Consider setting a public hearing for July 12, 1988, on an ordinance to vacate a portion of Maiden Lane. Comment: At its June 16, 1988, meeting, the Planning and Zoning Commission recommended, by a vote of 6-0, approval of an ordinance to vacate 19 feet of Maiden Lane between the southern right-of-way line of Harrison Street and Ralston Creek. The applicant, Benjamin Chait, requests that this segment of Maiden Lane be vacated to allow integration of a parking lot he owns east of Maiden Lane with a city -owned parcel he proposes to purchase west of Maiden Lane. Action: 121 f OAJ b. Consider setting a public hearing for July 12, 1988, on an ordinance to rezone properties at 1807, 1809, 1813, 1819, 1825 and 1831 Lower Muscatine Road from RS -5 to RS -8. Comment: At its June 16, 1988, meeting, by a vote of 4-2 (Hebert and Cooper voting no), the Planning and Zoning Commission recommended approval of the request to rezone property on the south side of Lower Muscatine Road between DeForest Avenue and Sycamore Street from RS -5 to RS -8. The recommendation is inconsistent with the staff report. Provided lots meet the minimum lot area requirement, the RS -8 zoning classification would allow redevelopment of the properties for duplex use. Public hearing on an ordinance to vacate portions of Capitol and Bloomington streets. (V-8801) Comment: At its May 19, 1988, meeting, the Planning and Zoning Commission recommended by a vote of 5-1 (Scott voting no) approval of an ordinance to vacate Bloomington Street from Capitol Street west to mid - block east of Madison Street and to vacate a 10 foot wide strip on the west side of Capitol Street between Davenport and Bloomington streets. This vacation is part of a joint University -City project to construct a parking ramp, water storage facility and chiller plant. The Commission's recommendation is consistent with a report dated May 19, 1988. Action: d. Consider an ordinance to vacate portions of Capitol and Bloomington streets. (First consideration) Comment: See preceding item. Action: AInIz-� &t,,k (o1 e. Consider an ordinance to amend the Zoning Ordinance parking requirements in the CB -2 zone. (Second con- sideration) Comment: The Planning and Zoning Commission, at its April 21, 1988, meeting, recommended approval of an amendment to the parking requirements of the CB -2 zone to exempt office usage in excess of 8,000 sq. ft. in a single building from providing parking spaces. The recommendation was by a vote of 5-2 with Clark and Hebert voting no. This recommendation concurs with theproposal submitted by the Iowa City Chamber of Commerce/Downtown Association Task Force. Consider an ordinance to amend the high-rise dwelling, grade, and story definitions in the Zoning Ordinance. (Pass and Adopt) Comment: At its April 21, 1988, meeting, the Planning and Zoning Commission recommended by a vote of 7-0, approval of the amendment which clarifies the defini- tion of grade and story and redefines high-rise dwellings as those with four or more stories above grade. Included with this agenda is a memorandum concerning this matter. A public hearing was held May 17, 1988; no convents were received. Action: �i4cu i / ,Q""z b a g. Consider a resolution approving the final plat of Southwest Estates Subdivision, Part 3, a 9.62 acre, 27 -lot residential subdivision located north of Rohret Road and east of Phoenix Drive. (60 -day limitation period: June 29, 1988.) Comment: By a vote of 7-0, the Planning and Zoning Commission, at its May 5, 1988, meeting, recommended approval of the final plat of Southwest Estates Sub- division, Part Three. This recommendation is consis- tent with the staff report. Construction plans, an estimate of all off-site costs and legal documents have been approved by staff. An off-site sanitary sewer easement, however, is still being negotiated by. the developer and the owner of the adjacent property. The subdivision is proposed under the "out -of - sequence" development provisions of the Comprehensive Plan. This item was deferred at the June 14 meeting of the City Council to this meeting. A waiver of the 60 -day limitation period was granted until June 29. Action: AWA Agenda Iowa City City Council June 28, 1988 Page 7 X83 1 h. Consider a resolution approving the final plat of Southwest Estates Subdivision, Part 4, a 12.242 acre, 28 -lot residential subdivision located generally north of Rohret Road and East of Phoenix Drive. (60 -day limitation period: June 29, 1988.) Comment: At its May 5, 1988, meeting, by a vote of 7- 0, the Planning and Zoning Commission recommended approval of the"out -of -sequence" development proposal for Southwest Estates Subdivision, Part 4. The Commission's recommendation is consistent with that of the staff report. Legal documents, construction plans and an estimate of off-site costs have been approved. The developer is still negotiating an off-site sanitary sewer easement. This item was deferred at the June 14 Council meeting to this meeting as stated in item g. Action: Am"I, I i. Consider a resolution approving the preliminary plat for Lots 9, 10, and 11, Block 1, Braverman Center, a 13.65 acre subdivision generally located south of K- Mart between Keokuk Street and Broadway Street and the final plat for Lot 9, Block 1, Braverman Center, a 1.10 acre lot located near the intersection of Southgate Avenue and Keokuk Street. (S-8820. 