RESOLUTION AUTHORIZING CONVEYANCE OF A VACATED PORTION OF FIRST
STREET RIGHT-OF-WAY WEST OF GILBERT STREET IN IOWA CITY, IOWA, IN
EXCHANGE FOR GRANT OF SANITARY SEWER EASEMENTS
WHEREAS, the City Council passed and approved Ordinance No. 89-3426 July 25,
1989, vacating a portion of First Street right-of-way lying west of Gilbert
Street, more particularly described as follows:
That portion of First Street lying west of a line lying parallel to
and 120 feet west of the east line of Block 2, of Cook, Sergeant and
Downey's Addition to Iowa City, Johnson County, according to the
recorded plat thereof and the north nine (9) feet of First Street
lying south of and adjacent to Lots 9 and 10 of Block 2, of Cook,
Sergeant and Downey's Addition to Iowa City, Johnson County,
according to the recorded plat thereof; and
WHEREAS, the City Council adopted and approved Resolution No. 89-187 July 25,
1989, declaring.its intent to dispose of said vacated street right-of-way by
conveyance to Aero Rental, and also authorized publication notice of its
proposal, and set the date and time for public hearing thereon; and
WHEREAS, following public hearing on said proposal, the Council finds the
proposed disposal of vacated street right-of-way as excess City property is in
the best interest of the City of Iowa City, Iowa.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY,
IOWA:
That the Mayor and the City Clerk are hereby authorized, empowered and
directed to execute and deliver a Quit Claim Deed conveying the City's
interest in the portion of vacated First Street right-of-way described
above to Aero Rental, for. and in consideration of a grant to the City of
sanitary sewer easements across Aero Rental's property.
That the City Attorney be and is hereby authorized, empowered and directed
to prepare and deliver said Deed, and to simultaneously obtain said
sanitary sewer easements.

RESOLUTION APPROVING THE PROPOSED EXPANSION OF AN ELECTRI-
CAL UTILITY TRANSMISSION SYSTEM BY IOWA -ILLINOIS GAS & ELECTRIC
COMPANY AT 2200 HEINZ ROAD, IOWA CITY, IOWA.
WHEREAS, Iowa -Illinois Gas & Electric Company has requested approval to construct an
electrical substation, with potential future expansion on property located at 2200 Heinz Road,
the northeast lot of the Business Development, Inc. Industrial subdivision; and
WHEREAS, the Public Works Director and the Planning and Zoning Commission have reviewed
the utility transmission system expansion request as required under Section 33-180 of the Iowa
City Code of Ordinances, and have recommended approval conditioned on Iowa -Illinois Gas
& Electric Company providing 1) screening on the north and east sides of the facility and 2)
giving the City an opportunity to review the technical feasibility of undergrounding transmis-
sion lines prior to expanding the substation in the future; and
WHEREAS, pursuant to Section 33-180, the Planning and Zoning Commission determined that
locating the proposed utility expansion in an industrial park was in the best Interest of the
community; that the expansion would foster economic development; and that screening of
neighboring residential properties was necessary to lessen the negative aesthetic impacts of
the proposed utility expansion on the neighborhood.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY,
IOWA:
1. That the request submitted by Iowa -Illinois Gas & Electric Company to expand a utility
transmission system for property located in an 1-1 zone at 2200 Heinz Road is hereby
approved subject to the following conditions:
a. Screening of pyramidal arbor vitae will be provided along the north property line
of the site, and that screening, as Identified by City staff and Iowa -Illinois Gas
& Electric Company, will be provided along the east side of the property.
b. In the event Iowa -Illinois chooses to expand the substation, the City will review
the expansion as to whether undergrounding the 161 kV transmission lines is
technically feasible.
C. The Mayor and City Clerk of Iowa City, Iowa are hereby authorized and directed
to certify this Resolution, and to affix the Resolution to the Design Plans for the
proposed substation after passage and approval by law.

