Animal Control Building Committee has reviewed the resubmissions
of bids for the new Animal Shelter. We recommend that the cities
award the contract to Frantz Construction, Iowa City, Iowa. The
low bid would be for $325,766. This acceptance would delete items
(shown as deductions on the attached sheets) 4, 5, 7, 9, 10, 12,
14 and 15. From the contract amount $13,703 will be paid for from
the Fnergy Savings Payback Fund.
We feel that this building will provide the cities with a facility
that meets, our existing physical plant shortcomings and will be
efficient to operate in the future.

CORALVILLE-IOWA CITY ANIMAL SHELTER
Sealed proposals will be received by the
City Clerk of the City of Iowa City, Iowa,
until 10:30 A.M. on the 28th day of March,
1989, and opened immediately thereafter by
the City Engineer. Proposals will be acted
upon by the City Council at a meeting to be
held in the Council Chambers at 7:30 P.M.
on April 4, 1989, or at such later time and
place as may then be fixed.
The work will involve the following:
A 3,000 sq. ft. addition to the existing
Iowa City Animal Shelter at Kirkwood and
Clinton, and limited remodeling to the
existing facility. Also included is a ten
car parking lot and a 30 -foot by 73 -foot
fenced outdoor kennel and dog run.
All work is to be done in strict
compliance with the plans and specifica-
tions prepared by J.L. Schoenfelder, City
Architect, of Iowa City, Iowa, which have
heretofore been approved by the City
Council, and are on file for public exami-
nation in the Office of the City Clerk.
Each proposal shall be completed on a
form furnished by the City and must be
accompanied in a sealed envelope, separate
from the one containing the proposal, by
either of the following forms of bid
security: (1) a certified or cashier's
check drawn on a solvent Iowa bank or a
bank chartered under the laws of the United
States or a certified share draft drawn on
a credit union in Iowa or chartered under
the laws of the United States, in an amount
equal to 10% of the bid, or (2) a bid bond
executed by a corporation authorized to
contract as a surety in the State of Iowa,
in a penal sum of 10% of the bid. The bid
security shall be made payable to the
TREASURER OF THE CITY OF IOWA CITY, IOWA,
and shall be forfeited to the City of Iowa
City as liquidated damages in the event the
successful bidder fails to enter into a
contract within ten (10) days and post bond

faithful performance of the contract and
maintenance of said work, if required,
pursuant to the provisions of this notice
and the other contract documents. Checks
of the lowest two or more bidders may be
retained for a period of not to exceed
fifteen (15) days until a contract is

awarded or rejection is made. Other checks
will be returned after the canvass and
tabulation of bids is completed and
reported to the City Council.
Payment to the Contractor will be made
as specified in Division 1- General Condi-
tions; Section AC.
The successful bidder will be required
to furnish a bond in an amount equal to one
hundred percent (100%) of the contract
price, said bond to be issued by a respon-
sible surety approved by the City Council
and shall guarantee the prompt payment of
all materials and labor and protect and
save harmless the City from claims and
damages of any kind caused by the operation
of the contract, and shall also guarantee
the maintenance of the improvement for a
period of one year from and after its
completion and acceptance by the City.
The following limitations shall apply to
this project:

The plans, specifications and proposed
contract documents may be examined at the
Office of the City Clerk. Copies of said
plans and specifications and form of
proposal blanks may be secured at the
Office of Francis K. Farmer, P.E., City
Engineer of Iowa City, Iowa, by bona fide
bidders. Return all plans and specifi-
cations to the City Engineer's office in
good condition within fifteen (15) days
after the opening of the bids. All
questions regarding plans and specifica-
tions shall be referred to Jim
Schoenfelder, City Architect (356-5044,
office located in Civic Center).
Prospective bidders are advised that the
City of Iowa City desires to employ
minority contractors and subcontractors on
City projects.
The Contractor awarded the contract
shall submit a list of proposed subcontrac-
tors along with quantities, unit prices and
amounts before starting construction. If
no minority business enterprises (MBE) are
utilized, the Contractor shall furnish
documentation of all efforts to recruit
MBE's.

Civil Rights Specialist at the Iowa City
Civic Center by calling 319/356-5022.
By virtue of statutory authority, pref-
erence will be given to products and provi-

sions grown and coal produced within the
State of Iowa, and to Iowa domestic labor,
to the extent lawfully required under Iowa
Statutes. The Iowa Reciprocal Preference
Act (SF 2160) applies to the contract with
respect to bidders who are not Iowa resi-
dents.
The City reserves the right to reject
any or all proposals and to waive techni-
calities and irregularities.
