After conferring with Police Chief R. J. Winkelhake,
we would like to recommend that Tuesday, October 31st,
between dusk and 9:00 p.m., be declared as the official
"Trick -or -Treat Night" in Iowa City this year.
This appears to be the most appropriate date, as the
31st is Halloween and it will also be "Trick -or -Treat Night"
for the City of Coralville.
If possible, we would like the City Council to act
upon this recommendation at its next meeting.

Thank you for your letter of 7.24.89.
As you recall we the occupants of 29 Tucson Place
were concerned regarding the absence of a sidewalk on lots
3 and 6 on the enclosed layout of Southwest Estates here in
Iowa city. The said lots 3 and 6 are currently the location
of the Korean Church.
Our two children ages 10 and 8 years attend
Roosevelt School, where they have been students now for 4
and 3 years respectively. The school bus will pick them up
each morning from the corner of Rohret Rd. and Phoenix
- ,coon finis poins of pick-up, our and other
children will have to walk in the street rather than on a
sidewalk. Once at the bus stop the childrenwill have to
wait in the street in the absence of a sidewalk. As you
might expect, this walk and wait may not only be quite a
chore for the kids in rain and snow, but perhaps also
dangerous on the corner of a busy route such as Rohret Road.
Following your advice we have obtained the
signatures of all but two of the property owners on the
Southwest Estates area of Iowa city. One of the two is
involved in another issue under negotiation with the Korean
Church. The other opted not to sign the petition,with the
assumption that the church would in time put in a sidewalk.
It is notworthy that the latter owners do not have children
that ride the school bus, yet recognized that the situation
was potentially dangerous..
The area of Southwest Estates is growing, with a
lot more children to benefit from such a sidewalk on lots 3
and 6. It is to be understood that all the signatories
fully endorse the requested sidewalk, without however
willing to undertake the cost of building it. We believe
that this is the responsibility of the lot occupant, just as
it has been expected of each one us signing the enclosed
petition..
We trust you will give this matter the attention
it deserves, particularly since the beginning of school is
only two weeks away.

Open burning in Iowa City should stop. When we were
transferred to Iowa City from Des Moines last year, we
were shocked to find open burning still allowed here.
It only takes one person to ruin the air for an entire
neighborhood.— People cannot enjoy the ordinary use of
their homes. They cannot have their windows open to enjoy
a fall breeze because of.the noxious fumes coming in.
Also, we are not interested in finding out what long-
term effect open burning has on our health and the health
of our child.
City residents have to accept the fact that their
actions affect everyone else. However, even in a more
rural setting this activity would be unacceptable. The
cumulative effect of allowing anyone the right to set fire
to their trash is to reduce the air quality for everyone.
We trust that the Mayor and City Council will act
responsibly to protect their citizens by putting a stop
to open burning.

concept of granting "air space" or rights to

61 A is a thrilling concept. It could centralize'
` the activities and facilities of our community
I arts organizations in a location that would
only enhance our already charmed downtown
area.
Parking, accessibility, location, are all
there! We've searched for existing buildings,
potentialareas that would be strategically
located, and needless to say, this would be
the ultimate.

Re: D.A.R.E, Program
In an earlier memorandum I advised you that we had undertaken discussions with a number
of schools in the Iowa City School District concerning their possible participation in the D.A.R.E.

Program. At that time we felt the schools would permit the participation of our Community
Relations Officer with the D.A.R.E. Program in the public schools. As you know, we are
scheduled to undertake the program at Regina School this fail. It now appears that the City
will not have a drug abuse resistance program in the public schools. We will continue to
actively pursue the participation of the School District in D.A.R.E. education; however, at this
time, it appears that they wish to continue their School District -sponsored efforts.
We have made contact with area churches and the youth program at one of the local churches
has indicated their Interest in sponsoring a D.A.R.E, education effort. We will continue to
pursue these Initiatives,

On September 7 the 20th Anniversary of Sycamore Mall will be cele-
brated between 4:30 and 6:30 P.M. at the Mall. This will be similar
to the Business PM events which the Chamber of Commerce has been
scheduling at various locations.
On September 14, at 4:30 P.M., the time capsule from our Sesqui-
centennial Celebration will be buried near the old City. Hall bell
adjacent to the Civic Center. Exact plans for this ceremony have
not been finalized at this time.

The City of Iowa City is In receipt of the Public Hearing Notice referenced above
concerning the placement of fill in approximately ten acres of forested wetland
adjacent to the Iowa River.
The application to fill was submitted by Development International Associates Ltd.
of Burlington, Iowa.
Development International Associates proposes to establish a planned development
on the approximate ten -acre site. Before construction of the development can
begin, the developer must secure approval from the Iowa City Zoning Commission
and the City Council.
The City desires that the proposed fill not be approved independent of review and
approval of the planned use of the property, since it is an integral part of the
development plan.
Therefore, the City requests that either the public hearing be continued until the
City Zoning Commission and City Council have acted on the development proposal
or that authorization to fill be denied at this time.

