ORDINANCE VACATING A PORTION OF THE EAST -WEST
ALLEY RIGHT-OF-WAY LOCATED BETWEEN GOVERNOR
AND SUMMIT STREETS, NORTH OF BOWERY STREET
AND SOUTH OF BURLINGTON STREET.
WHEREAS, the Cly of Iowa City has previously platted a
12 -foci wide east -west alley between Governor and Summit
streets, north of Bowery Street and south of Burlington Street;
and
WHEREAS, the owners of property Immediately north of the
eastern portion of this alley have requested that the easterly
189.25 feet of the alley right-of-way be vacated as a public
right-of-way, In order to reduce exposure to vehicular traffic;

WHEREAS, the Department of Planning and Program
Development, in a staff report dated May 18, 1989,
recommended denial of the vacation application; and
WHEREAS, on May 18, 1989, the Planning and Zoning
Commission, on an affirmative motion to recommend vacation,
voted two In favor, four against (Cooper and Scott voting In
the affirmative).
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COUNCIL OF THE CITY OF IOWA CITY, IOWA:
SECTION I. VACATION. That the City of Iowa City hereby
finds the easterly 189.25 feet of the east -west alley rlghtof-way,
located between Governor and Summit streets, north of
Bowery Street and south of Burlington Street, more particularly
described in Exhibit A attached hereto, Is no longer
app opdale for vehicular traffic and serves no public purpose,
as originally anticipated; and that the easterly 189.25 feel of
rightof-way, set forth in Exhibit A should be and hereby is
vacated, subject to the gram of a utllq easement to the Cly
of Iowa City, running parallel to and five feet north of the
southerly rightof-way line of this vacated alley.
SECTION if. REPEALER. Ail ordinances and parts of
ordinances In conflict with the provisions of this Ordinance are
hereby repealed.
SECTION IIL SEVERABILITY. If any section, provision or part
of the Ordinance shallbe adjudged to be Invalid or
unconstitutional, such adjudication sflell not affect the validity
of the Ordinance as a whole or arty section, provision or part
thereof not adjudged Invalid or unconstitutional.
SECTION IV. -EFFECTIVE DATE. This Ordinance shall be In
effect after Rs find passage, approval and publication as
required by law, and shill be recorded In the Johnson County
Recorder's Office.

BACKGROUND:
The alley provides the only means
of access to a garage owned by the
applicants. A garage serving the
property to the south is also
accessed via the alley. As Governor
is a one-way street going north,
this segment of the alley is also
used by nearby residents to more
easily access points south of Bowery
Street.
Paul M. and Joan L. Victor, the applicants, request that a segment of a 12 -foot
wide alley contiguous to their south property line be vacated as an alley and
disposed of to them. The alley segment, 189.25 feet in length, is the eastern
portion of an east -west oriented alley located between Governor and Summit
streets.
As illustrated on the accompanying vacation exhibit, a north -south alley between
Governor and Summit streets intersects with the east -west alley at the southwest
corner of the applicants' property. The north -south alley does not extend north
to Burlington Street but, instead, terminates at a parking lot which serves a
multi -family residential development on Governor Street. As Governor Street is
a one-way street going north, tenants of the multi -family residential use and
other residents with garages and parking spaces fronting the north -south alley
rely, from time to time, on the portion of the east -west alley south of the
applicants' property to access Summit Street and points south of Bowery Street.
The applicants wish to gain control of the alley contiguous to their property
to restrict access to this segment of the alley and thereby reduce their exposure
to traffic and the dust generated by this traffic.
ANALYSIS:
Private Property Access: The entire east -west oriented alley between Summit and
Governor streets has been established as a trafficway and is used regularly by
residents who are dependent upon this alley to access garages which front onto
the alley. The eastern portion of this alley, for example, is the only means
by which the applicants can practically access their garage. Although a garage
which is located on the south side of the alley, directly south of the
applicants' property, is oriented toward Summit Street, lack of a curb cut on
Summit Street requires this property owner to access his/her garage via the
alley's Summit Street entrance.
The north -south oriented alley which also exists between Governor and Summit
streets originates at its intersection with the east -west alley. Its northern
terminus is a parking lot which serves a multi -family residential development
on Governor Street. This north -south alley does not extend to either Burlington
or Bowery streets. At a minimum, therefore, one leg of the east -west alley must
be preserved to assure access to garages and parking spaces which front the
north -south alley.

