Womachka to vend hand-crafted Jewelry as an ambulatory vendor on May 31, 1989. (approved) END OF CONSEWM�nL4nm i ITEM NO. 7 • PLANNING AND ZONING MATTERS. t a. Consider setting a public hearing for June 27, 1989, on an 1 ordinance to vacate the easterly 189.25 feet of the east -west alley II between Governor and Summit Streets (V-8902). Comment: Paul M. and Joan L Victor request that the portion of an alley contiguous to their south property line be vacated and disposed of to them so that they may restrict public access to this part of the alley and thereby reduce their exposure to traffic and the dust generated by this traffic. At Its June 1, 1989 meeting, by a vote of 1-4 (Scott voting yes) on an affirmative motion, the Planning and Zoning Commission recommended against the alley vacation request. This recommendation is consistent with that of staff. Action: b. Consider setting a public hearing for June 27, 1989, on a resolution adopting the 1989 Comprehensive Plan Update. Comment: The Planning and Zoning Commission recommended, by a vote of 5.0, approval of the 1989 Comprehensive Plan Update at their meeting on June 1, 1989. This recommendation comes after seven months of Commission work sessions and three neighborhood public hearings held in April. The Commission's recommendation is consistent with that of the staff, Action: i Agenda Iowa City City Council June 13, 1989 Page 5 c. Consider setting a public hearing for June 27, 1989, on an ordinance amending Section 36-4 and 36-56 of the Zoning Ordinance to eliminate certain child care providers from the Zoning Ordinance regulations for child care facilities and to extend the hours of house calls for home occupations. Comment: The Planning and Zoning Commission, at its June 1, 1989 meeting, recommended that the ordinance noted be approved. This was consistent with the a recommendation Included in a staff memo dated May 25, 1989. An ordinance dealing with small daycare providers was placed before the Council in January, 1989. The Council referred the ordinance back to the Commission to address all-night child care. The ordinance currently before the Council provides for the legitimacy of all-night providers through the special exception process. Action: _&Z-1 A" �L d. Consider a resolution setting a public hearing for June 27, 1989, on the Intent to convey to Jack Moyers et al, the vacated right-of- way of Loos Street, between Rocky Shore Drive and Black Springs Circle. (D-8901) Comment: On December 13, 1988, the City Council vacated Loos Street, an unimproved right-of-way extending between Black Springs Circle and Rocky Shore Drive. Jack Moyers and four other property owners have submitted an offer to purchase the vacated right-of- way as it abuts their respective properties. This resolution sets forth the City's intent to convey the vacated right-of-way to these individuals for $600 and sets a public hearing on this issue for June 27, 1969. Freeman that vacated Lafayette Street right-of-way between Ralston Creek and South Gilbert Street and a portion of the vacated Linn Street right-of-way immediately north of the vacated Lafayette Street right- of-way. Comment: The Freeman wish to purchase a portion of the vacated Llnn Street and a portion of Lafayette Street, currently under consideration for vacation by the Council (see Items f. and g.), and to develop these former rights-of-way in conjunction with their property on the northwest corner of Lafayette and Gilbert Streets for an office use. This resolution declares the City's intent to convey Its interest in these rights-of-way and sets a public hearing for June 27, 1989, on the proposal to convey this property. Action: nten a; 'i t! Public hearing on an ordinance to vacate that portion of the Lafayette Street right-of-way generally located between the easterly right-of-way line of the north -south alley between Dubuque Street and Ralston Creek and that portion of the Lafayette Street rightof- way immediately west of its intersection with South Gilbert Street (V-8901). Comment: Gary L. and Ralph J. Freeman own property on the northwest corner of Lafayette and South Gilbert Streets and request that the portion of Lafayette Street immediately west of Gilbert Street be vacated. The Freemans wish to purchase vacated portions of Lafayette and Linn streets and develop these former rights-of-way and their property for an office use. The City also proposes vacation of that part of Lafayette Street contiguous to a City -owned parcel immediately west of Ralston Creek. At least a portion of this part of Lafayette Street would be offered to the individual who purchases the City -owned parcel. At its May 18, 1989 meeting, by a vote of 6-0, the Planning and Zoning Commission recommended approval of these right-of-way vacation proposals. This recommendation is consistent with the recommendation included in the May 18, 1989 staff report. Action: :4A h1W 4+ A Q.,.-ei g. Consider an ordinance to vacate that portion of the Lafayette Street right-of-way generally located between the easterly right-of-way line of the north -south alley between Dubuque Street and Ralston Creek and that portion of the Lafayette Street right-of-way Immediately west of Its Intersection with South Gilbert Street (V-8901). (First consideration) Comment: See preceding item. In a letter dated April 28, 1989, the applicant requests expedited consideration of this ordinance. Public hearing on an ordinance vacating a public walkway easement located between Lots 26, 27, 46 and 47 of Pepperwood Addition, Part 2 (V-8903). Comment: Property owners adjoining the subject walkway easement request that the easement be vacated to eliminate the required construction of sidewalk. Once installed, the walkway would provide ' pedestrian access between Sandusky Drive and Briar Drive. On May 18, 1989, an affirmative motion of the Planning and Zoning Commission recommending vacation of the walkway easement failed 1 by a vote of 1-5 (Clark voting