RESOLUTION CALLING A SPECIAL ELECTION ON A REFERENDUM 4
PROPOSITION TO RECONSIDER COUNCIL ACTION CHANGING THE
COMPREHENSIVE PLAN LAND USE CLASSIFICATION FOR A 28 ACRE
TRACT OF LAND ALONG HIGHWAY 1 WEST, NORTH AND WEST OF THE
IOWA CITY MUNICIPAL AIRPORT, FROM INDUSTRIAL TO GENERAL
COMMERCIAL
WHEREAS, pursuant to Resolution No. 89.102, passed and approved on May 16, 1989, the
City Council did amend the Comprehensive Plan Land Use Classification for the above.
referenced tract of land from Industrial to General Commercial; and
WHEREAS, a referendum petition pursuant to Article VII of the Home Rule Charter of Iowa City,
asking for reconsideration of said Council action, was presented to the City Clerk on July 14,
1989, and was certified insufficient on July 17, 1989; and
WHEREAS, an amended referendum petition was presented to the City Clerk on August 2,
1989, and was certified sufficient on August 7, 1989, which certificate of sufficiency was
approved by the City Council at its regular meeting on August 8, 1989; and
WHEREAS, in the absence of Council reconsideration, Article VII of the City's Charter requires
that the proposition set forth in the referendum petition be submitted to the voters of the City
at the next regular city election or at a special referendum election after expiration of the 30
day period for reconsideration; and
WHEREAS, the City Council has declined to reconsider its action amending the Comprehensive
Plan.
NOW, THEREFORE, BE AND 1T IS HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF IOWA CiTY, IOWA:
Section 1. That a special election is hereby called to be held in the City of Iowa City, Iowa,
in conjunction with the regular city election to be held on Tuesday, November 7, 1989, for the
purpose of submitting to the qualified electors of the City, to be by them voted upon, a
referendum proposal in question form as follows:

Shall the action of the City Council of Iowa City changing the Comprehensive
Plan land Use Classification for a 28 acre tract of land along Highway 1 West,

opened and closed shall be as set out in the Notice of Election, said Notice to be prepared
and approved by the County Commissioner of Elections.
Section 3. That the form of ballot to be used at said election shall be of the type authorized
by the Code of Iowa that will permit the use of electronic counters and will be in substantially
the form set forth in the Notice o1 Election. That, If more than one public measure shall be
submitted to the electors at the time of the said election, all such measures shall be printed
upon one ballot.

Section 5. That the Auditor of Johnson County, Iowa, being the County Commissioner of
Elections, is hereby directed to publish the notice of election once in the Iowa City Press•
Citizen, being a legal newspaper, printed wholly in the English language, as defined by Section
618.3 of the Code of Iowa, published in said City and of general circulation therein, said
publication to be not less than four days nor more than twenty days prior to the date of said
election.
Section 6. That the County Commissioner of Elections shall cause to be prepared all such
ballots, election registers and other supplies as may be necessary for the proper and legal
conduct of said election. The Clerk is hereby authorized and directed to cooperate with said
Commissioner of Elections and to do and prepare all necessary matters in order to make said

Re: Update on 1990 Census Committee
As you may know, in May, 1989, members of the 1990 Census Committee made individual
commitments to assume responsibility for promoting the 1990 Census among sectors of the
community they felt most comfortable working with. Jean Snow Mann, for example, will
concentrate her efforts promoting the Census among the community's elderly population.
Articles regarding the Census will be Included in the Senior Center POST; the Council of
Elders and AARP may also assist in Census activities. Dottie Ray is working on getting the
Census included in the 1989-1990 school year curriculum for K-12 students. Jack Newman
is promoting Census activities among area churches.
Pepe Rojas -Cardona, President of the University of Iowa Student Senate, has identified a
number of mechanisms to encourage the student population to be counted. Through his
efforts, it is anticipated that some journalism classes will take on promotion of the 1990 Census
as a class project. Pepe, along with Kevin Taylor, Director of Campus Organizations and
Student Activities, have suggested that certain Census promotion materials be Included in the
various mailings sent to the University population. Posters and flyers will also be displayed in
University buildings. Similarly, effort Is being made to include Census Information in City water
bills and it is anticipated that Census posters will be displayed in all municipal buildings, as
well.
Mary Mclnroy, a University of Iowa Libraries employee in the Government Publications Depart-
ment, has recently joined the 1990 Census Committee. Mary works with Census documents
regularly and has volunteered to speak before various organizations regarding the Importance
of the 1990 Census.
It is anticipated that through April, 1990, the Census Committee will be meeting monthly.
Arrangements are being made to have representatives from the Kansas City Regional Census
Center and the Des Moines District Office present an audio-visual program to the Committee
In mid-September. The Council will be advised of the date of that program.

Re: verdict in Dane Condemnation Trial
Dear Honorable Mayor McDonald and Members of the City Council:
Enclosed please find a copy of the order and verdict in
the Dane Condemnation case which was tried from August 7th
through August 9, 1989, in Johnson County District Court. On
August 10, 1989, the jury returned a verdict in the amount of
$320,000.00 as damages for the condemnation of 47.63 acres of
the plaintiffs' land near the Iowa City Airport. This
condemnation was a part of the property acquisition for the
Runway 6-24 extension project at the airport.
For your information, this verdict is well below the
appraisal of damages testified to by plaintiffs' appraiser
who claimed that the Danes had incurred damages in the amount
of $825,000.00 as a result of this taking. On the other
hand, the verdict is greater than the appraisals of damage as
testified to by the two appraisers retained by the City in
this case. The City's highest appraisal was about
$200,000.00.