BACKGROUND:
Iowa -Illinois Gas and Electric Company is requesting to expand a public utility
in an industrial zone in southeast Iowa City. The applicant proposes to
construct a new electrical substation at 2200 Heinz Road, the northeast lot in

the Business Development, Inc. industrial subdivision. The applicant desires
to construct a small substation within the next two years, and replace it in the
future with a larger, more substantial substation should the consumer demand for
electrical load increase sufficiently to warrant the expansion.
The proposed site for the new substation would provide aerial access to a nearby
power source, an existing 161 kV transmission line. This power line is located
on the north side of the Heartland railroad right-of-way, which bounds the north
side of the 2200 Heinz Road property. Smaller (13.8 kV) distribution lines will
be undergrounded to service the surrounding area electrical load.
Chapter 33, Section 180 of the Public Utilities Regulation Ordinance sets forth
the standards and criteria for review of the location of the proposed expansions
or extensions of electrical utility transmission systems. The Planning and
Zoning Commission is required to review the written report and the maps, plans
and specifications submitted by the electrical utility company in light of the
following criteria:
1. The relationship of the proposed project to present and future economic
development of the area.
2. The relationship of the proposed project to the existing electric utility
system and parallel existing utility routes.
3. The possible use of alternative routes.
4. The relationship of the proposed project to the present and future land use
and zoning ordinances.
5. The inconvenience or damage which may result to property owners as a result
of the proposed project.
The Planning and Zoning Commission is required to report its findings and
recommendations to the City Council within 60 days of the company's final
submission of its report, and the accompanying maps, plans and specifications,
in this case by September 11, 1989.
ANALYSIS:
The analysis of this report relates specifically to the planning criteria cited
in Chapter 33, Section 180 of the Public Utilities Regulation Ordinance:
1. In investigating the relationship of the proposed project to present and
future economic development of the area, the staff finds that construction
of the substation on Lot 6 of the Business Development, Inc. industrial
subdivision should facilitate economic growth as it occurs in the area.
Locating the substation close to consumer load demands, particularly energy
intensive industrial development, reduces electrical distribution costs.
Having an on-line source of electrical power with sufficient capacity should
facilitate residential development as well as industrial growth in the area.
The existing substation currently serving the southeast area of Iowa City
is located along Lower Muscatine Road and Sycamore Street. This Substation
E operates at near 100% capacity during peak load periods. The utility will

need to expand its load capacity to meet even minimal increases in demand.
In staff's view, building a new substation in an industrial zone, as is
proposed, would be preferable to expanding Substation E, which is located
immediately across the street from a fully developed single-family
residential area.

The relationship of the proposed project to the existing electric utility
system and parallel existing utility routes is described in detail in the
attached report from Iowa -Illinois Gas & Electric Company. The substation
would link into the existing 161 kV transmission line located north of the
Heartland railroad right-of-way. Power loads can then be shifted from the
Lower Muscatine Road substation to meet the load demands in the Scott
Boulevard vicinity.

Staff did not explore the possible use of alternative routes because of the
close proximity of an existing 161 kV transmission line to the proposed 1
substation.

The relationship of the proposed project to the present and future land use
and to the Zoning Ordinance is a positive one. The Comprehensive Plan '
indicates industrial expansion for the area south of the railroad and {
residential development to the north. This is consistent with the way these
areas are zoned: industrial to the south of the railroad and single-family
residential to the north. The proposed project should facilitate these
intended uses.

The high profile of the substation as designed with 42 -foot high poles and
wiring apparatus will project vertically into air space visible from the
single-family residential area to the north. Staff investigated the P
'
feasibility of placing the 161 kV transmission lines underground to reduce
the aesthetic damage to neighboring property owners. We concluded,
following discussions with state officials, other utility company personnel
and City engineering staff, that technology is not to the point where
undergrounding transmission lines can occur without significant additional

expense in terms of initial installation costs and the doubling of the
number of transmission lines needed to avoid excessive down time when the
lines are being repaired. When expansion occurs in the future, however,
the City should be given the opportunity for review by the Planning and
Zoning Commission and the City Council to determine the feasibility of
undergrounding transmission lines at that time.
Staff recommends that a screening of pyramidal arbor vitae be provided along
the north edge of the property. This would soften the appearance of the
substation for the single-family residential area to the north. Iowa -
Illinois Gas and Electric Company representatives have indicated their
willingness to comply with this staff recommendation, which is consistent
with what is required for industrial or commercial uses abutting or across
from a single-family residential zone. However, the arbor vitae shown to
north on the site plan submitted on July 10, 1989, are located within a 20'
force main easement. Staff strongly recommends that the screening should
be located outside the force main easement. This would avoid the difficult
situation of enforcing the replacement of arbor vitae of comparable maturity
as repairs and upgrading of the force main occur over the next 10 to 20
years, It is noted that there is a separation between the proposed

substation and the residences to the north: the 100 -foot wide railroad
right-of-way and the area immediately to the north of the railroad in the
Village Green residential subdivision which is dedicated for a stormwater
detention basin.
STAFF RECOMMENDATION:
Staff recommends approval of the proposed Iowa -Illinois Gas and Electric Company
construction and future expansion of the proposed electrical substation on
property located at 2200 Heinz Road with the following conditions: 1) screening
of pyramidal arbor vitae along the north boundary of the property outside the
20 -foot force main easement, and 2) City reassessment of the technical
feasibility of undergrounding the transmission lines when expansion of the
substation occurs in the future.

