Setting i Public Hearings. i (1) Consider a motion setting a public hearing for May 17, 1988, to receive citizen comments on the program description for the proposed use of $93,000 in rental rehabilitation grant funds for 1988. Comment: The Department of Housing and Urban Development requires that prior to the filing of a program description of the Rental Rehabilitation Program, citizens be given the opportunity to comment on the Program. (2) Consider a resolution setting public hearing on IFWi - amending the FY88 operating budget. Comment: State legislation mandates municipali- ties amend their annual budget by May 31. This resolution sets the public hearing for amendments on May 17, 1988. Detailed information on amend- ments will be available for public inspection on May 10, 1988. (3) Consider a resolution setting public hearing on amending the FY88 capital projects budget and establishing a capital projects budget for FY89. Comment: This resolution sets the public hearing for amending the Capital Projects Budget for FY88 and FY89 an May 17, 1988. Detailed information on the budget will be available for public inspection on May 10, 1988. f. Correspondence. Consider setting a public hearing for May 17, 1988, on an ordinance to amend the Zoning Ordinance parking requirements in the CB -2 zone. Comment: The Planning and Zoning Commission, at its April 21, 1988, meeting, recommended approval of an amendment to the parking requirements of the CB -2 zone to exempt office usage in excess of 8,000 square feet a in a single building from providing parking spaces. The recommendation was by a vote of 5-2 with Clark and Hebert voting no. This recommendation concurs with a proposal submitted by the Iowa City Chamber of Com- merce/Downtown Association Task Force. Action: b. Consider setting a public hearing for May 17, 1988, on an ordinance to amend the high-rise dwelling, grade, and story definitions in the Zoning Ordinance. Comment: At their April 21, 1988 meeting, the Planning and Zoning Commission recommended by a vote of 7-0 approval of an amendment which clarifies the definition of grade and story and redefines high-rise dwellings as those with four or more stories above grade. This rec- ommendation is consistent with that of the staff. Action: dll,I c. Consider setting a public hearing for May 17, 1988, on an ordinance to amend Chapter 32, subdivision Regula- tions, to permit a waiver of certain requirements and correct an error in Section 32-7, Exceptions. Comment: The Planning and Zoning Comnission recom- mended, at their April 21, 1988 meeting, approval of an amendment to the Subdivision Regulations to permit the waiver of certain standards and technical requirements for subdivisions under conditions of hardship, when good subdivision design would dictate a waiver, and when compliance would result in substantial degradation of the environment. This recommendation was given by a vote of 6-1 (Clark voting no) and is consistent with that of the staff. (passed and adopted) Comment: The Planning and Zoning Commission, at its April 7, 1988, meeting, recommended approval of a re- quest submitted by Jeffrey Wright Development Company i of Seattle, Washington, for a Planned Development Overlay (OPDH-12) on 4.75 acres west of Mormon Trek Boulevard and south of Walden Road. The Planned Devel- opment permits the construction of 112 units of elderly housing. The density the of elderly housing is less than that permitted in the proposed RM -12 zone. Consider a resolution approving the preliminary and final subdivision plat of Walden Wood, Part 2, a _QQ)-?3b two -lot residential subdivision at the intersection of Walden Road and Mormon Trek Boulevard. (S-8809) Comment: The Planning and Zoning Commission, at its April 7, 1988 meeting, recommended by a vote of 6-0 approval of the subdivision of Walden Wood, Part 2 subject to final approval of legal papers. This recom- mendation is consistent with that of the staff. The legal papers have been approved subsequently. Action:�<% c �9 h. Consider a resolution approving the preliminary and final Large Scale Residential Development Plan for the Iowa City Retirement Residence. (S-8809) Comment: At its April 7, 1988 meeting, the Planning and Zoning Commission recommended by a vote of 6-0 approval of the preliminary and final Large Scale Residential Development plan for the Iowa City Resi- dence. Consider an ordinance to rezone the site of Hunter's 3 Run Subdivision, Parts 2 and 3, and a 57.66 acre tract immediately to the west from PDH -5 to RS -5. (Second Consideration) Comment: Hunter's Run Development Company is request- ing the subject area be rezoned to permit its develop- ment as a conventional single-family residential subdivision, through prior amendments Parts 2 and 3 have already been platted as a single-family develop- ment. By a vote of 7-0, the Planning and Zoning Commis- sion recommended approval of the rezoning at its March 3, 1988 meeting. The Commission's recommendation is consistent with that of staff. No comments were re- ceived at a public hearing held April 5, 1988. The Council is requested to waive second consideration of this ordinance and vote for final passage at this time. In addition, the Commission also recommended waiving sidewalks on Samuel Drive by a vote of 7-0. The Commission's recommendation is consistent with that of staff included in a report dated April 7, 1988. Action: 1. Consider a resolution approving the preliminary plat of Idyllwild Subdivision, a 20.80 acre, 68 -lot residential subdivision located west of Dubuque Street between Foster Road and Taft Speedway. (S-8807) Comment: By a vote of 