yes). On a separate motion to recommend denial of the vacation request, the motion passed 5-1 (Clark voting no). This recommendation is consistent with the I recommendation Included in the staff report dated May 18, 1989. Action: LJ i. Public hearing on an ordinance to approve Oberlin Estates, a preliminary and final Planned Development Housing (PDH) and a Large Scale Residential Development (LSRD) plan and to rezone Lots 100 and 106 of Court Hill -Scott Boulevard Addition from RM - 20 and RS -5, respectively, to PDH -8. (S-6916) i Comment: At its May 18, 1989 meeting, the Planning and Zoning Commission recommended, by a vote of 6.0, approval of the proposed plan and rezoning subject to four stipulations as referred to In a memorandum dated May 18, 1989 from Linda Newman Gentry to Tom Scott. Consider an ordinance approving an amended preliminary Planned Development Housing (PDH) plan for Summit Place, a 1.69 acre �k8q 3`� IJP development located at the southeast corner of the IGrkwood Avenue and Marcy Street intersection. (S-6910) (second consideration). t&cll 17 Comment: At its April 20, 1989 meeting, the Planning and Zoning Commission recommended, by a vote of 6-0, to approve the amended plan subject to stipulations of an ancillary agreement regarding the historical significance of the property. The Commission's recommendation is inconsistent with that of staff. Comments regarding this proposal were received by the Council at a public hearing held on May 16, 1989. Consider an ordinance changing the use regulations of certain property generally located south of Hilltop Mobile Home Park and west of existing Pepperwood Addition development on Sandusky and Pepper drives extended from ID -RM to RS -5. (Z-8903) (second consideration) Comment: Braverman Development, Inc. proposes to subdivide an approximate 22 acre tract of land for low-density, single-family residential use. The western portion of the tract is zoned ID -RM, Interim Development Multi -Family Residential. The developer appeals to the City to rezone the western part of the parcel to RS - 5, the low-density, single-family residential zoning classification shown on the eastern part of the tract, At Its April 20, 1989 meeting, by a vote of 6-0, the Planning and Zoning Commission recommended approval of this rezoning request. This recommendation is consistent with that of staff. No comments were received at a public hearing held by the Council on May 16, 1989. Consider a resolution approving the preliminary plat of Pepperwood 9 130 Addition, Part 8, a 22 -acre, 82 -lot low density single-family residential subdivision generally located west of existing Pepperwood Addition development on Sandusky and Pepper drives extended. (S-8912) Comment: At @s April 20, 1989 meeting, by a vote of 6-0, the Planning and Zoning Commission recommended approval of the preliminary plat of Pepperwood Addition, Part 8, subject to reduction of minimum block length and width requirements for certain blocks within the proposed subdivision and to modification of the cul-de- sac design requirements to permit the cul-de-sac design proposed within the development. This recommendation is consistent with the recommendation included in the April 6, 1989 staff report. In a letter dated May 31, 1989, the applicant requests expedited consideration of this application. Action on this Item is dependent upon affirmative action on the rezoning noted in Item K. Action: .&,E / ,Qy M. Consider a recommendation of the Planning and Zoning Commission that parking be restricted to one side only on all cul- de-sacs within Pepperwood Addition, Part 8. Comment: At Its April 20, 1989 meeting, by a vote of 6.0, the Commission recommended that parking on Balsam Court and Chestnut Court within Pepperwood Addition, Part 8, be permitted on one side only to facilitate traffic circulation within these cuf-de- sacs. Action: ±469.13 I o. Consider an ordinance to rezone approximately 28 acres along Highway 1 West from 1-1 to CC -2. (Z-8902) (passed and adopted) Comment: At Its April 20, 1989 meeting, the Planning and Zoning Commission recommended approval of the conditional rezoning of approximately 28 acres north and west of the Iowa City Airport on Highway 1 West from 1-1, Industrial, to CC -2, Community Commercial. The Commission recommended approval of this request on a vote of 5-1 (Wallace voting no). The staff recommended that, if the Comprehensive Plan were changed, rezoning of the property in question should be done conditionally. 9a4 �. Consider a resolution approving the amended preliminary plat for Ruppert Subdivision, Part 1, and the resubdivision of Lot 1, Ruppert Subdivision, Part 1. (S-8906) Comment: The Planning and Zoning Commission, at their May 18, 1989 meeting, recommended by a vote of 6-0 approval of the amended preliminary plat for Ruppert Subdivision, Part 1. By Resolution No. 85-295 the City Council authorized the execution of a Consolidated Annual Contributions Contract and General Depository Agreement which was approved by the Department of Housing and Urban Development effective October 18, 1985. The attached budget combines the receipts and expenditures of the three Public Housing Projects referenced above. The Iowa City Housing Authority is an officially "Recognized Status Performer." As such HUD approval of budget revisions are not necessary as long as the bottom line is not changed. The proposed budget revision reflects receipts of $113,946, prior year adjustments of $5,910 and expenditures of $114,220. This individual is assisted by temporary maintenance workers, which has resulted in a constant re-hiring/re-training process. It is anticipated that hiring a permanent part-time maintenance worker will provide a much greater degree of continuity, and a better level of maintenance. In order to help fund this position, the budgeted amount for temporary employees has been reduced by 20 hours per week, resulting in a net wage increase of approximately $3,400.
