(1) CONSIDER A MOTION SETrING A PUBLIC HEARING FOR
NOVEMBER 5 REGARDING PROPOSED AMENDMENTS TO IOWA
CITY'S 2001-2006 CONSOLIDATED PLAN (CITY STEPS).
Comment: The U.S. Department of Housing and Urban Development
requires an annual public review of the CITY STEPS plan. The Housing
and Community Development Commission held a public meeting on
October 17, 2002. In addition, public meetings were held at by the Local
Homeless Coordinating Board (October 9, 2002) and by Neighborhood
Centers of Johnson County (October 16, 2002).
~ (2) CONSIDER A RESOLUTION OF INTENT TO CONVEY 656 SOUTH
GOVERNOR STREET TO GARY HUGHES, AND SETTING A PUBLIC
HEARING ON SAID CONVEYANCE FOR NOVEMBER 5.
Comment: The City condemned the property located at 656 South
Governor Street as a public nuisance. The City has entered into a
contract for the sale of the property to Gary Hughes for demolition of the
currently existing structure and construction of a new residential
structure. The contract sale price is $26,000. The contract is contingent
upon formal approval by City Council. This resolution declares the City
Council's intent to convey the above property to Gary Hughes for
demolition of the currently existing structure and construction of a new
residential structure, and sets a public hearin9 on the proposed

707 WALNUT STREET TO EDWIN TEAGLE, AND SE'I-rING A PUBLIC

Comment: The City condemned the property located at 707 Walnut

REGENTS, WITHOUT COMPENSATION, AND SE'I-rING A PUBLIC
HEARING ON SAID CONVEYANCE FOR NOVEMBER 5.
Comment: On October 22, 2002, the City Council will consider final
adoption of two ordinances vacating several small portions of right-of-
way along Front Street between Burlington and Prentiss Streets as well
as the west half of the 100 block of West Prentiss Street, and the
second ordinance vacating the right-of-way comprising the east half of
the 100 block of West Prentiss Street, the 100 Block of West Harrison
Street and the 20' wide alley between the 100 Blocks of West Prentiss
and West Harrison Streets for the purpose of facilitating redevelopment
of the adjacent and subject properties by The University of Iowa. Said
adjacent properties have been acquired by The University of Iowa/Iowa
State Board of Regents for said redevelopment, and as such
redevelopment is by a governmental body for a public purpose, it is
proposed that said property transfer be made without compensation
pursuant to Iowa Code {}364.7(3) (2001). This Resolution declares the
City Council's intent to convey the above vacated right-of-ways to The
University of Iowa/Iowa State Board of Regents without compensation
as allowed by Iowa law, and sets a public hearing on the proposed
conveyance for November 5, 2002.

~3' (1) CONSIDER A RESOLUTION AUTHORIZING THE
MAYOR TO SIGN AND THE CITY CLERK TO Al-rEST A
SANITARY SEWER EASEMENT AGREEMENT FOR
DUCK CREEK CONDOMINUIMS, IOWA CITY, IOWA.
Comment: Pursuant to the site plan for Duck Creek Condominums,
Iowa City, Iowa, a sanitary sewer line was installed to service the
additional development within the subdivision. The proposed Sanitary
Sewer Easement grants the City an easement which follows the area of
the installed public improvement. This Resolution authorizes the
execution of the Sanitary Sewer Easement Agreement necessary for the
City to acquire easement rights for the installed sanitary sewer.
~ (2) CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN
AND THE CITY CLERK TO Al-rEST TO THE RELEASE OF
LIEN REGARDING TWO MORTGAGES FOR THE PROPERTY
LOCATED AT 1507 CROSBY LANE, IOWA CITY, IOWA.
Comment: The owner of the property located at 1507 Crosby Lane
received assistance through the City's Housing Rehabilitation Program
in the amount of $5,781.59. The loans were paid off October 4, 2002;
thus the lien can now be released.