4-2 (Dierks and Wallace voting no), the Planning and Zoning Commission, at its April 7, 1988, meeting recommended approval of the prelimi- nary plat of Idyllwild Subdivision subject to: 1. A warrant study being completed for signalization at Foster Road and Dubuque Street, and at Taft Speedway and Dubuque Street; and 2. The Council authorizing an assessment project for the improvement of Foster Road, Taft Speedway and Calibria Court and amendment of the Capital Im- provements Program to include said improvements in FY88-89. The Commission's recommendation is consistent with that of staff included in a report dated March 17, 1988. This item was deferred from the Council's April 19, 1988 meeting to permit completion of the warrant study and to allow time for discussion of flooding in the Taft Speedway area. Please refer to a copy of the minutes of the informal Planning and Zoning Commission which is attached to the agenda. Action n. Consider a recommendation of the Planning and Zoning Commission concerning the improvement of Foster Road, Taft Speedway, and Calibria Court in association with the preliminary plat of Idyllwild Subdivision. Comment: If the Council finds assessment inappropriate or not feasible, the Commission recommended, by a vote of 5-1 (Clark voting no), that prior to preliminary plat approval, an amendment to the Subdivision regula- tions be adopted to require subdividers to place in escrow an amount in cash, with interest staying in the escrow account, equal to their estimated share of the cost of off-site improvements. Consider a recommendation of the Planning and Zoning Commission that the City Council request of the Johnson County Council of Governments that a traffic study of Dubuque Street between I-80 and Park Road be done. Comment: Related to the review of the preliminary plat of Idyllwild Subdivision, the Commission at its meeting of April 5, 1988, recommended by a vote of 6-0 that a traffic study be done on Dubuque Street from I-80 to Park Road. This item and item n above were deferred in j conjunction with the deferral of the Idyllwild Subdivi- sion at the Council's April 19, 1988, meeting. Q'!o Action: ITEM NO. 5 - PUBLIC HEARING ON OFFERS TO PURCHASE FOR PRIVATE REDEVELOP- MENT PARCELS 8 AND D LOCATED IN THE LOWER RALSTON CREEK AREA OF IOWA CITY. Comment: The City has received three bids for the purchase of Parcel B and two bids for the purchase of Parcel D. Staff has reviewed the bid proposals and recommends sale of Parcel B to Doug Fisher, Fisher Construction Company, and Parcel D to Benjamin Chait. Comment: The City of Iowa City purchased this vacated portion of Hollywood Boulevard right-of-way from the State for the fair market value of $5,100. Hawkeye Real Estate Investment Company operates the Colonial Park Office Build- ing which is an abutting property to this vacated right-of-way. Hawkeye has offered to purchase this vacated portion of right-of-way from the City for $5,700. The City should proceed with the sale of this parcel to Hawkeye Real Estate Investment Company. Comment: The current design standards for public works improvements in Iowa City, Iowa, stipulate lumen output for street lighting that can be achieved by mercury vapor street lighting. In the time since these design standards were developed by the Public Works Departments, certain technological developments have occurred which have made high pressure sodium vapor street lighting a more energy efficient form of roadway lighting. The proposed modifica- tion to the design standards would direct that the City no longer install mercury vapor lighting but instead use high pressure sodium. This choice of light source will increase the amount of light being generated for roadway lighting while expending less energy. By this change in design standards, the Public Works Department will direct that Iowa -Illinois Gas & Electric move forward to convert exist- ing mercury vapor street lighting to high pressure sodium vapor lighting. These changes will be done at no cost to the City of Iowa City. The cost will be borne by Iowa -Illinois Gas & Electric. Changes and cost of the changes are being made under the terms of the Iowa -Illinois' Gas & Electric tariff schedule rate #43 which has been filed and approved by the Iowa State Commerce Commission. The City's Energy Conservation Coordinator agrees with and supports this modification. WASSHINGTON STREET, IOWA CITY, IOWA. Comment: The three-year lease agreement with Washington Park, Inc. and Addendum dated September 10, 1987, on the suite of offices utilized by the Assisted Housing Division is scheduled to terminate June 30, 1988. Subject resolu- tion authorizes a lease agreement for a period of two years with an increase in rent of 19%. This increase appears reasonable in that it has been three years since the last increase and is a fixed sum for two years. The space has been thoroughly remodeled during the current lease term at no cost to the Housing Authority. The rate of $9.00 per square foot per year (1,625 square feet) includes heat, water, taxes and insurance. All costs incurred will be borne by the Assisted Housing Program. INCREASE FEES FOR RESIDENTIAL SOLID WASTE COLLECTION AND FOR LANDFILL USE AND ALSO ADD AN ANNUAL ADVANCE -PAYMENT OPTION FOR MONTHLY ALL -DAY PARKING PERMITS. (First Consideration) jComment: The FY89-91 Financial Plan was prepared with fee i increases for both residential solid waste collection and also landfill use. The fees need to increase because the i State surcharge on landfills increases from $.25 per ton to $1.50 per ton on July 1, 1988, and again on July 1, 1989, to $2.00 per ton.