60 -day limitation period: July 11, 1988.) Comment: At its June 16, 1988, meeting, the Planning and Zoning Commission recommended, by a vote of 6-0, approval of the preliminary and final plats subject to approval of legal papers. The Commission's recommen- dation is consistent with a report dated June 16, 1988. A deficiency listed in the report concerning the preliminary plat has been resolved. Consider a recommendation of the Planning and Zoning Commission concerning a request for an amended Condi- tional Use Permit to allow the placement of a storage building on the grounds of Pleasant Valley Golf Course in the County. (CU -8602-A) Comment: On June 16, 1988, the Planning and Zoning Commission recommended approval of the Conditional Use Permit, by a vote of 6-0, subject to amendment of the site plan to accurately reflect the building's setback from the west property line and provision for screen- ing. The Commission's recommendation is generally consistent with the staff report dated June 16, 1988, with the exception of an additional stipulation that would have required the subject building not be used in any manner in which disturbance such as noise, vibration, smoke, dust, odor, heat or glare is detectable beyond the boundaries of the golf course. Action: k. Consider a recommendation of the Planning and Zoning Commission concerning a request for a Conditional Use Permit to establish a law enforcement firearms training facility in the County. (CU -8801) Comment. At the June 16, 1988, Planning and Zoning Commission meeting, a motion to recommend approval of the Conditional Use Permit failed by a vote of 0-6. The Commission recommended denial of the proposed facility finding its operation to be a disturbance to nearby residential properties. The Commission's recommendation is inconsistent with that of the staff report dated June 16, 1988 and subsequent memorandum also dated June 16, 1988. Comment: JCCOG is completing applications to the UMTA Section 3 and Section 9 programs in behalf of Iowa City Transit for the purchase of two buses in FY89 and two buses in FY90. An application is also being filed with Iowa DOT for a $65,670 no interest loan of funds to assist in providing the local match for these purchases. If granted, the funds will be repaid in three equal installments of $21,890 in 1991, 1992, and 1993. The Director of Finance has authorized this application. Comment: This resolution authorizes the Mayor to sign the contract with Iowa DOT for RISE funds to be used for reconstruction of Highway 1 North. The project will also j involve reconstruction of the Highway 1 I-80 interchange. A total of $446,360 in RISE funds will be available, together with $398,674 of FHWA Interstate 4R funds. The City will provide $111,590 to match the RISE funds. Comment: A right-of-way for walkway presently exists between Lots 20 and 21 of Windsor Heights Fifth Addition. The right-of-way extends west from Seventh Avenue and was intended to provide access to Hickory Hill Park. The owner of Lot 21 has requested permission to allow extension of an existing retaining wall two feet onto the right-of-way. The City Engineer has no objection. In addition, a survey has disclosed that a retaining wall presently located on the rear of that property encroaches onto a City sewer easement. The second Agreement is intended as an acknowledgement of the encroachment and a statement of the City's rights if work has to be done on the sewer. Comment: Staff recommends that certain changes be made in the policies for the City's Housing Rehabilitation Programs as described in the memo included in the Council packet. The changes will make better use of existing funds and allow us to rehabilitate more properties in Iowa City. At its meeting on June 14, 1988, the Housing Commission unanimously recommended approval of the changes. In a telephone poll conducted by CDBG staff, CCN voted 8-0 to recommend to the City Council approval of the proposed changes. Comment: This is settlement of the litigation involving the agreement of August 28, 1984, regarding the approval by the City of the sale of the local system and transfer of the franchise.