STATEMENT TO CITY OF IOWA CITY IN SUPPORT OF
IOWA -ILLINOIS GAS AND ELECTRIC COMPANY'S REQUEST
CONSTRUCT AN ELECTRIC SUBSTATION AT 2200 HEINZ ROAD,
WHICH IS LOT 6 OF BDI FIFTH ADDITION TO IOWA CITY, IOWA
Iowa -Illinois Gas and Electric Company finds it desirable to
construct a new substation in the southeast part of Iowa City to
accommodate residential and industrial load growth in this area.
Current load estimates indicate such a substation should be
completed within the next two years, and construction would have
to start within the next year. A site near the intersection of
Scott Blvd. and the Heartland railroad tracks would be most
convenient from the standpoint of serving the present and future
distribution circuits that would be expected to serve electric
load in the southeast part of the city. This location was
selected because it is adjacent to the existing 161 kV
transmission line which would serve as the supply source to the
substation. It is also near the industrial development that is
presently taking place in southeast Iowa City.
The search for a suitable site was essentially limited to
property along the route of the existing 161 kV transmission line
which would be required for the supply source to the substation.
The transmission line currently traverses west along the railroad
right-of-way, and north on Scott Blvd. An examination of
property in both directions indicates the selected site is
probably the most desirable. It is in an industrial zoned area,
is separated from properties on the north by a 100 ft. railroad
right-of-way, and is faced by undeveloped land to the east of
Scott Blvd.
The initial substation to be constructed within the next two
years will consist of 161 kV wood pole structures, insulators,
aluminum conductors, a power transformer and high voltage and low
voltage switching structures and devices. A building will not be
erected for the initial substation. Plan and section views of
the substation structures and equipment are shown on Drawings 60-
OOY-100-103 and 60-OOY-120-102. These designs are based upon
preliminary engineering data and may vary somewhat when the
detailed engineering plans are completed.
If load growth develops in this area as anticipated, we will
replace the initial substation with a larger and more substantial
substation. At that time, all or part of the initial
installation would be removed. The ultimate substation
configuration could develop as shown on Drawings 60-OOY-108-002
and 60-OOY-120-001. The timing and development of this ultimate
substation will depend upon the growth of electric load in this
area. Our best estimate at this time is that this could be ten
years away.
The substation will be graded so as not to change the
drainage towards the south (Heinz Road) and the west and nothing

will be done to interfere with the Stormwater Storage Management
Plan as shown on the final plat for the BDI Fifth Addition
Subdivision. The substation will be enclosed in an eight (8)
foot high chain link fence. There will be 25 feet fence setbacks
on the Heinz Road and Scott Boulevard sides and 20 feet on the
north side so that the City will have unobstructed access to the
sanitary sewer easements described on the subdivision plat. The
area within the fence and extending to two (2) feet outside the
fence line will be covered with a minimum four (4) inch depth of
white crushed rock. All other areas will be seeded. The areas
between the fence and the property lines on the south and east
will be landscaped similar to other property in the BDI Fifth
Addition Subdivision.
Access to the subdivision will be via a 20' wide driveway. A
culvert of suitable size will be placed in the drainage swale
immediately north of the Heinz Road pavement. This electric
substation will remain normally unoccupied except during
construction, maintenance, or emergency situations and will be
operated by or used exclusively by Iowa -Illinois Gas and Electric
Company.
The initial'substation will be supplied by a tap from the 161
kV .transmission line located on the north side of the railroad
right-of-way. When the.ultimate substation is constructed in the
future, the 161 kV line will be routed through the substation.
There will be two (2) 13.8 kV distribution lines served from
the initial substation. These lines will exit the substation via
underground cable to two (2) existing poles on the west side of
Scott Boulevard. The ultimate future substation could consist of
up to four power transformers and a proportionately larger number
of 13.8 kV distribution circuits.
Iowa -Illinois Gas and Electric Company was advised to comment
directly on the planning criteria listed in Section 33-180-(b)-
(1), (2), (3), (4) 6 (5).

