Dr. Jean Fitzgerald - Iowa City, IA - Spoke to the specifics of the Board's previous objections. She felt that the rabies question was not a valid argument, even though a vaccine is just nearing completion. The safety question had been blown out of 'v, I proportion by alarmists and cited statistics that they were as safe as dogs. i 5.. Lynn Vermace - Iowa City, IA - Concerned about the fate of the five ferrets in the Iowa (. Suzanne Hoofnagel - West Branch, IA - Described the "halfway house: procedures and policies set up In various locations. Showed a videotape of one house featured on CNN. She stated that George Harmon, President of the International Ferret Association, will be sending a letter offering to fly the five ferrets to Roanoke, VA for adoption. 11. Jim Johnson - Iowa City, IA - The proud owner of seven ferrets. He first became an owner because he was allergic to cats and the apartment he was living in would not allow dogs. He would recommend ferrets as pets to anyone. 12. Bev Horton, Iowa City Animal Control, and Barb Russo, Coralville Animal Control - Answered various questions from participants and the Committee. This is an update on the matter. As previously discussed, it was our opinion that the plain language of the original Conditional ' - Zoning Agreement limited the number of "residences" to no more than twenty-seven (27), but £ said, nothing about lots. Housing and Inspection Services then monitored the number of ' building permits Issued The number of permits has now reached 27. As a result of lot line changes, two subdivided lots are now unbuildable: 'Lot 94, owned by Dr. Ed Law; and Lot 101; owned by the Sub- divider with_a potential sale "in the works." Dr. Law has requested a building permit. His request was denied, as in violation of the original Conditional Zoning Agreement. Dr. Law took his dilemma to the Planning and Zoning Commission October 5, 1989. After discussion at a formal meeting, the Commission voted'to recommend approval of the Amended Conditional Zoning Agreement now presented to you. This Amendment would permit the two unbuildable lots to be used for single family homes. i The Amended Agreement was drafted by me. It has now been signed by Dr. Law and by Bruce Glasgow, the original Subdivider. The Amended Agreement limits the number of building permits, the number of lots, and the number of residences to no more than 29. Moreover, the Amended Agreement supersedes the private Covenants in direct conflict with the Original i Agreement, see paragraph 8 of the Amended Agreement, The current combined language should clarify the matter once and for all, and limit First and Rochester Subdivision, Part Three to 29 lots, residences, and building permits. While some persons may chafe at the Amended Agreement, it is my considered opinion that the two (2) additional residences, for a total of 29, will not adversely affect the safety of the Subdivision; and that the difference between 27 residences and 29 residences is sufficiently de minimus to warrant your approval. Moreover, considering the desirability of the area, with City services already available, it does not appear reasonable to leave Dr. Law's lot unbuildable. Nor is it desirable to leave the remaining corner Lot 101 unusable. It explicitly provides that "the parties have agreed that twenty=seven (27) is the maximum number of single family residences which may be allowed on the Development Land before secondary street access isrovided to the area," see attached agreement. p Recently, a local attorney, in examining an abstract for a client's purchase of two large lots in this Subdivision, found that private Covenants, not involving the City, were recorded by the Subdivider after his execution of the Conditional Zoning Agreement. These private covenants explicitly contemplated that Lots 91, 92, 94 and 95 could be split into two lots each. See attached Plat and private Covenants. City practice has traditionally, and we believe lawfully, permitted one -lot splits after sale to a new owner. However, the attorney later learned from City staff that the City's Conditional Zoning Agreement limited the Subdivision to 27' residences until secondary access was obtained. The local attorney then informed the Legal Department that the Conditional Zoning Agreement was not "of record" in the Recorder's office, and therefore did not show up In his client's abstract of title. We admire and appreciate this attorney's candor in bringing this to our. attention. Although Iowa law does not require the recording of a conditional zoning agreement since it is effective upon publication of the zoning ordinance of which it is a part, the better practice would be to record conditional zoning agreements since they are, by their nature, designed to be covenants running with the land and should be recorded. Conversely, a conditional zoning agreement is not simply another agreement between the City and the subdivider. It Is intended to be effective against the subdivider as well as against subsequent purchasers. In response to these events, we recorded the Conditional Zoning Agreement. We also alerted the Housing and Inspection Services Department, by written memo dated April 10, 1989, to keep track of the number of building permits issued in the above Subdivision. The Conditional Zoning Agreement limits the number of "single family residences to a total number of 27 until secondary access Is available. Also, according to the provisions of the Conditional Zoning Agreement, the City I h- I I) � + 2 is not obligated to approve any further "subdivision plat or plats" until and unless secondary access is provided, see attached.
