a. Consider setting a public hearing for August 22, 1989, on an
ordinance to amend the Zoning Ordinance to permit an increase
In building height in the Commercial Office, CO -1, Zone.
Comment: At their July 20,1989, meeting, the Planning and Zoning
Commission recommended approval of an amendment to the Zoning
Ordinance to allow the construction of buildings in excess of the
25 -foot height limitation, in certain circumstances. This recommen-
dation was by a vote of 6.0 and is consistent with a staff memo
dated June 30, 1989.

construction for zone boundaries.
Comment: The Planning and Zoning Commission, at their July 20,
1989, meeting, recommended approval of an amendment to the
Zoning Ordinance to clarify that zone boundaries along streets are
drawn at the centerline of streets. This amendment was
recommended by the staff.

portion of First Street right-of-way, west of Gilbert Street.
Comment: On July 25, 1989, the City. Council approved an
ordinance vacating First Street right-of-way west of Gilbert Street,
except for the south 51 feet of the east 120 feet. At that same
meeting the Council passed a resolution of Intent to convey the
vacated right-of-way to Aero Rental in exchange for a sanitary sewer
easement granted to the City, provided a non-exclusive utility
easement is retained over the entire vacated right-of-way.

to define used merchandise stores and permit them in the
Commercial Intensive Zone. (First Consideration)
Comment: At its June 15, 1989, meeting, the Planning and Zoning
Commission recommended by a vote of 5.0 approval of a Zoning
Ordinance amendment to define and permit used merchandise
stores in the CI -1 zone. This recommendation is not consistent with
that of the staff. A public hearing was held July 25, 1989;
comments were received from two Individuals in support of the
proposed amendment. A letter from Melissa Williams requesting
expedited action on this item was included in the Council packet
Of July 25, 1989. An amended ordinance and memorandum from
the Director of Planning and Program Development is Included in
this packet for the Council's consideration.

feet of an alley contiguous to their south property line be vacated
and disposed of to them so that they may restrict public access to
this part of the alley and thereby reduce their exposure to traffic and
the dust generated by this traffic. At its June 1, 1989, meeting, by
a vote of 1-4 (Scott voting yes) on an affirmative motion, the
Planning and Zoning Commission recommended against the alley
vacation request. This recommendation is consistent with that of
the staff. Comments in opposition to the proposed vacation were
received from a resident living immediately south of the alley at the
Council's public hearing on June 27, 1989. In accordance with a
recommendation from the Planning and Zoning Commission, the
Council referred an investigation of alternative solutions to the
perceived problem on this alley to the staff at Its July 11, 1989,
meeting.

9. Consider a resolution approving the proposed expansion of an
�9 electrical utility transmission system by Iowa -Illinois Gas & Electric
a�� Company at 2200 Heinz Road, Iowa City, Iowa. (S-8924)
ITEM NO. 4
Comment: Iowa -Illinois Gas and Electric Company has requested
approval to construct an electrical substation and to expand the
substation in the future. The Public Works Director and the
Planning and Zoning Commission have reviewed the request as
required under Section 33-180, the Iowa City Public Utilities
Regulation Ordinance, and have recommended approval conditioned
on Iowa -Illinois Gas and Electric Company providing 1) screening
on the north and east sides of the facility, and 2) City review in the
future for undergrounding transmission lines. Please reference in
your packet the City Engineer's letter attached to the July 20, 1989,
staff report for item S-8924 and the July 20, 1989, Planning and
Zoning Commission minutes. Additionally, please note that on July.
18, 1989, the Iowa City Board of Adjustment approved the proposed
substation and subsequent planned expansion with similar
conditions for screening and City review of undergrounding
transmission lines.

Comment: On June 8, 1989, an Affidavit to Commence Referendum
Proceedings on the above-mentioned matter was filed with the City Clerk.
Petitions were filed by July 14th and certified as insufficient due to lack of
required signatures on July 17th. On July 18 a Notice of Intent to Amend
was filed. Supplemental petitions were filed on August 2. A Certificate of

CONSIDER A RESOLUTION ENGAGING AUDITOR FOR FISCAL YEAR
ENDING JUNE 30, 1989.
Comment: In 1988, the City took proposals from independent auditors
and did award a three-year contract to KPMG Peat Marwick. The Finance
Director and the Controller recommend that the Council approve this
resolution formally engaging Peat Marwick for the second year of the
three-year contract, in addition to providing notification to the State Auditor.

AGREEMENT ON EXCHANGE OF INFORMATION BETWEEN THE IOWA
DEPARTMENT OF REVENUE AND FINANCE AND THE CITY OF IOWA
CITY.
Comment: This resolution authorizes the City Manager and the Finance
Director as the City's designated representatives who may inspect or
receive Information relating to the City's receipts from Hotel/Motel taxes or
a local sales and service tax.

Comment: Parking fees are being revised as a result of selling monthly
parking permits in the Capitol Street Parking Ramp and the establishment
of an all -day maximum rate in the Dubuque Street Parking Ramp.

IOWA CITY, IOWA, BY REPEALING SECTION 32.1.55 THEREOF, AND
ENACTING IN LIEU THEREOF A NEW SECTION TO BE CODIFIED THE
SAME, SETTING THE AMOUNTS OF FEES FOR THE COLLECTION OF
APPUANCES AND TIRES AND FOR THE DISPOSAL OF APPLIANCES
AND TIRES AT THE LANDFILL, AND INCREASING THE MINIMUM FEE
FOR LANDFILL USE. (Passed and Adopted)
Comment: The latest revision to the proposed ordinance provides for a
fee to recover the City's costs for disposal of special or hazardous wastes
that must be buried separately from normal household solid waste. The
Iowa City Landfill accepts such wastes only in cases of emergency. Such
a condition now exists with the temporary shutdown of animal carcass
disposal facilities in Southeast Iowa. The Iowa City Landfill will only accept
minimal carcasses from the Iowa City Animal Shelter and Johnson County
veterinary offices. It is recommended that first and second consideration
of this ordinance be given at the July 25th Council meeting, and that third
consideration occur at the August 8th meeting.
