a. Public hearing on an ordinance to amend the Zoning
Ordinance parking requirements in the CB -2 zone.
Comment: The Planning and Zoning Commission, at its
April 21, 1988 meeting, recommended approval of an
amendment to the parking requirements of the CB -2 zone
to exempt office usage in excess of 8,000 square feet
in a single building from providing parking spaces. The
recommendation was by a vote of 5-2 with Clark and
Hebert voting no. This recommendation concurs with a
proposal submitted by the Iowa City Chamber of Com-
merce/Downtown Association Task Force.^2

b. Public hearing on an ordinance to amend the high-rise
dwelling, grade, and story def
Ordinance. initions in the Zoning
Comment: At their April 21, 1988 meeting, the Planning
and Zoning Commission recommended by a vote of 7-0 i
approval of the amendment which clarifies the defini-
tion of grade and story and redefines high-rise dwell-
ings as those with four or more stories above grade. A
memorandum concerning this item is attached to the
agenda.

c. Public hearing on an ordinance to amend Chapter 32,
Subdivision Regulations, to permit a waiver of certain
requirements and correct an error in Section 32-7,
Exceptions.
Comment: The Planning and Zoning Commission recom-
mended, at their April 21, 1988 meeting, approval of an
amendment to the Subdivision Regulations to permit the
waiver of certain standards and technical requirements
for subdivisions under conditions of hardship, when
good subdivision design would dictate a waiver, and
when compliance would result in substantial degradation
of the environment. This recommendation was given by a
vote of 6-1 (Clarkvoting no). Expedited action on
this item is requested by the staff.

Idyllwild Subdivision, a 20.80 acre, 68 -lot residential
subdivision located west of Dubuque Street between
Foster Road and Taft Speedway. (S-8807)
Comment: By a vote of 4-2 (Dierks and Wallace voting
no), the Planning and Zoning Commission, at its April
7, 1988, meeting, recommended approval of the prelimi-
nary plat of Idyllwild Subdivision subject to:
1. A warrant study being completed for signalization
at Foster Road and Dubuque Street, and at Taft
Speedway and Dubuque Street; and

2. The Council authorizing an assessment project for
the improvement of Foster Road, Taft Speedway and
Calibria Court and amendment of the Capital Im-
provements Program to include said improvements in
FY88-89.
The Commission's recommendation is consistent with that
of the staff. This item was deferred from the Council's
April 19, 1988, and May 3, 1988 meetings, to permit
completion of the warrant study and to allow time for
submission of additional information on flooding in the
Taft Speedway area. Memoranda on these items are

f. Consider a recommendation of the Planning and Zoning
Commission concerning the improvement of Foster Road,
Taft Speedway, and Calibria Court in association with
the preliminary plat of Idyllwild Subdivision.
Comment: If the Council finds assessment inappropriate
or not feasible, the Commission recommended, by a vote
of 5-1 (Clark voting no), that prior to preliminary
plat approval, an amendment to the Subdivision regula-
tions be adopted to require subdividers to place in
escrow an amount in cash, with interest staying in the
escrow account, equal to their estimated share of the
cost of off-site improvements.

g. Consider a recommendation of the Planning and Zoning
Commission that the City Council request of the Johnson
County Council of Governments that a traffic study of
j Dubuque Street between I-80 and Park Road be done.
Comment: Related to the review of the preliminary plat
of Idyllwild Subdivision, the Commission at its meeting
of April 5, 1988, recommended by a vote of 6-0 that a
traffic study be done on Dubuque Street from I-80 to
Park Road. This item and item f above were deferred in
conjunction with the deferral of the Idyllwild Subdivi-
sion at the Council's May 3, 1988, meeting.

Nottingham Place, a 29 -lot, single-family residential
subdivision located north of Whiting Avenue, east of
Ridge Road and west of Shimek School. (5-8727)
Comment: At the May 5, 1988, Planning and Zoning
Commission meeting, a motion to recommend approval of
the prelIry plat of Nottingham Place failed by a
vote of 2-0 Clark and Hebert voting in favor). On a
separate motion to recommend denial of the subdivision,
the motion passed by a vote of 5-2 (Clark, Hebert
voting no). The Commission recommended denial of the
subdivision on the basis of the anticipated impact of
this proposed development on existing roadways. The
Commission's recommendation is inconsistent with that
of the staff report dated April 7, 1988. The defi-
ciency listed in that report has been corrected.

