This action will take place on or shortly after August 3, 1989. COMMENT: This action is being.taken to better organize eastbound traffic on the west leg of the intersection of Benton Street and Riverside Drive: At the present time, eastbound traffic on Benton Street may flow through the intersection from two lanes. This creates a difficulty on the east side of the intersection as the two lanes of traffic must merge into one lane as they cross the Benton Street bridge., The action noted above will require that the most southerly lane turn right onto Riverside Drive. Dubuque St. for the following reasons: This is the second application by the Sports Column for a beer garden in a little over two years. Serving alcoholic beverages and serving people 'outside would cause•a noise problem into the late hours of the night. - 2. The present alley would be obstructed for our use and accessibility to all properties along the alley. This alley is for delivery purposes. My reasons are as followst Note the last page of the petition presented to the Council. As an lwner, rj was not consulted in regards to this petition. I see no other signatures of property owners. Is the signature 'Big B Cleaners" a legal signature? Also note the attached letters of Irene Wherritt of the Women's Sports Company and Doug Sjoerdsma of the University Camera Shop, lessors of 2 and 4 South Dubuque St. respectively.._ An open air beer garden will cause a noise problem a good portion of the night for the occupants in the apartments on ..the second floor of the mentioned properties. The entrance to these apartments is next to the alley at 207J Iowa Ave. This noise could well be a test of our noise ordinance. This alley presently serves as a fire lane. It is a fire exit for both the Copper Dollar and the Deadwood Tavern. A •fire escape is built in the alley, plus other equipment such as an air conditioner. .Therefore, I do not feel it wise to fence. this area off. Because of the very poorly maintained surface and the poor lighting, I consider it hazardous to have such a gathering here. The letter from Mr. David Poula reads, "all cleanup would be accomplished by the Copper Dollar staff". My experience is that the Copper Dollar has not cleaned up around their premises, the alley, or the refuse strewn along my properties, after their regular Friday and Saturday nights and wonder if they would do any better after a beer garden affair. They are opposed to the pending Application of The Sports Column Corp. for an outdoor service area adjacent to 12 South Dubuque Street, which is scheduled for Council consideration on July 25, 1989. The outdoor area in question is located on a private right-of-way which has served the property owners which abut on it for many years providing access to the rear of the properties for maintenance, ingress and egree, and fire pro- tection. This right-of-way is presently fenced off at the south end where it enters the alley which runs east and west through this block. This fence was placed without prior knowledge or approval of my clients sometime after January 1, 1989, and as such it creates a restriction on the property owners' right for the use of this right-of-way and we will be contacting the owner of The Sports Column property to demand its removal. The Sports Column Corp. is claiming ownership rights to the right-of-way by virtue of a quit claim deed which it obtained in 1986. However, this quit claim deed can only convey such ownership rights, if any, that the grantor may have owned. Clifford (Florence) Wikel, legal titleholder to the two 'buildings situated at 2 and 4 South Dubuque Street occupied by University Camera and River City Sports. She resists, with some energy, the above application. As many of you will remember, she and her husband occupied the building approximately 35 years ago and operated the Wikel Typewriter business from that location for many, many years. I believe the applicant has previously, at least once and perhaps twice, attempted to secure the Council's permission to operate an outdoor service area. I believe applicant wishes to construct a beer garden and close -off the "alley". We specifically resist the application for the following reasons: 1. In my opinion, the applicant has no right to restrict in any way the use of the right-of-way (the alley) to other owners of buildings which abut the "alley". I direct your attention to Exhibits "A", "B" and "C" Exhibit "A" is a Xerox copy of a portion of an abstract of title showing an original deed dated December 28, 1872, conveying the Northwest Quarter of that entire City block to First, Universalist Parish. Exhibit "B"sets forth an 1876 deed conveying one of the buildings facing Dubuque Street to Daniel Nam. I have highlighted in yellow a perpetual easement which was reserved in that deed and reserves to all owners of the Northwest Quarter of said Block 66, a right-of-way 18 feet wide "to remain open perpetually for the use as A 'Oh -I nL-VI-wA yr cne owners or saia uarter DIDCK...." Exhibit "C" is a re- latively recent acknowledgment of the easement (although this acknow- ledgment is not necessary for its validity). Its recognition appears in a warranty deed dated April 2, 1986 in which Mary Jo Eicher, the then titleholder, conveyed to Oakwood Partners. I am aware that the Sports Column Corporation received a quit claim deed in June, 1988, to the 18 foot strip from the Unitarian Universa- list Society, successor in interest to The First Universalist Parish. However, this quit claim deed is meaningless and cannot abrogate the rights of the other property owners in whose interest the original easement was perpetually reserved. A quit claim deed merely conveys any interest that the grantor has in a piece of property. In this instance, the grantor had no interest. It had previously conveyed all of its interest. Further, even if the grantor did have an inter- est, the conveyance cannot eliminate the easement interests previous- ly reserved to the other owners of buildings along the 18 foot strip. 2. For many years, the tenants occupying 2 South Dubuque and 4 South Dubuque have used two parking stalls each of which is nine feet in width and twenty feet in length immediately behind the two buildings. Each building is twenty feet wide. 3. Also, the rear exit of each building is used as secondary access for the first floor tenants, River City Sports and University Camera Shop. Some time ago, I believe the tenant occupying the Sports Column Bar construct- ed a fence across the 18 foot strip. I would request that he be asked to re- move that fence so as to permit the right-of-way which was reserved to us. It inhibits the travel of fire trucks and other emergency vehicles which would otherwise be able to utilize the "alley" for fire protection of our build- ings. I also draw to your attention the fact that the diagram attached to the appli- cation shows anticipated construction of a beer garden 11.5 feet wide.
