Consider setting a public hearing for June 13, 1989, on an ordinance to vacate that portion of the Lafayette Street right-of-way generally located between the easterly right-of-way line of the north - south alley between Dubuque Street and Ralston Creek and that portion of the Lafayette Street right-of-way Immediately west of its intersection with South Gilbert Street. Comment: Gary L. and Ralph J. Freeman own property on the northwest corner of Lafayette and South Gilbert streets and request that that portion of Lafayette Street immediately west of Gilbert Street be vacated. The Freemans wish to purchase vacated portions of Lafayette and Linn streets and develop these former rights-of-way and their property for an office use, The City also proposes vacation of that part of Lafayette Street contiguous to a City -owned parcel immediately west of Ralston Creek. At least a portion of this part of Lafayette Street would be offered to the Individual who purchases the City -owned parcel. At Its May 18, 1989, meeting, by a vote of 6.0, the Planning and Zoning Commission recommended approval of these right-of-way vacation proposals. This recommendation is consistent with that of staff. Consider setting a public hearing for June 13, 1989, on an ordinance to approve Oberlin Estates, a preliminary and final Planned Development Housing (PDH) and a Large Scale Residential Development (LSRD) plan and to rezone Lots 100 and 106 of Court Hill -Scott Boulevard Additions from RM -20 and RS -5 respectively to PDH -8. Comment: At Its May 18, 1989, meeting, the Planning and Zoning Commission recommended, by a vote of 6.0, approval of the proposed plan and rezoning subject to four stipulations as referred to in a memorandum dated May 18, 1989, from Linda Newman Gentry to Tom Scott. The applicant's attorney is preparing the necessary legal documents responding to these stipulations and will be received prior to the June 13 public hearing. The Commission's recommendation is consistent with that of staff. Action: A/, C. Consider setting a public hearing for June 13, 1989, on an ordinance to vacate a public walkway easement located between Lots 26, 27, 46 and 47 of Pepperwood Addition, Part 2. Comment: Property owners adjoining the subject walkway easement request that the easement be vacated to eliminate the required construction of a sidewalk. Once Installed, the walkway would provide pedestrian access between Sandusky Drive and Briar Drive, On May 18, 1989, an affirmative motion of the Planning and Zoning Commission recommending vacation of the walkway easement failed by a vote of 1-5 '(Clark voting yes). On a separate motion to recommend denial of the vacation request, the motion passed 5-1 (Clark voting no), This recommendation is consistent with that of staff. Action: y 1,&a r Agenda Iowa City City Council May 30, 1989 Page 6 d. Consider an ordinance to zone a portion of vacated Hollywood Boulevard right-of-way to CO-1 (Commercial Office). (First Consideration) Comment: At its meeting of April 20, 1989, the Planning and iZoning Commission recommended, by a vote of 6-0, that a 20,246 square foot portion of the vacated Hollywood Boulevard right-of- way between Broadway Street and Taylor Drive be zoned CO-1 with the condition that redevelopment of the parcel for commercial office use would have access limited to Broadway Street. This is a City-initiated zoning and expedited consideration is requested to permit redevelopment of this property in early summer. Comments regarding this proposal were received by the Council at a public hearing held on May 16, 1989. Action: _r°�uYZAW R"e'o %O e. Consider an ordinance changing the use regulations of certain property generally located south of Hilltop Mobile Home Park and west of existing Pepperwood Additions development on Sandusky and Pepper drives extended from ID-RM to RS-5. (First Consideration) Comment: Braverman Development, Inc, proposes to subdivide an approximate 22 acre tract of land for low-density, single -family residential use. The western portion of the tract is zoned ID-RM, Interim Development Multi-Family Residential The developer appeals to the City to rezone the western part of the parcel to RS- 5, the Idw-density, single -family residential zoning classification shown on the eastern part of the tract. At Its April 20, 1989, meeting, by a vote of 6.0, the Planning and Zoning Commission recommended approval of this rezoning request. This recommendation Is consistent with that of staff. No comments were received at a public hearing held by the Council on May 16, 1989. Action: A4Z 