In response to our recent discussion, I requested our Energy
Planning Department prepare a brief statement concerning the
selection of a site near the railroad tracks and Scott Blvd. for
a future electric substation. A copy of this statement
pertaining to our future "Substation Y" is enclosed.
As I noted in our telephone discussion, our Energy Planning
Department is continually conducting studies of potential and
future electric loads, and looking at feasible and economical
means for serving them. We hope our estimates and projections
are realistic, but our "crystal ball" is not necessarily better
than the City's, or anyone elses. However, we are faced with
some realistic limitations in our efforts to serve anticipated
future loads. From past experience, we know that it can take up
to two years or more to complete an electric substation project,
once we have started. This period can be especially long when a
new site must be procured. Also, if we wait until an area is
completely built-up, and the load has already developed, then it
may be impossible for us to find a site upon which to construct a
new substation. By the nature of our business, it is necessary
that we plan a course of action before -the -fact, and we ask that
this be recognized by the various persons and groups that must
approve our request.

The southeast part of Iowa City is presently served by
Substation E, located at Lower Muscatine Road and Sycamore
Street. Substation E operates near 1008 of its capacity during
peak load periods.
A significant portion of Substation E's load in located in
the southeast Iowa City industrial park. Load in the area is
expected to increase 308 or more by 1991. The potential for.load
growth in..the..area.is.much.higher.
Reliability and economic evaluations have concluded that
Substation Y should be constructed where the Iowa Interstate
Railroad crosses Scott Blvd. Substation Y will relieve the
loading problem at Substation E and provide capacity for future
load increases in the industrial park area.

As I understand, Chuck has requested that the 161 KV supply
crossing the Iowa Interstate Railroad be placed underground.
Since the initial substation is temporary and is to be removed
with completion of a larger and more substantial substation when
required, it is recommended that the initial 161 KV overhead
crossing be allowed. However, when the large substation is
constructed in +/-10 years, the two new 161 KV crossings should
be considered for undergrounding at that time. The technology
for placing 161 KV underground may have improved to allow a safer
and less costly procedure.
In addition, screening should be placed along the north side of
the substation site to enhance the view from the Village Green
residential area.
A curb cut and driveway construction permit will be required for
installation of the drive to the site. The size of the culvert
under the drive can be determined at that time.
The proposed 5 -inch underground electric ducts to the existing
power poles along Scott Blvd. will be crossing the sidewalk, a
42 -inch storm sewer and two sanitary sewer forcemains. The
sidewalk will need to be replaced in kind. it will be necessary
to adjust the elevation of the electric duct so it will bypass
the storm sewer and sanitary sewer force main. Construction
plans showing elevations and locations of the existing and
proposed utilities will be required for review before commencing
work to eliminate as many conflicts as possible.

RESOLUTION N0. 89-204
RESOLUTION AUTHORIZING APPROVAL OF THE AGREEMENT ON EXCHANGE OF
INFORMATION BETWEEN THE IOWA DEPARTMENT OF REVENUE AND FINANCE AND
THE CITY OF IOWA CITY.
WHEREAS, Iowa Code Section 422.72(6) permits a municipal government to designate
two paid City employees to receive actual information regarding local option
taxes, and
WHEREAS, it would be to the City's benefit to receive such information
periodically to be utilized for budget projections and budget monitoring, and
WHEREAS, the actual information received is confidential in nature and the
release of such information to persons other than those authorized, or the use
of the information for purposes other than that intended by the Iowa Department
of Revenue and Finance is punishable, and
WHEREAS, the State of Iowa requires the execution of an Agreement on Exchange