TO SIGN AND THE CITYCLERK TO ATTEST TO THE
RELEASE OF LIEN REGARDING AN ADDENDUM, A
REHABILITATION AGREEMENT, A PROMISSORY NOTE, LOW
INTEREST LOAN, AND A MORTGAGE FOR THE PROPERTY
LOCATED AT 814 BOWERY STREET, IOWA CITY, IOWA.
Comment: The owner of the property located at 814 Bowery Street
received assistance through the City's Rental Rehabilitation Program
totaling $16,875. The financing was in the form of a Iow interest loan.
The loan has been paid off; thus the lien can now be released.
(4) CONSIDER A RESOLUTION ACCEPTING THE WORK FOR
THE FIRST AVENUE CORRIDOR IMPROVEMENTS PROJECT.
Comment: This project has been completed in substantial accordance
with plans and specifications. The Engineer's Report and Performance
and Payment bonds are on file with the City Clerk.

a. Consider a motion setting a public hearing for November 5 on an ordinance
amending Title 14 Entitled 'Unified Development Code,' Chapter 6, Entitled
'Zoning,' Article U, entitled 'Administration and Enforcement,' Section 7
Entitled 'Violations and Penalties' To Increase the Municipal Infraction Civil
Fines for Violating the 70ning Code.
Comment: At its October 3 meeting, by a vote of 7-0, the Planning and
Zoning Commission recommended approval of amendments to the Zoning
Code to provide that a penalty of $250 be assessed against the property
owner/tenant/landlord for the first offense, $500 for the second violation and
$750 for the third violation of the Zoning Code. This ordinance enacts one
of the recommendations of the Neighborhood Housing Relations Task
Force.

to vacate the northern 2' of Benton Street beginning 60' east of Gilbert
Street and ending at Maiden Lane. (VAC02-0005)
Comment: At its October 3 meeting, by a vote of 7-0, the Planning and
Zoning Commission recommended approval of this request subject to the
applicant maintaining the two feet of vacated right-of-way as landscaped
area and subject to utility easements if necessary. Staff recommended
approval in a report dated October 3. Approval of this request will allow the
property owner to reconfigure and expand a parking area to accommodate
a restaurant at 320 E. Benton Street.

Comment: At its August 15 meeting, by a vote of 4-3 (Shannon, Hansen,
and Anciaux voting no), the Planning and Zoning Commission
recommended approval of the proposed vacation subject to the creation of

portions, except the alley in Block 5 of the County Seat Addition. Staff

6.94-acre, 5-lot residential subdivision located at the intersection of Ashford

Comment: At its October 3 meeting, by a vote of 7-0, the Planning and
Zoning Commission recommended approval of this subdivision subject to
staff approval of legal papers and construction drawings prior to City
Council consideration of the final plat. The construction drawings and legal
papers have been approved. This subdivision will allow the development of
16 duplexes and I single-family dwelling. Staff recommended approval in a
repod dated October 3.

i. Consider a letter to the Johnson County Board of Supervisors
recommending approval of a rezoning from Al, Agricultural, to CP2,
Planned Commercial for 54.8 acres located south of Herbert Hoover
Highway and west of Interstate 80 subject to conditions pertaining to traffic
improvements and sanitary sewer treatment. (CZ02-012)
Comment: At its October 3 meeting, by a vote of 7-0, the Planning and
Zoning Commission recommended approval of this rezoning provided that
an agreement be reached with the property owner regarding the
construction of turning lane / deceleration lane improvements to Herbert
Hoover Highway necessary to serve future development on this property,
and that assurances be given that adequate wastewater treatment will be
provided, prior to this property being rezoned to CP2. Staff recommended
approval with these conditions in a report dated October 3.

ITEM 7. PUBLIC HEARING ON AN ORDINANCE AMENDING TITLE 14, CHAPTER 8,
ENTITLED "AIRPORT ZONING" BY REPEALING THE EXISTING CHAPTER
IN ITS ENTIRETY AND REPLACING SAME WITH A CHAPTER REGULATING
AND RESTRICTING THE USE AND HEIGHT OF STRUCTURES AND
OBJECTS OF NATURAL GROWTH IN THE VICINITY OF THE IOWA CITY
MUNICIPAL AIRPORT BY CREATING APPROPRIATE ZONES AND
ESTABLISHING BOUNDARIES THEREOF: DEFINING CERTAIN TERMS
USED HEREIN: REFERRING TO THE IOWA CITY MUNICIPAL AIRPORT
ZONING MAP, AS AMENDED, WHICH MAP IS ADOPTED BY THIS

Comment: At its September 9, 2002 meeting, the Iowa City Airport Zoning
Commission recommended approval of this ordinance. The ordinance updates
the language of the Airport Zoning Code and provides zoning protection for the
projects anticipated by the Airport Master Plan. After the ordinance is approved
by the City Council, it will be forwarded to the Johnson County Board of
Supervisors for approval. The ordinance has been reviewed by the Airport
Commission, and the Airport Commission recommends approval.