4XI, Agenda Iowa City City Council May 30, 1989 Page 7 I. Consider an ordinance approving an amended preliminary Planned Development Housing (PDH) plan for Summit Place, a 1.69 acre development located at the southeast corner of the IQrkwood Avenue and Marcy Street intersection. (S-8910) (First Consideration) Comment: At its April 20, 1989, meeting, the Planning and Zoning Commission recommended, by a vote of 6-0, to approve the amended plan subject to stipulations of an ancillary agreement regarding the historical significance of the property. Enclosed is an approved Summary Report substantiating the Commission's findings regarding variations proposed. by the plan. The Commission's recommendation is Inconsistent with that of staff. Consider an ordinance to rezone approximately 28 acres along9 Highway 1 West from 1.1 to CC -2. (Second Consideration) Comment: At its April 20, 1989, meeting, the Planning and Zoning Commission recommended approval of the conditional rezoning of approximately 28 acres north and west of the Iowa City Airport on Highway 1 West from 1.1, Industrial, to CC -2, Community Commercial. The Commission recommended approval of this request on a vote of 5-1 (Wallace voting no). (8-8909) Comment: At its May 18, 1989, meeting, the Planning and Zoning Commission recommended, by a vote of 6-0, approval of the preliminary plat of Hidden Valley Subdivision. RAIL SPUR RAP-RR89(5)-9T-52. Comment: This project involves the Installation of an approximately 885 - foot long railroad spur off the main line of the Iowa Interstate Railroad to serve the Central States Can Co. The estimated total cost of construction Is $58,000.00. This project is funded 80% through the Iowa DOT Rail Economic Development Program. The can company developer will fund the remaining 20% plus the non -eligible cost. Comment: This remodeling and expansion project for the Police and Fire Departments at the Iowa City Civic Center Includes the construction of approximately 5,867 square feet of new space and remodeling and renovation of 7,569 square feet of existing space. Also included is the Installation of a new driveway and parking lot entrance just north of the existing Fire Department. Estimated costs of the base project is $765,634, with additional alternates of $95,857. THREE AND Comment: On January 26, 1988, the City and Developer Seville Corporation entered into a Conditional Zoning Agreement requiring the Developer to install public Improvements relating to paving, sanitary sewer, and water mains, in consideration for the City's approval of the out -of - sequence development, Paragraph 2 of the Agreement. On December 13, 1988, the City Council accepted and approved the sanitary sewer, paving and storm sewer improvements, in satisfaction of the Subdivider's Agreement, Resolution 88.246. The Developer now wishes to remove clouds on the title of this Subdivision regarding acceptance of water main Improvements, which exist by reason of the Conditional Zoning .. Agreement, Paragraph 2. i Engineering advises the water mains in this Subdivision were installed by the City's Water Division, and recommends acceptance by the City, see attached, The Legal Department recommends authorization of the Limited Release to remove existing clouds on title within Southwest Estates, Parts Three and Four with respect to water main Improvements. These vehicles have been under lease to the University since August 1988 and they now wish to purchase them. Comment: The one-year arbitrated agreement Includes a 3.5% across- the-board wage Increase and an increase in shift differential pay from 50 to 150 per hour for bargaining unit members on the 3 p.m. to 11 p.m. shift, and from 10¢ to 250 per hour for bargaining unit members on the 11 p.m. to 7 a.m. shift. Action: /'&'a ITEM NO. 23 - CONSIDER AN ORDINANCE AMENDING CHAPTER 34, ARTICLE III OF THE CODE OF ORDINANCES OF THE CITY OF IOWA CITY, IOWA, "WEED CONTROL,' BY REPEALING SECTIONS 34-73,34-75, AND 34- 76 THEREOF, AND ENACTING NEW SECTIONS IN LIEU THEREOF TO BE CODIFIED THE SAME, CLARIFYING THE PROVISION WHICH MAKES FAILURE TO CONTROL WEEDS A NUISANCE, AND PROVIDING FOR YEAR ROUND ENFORCEMENT OF WEED CONTROL REGULATIONS BY USE OF THE NUISANCE ABATEMENT PROCEDURES PROVIDED IN CHAPTER 24, ARTICLE VI OF THE CITY CODE. (first consideration) Comment: This ordinance amends the "Weed Ordinance" by clarifying the provision which makes failure to control weeds a nuisance and also provides for year-round enforcement of the weed control regulations as opposed to the present enforcement between June 15 and October 15.
