Box 2659 Iowa City, Iowa 52244 Phone: 351-2244 Vacation of a portion of the Lafayette Street right -of way. Purpose: To.permit acquisition by adjoining property owners. Location: Lafayette Street generally located between the creek and the east right-of-way line of the north -south alley between Dubuque Street and Ralston Creek and that portion of Lafayette Street immediately west of its intersection with Gilbert Street, Size: Surrounding land use and zoning: Applicable regulations: • West of the Creek: 125.5 feet by 80 feet; 10,040 square feet. East of the Creek: Approximately 1,760 square feet. West of the Creek North - Undeveloped City -owned parcel; CH. East - Ralston Creek; CH. South - Commercial and warehousing; CI -1. West - Commercial and vacant; CI -1. East of the Creek North - Single-family dwelling; CC -2. East - Commercial; CC -2 and CH. South - Office; CIA. West - Ralston Creek; CH. Chapter 364 of the Code of Iowa, 1987. /009 ■ ■ Page 2 9�xdG1�I�l3i]:I�SL•�1C�LF Public utilities: Storm and sanitary sewers and telephone, gas and electric, and cable television services are located in the Lafayette Street right-of-way. The CRANDIC Railway is also located in this right- of-way. Transportation: Property located on the northwest corner of Gilbert and Lafayette streets is currently accessed via Lafayette Street. No property is dependent upon access via the segment of Lafayette Street under consideration west of the creek. Properties immediately north and south of the westerly segment of this right-of- way are accessed from an alley. BACKGROUND: Gary and Ralph Freeman, the applicants, request that a portion of the Lafayette Street right- of-way immediately west of Its intersection with Gilbert Street be vacated. In June, 1985, the City vacated that portion of Lafayette Street between Ralston Creek and the part of the right- of-way under consideration. The attached Illustration depicts the remaining portion of the Lafayette Street right-of-way located east of the creek and west of Gilbert Street which the applicants wish vacated and disposed of to them. The applicants own the property located on the northwest corner of the intersection of Lafayette and Gilbert streets and wish to purchase Lafayette Street between the creek and Gilbert Street as well as the vacated portion of Linn Street which abuts the west property line of their parcel. They Intend to remove an existing residential dwelling on their land to redevelop this lot and the vacated rights-of-way for an office use. The City Is also recommending vacation of a portion of Lafayette Street west of Ralston Creek. The City specifically wishes to vacate a 125.5 foot long portion of Lafayette Street generally located between Ralston Creek and the east rightof-way line of a north -south alley between Dubuque Street and the creek. This portion of Lafayette Street is illustrated on one of the maps attached to this report, This unimproved part of Lafayette Street is Immediately south of a City -owned parcel of land which the City wishes to sell. At least a portion of the Lafayette Street right-of-way contiguous to this property would be offered to the individual purchasing the City -owned parcel. ANALYSIS: Private Property Access: Private property access would not be affected by vacation of the remaining portion of the Lafayette Street right-of-way east of the creek. Access to the Freeman property Is currently provided from a portion of the Lafayette Street spur that has already been vacated. With redevelopment of this parcel, this drive will most likely be eliminated and the redeveloped site will be accessed from Gilbert Street. I i /ooh Page 3 No property west of the creek is dependent upon access via the unimproved segment of Lafayette Street Immediately east of the north -south oriented alley, Properties abutting this right-of-way are accessed via the alley instead. Traffic Circulation: A substantial amount of the Lafayette Street right-of-way east of Ralston Creek was vacated in June, 1975. Vacation of the remaining segment of this right-of-way and Its disposition and redevelopment in conjunction with redevelopment of the parcel directly to the north will not Impact traffic circulation on Gilbert Street. However, If the applicants propose to remove the existing paving from this part of Lafayette Street, plans should be submitted showing such items as curb replacement, sidewalk installation, storm sewer modification and the proposed entrance location. Vacation of that portion of Lafayette Street west of the creek and east of the alley will not hinder traffic circulation in the area. This part of the rightof-way is not required to facilitate the movement of traffic generated by surrounding commercial uses. Public Utilities: Storm and sanitary sewers and telephone, gas and electric, and cable television services are located in the segments of Lafayette Street under consideration. In addition, the tracks of the CRANDIC Railway are located within the south halves of these rights- of-way. If these rightsof-way are vacated, the entire tracts should be subject to perpetual easements that protect the interests of these utilities. In addition, prior to disposition of these former rights-of-way, any redevelopment plans for these parcels should be reviewed by CRANDIC Railway to assure that the proposed Improvements do not Interfere with CRANDIC operations. Conservation Easement: Vacation of the subject rights-of-way should only occur if a 20 foot wide conservation easement is retained over those portions of the rights-of-way which are contiguous to the banks of Ralston Creek. Access to the conservation easement areas from the public right-of-way should also be preserved. The applicants wish to buy the portion of Lafayette Street east of the creek which was vacated In June, 1975, as well as the remaining portion of Lafayette Street immediately west of Gilbert Street. For creek maintenance purposes, the part of the vacated portion of the right-of-way which is contiguous to the banks of Ralston Creek should be protected by way of a 20 foot wide conservation easement. This easement will be secured prior to disposition of this former part of Lafayette Street. Access to this easement via an easement extending westerly from Gilbert Street should also be retained before that part of Lafayette Street immediately west of Gilbert Street is vacated. That way, City access to the creek from public property is assured. With respect to that part of Lafayette Street west of the creek, a 20 foot wide conservation easement running parallel with the top of the creekbank should be retained to permit City access to maintain the creek channel, An easement permitting access to the creek from the remaining part of Lafayette Street should also be reserved. /too STAFF RECOMMENDATION: Staff recommends that the request to vacate a portion of the Lafayette Street right-of-way immediately west of its intersection with Gilbert Street be approved subject to retaining an easement to allow access to public utilities and the creek over the entire parcel. Staff also recommends vacation of a section of Lafayette Street located on the west side of Ralston Creek from the easterly rightof-way line of a north-south oriented alley between Dubuque ! Street and the creek to a point 125,5 feet east of the easterly boundary of the alley subject i to retention of an easement to allow access to public utilities and the creek over the entire parcel. 4 ATTACHMENTS: 1.