Comment: At its May 5, 1988, meeting, the Planning
and Zoning Commission recommended by a vote of 6-1
(Dierks voting no) to approve the final plat of First
and Rochester, Part Three, subject to approval of
construction plans and other stipulations noted in the
attached memorandum dated May 12, 1988. Construction
plans and legal documents have been submitted and are
being reviewed by staff. The Commission's recommenda-
tion is consistent with that of the staff report dated

1. Consider a recommendation of the Planning and Zoning
Commission that the City undertake a study to analyze
the future development of the downtown
Comment: At its April 21, 1988, meeting, the Planning
and Zoning Commission recommended by a vote of 7-0 to
endorse the recommendation of the Chamber of Commerce
and the Downtown Association to undertake a complete
analysis of the potential future development of the
downtown and surrounding areas. This study should
include market, land use, transportation and parking
analyses of this area and ultimately recommend pre-
ferred land usage for the area south of Burlington
Street. The study should address the impact of poten-
tial decentralization of the current Central Business,du]
District.

Comment: The City of Iowa City purchased this vacated
portion of Hollywood Boulevard right-of-way from the State
for the fair market value of $5,700. Hawkeye Real Estate
Investment Company operates the Colonial Park Office Build-
ing which is an abutting property to this vacated
right-of-way. Hawkeye has offered to purchase this vacated
portion of right-of-way from the City for $5,700. The City
should proceed with the sale of this parcel to Hawkeye Real
Estate Investment Company.

DESCRIPTION FOR THE PROPOSED USE OF $93,000 IN RENTAL
REHABILITATION GRANT FUNDS FOR 1988.
Comment: The Department of Housing and Urban Development
(HUD) requires that prior to the filing of a program de-
scription of the Rental Rehabilitation Program, citizens be
given the opportunity to comment on the program. A short
memo explaining changes in this year's program is included
in the Council packet.

a. The Riverfront Commission recommends to Council that
the City develop a safe pedestrian right-of-way between
Harrison and Prentiss streets along the Iowa River and
maintain the area for public recreational use.
Comnent: The March 2, 1988, Riverfront Commission
minutes included a discussion of the recommendation
above. Also attached to the agenda is an April 10,
1988, memo from Riverfront Commission member, Douglas
W. Jones, detailing the Commission's position on this
item. It is the staff's recommendation that this
request be referred to the staff for investigation and

ITEM NO. 19 - CONSIDER A RESOLUTION ACCEPTING AN OFFER TO PURCHASE A_

Comment: This resolution authorizes the sale of Parcel D
to Mr. Chait only for use in conjunction with a development
of the Regina Elementary School property as described in
Mr. Chait's proposal. If a real estate contract is not
completed within 90 days, the City can rescind sale of the
parcel to Mr. Chait.

ITEM NO. 25 - CONSIDER AN ORDINANCE AMENDING THE HOUSING CODE, CHAPTER 17
OF THE CODE OF ORDINANCES. (first consideration)
Comment: At their April 12, 1988 meeting, the Housing
Commission recommended by a unanimous vote approval of an
ordinance amending the Housing Code. The current Iowa City
Housing Code was adopted in December of 1980 and has not
been amended in the last eight years. The ordinance in-
cluded in Council's packet highlights in bold the proposed
amendments. The proposed amendments include clarification
of procedures, elimination of exemptions of condominiums
and cooperatives in rental structures, correction of spell-
ing errors and additional tenant responsibilities. The
amendment reflects changes in the Uniform Building Code,
Fire Code, Zoning Code, and administrative interpretations
of the Housing Code.

ITEM NO. 26 - CONSIDER AN ORDINANCE AMENDING HAPTER 32.1, ENTITLED
'TAXATION AND REVENUES' OF THE CODE OF ORDINANCES OF THE
CITY OF IOWA CITY, IOWA, BY AMENDING SECTION 32.1-55 AND
8 SRO SECTION 32.1-63 THEREIN TO, RESPECTIVELY, INCREASE FEES FOR
RESIDENTIAL SOLID HASTE COLLECTION AND FOR LANDFILL USE AND
ALSO ADD AN ANNUAL ADVANCE -PAYMENT OPTION FOR MONTHLY
ALL -DAY PARKING PERMITS. (second consideration)
Comment: The FY89-91 Financial Plan was prepared with fee
increases for both residential solid waste collection and
also need to increae