Public Utilities: The only utility present in the portion of the east -west alley
under consideration for vacation is a buried telephone cable which is located
parallel to and three feet north of the southern edge of this part of the alley.
If the eastern portion of this alley is vacated, U.S. West Communications
requests a five foot wide easement parallel to and five feet north of the
southern edge of this part of the alley to access this cable.
Traffic Circulation: As Governor Street north of Bowery Street is a one-way
street going north, the easterly leg of the east -west alley is also used to more
conveniently access Summit Street and points south of Bowery Street. Without
this alternative, traffic from the alleys between Governor and Summit streets,
bound for destinations south of Bowery, would be obliged to egress near the
Bowery/Governor intersection, travel north to Burlington Street, and backtrack
to points south. The easterly portion of the east -west alley, even more than
the westerly half of this alley, then, functions in a way which eases the ability
of neighborhood residents to get from one point to another. Although staff is
sympathetic to the applicants' plight as a result of exposure to alley traffic
immediately west and south of their property, it is in the interest of the
neighborhood to facilitate traffic circulation in the neighborhood by not
vacating the easterly portion of the east -west alley between Summit and Governor
streets.
STAFF RECOMMENDATION:
Staff recommends that the request to vacate the easterly 189.25 feet of the 12 -
foot wide alley between Governor and Summit streets be denied.

AN ORDINANCE AMENDING CHAPTER 36, ENTITLED
20NING ORDINANCE' OF THE CODE OF ORDINANCES OF
THE CITY OF IOWA CITY, IOWA, BY AMENDING SECTIONS
364 AND 36-56 THEREIN TO EUMINATE CERTAIN CHILD
CARE PROVIDERS FROM THE ZONING ORDINANCE
REGULATIONS FOR CHILD CARE FACILITIES AND TO
EXTEND THE HOURS OF HOUSE CALLS FOR HOME
OCCUPATIONS.
WHEREAS, the Zoning Ordinance presemy defines child
care facilities as all those facilities licensed or registered by the
State where children are cared for, and
WHEREAS, this definition was adopted at a time when child
care providers who cared for six or fewer children were neither
required nor encouraged to register their operations with the
State; and
WHEREAS, such providers are now being encouraged by
day care provider groups and parents to register their
operations with the State; and
WHEREAS, the Intent of the Iowa City Zoning Ordinance
was to not regulate such small providers but 10 treat them as
home occupations; and
WHEREAS, the hours of house tails for home occupations
are presently set between 8:00 am. and 9:00 p.m.; and
WHEREAS, a change of hours for house calls for home
occupations beginning at 7:00 am. and ending at 10:00 p.m.
to accommodate child care providers should not adversely
affect residential areas.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF
IOWA CITY THAT:
SECTION I. That Chapter 36, 'Zoning Ordinance' of the Code
of Ordinances of the City of Iowa City, Iowa, be, and the same
Is hereby amended by repealing Section 36.4(c)(3) and
enacting In lieu thereof a new section to be calmed the same
to read as follows:
Section 36.4(c)(3). Child care facility. State licensed or
registered facllNy where more than six (6) children are
temporarily left with attendants. Any establishment which
receives any number of children after 10.00 p.m. and before
7:00 am., is defined as a child care facility and as such is
state licensed or realstared.
SECTION II. That Chapter 36, 'Zoning Ordinance' of the Code
of Ordinances of the City of Iowa City, lava, be, and the same
Is hereby amended by repealing Section 36.56(b)(4)c. and
enacting In lieu thereof a new section to be codified the same
to read as follows:
Section 36.56(b)(4)0. Any exterior display, exterior storage
or materials, signs (except as otherwise pannitted), house calls
after 10_00 p.m. or before 700 am., of other Indication from
the exterior that the dwalling unit or accessory building Is
being used in part for any use other than that of a dwelling or
accessory building for purely resldemlel purposes.
SECTION III. REPEALER. All ordinances and parts of
ordinances In conflict with the provisions of this Ordinance are
hereby repealed.

