RESOLUTION AUTHORIZING AND DIRECTING THE CITY MANAGER TO NEGOTIATE
AND EXECUTE A PURCHASE AGREEMENT WITH PLEASANT VALLEY ORCHARDS AND
NURSERY, INC. FOR THE PURCHASE OF NURSERY STOCK FOR THE AMOUNT OF
$36,000, ALL IN CONJUNCTION WITH THE OUTFALL SEWER PROJECT.
WHEREAS, the City of Iowa City is engaged in a project to construct the new
South Wastewater Treatment Plant, including an Outfall Sewer therefrom to the
Iowa River; and
WHEREAS, the City has proposed, in conjunction with the construction of the
Outfall Sewer, to acquire a temporary construction easement over certain
property which is owned by Pleasant Valley Orchards and Nursery, Inc.; and
WHEREAS, the real estate upon which the City desires to acquire said temporary
construction easement is now being used by Pleasant Valley as a nursery and is
occupied by nursery stock, as identified in Exhibit A hereto, which will have
to be removed or destroyed to accommodate construction of the Outfall Sewer; and
WHEREAS, the City desires to purchase and remove the said nursery stock
therefrom prior to the completion of the acquisition of the said easement; and
WHEREAS, Pleasant Valley has indicated its willingness to sell said nursery
stock independently of the proceedings to acquire said temporary construction
easement.
NOW, THEREFORE, BE AND IT IS HEREBY RESOLVED that the City Manager be and he is
hereby authorized and directed to negotiate the terms of a Purchase Agreement
for the purchase of the nursery stock identified in Exhibit A hereto for the
amount of $36,000 and, upon approval thereof by the Legal Department, to execute
said Purchase Agreement for and on behalf of the City of Iowa City, Iowa.
AND BE IT FURTHER RESOLVED that upon execution of said Purchase Agreement by the
City and Pleasant Valley, the Director of Finance be and is hereby authorized
and directed to issue a City Warrant in the amount of $36,000 from Fund No.
3327.0-91001 payable to Pleasant Valley Orchards and Nursery, Inc., and to
deliver same to the Legal Department for disbursement.
It was moved by Mrisco and seconded by Horowitz the
Resolution be adopted, and upon roll call there were:
