I. Neither the ordinance proposed, nor Section 36 defines "parked" or "storage", and there was uncertainty during the hearing as to what was meant in view of the last clause of Sec. 1(2) (a), concerning moving the vehicle every four days. 2. Opinions were expressed that the goal was not to bar vans such as the one we have, a picture of which was circulated. It would be unfortunate to sweep in unintended victims by accident. 3• The so-called "grandfather" section lends an owner small comfort since it is hedged with conditions and only runs 2 years. We have used this van for nine. Building a drive, and parking our van in the rear yard could disturb the view and the environment along the Iowa River. 4. The height limit of 72 feet is arbitrary. If the purpose is to allow visibility over the top, this figure is too high. Ten feet would comfortably allow our van to comply, since it is short enough. 5. Lastly, public support at the hearing was conspicuously absent. Upon retirement nine years ago we decided we wanted to travel around, and use the RV method. We selected a Particular style that is narrower and shorter than most. It was our idea that it would serve as a second car, and it has done so very well for nine years. It is no larger than Cadillac, andcan be parked in a diagonal parking Spot- It's configuration makes it difficult but not impossible to parallel park. The idea of parking it in some satellite lot would totally defeat its function as a second car. This would Put us in a bind at least twice a week since we use it as a car much more than we use it over the road as an RV. Sitting in the driveway of our home it does not block the neighbor's view of the street or back yards in any direction, and it is a neat vehicle, no more objectionable than various pickups, vans and boats that are parked around the neighborhood. It -seems to us that this ordinance is a heavy handed approach to satisfy complaints raised by a few neighbor - to - neighbor situations, which might be better solved by requiring lot line clearances or other methods rather than a complete boycott, affecting many cases where there is no problem. Further, I do not think it is helpful to put_olution. a boycott into the city code when there is no. reasonable s Right now there are no fenced, lighted, secure storage areas available in Iowa City within the service area of bus routes. We urge your further consideration of the needs and convenience of those of us who depend on RV's for recreation and transportation, and to seek a more equitable solution than the first proposal. Kennedy Dick Buxton a ATTEST: Marian Karr, City Clerk 3a9 0 City of Iowa City MEMORANDUM Date: March 1, 1988 To: Honorable Mayor and City Council From: James Brachtel, Traffic Engineer Re: Parking Removal on Weeber Street As directed by Section 23-16 of the Municipal Code of Iowa City, this is to advise you of the following action: ACTION: Pursuant to Section 23-234 of the Municipal Code of Iowa City, the City Traffic Engineer will direct the installation of a NO PARKING CORNER TO HERE sign on the west side of Weeber Street, 60 feet south of its inter- section with Benton Street. This sign will be installed so as to create a 60 -foot long no parking zone on the west side of Weeber Street from the intersection with Benton Street south to a point 60 feet south of the intersection. This action will take place on or shortly after March 16, 1988. COMMENT: This action is being taken to ensure that vehicles turning from Benton Street will be able to enter Weeber Street when a car is queued on Weeber Street. At the present time parking is prohibited on the east side of Weeber Street, but periodically cars do park on the west side of Weeber Street. KARR CITY CLERK (3) 3,30 Y City of Iowa City MEMORANDUM Date: February 22, 1988 To: The Honorable Mayor and City Council From: James Brachtel, Traffic Engineer Re: Parking on Orchard Street As directed by Section 23-16 of the Municipal Code of Iowa City, this is to advise you of the following action: ACTION: Pursuant to Section 23-234 of the Municipal Code of Iowa City, the City Traffic Engineer will direct that the signs permitting one hour parking be changed to NO PARKING ANYTIME. Portions of Orchard Street affected by this signage will be from the intersection of Orchard Street with Benton Street north to the intersection of Orchard Street with Orchard Court. This action will take place on or shortly after March 9, 1988. COMMENT: This action is being taken at the request of the abutting property owners, Hartwig Auto. Prior to 1980, a NO PARKING ANYTIME had been posted in this location. In the fall of 1980, the then owner of Hartwig Motors came forward and requested that it be changed to one hour parking to facilitate customer parking. KARR CITY CLERK (3) 33/ V M City of IOWA City MEMORANDUM Date: February 5, 1988 To: Honorable Mayor and City Council From: James Brachtel, Traffic Engineer Re: Parking on the South Side of the 100 Block of East Washington Street As directed by Section 23-16 of the Municipal Code of Iowa City, this is to advise you of the following: ACTION: At the direction of the City Attorney, the Traffic Engineer will direct the installation of PARKING FOR COMMERCIAL VEHICLES ONLY - 15 MINUTE LIMIT on the south side of the eastern -half of the 100 block of Washington Street. This action will take place on or shortly after February 24, 1988. COMMENT: Section 23-236(b) of the Municipal Code of Ordinance of Iowa City prohibits non-commercial vehicles from standing, stopping or parking in any travel lane of a roadway in commercial districts. The City Attorney has indicated that the postings as noted above should be placed to advise the general public that the City is undertaking a change in its enforce- ment policy, and private, non-commercial vehicles that park in a travel lane will be subject to ticketing. Section 23-236(b) permits commercial vehicles to stop, stand or park in a travel lane while engaging in the loading or unloading of property, providing that ten feet of width of roadway is open for the free movement of vehicular traffic on one-way streets. Commercial vehicles will still be permitted to park in a travel lane. Washington St. Iowa City, Iowa 52240 Dear Sirs: This is in reply to your correspondence of February 3, 1988. I appreciate the issues you raise concerning financing of sewage treatment improvements. Many Iowa communities have faced similar considerations. They have had to make decisions on treatment im- provements without firm guarantees that major contributors to the system will remain in operation or continue paying current rates. Regarding sewer rates, this agency does not and will not intervene in a dispute between a utility and one of its users over a matter of user fee payment. This is a matter for local de- cision, and various legal means exist for resolving such disputes where and when negotiations fail. As to the issue of local zoning disputes, it is again our belief that this is an issue more appropriately resolved at the local level between the local units of government. Again, legal means exist for resolving continuing disputes between local govern- ments. Similar situations have occurred before, and have been re- solved either at the local level or through court proceedings. Some communities have had to alter their original preferred plan for treatment improvements in recognition or accommodation of other local governmental interests. This agency has not and will not intervene in local zoning issues. i do not view either of these issues to be of such statewide con- sequence as to warrant this agency introducing corrective legis- lation. Other communities are and have been faced with the federally mandated 1988 deadline for wastewater treatment compli- ance. Other communities have been faced with making financing and treatment decisions without guarantee of treatment loadings or revenue contributions from major sewer users. Other communities have had to deal with difficulties in acquiring needed easements a and property, including resolution of zoning difficulties. In summary, this agency will not intercede on behalf of the city with the Board of Regents concerning sewer rate payment issues. Neither will we sponsor, individually or jointly, the legislation which you propose. The matter of your compliance with waste treatment standards and schedules is before the Environmental Protection Commission. I am hopeful their decision to allow sixty days for mediation of your dispute with the university and the board of supervisors will prove fruitful, and allow for your compliance with your plan of action. Twenty-seven of the 100 members were in attendance. This meeting gave me the opportunity to share information about housing inspection services. In addition, the meeting provided an opportunity for an open exchange of ideas as well as a positive discussion of mutual concerns related to housing quality and inspection services. After the meeting several individuals told me they thought the meeting had been positive and productive. Several suggested that regular meetings of this type should be held in order to build upon the communication which was initiated at this meeting. Needless to say, I was pleased by the success of this meeting.