ITEM 8. CONSIDER A RESOLUTION AMENDING THE FY2003 OPERATING
~ BUDGET.
Comment: This resolution amends the FY2003 budget to carry over budget
authority from FY2002 to FY2003 for capital improvement projects and other
expenses that were either in process in FY2002 and not completed by FY2002
year end, or budgeted in FY2002 and delayed until FY2003. The City's policy is
to amend the current budget at the beginning of each fiscal year for the
continuation of projects from the prior fiscal year.

Comment: This certificate is executed and delivered in connection with the
issuance by the City of $10,600,000 General Obligation Refunding Bonds.
This certificate sets out in detail a number of facts, promises and obligations
which must be met and agreed to by the City in order to maintain these
Bonds as tax exempt.

Comment: This certificate is executed and delivered in connection with the
issuance by the City of Iowa City of $10,600,000 General Obligation

and in order to assist the participating underwriters in complying with the
Securities Exchange Commission (SEC) Rule 15c2-12(b)(5).

Comment: At their May 16, 2002, May 29, 2002 and September 12, 2002
meetings, the Housing and Community Development Commission made
recommendations to the Council that would recapture funds from an
unsuccessful FY02 project and reallocate those funds to two new projects as
part of the FY03 Annual Action Plan.

ITEM 12. CONSIDER AN ORDINANCE AMENDING CITY CODE TITLE 14, ENTITLED,
"UNIFORM DEVELOPMENT CODE," CHAPTER FIVE, ENTITLED,
"BUILDING AND HOUSING," ARTICLE E, ENTITLED, "HOUSING CODE"
TO REQUIRE THAT ALL LANDLORDS AND TENANTS EXECUTE A LEASE
ADDENDUM AND BY DELETING THE REQUIREMENT THAT THE CITY
PROVIDE WRITTEN NOTIFICATION OF HOUSING VIOLATIONS BEFORE
ISSUING A MUNICIPAL INFRACTION. (PASS AND ADOPT)
Comment: Council has approved two readings of a proposed ordinance
(hereinafter "original ordinance") to require that landlords and tenants sign a
form that includes specified information, such as the maximum occupancy of
the unit and the names of all tenants. After the second reading, the Greater
Iowa City Apartment Association proposed amendments to the original
ordinance. The Greater Iowa City Apartment Association provided staff with a
redlined version of the original ordinance that includes its requested
amendments (hereinafter "revised ordinance"). The revised ordinance is in the
packet with one exception as noted below. Prior to making its proposal, the
Greater Iowa City Apartment Association communicated with staff and with
Hillary Sale, the chair of the Neighborhood Housing Relations Task Force.
Staff finds the amended ordinance acceptable. Staff does recommend one
non-substantive amendment to clarify that minor children of tenants are not
required to execute the form, although they must be listed as tenants on the
form. For the ease of reference, staff's recommended amendment is in all
capital letters in the revised ordinance. The revised ordinance deletes the
requirement to list the driver's license number, which is a substantive change
from the original ordinance. As a result, there will need to be three readings,
but the first reading can occur at the October 22 meeting. Correspondence

EXCEPTION, TO CLARIFY THAT EACH ESTABLISHMENT SHALL BE
ALLOWED ONLY ONE TEMPORARY ONE-YEAR EXCEPTION. (PASS AND
ADOPT)
Comment: The City Clerk has received inquiries about the temporary one-year
exception allowed under Section 6-7-5(B) of the City Code concerning whether
subsequent one-year exceptions can be obtained. The proposed amendment
clarifies that each establishment shall be allowed only one temporary one-year
exception under the ordinance, and consecutive exceptions are not available.

ITEM 14. CONSIDER A RESOLUTION APPROVING, AUTHORIZING AND DIRECTING
~,'~ THE MAYOR TO EXECUTE AND THE CITY CLERK TO ATI'EST AN
AGREEMENT BY AND BETWEEN THE CITY OF IOWA CITY AND
FARRAGUT SERVICES INC. OF LAFAYE'I-FE, COLORADO, TO PROVIDE
CONSULTANT SERVICES FOR DEVELOPMENT OF STORM SEWER
MAPPING APPLICATIONS.
Comment: This contract will provide services to prepare for and develop
mapping applications for a storm sewer map using the digital mapping currently
being processed. This work is consistent with recommendations made in the
GIS Design and Implementation Plan for the City of iowa City. The cost of
these services will be $149,700 and will be funded by General Obligation bond
proceeds.
