RESOLUTION TO ISSUE CIGARETTE PERMITS
hT EREAS, the following firms and persons have made application
and paid the mulct tax required by law for the sale of cigarettes and
cigarette papers; therefore,
BE IT RESOLVED BY ME CITY COUNCIL OF IOWA CITY, IOIVA, that the
applications be granted and the City Clerk be and he/she is hereby
directed to issue a permit to the following named persons and firms to
sell cigarette papers and cigarettes:

RESOLUTION NO. 89-215
RESOLUTION SETTING PUBLIC HEARING ON PLANS, SPECIFICATIONS, FORM OF
CONTRACT AND ESTIMATE OF COST FOR THE CIVIC CENTER/POLICE AND FIRE
DEPARTMENTS ASBESTOS REMOVAL PROJECT.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY, IOWA:
1. That a public hearing on the above-named project is to be held on the 19th
day of September, 1989, at 7:30 p.m. in the Council Chambers, Civic
Center, Iowa City, Iowa.
2. That the City Clerk is hereby authorized and directed to publish notice
of the public hearing for the above-named project in a newspaper at least
once weekly and having a general circulation in the city, not less than
four (4) nor more than twenty (20) days before said hearing.
3. That the plans, specifications, form of contract and estimate of cost for
the above-named project are hereby ordered placed on file by the City
Architect in the office of the City Clerk for public inspection.

WHEREAS, the Engineering Division has certified that the following
improvements have been completed in accordance with the plans and specifications
of the City of Iowa City:
Paving improvements for Hunters Run Subdivision, Part Five, as
constructed by Metro Pavers, Inc. of Iowa City, Iowa.
Storm sewer and sanitary sewer improvements for Hunters Run Subdivision,
Part Five, as constructed by Jeffrey Maxwell Construction Co. of Iowa City,

WHEREAS, the Engineering Division has certified that the following

RESOLUTION NO. 89-218.
RESOLUTION CALLING A SPECIAL ELECTION ON A REFERENDUM
PROPOSITION TO RECONSIDER COUNCIL ACTION CHANGING THE
COMPREHENSIVE PLAN LAND USE CLASSIFICATION FOR A 28 ACRE
TRACT OF LAND ALONG HIGHWAY 1 WEST, NORTH AND WEST OF THE
IOWA CITY MUNICIPAL AIRPORT, FROM INDUSTRIAL TO GENERAL
COMMERCIAL
WHEREAS,WHEREAS, pursuant to Resolution No. 89-102, passed and approved on May 16, 1989, the
City Council did amend the Comprehensive Plan Land Use Classification for the above -
referenced tract of land from Industrial to General Commercial; and
4 WHEREAS, a referendum petition pursuant to Article VII of the Home Rule Charter of Iowa City,
asking for reconsideration of said Council action, was presented to the City Clerk on July 14,
1989, and was certified insufficient on July 17, 1989; and
WHEREAS, an amended referendum petition was presented to the City Clerk on August 2,
1989, and was certified sufficient on August 7, 1989, which certificate of sufficiency was
approved by the City Council at Its regular meeting on August 8, 1989; and
WHEREAS, in the absence of Council reconsideration, Article VII of the City's Charter requires
that the proposition set forth in the referendum petition be submitted to the voters of the City
at the next regular city election or at a special referendum election after expiration of the 30
day period for reconsideration; and
WHEREAS, the City Council has declined to reconsider its action amending the Comprehensive
Plan.
NOW, THEREFORE, BE AND IT IS HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF IOWA CiTY, IOWA:
Section 1. That a special election is hereby called to be held in the City of Iowa City, Iowa,
In conjunction with the regular city election to be held on Tuesday, November 7, 1989, for the
purpose of submitting to the qualified electors of the City, to be by them voted upon, a
referendum proposal in question form as follows:
Shall the following public measure be adopted? _ Yes _ No
Shall the action of the City Council of Iowa City changing the Comprehensive
Plan Land Use Classification for a 28 acre tract of land along Highway 1 West,
north and west of the Iowa City Municipal Airport, from Industrial to General
Commercial be reversed?
Section 2. That the voting place or places for said election and the hours the polls shall be
opened and closed shall be as set out in the Notice of Election, said Notice to be prepared
and approved by the County Commissioner of Elections.
Section 3, That the form of ballot to be used at said election shall be of the type authorized
by the Code of Iowa that will permit the use of electronic counters and will be in substantially
the form set forth in the Notice of Election. That, if more than one public measure shall be
submitted to the electors at the time of the said election, all such measures shall be printed
upon one ballot.

Section 4. That the Election Board for the voting precinct or precincts shall be appointed by
the County Commissioner of Elections, not less than 15 days before the date of said election,
a certified copy of which appointment shall be officially placed on file in the office of the Clerk
of said City.
Section 5. That the Auditor of Johnson County, Iowa, being the County Commissioner of
Elections, is hereby directed to publish the notice of election once in the Iowa City Press -
Citizen, being a legal newspaper, printed wholly in the English language, as defined by Section
618.3 of the Code of Iowa, published in said City and of general circulation therein, said
publication to be not less than four days nor more than twenty days prior to the date of said
election.
Section 6. That the County Commissioner of Elections shall cause to be prepared all such
ballots, election registers and other supplies as may be necessary for the proper and legal
conduct of said election. The Clerk is hereby authorized and directed to cooperate with said
Commissioner of Elections and to do and prepare all necessary matters in order to make said
election legal and valid.
Section 7. That the Clerk is hereby directed to file a certified copy of this resolution in the
office of the County Commissioner of Elections, which filing shall also constitute the "written
notice" to the County Commissioner of Elections of the election date required to be given by
the governing body under the provisions of Chapter 47 of the Code of Iowa.
