requesting permission to Install a canopy extending from the
building entrance to the street. This request has been

recommendation.

ordinance to rezone a 12.0 acre tract of land generally located in
the 2600 block of Rochester Avenue, north of Rochester Avenue,
and south of the north branch of Ralston Creek from ID -RS to RS -
5.
Comment: At Its October 5, 1989, meeting, the Planning.& Zoning
Commission will consider the application to rezone the 12.0 acre
tract from ID -RS to RS -5. Due to the Council's revised meeting
schedule, the applicant in a letter dated September 22, 1989, has
requested expedited consideration of this application by setting the
public hearing at this time.

d. Public hearing on an ordinance amending the Zoning Ordinance by
changing the use regulations of certain property in northwest Iowa
City, generally located northeast of U.S. Highway 218 and west of
Camp Cardinal Road from ID -ORP to ID -RS.
Comment: at its September 7, 1989, meeting, by a vote of 6.0-1
(Reid abstaining), the Planning and Zoning Commission
recommended amending the use regulations of certain property
located in the northwest portion of the City consistent with the 1989
Comprehensive Plan Update land use designation for this property.
This recommendation is consistent with that of staff included in a
staff report dated August 17, 1989.

conditionally changing the use regulations of a 7.966 acre tract of
land generally located south of Ventura Avenue and north of
Bjaysville Lane on North Dubuque Street (Old Highway 218) from

Comment: The Planning and Zoning Commission recommended,
by a vote of 5-1-1 (Clark voting no, Reid abstaining), at its
September 7, 1989, meeting, to conditionally rezone the subject
property from PDH -12 to RS -5 to permit the future subdivision of the
site for a conventional single-family residential development. The
Commission's recommendation conditions the rezoning by limiting
the extent the 7.966 acre tract may be subdivided to 16 lots. This
recommendation is consistent with that of staff Included in a staff
report dated August 3, 1989.

of Olympic Circle and set a public hearing for October 17, 1989, on
the conveyance.

Comment: Southgate Development Co. has offered to deed to the
City all land owned by Southgate Development Co, abutting
Napoleon Park, north to the CRANDIC rail line in exchange for the
vacated Olympic Circle right-of-way. This resolution sets a public
hearing on the disposition of the vacated Olympic Circle right-of-
way for October 17.
Action:
M. Consider a resolution of Intent to convey portions of a vacated alley
between J Street and the Iowa Interstate Railroad, west of First
Avenue and set a public hearing for October 17, 1989, on the
conveyance. (D-8905)
Comment: The alley in question was vacated as part of the City's
efforts to develop seven single-family lots on City -owned property
on First Avenue. The property owners to the west of the alley have
each made an offer of $422, $487, and $503 respectively for the
part of the alley abutting their lots at 2207 J Street, 1314 Second
Avenue, and 1322 Second Avenue. This resolution sets a public
hearing on the disposition of the west 10 feet of the vacated alley
for October 17.

P. Consider a recommendation of the Planning and Zoning
Commission that the City Council recommend to Johnson County
that the widest allowable turning radii be permitted at the
intersections of Highway 1 and Naples Avenue and at Naples
Avenue and the entrance drive to Lot 1 of Scott's Second Addition.
Comment: At its September 21, 1989, meeting, the Planning and
Zoning Commission recommended by a vote of 6.0 that the widest
turning radii allowable be permitted at the above -referenced
intersections within Scott's Second Addition to mitigate the impact
of turning truck traffic on traffic flow on Highway 1 and on Naples
Avenue.

ITEM NO. 11 - RECOMMENDATIONS OF BOARDS AND COMMISSIONS.
a. Consider recommendations from the City Council Rules Committee:
(1) That the proposed by-laws as presented by the Design
Review Committee be adopted.
(2) That the Council adopt a policy that any Councilmember who
utilizes City stationery for correspondence purposes copy the
Council, and that any correspondence that infers to reflect
the entire mood of the entire Council be signed by the
Mayor.
At their meeting of September 19, 1989, the Council Rules
Committee discussed the above-mentioned items. Minutes of the
meeting are Included in your Council packet. Adoption of the
Design Review Committee by-laws are Included on this agenda as
Item No. 12. If Council concurs with recommendation #2, a motion
should be made and a vote taken.
Action:
b. Consider a recommendation of the Design Review Committee that
the City Plaza Ordinance be revised to eliminate provision for
ambulatory vendors except in cases of special events and festivals.

Comment: As a result of recent difficulties in enforcing ambulatory
vending regulations on the City Plaza, the Design Review Committee
was asked to reassess the conditions for allowing this use. If the
City Council concurs with this recommendation, it should be referred
to the City staff. for preparation of an ordinance amendment. / zz`
Consider a recommendation of the Committee on Community Needs
that the 1990-1992 Community Development Plan be adopted. This
item is on the agenda as Item No. 14.

Comment: In conjunction with the construction of the City's new
wastewater treatment and collection facilities; the Public Works Department
recommends the development of operation and maintenance manuals
which serve a valuable function in the overall operation of the facilities.
The Public Works Department further recommends that, as the result of a
formal interview process, Howard R. Green be selected to prepare the
Operation and Maintenance manuals at a total cost of $115,000,

Comment: The Committee on Community Needs (CCN) has prepared a