Re: House Calls and Hours of Operation for Home Occupations and Neighborhood Centers
The staff presented an ordinance to you earlier this year which would lessen the restriction on
providers of childcare who care for six or fewer children in their homes. The proposed
ordinance redefined a 'childcare facility, as those places which accommodate more than six
children (see attached memorandum from Karin Franklin). This eliminated the requirement for
approval of a special exception by the Board of Adjustment for establishments with six or fewer
children. However, such establishments not classified as a childcare facility would by definition
be classified as a "home occupation." A home occupation is "an accessory use consisting of
an occupation or profession carried on by a person residing on the premises" (Section 36-
4.(h)(2) of the Zoning Ordinance) and must comply with the requirements for a home
occupation. One of the requirements is that house calls after 9:00 PM or before 8:00 AM are
not permitted. The Commission, in its recommendation to Council, advised changing the
beginning hour for house calls from 8:00 AM to 7:00 AM in response to comments from
childcare providers. Concern for providers who care for children throughout the night
prompted the City Council to refer the ordinance back to the Planning and Zoning Commission
for consideration of exempting a home occupation Involving childcare from a limitation of hours
for house calls.
Exempting a use from the zoning requirements applicable to other uses within the same zoning
category results in concerns both philosophically and legally. When standards were developed
for home occupations as part of the new Zoning Ordinance, the Planning and Zoning
Commission was less concerned about the nature of the use operated within the confines of
E a dwelling where It was not visible but it was very sensitive to the exterior effects of the home
occupation. Consequently, it was adamantly in favor of establishing hours for making house
calls, although the home occupation could operate all night long.
s This matter was referred to the joint staff for Its review. Staff members felt that the vehicles of
parents leaving off children in the middle of the night could create as great or greater
disturbance than for most other home occupations. The staff does not support eliminating the
hours for house calls for home occupations that provide childcare. The joint staff did, however,
have less objection to expanding the hours for house calls for all home occupations to 7:00

AM and 10:00 PM.

7 Section 414.2 of the Code of Iowa stipulates that "...regulations and restrictions shall be uniform
V for each class or kind of buildings throughout each district, but the regulations in one district
may differ from those in other districts." Simply stated, the requirement for home occupations
shall be uniform and applicable to all home occupations. The purpose of this stipulation is to
avoid granting a special privilege to a use by treating it differently from other uses having
similar characteristics.

The 4 -C's Childcare Information and Referral Services, which publishes a directory of daycare
and preschool facilities in Johnson County, was contacted to determine how many facilities
offer night-time childcare. Only eight indicated at least some interest in evening work (see
attached list). Only three absolutely stated working hours during evenings.
Perhaps there are other facilities which have chosen not to list their services with the 4 -C's.
Regardless, of the hundreds of facilities in Johnson County, there does not appear to be a
large interest in evening childcare.
In lieu of an outright exemption to a limitation on hours for house calls for home occupations
Involved with childcare, the staff would suggest one other alternative:
(a) Extend the hours of house calls for home occupations to 7:00 AM and 10:00 PM. The
present ordinance does not permit house calls before 8 AM nor after 9 PM. (Keep in
mind that home occupations may operate all night long; only house calls are limited.)
(b) Alter the definition of a childcare facility such that any facility where six or fewer children
are cared for and where the children are left off or picked up before 10:00 PM and after
7:00 AM shall not be classified as a childcare facility. Childcare facilities will still Include
providers caring for more than six children and all providers who accept children after
10:00 PM or before 7:00 AM, i.e, all night long. This change in definition would exempt
numerous facilities from the special exception procedures of the Zoning Ordinance for
childcare facilities but still permit a provider with six or fewer children, who wishes to
provide evening service, to be permitted to do so under the special exception
provisions.
Hours of operation has been discussed in conjunction with the more recent ordinance
pertaining to neighborhood centers. The hours of operation for a neighborhood center are
established as 7:00 AM to 10:00 PM. While the Board of Adjustment may further restrict the
hours of operation it may not expand them.
A neighborhood center is a use permitting many activities, one activity of which may be
childcare. Because of the other activities associated with the center, there may be some
negative effects on adjacent land uses, particularly single-family residences. Night hours of
operation, therefore, are not recommended, except in those circumstances where such negative
effects will not be injurious to adjoining property. The Willowcreek neighborhood center
located west of Mormon Trek Boulevard exemplifies a neighborhood center that does not affect
adjoining property because of its location. The Broadway center on Broadway Street, however,
Is located immediately adjacent to single-family dwellings. Night hours of operation could
result In a negative Impact on these dwellings. For these reasons, the staff would recommend
that the provisions for neighborhood centers be amended allowing for the expansion of the
hours of operation by the Board of Adjustment but only where the Board determines that such
an expansion of hours Is appropriate.
Attached to this memorandum is a proposed ordinance which would amend the present
ordinance regulations pertaining to childcare facilities and neighborhood centers as suggested
In this memorandum. This ordinance has been reviewed by the staff and is being
recommended for approval.