1. It shall be unlawful for any present or former officer or
employee of the state to divulge or to make known in any manner
whatever not provided by law to any person the amount or source
of income, profits, losses, expenditures, or any particular
thereof, set forth or disclosed in any income return, or to per-
mit any income return or copy thereof or any book containing any
abstract or particulars thereof to be seen or examined by any
person except as provided by law; and it shall be unlawful for
any person to print or publish in any manner whatever not pro-
vided by law any income return, or any part thereof or source of
income, profits, losses, or expenditures appearing in any income
return; and any person committing an offense against the fore-
going provision shall be guilty of a serious misdemeanor. If the
offender is an officer or employee of the state, such person shall
also be dismissed from office or discharged from employment. j
Nothing herein shall prohibit turning over to duly authorized
officers of the United States or tar, officials of other states,
state information and income returns pursuant to agreement between
the director and the secretary of the treasury of the United States
or the secretary's delegate or pursuant to a reciprocal agreement
with another state. iJ
2. It shall be unlawful for any officer, employee, or agent,
or former officer, employee, or agent of the state to disclose to
any person, except as authorized in subsection 1 of this section, f
any federal tax return or return information as defined in sec-

or return information, as defined in section 6103(b) of the
Internal Revenue Code of 1954, is disclosed in a manner unauthor-
ized by subsection 1 of this section to thereafter print or

I. It shall be unlawful for the director, or any person having
an administrative duty under this chapter, or any present or
former officer or other employee of the state authorized by the
director to examine returns, to divulge or to mal:e known in any
manner whatever, the business affairs, operations, or information
obtained by an investigation under this chapter of records and
equipment of any person or corporation visited or examined in the

entrusted with enforcement of the motor vehicle fuel tax laws of
the federal government or any other state, may forward to such
officials and pertinent information which the department may have
relative to motor fuel and special fuel provided t!,? officials of

AGREEMENT ON EXCHANGE OF INFORMATION
BETWEEN THE IOWA DEPARTMENT OF REVENUE AND FINANCE
AND CITY OF IOWA CITY
The Iowa Department of Revenue and Finance and City of
Iowa City, represented by the undersigned officials, do hereby
enter into the following agreement for the exchange of informa-
tion.
This agreement shall not become effective until each Agency
has signed it in the space provided below. Upon ratification
this agreement will remain in effect until revoked orterminated
by either Agency.
I. Definitions

If there is any change affecting an agency representa-
tive's riaht of access return information or status as an
agency representative, City of Iowa City shall immediately
advise the Iowa Department of Revenue and Finance of such a
change in writing, specifying that such individual is no
longer an agency representative.
The agency agrees to destroy state tax information by
shredding or other appropriate means after its useful
retention period.
Termination or Modification of Agreement
The provisions of this agreement are subject to the
provisions of the Code of Iowa and to the implementing
regulations and published procedures promulgated there-
under. This agreement may be terminated or modified at the
discretion of the agencies in recognition. of changes in
state statutes and regulations or whenever in the ad-
ministration of state tax law that action seems appropri-
ate.
Any unauthorized use or disclosure of state return
information obtained pursuant to this agreement, or
inadequate procedures for safeguarding the confidentiality'
of such returns or return information, also constitutes
grounds for termination of this agreement and the exchange
of information thereunder.
The City of Iowa City agrees to notify the head of the
Iowa Department of Revenue and Finance immediately upon
learning of any improper use or disclosure of state return
information provided under this agreement and which
constitutes grounds for termination of the agreement.

Re: Long term parking in CBD
During the past year demand for long term parking in the CBD has increased. This Increase
is documented by the current waiting list for permits, daily inquiries into permit availability and
the Parking Study recently conducted by JCCOG. After monitoring parking usage over the last
six months we are making the following recommendations in order to better meet the needs
of long term parkers.
1. Increase the number of permits in the Municipal Lot located at the corner of Linn and
College Streets by 10. This will Increase the number in this lot to 105.
2. Sell 75 permits in the Capitol Street Parking Ramp. These permits would sell for $50.00
per month, This is $10.00 per month higher than the Dubuque Street Ramp but it is
felt that this is a more desirable location.
3. To provide an alternative for Infrequent long term parkers it is recommended that a
daily maximum of $3.20 be established for the Dubuque Street Ramp. This would
provide part time employees and those that do not drive dally an alternative to paying
$.40 per hour at a meter or in the Capitol Street Parking Ramp.
The increase in the number of permits could become effective immediately following approval
and publication of an amended rate ordinance. A waiting list exist for permits at this time. The
daily maximum in the ramp would require a program change to the software on the cash
registers used by ramp cashiers. This would not be completed until this fall.
These changes would Increase the number of permit spaces by 85. This increase and the
dally rate In the Dubuque Street should meet the current demand for long term parking in the
CBD. It should be noted that any further development or redevelopment to a higher usage in
the CBD will possibly Increase demand above the current level.