Re: Amendments to the Zoning Ordinance re: Child Care
In November 1988, the Family Child Care Providers Cooperative of Iowa City
presented a proposal (attached) to the Planning and Zoning Commission
suggesting various amendments to the Zoning Ordinance to make the
establishment of child care facilities easier and lessen the restrictions
on them. The Commission considered the proposal and decided to address
only one aspect of it at this time and delve into the issue more deeply
after the Commission was done with the Comprehensive Plan.
The ordinance before the Council addresses the problem of small providers
who care for six or fewer children and who potentially fall under the
Zoning Ordinance requirement for a special exception before establishing
the use. When the child care provisions were originally adopted in 1983,
the intent was to exempt from regulation babysitting, i.e. those people
who cared for six or fewer children. Child care facilities were defined
as those licensed or registered facilities that cared for children. At
that time small providers were neither licensed or registered. Now the
movement in the child care profession is to register even the small
providers. This is not required by State law but is becoming important
for parents since registration entails a background check on the provider.
As small providers voluntarily register, they come into non-compliance
with City zoning. The ordinance before the Council, which is recommended
by the staff and the Commission, takes small providers out'of the defini-
tion of child care facilities. Those small providers who register their
operations will no longer be required to obtain a special exception before
the Board of Adjustment.
People who care for six or fewer children will, with this amendment, be
treated as home occupations. An amendment of the hours for home occupa-
tions has also been recommended by the Commission with the beginning time
changed from 8 AM to 7 AM to allow for the majority of babysitters who
accommodate working parents. Home occupations do not require a permit and
are treated as an accessory use in residential zones. Regulation of home
occupations is done on a complaint basis. Any child care provider who has
children left at their home outside the hours of 7 AM to 9 PM will be
investigated only if this activity is disruptive to the neighborhood and a
complaint is filed. The staff does not feel that this will be a problem.

AN ORDINANCE VACATING PORTIONS OF LAFAYETTE
STREET.
WHEREAS, vacation of the rights-ot-way described below
Will facilitate development of a tract of land located Immediately
west of Ralston Creek and east of a north -south alley between
Dubuque Street and the creek, together with a trap of land
located east of Ralston Creek and west of Gilbert Street; and
WHEREAS, the westerly segment of Lafayette Street has
never been Improved and, while this segment of the fight -of -
way provides public utility access, this segment provides no
vehicular or pedestrian access to adjacent properties; and
WHEREAS, although the easterly segment of Lafayette Street
Is Improved and provides utility access and pedestrian and
vehicular access to a parcel north of this segment, pedestrian
and vehicular access to this parcel may be achieved via
Gilbert Street.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COUNCIL OF THE IOWA CITY, IOWA:
SECTION I VACATION. That the City of Iowa City hereby
vacates those portions of Lafayette Street legally described as
follows:
That portion of the Lafayette Street right -o} -way lying
between a line parallel to and 210 feel east of the
centedine of Dubuque Street, said line being the east line
of the north -south alley In Block 18, County Seat Addition
and a line parallel to and 335.50 feet east of the centedine
of Dubuque Street; and
That portion of the Lafayette Street right-of-way lying
between a line parallel to and 480.50 feet east of the
centerllne of Dubuque Street to the west right-of-way line
of South Gilbert Street.
SECTION It. REPEALER. All ordinances and parts of
ordinances in conflict with the provisions Of this Ordinance are
hereby repealed.
SECTION III, SEVERABILITY. If any section, provision or pan
of the Ordinance shall be adjudged to be Invalid or
unconstitutional, such adjudication shall not affect the validity
of the Ordinance as a whole or any section, provision or part
thereof not adjudged invalid or unconstitutional.
SECTION IV. EFFECTIVE DATE. This Ordinance shall be In
effect after its final passage, approval and publication as
required by law, and shall be recorded In the Johnson County
Recorder's Office.
